1 ROSTER BUILD AGREEMENT ADMINISTRATION

1.1 INTRODUCTION

This Roster Build Agreement has been formulated to comply with Clause 23.4, Sub-Clause 23.4.1, and 23.5 of the Jetstar Airways Pilots Agreement 2008. (The Agreement)

This Agreement should be read in conjunction with the CASA Regulations and Orders, the CAO 48 Exemption, The Agreement and the Company Operations Manual. Where there is any inconsistency, the CASA Regulations and Orders, The CAO 48 Exemption, The Agreement and the Company Operations Manual will take precedence to the extent of any inconsistency except where this Roster Build Agreement is more restrictive as it addresses specifics that are either more limiting than, or not addressed by these other publications.

This agreement will apply to the production of pilots monthly rosters but will cease to have effect once the roster has been published, when the Day of Operations Agreement will take effect, provided that any published errors identified in a pilot’s roster will be corrected under the principles of this agreement

1.2 OBJECTIVES

The objectives of this document are to fulfill the requirement as set out in The Agreement and to provide a document containing the rostering rules and limitations to be used by Pilots and Jetstar.

The Roster Build Agreement is intended to meet the operational needs of Jetstar

while recognising and striving to meet pilots’ lifestyle needs. To this end, where specific requirements exist that are not able to be satisfied by strict adherence to the parameters contained herein, the Company may roster pilots in such a manner as will satisfy its requirements, by mutual agreement with the pilots concerned, provided all regulatory requirements are satisfied.

1.3 FACILITATIVE PROVISIONS

From time to time the Roster Build Agreement may require amendments. Any amendments must be agreed between Jetstar and the JPA.

1.4 AGREEMENT VARIATIONS

On a case by case basis Jetstar may approach the JPA to seek a dispensation to the Roster Build Agreement. This can only be due to exceptional operational circumstances whereby it would be greatly impractical and/or inefficient to adhere to the Roster Build Agreement. Any such variations will be recorded for review by the JPCC and/or the RRC.

1.4.1.1 DEFINITIONS

In addition to the definitions contained in the Jetstar Airways Pilots Agreement 2008 the following definition applies:

“International Operations” means a flight departing an International port where

Customs and/or Immigration formalities are required to be completed by crew prior to departure but excluding flights between Australia and New Zealand. (Trans-Tasman Operations)

1.5 ROSTER REVIEW PROCESS The Roster Review Committee (RRC) will meet at least quarterly to review rosters

and discuss roster related issues.

The RRC will be chaired by the Crew Planning Manager, or nominee, and be attended by JPA nominated representatives of the Pilot Group and members of the Jetstar Operations Group.

The Operations Group shall report on the following at the Roster Review

Committee:

• Spread of rostered hours by status • Spread of actual hours flown by status • Spread of standby days • Spread of over nights • Updated weekend off report • Any other reports that may be beneficial to the understanding of the rostering process by pilots.

Minutes of this meeting will be distributed to all bases.

1.6 FITNESS FOR FLIGHT CREW DUTIES

Information on the following topics can be found in Operations Manual 1 (OM1).

1.7 FATIGUE RISK MANAGEMENT SYSTEM

If an approved Fatigue Risk Management System is to be introduced, Jetstar and

the JPA will agree on any required changes to the Roster Build Agreement prior to implementation.

2 ROSTER LIMITS

2.1 FLIGHT AND DUTY HOURS

2.1.1 A Narrow body pilot will not be rostered to fly in excess of thirty-five (35) hours in any consecutive seven (7) days. In the event of any future wide-body dedicated short haul domestic operation, consideration will be given to apply the same seven (7) day limit through the JPCC.

2.1.2 A pilot will not be rostered for cumulative duty time in excess of ninety (90) Duty

Hours in fourteen (14) days.

2.2 SIGN-ON AND SIGN-OFF PROCEDURES

2.2.1 An operating pilot’s standard sign-on time for narrow body and wide body domestic and Trans-Tasman operations shall be at least sixty (60) minutes before the scheduled departure time of the pilot’s first flight of a duty period.

2.2.2 An operating pilot’s standard sign-on time for international operations (excluding

Trans-Tasman operations) shall be at least seventy-five (75) minutes before the scheduled departure time of the pilot’s first flight of a duty period.

2.2.3 A deadheading pilot’s standard sign-on time shall be at least forty-five (45) minutes

before the scheduled flight departure time. 2.2.4 Should the flying schedule require that a sign-on time before the pilot’s first flight of

a duty period be reduced on a continual basis, Jetstar will consult with the JPA prior to implementation.

2.2.5 A pilot’s standard sign-off time shall be at least fifteen (15) minutes after the last

flight of that duty period. 2.2.6 Should circumstances require the use of a sign-on or sign-off time greater than

standard, it will be published on the roster, or otherwise by mutual agreement.

2.3 STANDBY PERIODS

2.3.1 The maximum rostered duration of a standby period shall be in accordance with the following table:

* i. A wide body pilot may self-nominate to be eligible for a four (4) hour callout

time from a standby period, and will be referred to as a SNWBP throughout the Roster Protocol.

ii. Self-nomination for a four (4) hour callout time will be considered a standing

request until cancelled by the pilot, who must provide Jetstar with notice of at least three (3) roster periods.

2.3.2 A pilot will not be rostered for a standby period that would infringe into the Time

Free of Duty associated with a Designated Day Off, Duty Free Day or a Rest Period.

2.3.3 A standby period rostered immediately prior to a Designated Day Off shall

terminate by 1800.

2.4 TIME FREE OF DUTY

2.4.1 Where a single Designated Day Off is rostered, the time free of duty will be for a minimum of thirty-six (36) hours duration commencing no later than 2300 hours. This may be extended to no later than 2400 hours with an extra one (1) hour rest for every thirty (30) minutes or part thereof in excess of 2200 hours.

2.4.2 Each additional day off shall be as per 2.4.1 plus twenty-four (24) hours per day

(e.g. Two (2) days = sixty (60) hours, three (3) days = eighty-four (84) hours etc.) 2.4.3 In relation to 2.4.2, the rest period may be reduced once per pilot per roster, around

three (3) or more consecutive Designated Days Off, and once around two (2) or more consecutive Designated Days Off, by up to a maximum of six (6) hours (e.g. two (2) days = fifty-four (54) hours, three (3) days = seventy-eight (78) hours)

2.4.4 A pilot will not be required to sign-on any earlier than 05:00 LMT following a

Designated Day Off. 2.4.5 As far as practicable, Jetstar will distribute weekends free of duty as Designated

Days Off amongst all line pilots in an equitable and fair manner. The minimum number of weekends off for each line pilot will be no less than eight (8) per year excluding weekends contained within annual leave.

A pilot may elect to opt out of these commitments by the Company. 2.4.6 Duty Free Days will be for a period no less than eighteen (18) hours and will

normally be rostered adjacent to a designated day off. 2.4.7 Upon completion of a Tour of Duty of five (5) or more consecutive days duration

away from home base, a pilot will be rostered for time free of duty at home base, equal to at least 50% of the days spent on that tour. That is a six (6) day tour will be followed by three (3) Designated Days Off or Duty Free Days in any combination. Odd numbered days will be rounded down e.g. a five (5) day tour of duty will be followed by two (2) days off, a seven (7) day tour of duty will be followed by three (3) days off

2.4.8 Roster periods:-

2.4.9 By mutual agreement with the pilot concerned one (1) Designated Day Off in a

roster period may be deferred to the next roster period. This Designated Day Off will adjoin a minimum of two (2) consecutive Designated Days Off in the next roster period or as otherwise mutually agreed.

2.4.10 A pilot at a layover port, or assigned temporary duty away from home base, will be

rostered for days free of duty as required. Jetstar will ensure that such days do not detract from the basic entitlement to Designated Days Off at home base, except with the pilot’s consent or request. The pilot will be rostered for any days off accumulated under this provision upon their return to home base or where this is not possible, in the next roster period.

2.4.11 Jetstar will, subject to operational requirements, roster a minimum time free of duty

of ten (10) hours at a layover port. 2.4.12 A flight duty period following time free of duty at a layover port will not be rostered

to exceed the time free of duty. However, if the time free of duty is less than ten (10) hours, then the following flight duty period will not be rostered to exceed eight (8) hours.

2.4.13 Travel time between the airport and Jetstar provided accommodation at a layover

port shall not exceed thirty (30) minutes each way unless agreed to between Jetstar and the JPA.

2.5 CONSECUTIVE SHIFTS

2.5.1 Consecutive shifts, signing-on prior to 06:00LMT or consecutive shifts signing-off

after 22:00 LMT, will be limited to a maximum of four (4). 2.5.2 Jetstar will roster pilots for a variety of flying duties as much as possible.

2.6 ROSTERS

2.6.1 Rosters will be provided in accordance with The Agreement

2.6.2 Roster requests will be limited to a maximum of four (4) requested designated days off and one (1) preferred Tour of Duty per roster period. Of these four (4) requests a pilot may only roster request a maximum of two (2) weekend days off i.e. 2 Saturdays or 2 Sundays or a Saturday and a Sunday. The purpose of this limitation is to facilitate the fair distribution of ‘weekends free’ as required by RBA Clause 2.4.5

2.6.3 In consultation with the RRC representatives, Crew Planners will avoid (as much as

possible) the rostering of a duty period with an early sign-on prior to or following “back of the clock” duty periods, and will take into account pilot’s preferred work shifts providing that these procedures do not adversely affect the building of rosters.

2.6.4 Suitable accommodation will be provided for pilots as required by The Agreement

Clause 26.2.3. Additionally, where a waiting period of 5 hours (4 hours plus 15 minutes after on blocks time, plus 45 minutes before scheduled departure time) or more is rostered between flights, Jetstar will provide pilots with this accommodation.

2.6.5 For roster planning purposes, simulator and aircraft training sessions shall be

considered as flight duty periods, 2.6.6 In the event that roster preparation is delayed as a result of schedule uncertainty or

any other reason beyond the Company’s control, Jetstar and the JPA will agree in advance on how much of the roster need be promulgated and what changes may be made without penalty to the Company.

2.7 ROSTER BALANCING

2.7.1 Within each base, the credit hours allocated to a line pilot’s roster encompassing a

full calendar month shall be built within +/- 7.5 credit hours of the average hours of all the line pilot’s rosters for that calendar month unless varied by agreement with the JPA. With the approval of the JPA, dual bases may be considered separately for the purposes of this paragraph.

2.7.2 Within each base, the hours allocated to a line pilot’s roster encompassing only a

part calendar month shall be allocated on a pro rata basis of the average hours of all the line pilot’s rosters for that calendar month.

2.8 DEADHEAD TRAVEL

2.8.1 Positioning Travel prior to or after a Flight Duty Period is to be counted as Flight

Duty. All the time so spent, as well as the number of sectors travelled, will be considered when determining the maximum Flight Duty Period allowed.

2.9 SIMULATOR, LINE OR BASE CHECKS

2.9.1 Pilots will be given as much notice as possible of any simulator, line or base check,

but in any case not less than ten (10) days, except where a duly notified check is cancelled, deferred or requires a repeat and re-rostered within the current roster period.

2.9.2 A pilot will not be rostered for a simulator or route check within (7) days of returning to work after annual leave of (7) days or greater. However, in the event a pilot’s route check or simualtor recency has expired whilst on annual leave, the pilot will be rostered for an appropriate ‘return to work’ flying/simulator training program as determined by the Training and Check Department

2.10 BASE TRANSFERS

2.10.1 Where a pilot is required to transfer to another base at the direction of Jetstar, that

pilot will be rostered for Moving Days as mutually agreed or stated in the transfer package.

2.10.2 When the transfer package is developed in accordance with Sub-clause 24.2 of

The Agreement, Jetstar will use the following table as a guideline in determining the maximum number of Moving Days the pilot may be rostered for,

Packing and Removal 1 Day Cleaning and Other Arrangements 1 Day Air Travel As required. Not to exceed 9 Hours Duty Per Travel day Road Travel 1 day per 500 Kilometres or part thereof Accommodation Arrangements 1 Day Unpacking and Settling In 1 Day

The last two (2) days will be rostered by mutual agreement during the period the

pilot spends in the Company supplied accommodation. 2.10.3 Where a pilot transfers to another base for personal reasons including upgrade etc,

the provisions of 2.10.1 and 2.10.2 will apply except that the days rostered will be drawn from the pilot’s Designated Days Off or Annual Leave entitlement as preferred by the pilot.

2.10.4 If on initial employment a pilot is assigned to a base different to his/her current city

of domicile, the pilot will be afforded the moving day off provisions of table 2.10.2 when taking up their assigned base, either prior to or post initial line training as appropriate.

2.11 GROUND DUTIES

2.11.1 A Duty Period rostered for the purpose of Ground School Training, will be limited to

9 hours (not including positioning travel) 2.11.2 Where a Duty Period rostered for the purpose of Ground School Training includes

Positioning Travel, a limit of 13 hours will apply, or will be followed by a Duty Free Day.

2.12 ANNUAL LEAVE

The System

2.12.1 Pilots annual leave entitlement will accrue as described in Clause 31.1.1 of The Agreement and will be allocated as follows.

2. 12.2 There are three (3) annual bid periods of eight (8) months duration in a cycle period

of twenty-four (24) months. Annual leave will be allocated in leave slots of two (2) weeks. The minimum allocation will be two (2) weeks and the maximum six (6) weeks.

2.12.3 Leave accrued must be equal to or greater than the leave slot/block requested at

the conclusion of the leave dates. e.g. If leave accrued to the end of a desired period was three (3) weeks and five (5) days only a two (2) week slot could be requested. If leave accrued was in excess of four (4) weeks then a four (4) week block could be requested.

2.12.4 Bids for leave slots will be called for sixteen (16) weeks prior to the commencement

of the next bid period. Initial bids will close twelve (12) weeks prior to the commencement of the next bid period. Bids will be allocated ten (10) weeks prior to the commencement of the next bid period. Following this allocation any remaining slots will be re-advertised. Remaining slots will be allocated six (6) weeks prior to the commencement of the next bid period. Allocation of leave slots will be awarded by base, status, order of priority and sequentially by seniority number.

2.12.5 Order of priority.

1. Six (6) weeks (any combination of two (2) week slots) 2. Four (4) weeks (any combination of two (2) week slots) 3. Two (2) weeks

2.12.6 Once a pilot’s annual leave has been allocated it will not be altered other than by

mutual agreement or where a pilot changes base and/or status in accordance with the relevant clause of The Agreement.

2.12.7 If a pilot fails to bid for leave, Jetstar will be entitled to direct a pilot to take

accumulated leave in accordance with the Clause 31.1.3 of the EBA Leave Blocks containing Christmas and Easter Public Holidays 2.12.8 A pilot will not be allocated a leave block containing Christmas Day more than once

in 3 consecutive calendar years, other than in the absence of a competing bid compliant with this sub-clause.

2.12.9 A pilot will not be allocated a leave block containing Easter Sunday more than once

in 3 consecutive calendar years, other than in the absence of a competing bid compliant with this sub-clause.

2.12.10 In order to equitably apply sub-clause 2.12.9, a pilot allocated a leave block

commencing on Easter Monday will be rostered Easter Friday, Saturday and Sunday as DDO’s and similarly a pilot allocated a leave block terminating on Easter Sunday will be rostered Easter Monday as a DDO.

Bid Preferences 2.12.11 Pilots will be invited to submit six (6) bid preferences. Jetstar will then allocate

requests determined by base, status, order of priority then seniority. Annual leave will be processed in order of your preferred bids. At any stage, should it be possible to allocate 50% or more of your requested leave slots (in highest preference order) you will be assigned those slots without review any lower order bid preferences. i.e. if your preference 3 bid can be assigned 50% or greater of requested slots your fourth preference will not be reviewed.

Note: - If it is not possible to satisfy the entire leave request the Company shall

satisfy 50% or more of the bid (i.e., a four (4) consecutive week + two (2) week (six (6) weeks) bid will be allocated the four (4) week portion a two (2) + two (2) + two (2) (6 weeks) bid may be allocated two (2) + two (2) weeks).A pilot that bids two(2) weeks and two(2) weeks (non-consecutive) will be assigned a two(2) week slot only – This does not apply for a four consecutive week bid i.e. two (2)weeks plus two ( 2) weeks)

Pilots that fall into this category may include themselves in the redraw process for the portion not allocated.

2.12.12 At the end of this process, if any slots remain unfilled, these will be re-advertised

only to those who have not been completely successful in the initial bidding process. Pilots must then submit a new leave application. These remaining slots will then be awarded by base, status, order of priority and seniority

2.12.13 Leave slots may become ‘available’ during a bid period because of status and/or

base changes. These vacant slots will be advertised by email and will be subject to a monthly draw. The closing date for the monthly draw bids will be the fifteenth (15th) of each month i.e. approximately six (6) weeks prior to the applicable roster period. Any advised slots should be applied for via the leave application bid process and will be determined by base, status, order of priority and seniority

2.12.14 Pilots should bid for at least one [two (2) week leave slot] in each bid period. A leave application for the requested leave preferences must be completed and returned prior to midnight on the nominated day for the lodgement of applications. Failure to lodge leave preferences by the required closing date and time will exclude a pilot from the bidding process for that bid period.

2.12.15 Following the bidding process pilots will be notified (via company email) of the

leave they have been allocated. 2.12.16 Leave overlap at the end of the bid period is available for those pilots taking blocks

of six (6) or four (4) consecutive weeks only. If the leave period a pilot wants to bid for overlaps two (2) bid periods by two (2) weeks in a four (4) week bid and by up to four (4) weeks for a six (6) week bid, the bid will be accepted and prioritised as is any other bid. To bid for overlap blocks as outlined, sequentially number the leave blocks from the end of the first bid period.

Change Of Status and/or Base

2.12.17 Any change of status and/or base may result in the cancellation to any leave

awarded (as determined by Jetstar). Pilots who have changed status or base may request un-awarded leave slots in their new status and/or base in the current leave period.

Leave Swaps

2.12.18 Leave swaps may be actioned for pilots of the same status and base provided the

swap entails no additional cost, or disadvantage, to Jetstar. The Company must be notified of any leave swaps via a Leave Swap application.

Leave Requests For More Than six (6) Weeks

2.12.19.1 Requests for leave in excess of six (6) weeks in any bid period will be considered on a case by case basis. In any such instance, the pilot should nominate a six (6) week preference period and then the additional leave being requested so that the bid will receive the correct priority.

ASSIGNED ANNUAL LEAVE

2.12.19.2 Jetstar will roster excess annual leave in accordance with The Agreemeent -

Clause 31.1.3. However, prior to any rostering of ‘Company Allocated’ annual leave of less than seven (7) days, a pilot will be offered the opportunity to increase the assigned annual leave to either seven (7) or fourteen (14) consecutive annual leave days

ADHOC Leave 2.12.21 ADHOC Leave must be applied for via KIOSK to the pilot’s Manager Line

Operations. An application for ADHOC Leave will normally only be approved due to exceptional circumstances.

Training and Check Pilots 2.12.22 Level 1 Training Captains leave allocation will be the same as Line Pilots as

described in this section.

2.12.23 Category A and Category B Training and Check (T&C) Captains leave allocation

will be awarded annual leave based on order of priority (see Clause 2.11.5) then seniority. T&C Captains will bid for dedicated T&C annual leave slots (base independent)

ACALS Review/Disputes Process 2.12.24 Any disputes arising with regard to the allocation of leave will be addressed by

application of the Agreement dispute settlement procedure. 2.12.25 Review of the leave allocation process will be undertaken following the re-draw

process to ascertain if the reasonable expectations of both Jetstar and pilots have been satisfied.

2.12.26 Any pilot wishing to have the leave allocation process reviewed should address

their representative body to approach the Company on their behalf. Jetstar will undertake to review any such requests.

2.13 LONG SERVICE LEAVE All applications for Long Service Leave should be submitted via a Long Service

Leave request form - see JEN (Pilot Forms)
