This workshop willmake explicit what those very dif-ferent assumptions are, exploretheir implications for the practice ofmediation, and indicate how aproper understanding of thoseassumptions would cause a media-tor to redefine his role in relation-ship both to the process and to thecouple whom he is trying to help,as well as to substitute a differentyardstick by which to judge theobject and success of a mediation.

ARBITRATION AND MEDIATIONIN THE SHIA IMAMI ISMAILIMUSLIM COMMUNITY.This paper shows how the Ismailis,an international Muslim community,spread over 25 countries, under theguidance of a living, hereditaryImam, (Spiritual Leader) has devel-oped its own dispute resolution sys-tem. Rooted in the Qur'an, the tra-ditions and the essential ethical andintellectual values of Islam, the sys-tem is also grounded in the laws ofthe many countries where it oper-ates, and functions in a contempo-rary context, through professionalvolunteers who enjoy respect andcredibility.
