I am pleased to present the wInter Issue of

the IU Law–Indianapolis alumni magazine and dean’s report.

the fall semester has been a busy one at the law school, as this

magazine attests. In the following pages, you will read about the

groundbreaking counter-terrorism simulation that took place

at the school in october as part of professor shawn Boyne’s

seminar in national security law. during the simulation,

students played the roles of government officials responding to

simulated terrorist attacks across the country and right here in

Indianapolis. In January, WFYI, the local PBS affiliate, will air a

documentary about this event.

the magazine also includes information about the new legal

clinic in eldoret, Kenya, that our school has helped to establish

and continues to support. I had the honor of visiting the clinic

in october and am in awe of what has been accomplished there

in a very short time.

You will also read about and see photos of the recent

Board of Visitors reception at the school, hosted by law school

alumnus, and former u.s. Vice president, dan Quayle. we had

a packed house for the event that brought many friends back to

the school to visit and reminisce.

I also want to take a moment to remember our beloved

professor mary harter mitchell, whose sudden and untimely

passing in november of this year leaves a tremendous void in

our law school family. we include a tribute to professor mitchell

in this magazine as well.

You will also note that the issue incorporates our annual dean’s

report, recognizing the generosity of those many individuals who

support the school financially. We are grateful to our alumni and

friends who help to make so many of our educational programs

possible. we thank you for your ongoing support of the school and

look forward to partnering with you in the coming year.

Alumni Publication and Programming AwardsIn October, the law school’s alumni magazine, IU Law–Indianapolis

received a Gold MarCom Award from the Association of Marketing and Communication Professionals for the summer 2009 issue, “The School that Never Sleeps.” The magazine is produced by the law school’s Office of Institutional Advancement in cooperation with the IU Law Alumni Association. It is edited by Jonna Kane MacDougall, ’86 and Elizabeth Allington.

The Council for the Advancement and Support of Education (CASE) presented the 2009 Pride of CASE V Silver Award for the Best Student Alumni Programming to the IU School of Law–Indianapolis Alumni Association for “Operation L.A.W.S. (Law Alumni Working with Students).” Operation L.A.W.S. is a mock-interview program designed to prepare students for the transition into life after graduation and to introduce them to the variety of career paths available for today’s legal professionals. A special thank you to all alumni who volunteered and participated in the program! Congratulations to Danny Kibble, director of alumni programs, and Chasity Thompson, Assistant Dean for Professional Development, who created the program.

a former law school faculty member,

Bepko served as dean of the school from

1981 until he was appointed Chancellor

in 1986. he was Chancellor of iupui and

iu Vice president for long range planning

until 2002. in 2003, he served as interim

president of indiana university.

as Chancellor, Bepko led a movement

to unify the various programs of iupui,

academically and geographically, by

bringing all schools to the West michigan

street campus and presiding over the

construction of more than 20 buildings.

during his tenure as chancellor, enrollment

grew by nearly 25 percent and external

support for faculty activities grew from $38

million in 1986 to more than $200 million

in 2001-02.

ida Coleman lamBerti, ‘92,

received the randall t. shepard award for

excellence in Pro Bono Publico during the

2009 randall t. shepard award dinner on

Friday, november 6 at the hyatt regency

in indianapolis. lamberti has been a

dedicated volunteer at the neighborhood

Christian legal Clinic (nClC) in

indianapolis for years. she currently works

with the Burmese refugee population,

assisting refugees with immigration

cases for nClC. she donated more than

750 hours in 2008 alone. according

to nClC administrators, lamberti’s

volunteer time makes a tremendous

impact on nClC’s refugee caseload,

making it possible for nClC to serve

vastly more low income families in need.

the shepard award dinner is sponsored

by the indiana Bar Foundation and the

indiana Pro Bono Commission.

recently appointed the law school’s Cynthia

Baker, Clinical associate professor of law

and director of the program on law and state

Government, to the indiana Commission for

higher education (iChe). the Commission

helps to plan and coordinate indiana’s

state-supported system of postsecondary

education, focusing primarily on public

higher education, but also considering

issues regarding k-12 standards and testing,

the education roundtable, department of

Workforce development efforts, and the state

student assistance Commission of indiana.

professor Baker joined the law school

in 1997 as the first director of the program

on law and state Government (plsG).

under her leadership, the plsG has

substantially expanded experiential learning

opportunities for students interested in the

confluence of law and state government.

Baker currently serves on the executive

committee of the government practice

section of the indianapolis Bar association

and as a co-chair of the state administrative

law committee of the aBa’s section of

administrative law and regulatory practice.

she also has served several appointments

as a member of indiana’s Code revision

Committee. Before joining the law school,

Baker was a section chief of the indiana

department of environmental management’s

(idem’s) office of legal Counsel.

university. professor orentlicher is the

samuel r. rosen professor of law and

co-director of the hall Center for law and

health. he is also a former member of

the indiana house of representatives.

Congressman mike pence represents

indiana’s 6th Congressional district,

and is currently serving his 5th term in

office. he also was elected unanimously

by house republicans to serve as

house republican Conference Chairman

in november 2008. other panelists

included dr. thomas Whiteman,

otolaryngologist, representative to the

indiana state medical association;

mr. larry dust, Ceo, key Benefit

administrators; and professor Cecil

Bohanon, professor of economics, Ball

state university. dr. Charles taylor, Ball

state university professor of political

science moderated the event. each

panelist explained his perspective on

health care reform and the audience was

invited to ask questions.

SouthAmericanDelegationVisitsLawSchool

on septemBer 25, the iu school

of law–indianapolis hosted a delegation

of lawyers, judges, law professors,

constitutional scholars, ministry officials

and journalists from a dozen south

american countries. the u.s. state

department sponsored the visit to help

these officials examine the u.s. civil,

criminal, military and juvenile justice

systems and explore legal education and

the practice of law.

the program included discussions

on a range of topics, such as judicial

case management, alternative dispute

resolution, arbitration, mediation, plea

bargaining, trial by jury, juvenile justice,

the civil rights movement, affirmative

action, family law, domestic violence,

human rights, judicial activism and

indigenous dispute resolution. it also

focused on legal education for foreign

students and officials in the u.s. the

proceedings were conducted in spanish

with interpretation.

the event was co-sponsored by

the meridian international Center, the

international Center of indianapolis and

the law school’s program in international

human rights law, which is directed by

professor George edwards.

who, outside the regular duties of their

profession, have brought together the

public and private sectors for civic

improvement in indianapolis. a partner at

Baker & daniels, neighbours serves on

the executive committee of the Greater

indianapolis Chamber of Commerce and

the board of the united Way of Central

indiana, where he is the immediate past

president. the founding board chair

of the Charles a. tindley accelerated

learning high school, neighbours is co-

chair of the legal Committee of super

Bowl XlVi; co-chair of the Central indiana

transit task Force, and a member of the

boards of the indianapolis Zoological

society and the Christian theological

seminary. he served as vice president

of the indiana sports Corporation and

THeSe NeWS rePOrTS AND THe ACTIvITIeS SUrrOUNDINg THe AFTermATH OF THe SImULATeD bOmbINgS Were PArT OF ONe OF THe mOST COmPLex AND AmbITIOUS exPerIeNTIAL eDUCATIONAL eveNTS ever UNDerTAkeN AT THe LAW SCHOOL—Or PerHAPS AT ANy LAW SCHOOL. Students in Professor Shawn boyne’s Seminar in Comparative National Security Law, along with students from the IU School of Public and environmental Affairs (SPeA), participated in a groundbreaking counter-terrorism simulation that placed them in the vortex of terrorist attacks and in the position of having to develop coordinated and cohesive responses.

Approximately 50 students played various roles from the President, to governmental staffers, to reporters covering the story as it unfolded. With help from realistic news broadcasts, courtesy of Scott Sander at WISH-Tv, as well as “top secret”

At approximately 9:00 a.m. on Friday, October 23, 2009, news reports circulated throughout the law school that the Pakistani embassy in Washington, D.C. had been bombed. In the Wynne Courtroom, the President of the United States was just coming to terms with this situation when, moments later, it was reported that a “dirty bomb” had exploded in downtown Indianapolis—near Lucas Oil Stadium. The governor and the mayor immediately attempted to obtain more information as they jockeyed for position scheduling press conferences in the press room in the Conour Atrium. In short, it was not “business as usual” at Inlow Hall.

intelligence injects supplied by Professor boyne and real-life national security experts, the students were forced to make split-second decisions regarding events as they happened. The story played out in seven distinct areas of Inlow Hall, and all of the action was recorded in each room and broadcast via a simulation “dashboard” that was live on the law school’s website. more than 200 people outside the school followed the events taking place in real time via the website.

“my hope in putting together the simulation was to help students to realize how important it is for government officials to structure their decision-making within the framework of the law,” said Professor boyne. “In the weeks leading up to the simulation, we discussed key background issues related to counter-terrorism, including how to define terrorism, the motivations of terrorists, the findings of the 9/11 Commission, and how to respond to terrorism within the frameworks of criminal law, as well as the law of armed conflict,” she added.


Counter-terrorismand the Law

“Although our nation has made great strides in improving homeland security in the wake of 9/11, substantial problems remain. The most significant is getting immense government bureaucracies with their own distinctive organizational cultures to work together. While students may begin to understand that problem by reading case studies and articles, perhaps the most effective way to learn about organizational challenges is to create a learning environment in which students experience those challenges firsthand,” she said.

IT WAS “DAUNTINg” TO be THe PreSIDeNT Third-year student Daniel Cicchini played the role of President of the United States. “To prepare for the simulation, I read and re-read our assigned material about on-the-ground responses to 9/11 and how state and local governments responded to the attack. Professor boyne recommended two books that I read over fall break, Terror Presidency: Law and Judgment Inside the Bush Administration, and Essence of Decision: Explaining the Cuban Missile Crisis. Those books helped me to appreciate different aspects of presidential decision-making and the impact of decisions on broader policy issues,” Cicchini said.

“It was daunting to be the President during a terrorist attack. There were eight people in the ‘White House’ during the simulation and everybody offered me information and advice on all of the issues occurring simultaneously….One of the participants in the White House was the general Counsel to the President, who offered regular reminders regarding the limits of executive authority while we responded.

“I learned about the importance of teamwork and being able to rely on that team. my natural reaction was to want to be

involved in everything to best understand and lead, but it was impossible. Delegating tasks to other participants in the White House enabled us to address many more issues much more efficiently. The simulation was a great experience,” he said.

Governor deals wiTh sTaTe/federal COmmUNICATION ISSUeS Third-year student James baldwin played the role of the governor of Indiana. As part of the simulation, he received word that the Lieutenant governor had been kidnapped. “during the morning, conflict developed between the State of Indiana and the federal government. In one instance, the President announced in his press conference that ‘we’ had rescued the kidnapped Lieutenant governor. The vice President had asked me not to tell the press about the Lieutenant governor’s kidnapping and that the Indiana State Police had rescued her. I had a teleconference with the President where I expressed my extreme unhappiness that he had not mentioned State efforts in his press conference and made the State look dependent on the federal government to keep us safe,” he said.

“The most important thing I learned about decision-making in the executive branch is how much is out of the executive’s control. Conflicting information comes in rapidly, and it is difficult to discern what to act on and when.

“I’m so grateful to have been a part of the simulation. It was probably the most fun I have had in law school, and it is certainly the most memorable event I have participated in thus far.”

beINg THe mAyOr OF INDIANAPOLIS WAS STreSSFUL Third-year student Joshua mcmahan played the role of mayor of Indianapolis. “To prepare for the role of mayor, I studied the Comprehensive emergency management

Plan for marion County. I tried to understand how the different agencies interact and what my role was in terms of who I needed to contact and what I needed to do to respond. I was mainly concerned with the initial response,” he said.

One of the situations facing mcmahan as mayor of Indianapolis was the aftermath of the dirty bomb attack—and the resulting air and water contamination. “The experience was very stressful because i was being flooded with phone calls and questions. I had to consider issues such as keeping the public calm and spinning the situation in a way that was truthful, yet not conducive to spreading mass panic throughout the city. I have a new level of respect for people who deal with such situations. I also learned that communication and coordination are the most essential aspects of effective response.”

U.S. AmbASSADOr INTerACTS WITH OFFICIALS Third-year student Hattie Harmon was the U.S. Ambassador to Israel. “Prior to the simulation, I studied a great deal of information regarding the role of ambassadors and their function within the State Department. Additionally, I read everything i could find about israel’s historical and current internal and external relationships. For me, preparing for the simulation was more difficult than preparing for a final examination because the parameters for what we might encounter in the simulation were less defined than they are for a final exam, so i felt the need to study very broadly,” she said.

“It was one thing to imagine what the situation might be like; it was quite another to actually confront such a fluid situation and deal with the other actors in ‘real time.’ As Ambassador, I had to consider the different levels of information that I could share with different people—for instance, I wouldn’t necessarily

want to share the same information with both the Israeli Prime minister’s representative and the CIA Tel Aviv Station Chief.

“I learned a tremendous amount about the current status of the arab-israeli conflict, the actors involved, and the roles of other world states and organizations in the conflict,” she added.

PrOFeSSOr bOyNe PLeASeD WITH THe OUTCOme Professor boyne praised her students and the fact that they took their roles in the simulation so seriously. “The students did a fantastic job,” she said. “The positive feedback that they received on their performance from our on-site counter-terrorism experts—who came from as far away as europe and the middle east—underscores the strong tradition that our law school enjoys in training students to assume leadership positions in government, non-profit organizations and the legal profession.”

eldoret, kenya. In a small room at the AmPATH Centre here, Jane nervously eyed the visitors from Indiana, smoothed her long black and white skirt, and launched into her story.

“I am a rape survivor,” she said in kiswahili-accented english. “I was assaulted by my uncle in March, and i ended up being hiv-positive.” Tears filled her eyes, but she continued to speak. After the attack, Jane (not her real name) went to the hospital and then to the police. but in kenya, corruption and gender discrimination cause most sexual assault cases to be dropped early in the process. The prosecutor in Jane’s case first ignored her, and then suggested she abandon the case.

“but then milkah came to my aid, and she pushed things along in court,” Jane said, gesturing at Milkah Cheptinga and smiling for the first time.

Legal Aid Centre of Eldoret Assists Low-income Clients in

Kenya


CHePTINgA IS THe LegAL DIreCTOr OF THe LegAL AID CeNTre OF eLDOreT (LACe), which works in close association with AmPATH (The Academic Model for the Prevention and Treatment of hiv/aids), the Nobel Peace Prize-nominated health and poverty program in which Indiana University School of medicine plays a central role. Cheptinga and volunteer kenyan lawyers and law students represent low-income clients like Jane for free in cases involving issues including family disputes, gender-based violence, and estate matters.

Some LACe clients have been pushed off their land by greedy in-laws, some have been discriminated against because they are HIv-positive. Others have been left destitute and homeless after going without spousal support for young children. In all these areas of the law, most kenyans have strong rights on paper yet no hope of enforcing those rights without an attorney.

riley and Quigley are co-founders of LACe, along with kenyan attorneys eric gumbo and moi University School of Law lecturer vincent mutai. Just as AmPATH is a partnership of physicians from Indiana and kenya, LACe is a growing partnership between the legal communities of indianapolis and eldoret, with critical financial support coming from indiana law firms, the rotary Club of indianapolis, and the reuben Family Foundation.

One of the cornerstones of the partnership is the relationship between IU Law–Indianapolis and moi University School of Law in eldoret. Through the Program in International Human rights Law, IU Law–Indianapolis students Aaron Stark and matt Trick spent part of the summer of 2009 working at LACe, helping draft documents, interview clients, and prepare materials for community education on human rights.

PIHrL director, Professor george edwards, also visited eldoret and lectured on international human rights law to students and faculty at moi School of Law. moi’s vincent mutai is a visiting Fellow at IU Law-Indianapolis’ Program in International Human rights Law, and is exploring joint advocacy projects with edwards and students from both schools.

IU School of Law–Indianapolis has begun providing an annual master of Laws scholarship to a promising moi Law graduate who promises to work in the LACe clinic after receiving their IU degree.

“We are pleased to be playing a role in helping to sustain the flow of well-trained attorneys working in this important program,” Dean roberts told a gathering of local magistrates and law professors in kenya.

LACe volunteer and 2008 moi Law graduate Avril rua is the first recipient of the laCe scholarship and will begin her LL.m. studies in Indianapolis in January. rua plays a key role in the representation of clients like Jane, and looks forward to applying what she learns in the IU Law–Indianapolis human rights law curriculum for the benefit of laCe clients. “i have already made so many Indiana friends who are students

visiting kenya, so I am eager to go to their home university and further my studies,” rua said.

in just its first year of operation and with a bare-bones, one-lawyer staff, LACe has already represented more than 200 clients, and helped most of them find justice. One of those success stories

is Jane’s. LACe leaned on the once-reluctant prosecutor and helped Jane obtain medical evidence, so now her attacker is jailed and facing several serious charges. “I am so grateful to milkah and LACe,” she said to the Indiana law delegation as she finished telling her story.

Now it was milkah’s turn to smile. “Once the court sees that someone like Jane has an advocate on her side pushing hard, things start to move the right way.”

The Indiana lawyers nodded in understanding. As IU and moi students, faculty and alumni are learning, some principles of legal advocacy hold true in the U.S. and kenya alike.

The sixth annual Jordan H. and Joan R. Leibman Forum on the Legal and Business Environment of Art took place on Friday, September 25 at the Herron School of Art and Design at IUPUI. The program featured a panel discussion on the topic, “The Art of Hope,” focusing on the establishment of the Imani Workshops in Eldoret, Kenya.

The Imani Workshops were established in January 2005 as a branch of the Family Preservation Initiative under the IU–Kenya Partnership’s AMPATH program. The Academic Model for the Prevention and Treatment of HIV/AIDS (AMPATH) is a working model of urban and rural HIV prevention and treatment services in the public sector of Kenya. AMPATH currently cares for more than 60,000 HIV infected adults and children in Western Kenya. The Imani Workshops are a revenue-generating social enterprise focused on producing high quality crafts by HIV+ artisans in western Kenya.

The featured speaker at the Leibman Forum was Evaline Njoki, one of the first clients at the Family Preservation Initiative (FPI), and now a manager for the Imani Workshops. She spoke about the profound effect the FPI and workshops have had on her life. While in the U.S., she traveled widely, visiting gift shops, teaching students and also learning skills to take back to Kenya.

Also on the panel was Peter Park, who served in Kenya as AMPATH’s associate field director for FPI from 2003-06. Park helped to launch the Imani Workshops in 2005. “Thousands have benefited from the AMPATH program. Through the Imani Workshops, we have been able to provide a hand up and not a hand out. Fair Trade Certification guarantees a reasonable standard of living for those who have participated in the workshops,” he said.

Other panelists for the evening included Susan Buck Sutton, IU Associate Vice President for International Affairs; Dr. Bob Einterz, co-founder and director of the IU-Kenya Partnership; Sam Carpenter, general manager of Global Gifts; Carole Darst, chair of the Rotary of Indianapolis World Community Service Committee; Elsie Rotich, community outreach coordinator for the IU–Kenya Partnership, and Barbara Zech, art educator with Very Special Arts Indiana and Imani Workshop volunteer. The panel was moderated by WTHR producer, Deshong Perry.

The Jordan H. and Joan R. Leibman Forum was established at IUPUI in 2004 to examine issues related to the legal and business environment of the arts, and is a joint project of the IU Kelley School of Business Indianapolis, the IU School of Law–Indianapolis, and the IU Herron School of Art and Design. This year, the program was also co-sponsored by the IU Office of International Affairs (OIA). Herron Professor Mark Richardson and Ian McIntosh, director of international partnerships with OIA, spearheaded the event.

Following welcoming remarks by IU Dean gary r. roberts, Professor Dr. Frank emmert, director of the egypt project spoke about the program’s mission and introduced student speaker, Yasmine hassan Mohamed sadek afifi. The President of Cairo University, Professor Dr. Hossam kamel, also offered welcoming remarks.

She holds an m.A. in International relations from the University of North Carolina at Chapel Hill and a b.A. in political science from the Cairo University, Faculty of economics and Political Science, where she currently is a Ph.D. candidate.

a career foreign service officer at the rank of Minister-Counselor, ambassador Margaret scobey was confirmed on March 14, 2009. in december 2003, she was confirmed as ambassador to syria and was recalled for consultations in February 2005, following the assassination of former Lebanese Prime Minister rafiq hariri. in addition to her service in syria, scobey served as Political Counselor in Baghdad in 2006-07, and deputy Chief of Mission at the U.s. embassy in riyadh, saudi arabia from september 2001 through November 2003. She has also served as Director of Arabian Peninsula Affairs in the department of State and as Deputy Chief of mission in Sanaa, yemen. born in memphis, Tennessee, Scobey graduated with a degree in history from the University of Tennessee in knoxville, where she also received a master’s degree. She pursued doctoral studies in history at the University of michigan.

Nineteen students became the first candidates for degree conferral as part of the Indiana University School of Law–Indianapolis LL.M.–Egypt Program.


grant award from USAID–egypt, the law school entered into formal agreements with both the Faculties of Law at Cairo and Alexandria University to offer the International and Comparative Law track of its LL.m. Program (with a curricular emphasis in international business and commercial law) to qualified egyptian nationals onsite in egypt. Through these collaborative efforts, and the financial backing of USAID–egypt, the IU School of Law–Indianapolis became the first U.S. law school to offer a graduate law degree program in the middle east. The program expects to hold its next graduation ceremony in late spring 2010 for approximately 75 students.

According to project director, Professor Dr. Frank emmert, graduates of the program are anticipated to play a significant role in on-going efforts to improve egypt’s overall economy and the legal system. “USAID is working with egyptian officials to help ‘rewrite’ or modernize that country’s legislation and government policies with a view toward the business sector,” he says.

Through these collaborative efforts, and the financial backing of USAID–Egypt, the IU School of Law–Indianapolis became the first U.S. law school to offer a graduate law degree program in the Middle East.

In October, Indiana University School of Law–Indianapolis faculty and staff members traveled to Cairo, Egypt to kick off the Fall 2009 LL.M.–Egypt program orientation. Those participating included project director, Professor Frank Emmert, along with Sonja Rice, ‘07, Egypt Program Director; Terri Cuellar, Director of Technology Services, and Jacob Manaloor, ‘03, Assistant Director of Grant Administration. Sixty-five new students were accepted to the LL.M. program in Cairo. The total active enrollment for the program is one hundred forty-one students. “We need to tell the story of our school,” Quayle said. “We’ll take our marching orders from the dean,” he added, “and I hope you’ll join me in support of our alma mater.”

ON OCTOber 2, THe LAW SCHOOL’S PrOgrAm ON LAW AND STATe gOverNmeNT HOSTeD ITS ANNUAL FeLLOWSHIP SymPOSIUm, which brought more than 80 attorneys and others to the school for presentations on the topic: “State Law and energy Policy: Initiatives and Ideas Powering the Future.” This was the ninth PLSg symposium which is a project of the PLSg Fellows under the direction of Professor Cynthia baker. This year’s Fellows were elliott mckinnis and Olivia Fleming. The PLSg Fellowship Symposium has earned the reputation of being one of the most interesting programs at the school, and this year’s symposium was no exception.

The day started with a presentation by Professor baker on “The big Objectives & Fine Print of State energy Policy.”

The morning address by Doug gotham, director of the State Utility Forecasting group, focused on “Powering the Future: A Forecast of Indiana’s electricity Consumption, Prices and resource requirements.” The first fellowship address was presented by elliott mckinnis and was entitled, “mandating renewable energy through Legislation: An Analysis of State renewable electricity Standards.”

The morning panel featured a lively discussion on the topic, “reacting to Nuclear reactors: State Legislative efforts Involving Nuclear energy.” Panelists included Dr. Audeen Fentiman, Professor of Nuclear engineering, Purdue University; Hon. eric koch, Indiana House of representatives, District 65; kerwin Olson, Program Director, Citizens Action Coalition of Indiana, and Charles Whitney, general Counsel, Oglethorpe Power Corporation.

The noon keynote address featured Nancy-ellen Zusman, Assistant Chief Counsel for Litigation and regional Operations with the Federal Transit Administration, who gave an eye-opening overview of Indiana’s position in terms of mass transit efforts as compared with other states in the midwest. Her talk was entitled, “mass Transit in the midwest: A Federal Perspective of State efforts.”

The afternoon Fellowship Address by Olivia Fleming focused on the topic, “Does mass Transit equate to energy Savings?” Her talk was followed by presentations by three graduate students in architecture from ball State University. Design teams from ball State developed conceptual plans for six potential light rail station transit development sites along the old Nickel Plate rail line running from downtown Indianapolis northeast to Noblesville. each student designed

a transit development either along the Nickel Plate rail line or another potential future transit line in Indianapolis. These urban design projects combined technology, climate responsive and energy producing architecture, mixed-use developments, and a “non-car-based urban lifestyle” in unique ways.

Nick Alexander’s project, “green Community: Urban Agriculture + Transit,” focused on sustainability. In explaining his project, he commented, “Urban agriculture provides essential goods and services to dense populations within the city. In Indianapolis, this effort begins by redefining 38th street and fall Creek as a major transit-oriented community along the revitalized Nickel Plate line. The development in my project is designed as a dense community with a new mode of life: urban farming along

the rail line. A new transit hub distributes people and food, greenways connect the neighborhood with other Indianapolis communities, and the valley itself is used for community gardening.”

Architecture student Paul konwinski created “Hydro-city,” explaining, “Hydro-city…focuses on the use of Fall Creek, a water feature adjacent to the Indiana State fairgrounds. hydro-city relies on the filtering, cleansing, and redistribution of the creek’s water; restoration of the natural landscape, and the connections to the urban fabric of downtown Indianapolis. rejuvenated neighborhoods are designed around different aquatic ecosystems such as wetlands and beaches.”

The third project, by matt vanSoest, was titled: “The yin and yang: Transit Development” and proposed a design

for 56th Street and keystone Avenue. “A lake, a private oasis to lake cottages and mansions, is integrated into the new development through a canal/wetlands system. in return, the existing residences can benefit through the design’s parks, infrastructure, and spaces which complete the “yin and yang” exchange,” he said.

This year’s program was entitled “Corporate Integrity—meeting Challenges and Doing the right Thing.” This was the ninth year for this all-day event which raises money for the law school’s scholarship fund. To date, the annual event has raised more than $100,000 in student financial aid.

The program wrapped up with a session on “Preemption and beyond: Legal Issues Changing the FDA,” presented by Professor ralph Hall, Distinguished Professor and Practitioner, University of minnesota School of Law.

JUDICIAL CLerkSHIPS Are AmONg THe mOST PreSTIgIOUS AND COmPeTITIve emPLOymeNT OPPOrTUNITIeS AvAILAbLe TO reCeNT grADUATeS. Judges get to select from the cream of the crop, from many law schools, when choosing students and recent graduates to become their clerks. IU School of Law–indianapolis students and alumni are seeking and finding clerkships after graduation in increasing numbers. According to Chasity Thompson, ’02, Assistant Dean for Professional Development, “To increase the number of our students accepting judicial clerkships was a personal goal. We have exceptional students, and I am elated to witness more of our students pursuing and accepting clerkship opportunities.”

Usually lasting one to two years, a judicial clerkship is an excellent way to bridge the gap between law school and the practice of law. Clerks at all court levels obtain unparalleled access to and knowledge about the judicial process. Additionally, a judicial clerk is exposed to a wide array of legal issues and is able to make a hands-on contribution to the judicial decision-making process. This experience and perspective is attractive to future legal employers who hire former judicial clerks for their significant legal knowledge, insider view of the court system, and ability to view cases from the court’s perspective. A judicial clerkship can provide a significant edge in the legal job market not only because of increased knowledge of the law and court system, but because of the valuable contacts and personal relationships developed during the clerkship experience.

Professor Joel m. Schumm, ‘98, who spent the three years after graduation in judicial clerkships, first with the honorable Theodore r. boehm of the Indiana Supreme Court and then the Honorable Paul D. mathias of the Indiana Court of Appeals, says, “many of our faculty did one or more judicial clerkships and know what an invaluable experience it is. We often talk with students one-on-one to explain and encourage them to apply for clerkships.”

Professor Schumm directs the law school’s Judicial externship Program and has served as a member or chair of the faculty clerkship committee since his appointment to the faculty. He says, “The Judicial externship Program also gives students an opportunity to do the same work as a judicial clerk. for many students, this experience has created or solidified an

interest in doing a clerkship. For some, it has created a contact or reference that helped secure that clerkship.”

“Clerking is a tremendous way of rounding off your legal education,” says Professor Jeffrey Cooper. “In law school, you tend to view the law in discrete parts; clerkships give you a chance to see the bigger picture, to see how those parts fit together, while still remaining focused on resolving individual disputes. I learned a tremendous amount about the law and about the judiciary during my clerkships, and that knowledge made me a better beginning lawyer than I would have been if I had gone right from law school into practice.” Professor Cooper clerked for the Honorable Louis H. Pollak of the U.S. District Court for the eastern District of Pennsylvania for a year after graduation from law school and for the Honorable guido Calabresi of the U.S. Court of Appeals for the Second Circuit for one year after he had been in practice for two years.

Dean Thompson assists students with navigating the judicial clerkship process. because she worked as a judicial clerk to Chief Justice randall T. Shepard of the Indiana Supreme Court for two years, Thompson understands the benefits of a clerkship and encourages students to consider the opportunity and its long-term benefits. “a clerkships affords recent graduates the opportunity to further explore diverse areas of law while honing research and writing skills. Judicial clerks receive an invaluable perspective on the court system and develop insight into how to better analyze legal issues,” says Thompson. “our office provides programming to expose students to the judicial clerkship process for federal and state opportunities, resource guides, personal counseling, mock interviews, reviews of application packets, and financial assistance with mailing applications. Additionally, we serve as the conduit between the students and the federal clerkship hiring system. We continue to cultivate relationships with members of the judiciary, many of whom are quite supportive of programming and networking events hosted by our office. The clerkship experience will be beneficial and memorable for our students.”

In addition to discussing issues such as access to justice, regulation of the legal profession, relations with the executive and legislative branches and addressing crises like foreclosure, drugs and immigration, the panel also took questions from the audience.

Indiana Court of AppealsOn September 23 the Indiana Court of Appeals heard oral arguments in the law school’s Wynne Courtroom as part of the court’s “Appeals on Wheels” program. The three-judge panel included Judge Patricia A. Riley, ‘74; Judge James S. Kirsch, ‘74; and Judge Paul D. Mathias. After the argument, the judges took questions from the audience, which consisted primarily of law students.

The school’s Diversity Committee, which is made up of students, faculty and staff, is chaired by Professor maría Pabón López and co-chaired by Tamara mcmillian, Associate Director of Professional Development.

Assistant Dean for Student Affairs, matt banker, says the group “brings to the table a dynamic collection of perspectives.” According to Professor López, the committee had the idea to identify a week during the Fall semester when members of the law school community could share information and exchange ideas about their similarities and differences. “I think Diversity Week is useful to open the eyes of students, faculty, and staff at the law school about the many faces that comprise the legal profession,” she says. The committee also hopes the events will help to build relationships between the law school and the Indianapolis community. Assistant Dean banker adds that they are seeking to “foster a sense of inclusiveness in the legal community.”

Hossein Fazilatfar, a master of Laws (LL.m.) student who serves on the committee, says he sees the purpose of the week’s events as “celebrating and sharing our cultures, traditions, backgrounds, thoughts, and beliefs

and, in sum, to celebrating our ‘diversity’ which we’re all proud of.” Anthony Pearson, President of the black Law Student Association (bLSA) says, “diversity is less about a person’s color and more about their perspective. A diverse legal ecosystem adds unparalleled value in the way it allows the legal community to respond to the multifaceted issues encountered by a community or company.”

The four days of events included a Cultural Celebration Fair, a panel discussion on the nomination of Hon. Sonia Sotomayor to the United States Supreme Court, a Human resources training workshop on “Diversity and entering the Profession,” and a Poetry Slam, entitled “The beauty of Struggle,” organized by bLSA.

“As the President of the black Law Students Association, I view The ‘beauty of Struggle’ Poetry Slam as an opportunity to reflect on the commonality of the struggles that we

all face irrespective of our differences,” Pearson says. “The understanding that accompanies this reflection will hopefully allow us all to become better servants and leaders at home, at work, and in the community. I appreciate the efforts of the Diversity Committee, and I know that the Indianapolis community, our students, faculty, and staff were enriched by participating in Diversity Week.”

The week’s events culminated with a keynote lecture by former Indiana Supreme Court Justice myra Selby.


The law school’s Black Law Students Association (BLSA) organized a Poetry Slam entitled “The Beauty of Struggle,” that took place in the Conour Atrium on October 6. From August 30 through September 5, Professor Lloyd T. (Tom) Wilson hosted eight visitors from the Faculdades Espirito Santenses (FAESA) law school in Vitória, Espirito Santo, Brazil. The trip was initiated by FAESA law professor Stella Emery Santana, who specializes in Environmental Law.

The delegation included the dean of the FAESA law school, two professors, four of the school’s top students, and a former state prosecutor. During their week in Indianapolis, the delegation attended four courses on the legal systems of the United States taught by Professor Wilson and were given a tour of the Baker and Daniels law firm, where Jackie Simmons discussed the firm’s focus on international law and business in Brazil.

Professor Wilson also arranged for the delegation to meet with leaders of all three branches of Indiana government. Chief Justice Randall T. Shepard of the Indiana Supreme Court spoke to the group in the Supreme Court Courtroom, and

Judge Edward W. Najam, Jr. of the Indiana Court of Appeals (and Professor Wilson’s former law partner) met with them in the Court of Appeals Courtroom. Lt. Governor Becky Skillman received the group at her State House office, and Indiana Senators Phil Boots and Mike Delph, who is currently a third-year student at the law school, addressed the group as they sat at Senators’ desks in the Senate Chambers.

In addition to the cultural activities available in the capital city, the FAESA delegation was treated to a trip to Crawfordsville, where they addressed the faculty and students of Wabash College. Additionally, they attended an IU football game in Bloomington. “The law school was very pleased to have this opportunity to promote our school’s contacts with Latin America,” Professor Wilson says. “Hopefully we are setting the foundation for mutual faculty and student exchanges in the future.”

Law School Hosts Visitors From Brazil

THe LAW SCHOOL’S PRo BoNo PrOgrAm, under the direction of LaWanda Ward, ’03, has organized a Pro Bono & Public Interest week in the Fall semester each year since 2002. The week is designed to provide law students with in-depth information about job search strategies in the public interest sector, panel discussions of student and attorney experiences, and an opportunity to interact with local partner agencies during the Pro Bono & Special Programs fair. This year’s Pro Bono & Public Interest week was held in conjunction with the American bar Association’s National Pro Bono week, October 26-30.

Lt. Col. David Benjamin Delivers LectureOn Thursday, October 22, Lt. Col. (Res.) David Benjamin

spoke in the Wynne Courtroom at the law school. His lecture, “Israel’s Fight Against Terrorism—The Charge of the Lawyer’s Brigade,” served as a preamble to the counter-terrorism program that took place at the school the following day. Lt. Col. Benjamin spent 17 years in the Israel Defense Forces (IDF) Military Advocate General Corps. From 2005 until his retirement, Lt. Col. Benjamin was Director of the Strategic and International Affairs Branch of the IDF International Law Department.

He continued to reside in the home until his death in 1901. it’s been a museum since 1974, and today attracts visitors with special exhibits, events and tours of where Harrison and his family lived, worked and campaigned.

It was during a recent board meeting that robert everitt, ‘65, noticed the trend of IU Law–Indianapolis alumni serving on the board. At that meeting, board members Professor of law susanah Mead, ‘76; John Krauss, ‘76; Michael Peek, ‘79; and steven Campbell, ‘97, were in attendance.

everitt joined the board as a natural extension of a long-standing interest in historical homes and Indiana history. He recruited mead, who knew the connection between Harrison and the IU School of Law–Indianapolis.

“Our law school was, at one time, the benjamin Harrison Law School,” she notes.

The benjamin Harrison Law School was a part-time evening school in Indianapolis at the turn of the 20th century. in 1936, it merged with the indiana law school, a full-time day school, until its affiliation with iU in 1944. Today, the iU School of Law–Indianapolis is the largest law school in Indiana and the only law school in the state to offer both full- and part-time programs, an important legacy from its early days as the benjamin Harrison Law School.

how many lawyers does it take to fill the board of directors at the benjamin Harrison Home? Sounds like a lame joke, but the truth is that five law school alumni currently sit on the governing board of the historic property at 1230 n. delaware street in indianapolis.

The attorneys on the board are valued for their expertise on a variety of legal issues, according to Phyllis geeslin, president and CeO of the benjamin Harrison Home.

but law school alumni and their dedication to the home are also a fitting tribute to harrison, who served as the first president of the Indiana bar Association during his long and distinguished law career, she says.

“benjamin Harrison was such a wonderful lawyer,” geeslin says. “He is considered to be one of the best lawyers to occupy the White House.”

The Dean’s Report recognizes those generous alumni and friends who have supported the school financially during fiscal year 2008-2009. Donors to the law school are recognized in several ways, including membership in the Landmark Society, the Century Society, the Black Cane Society, the Maennerchor Society (all carrying the Partners in Progress Giving Designation), the Dean’s Council and the Law School Associates. During the 2008-2009 fiscal year, gifts were received from 1,703 donors, totaling $799,994.44.

Our private fundraising is especially important because the law school is a state-assisted, not state-supported, institution. Private funds are crucial to create scholarships, to establish endowed professorships and faculty chairs, and to support our academic centers of excellence. court participation. Elijah Lovejoy was a publisher and avid abolitionist during the antebellum era who died defending his printing press. An angry mob murdered Lovejoy in 1837 on the frontier of the American west in Alton, Illinois. Many consider Lovejoy to be the first martyr to freedom of the press in the United States. Lovejoy was a contemporary of Abraham Lincoln, who later selected Lovejoy’s younger brother John to serve as U.S. counsel to Peru. Another brother, Owen, served and died in the U.S. Congress during Lincoln’s presidency. Upon hearing the news of Owen’s death, Lincoln said: “Lovejoy was the only friend I had in Congress.” The Lovejoy Award for best brief was established to honor this generation of brothers who dedicated their lives to a greater purpose and through the power of their words, writings, and advocacy changed a nation.Kyle R. Those words made a big impact on Arceneaux, a partner in the Competitive business Practice Litigation group at Ice miller LLP, although it’s far from the only lesson he learned.

“A l eg a l educa t ion i s a phenomenal experience,” he says. “The takeaway from law school is learning how to think and how to solve problems, regardless of your career path.”

An Indianapolis native who graduated from the IU kelley School of business in Indianapolis, Arceneaux was a fundraising consultant when he applied to law school. It felt a little like a gamble; he wasn’t sure he’d be successful, and his wife, margaret, had to support the newly married couple on her salary.

He shouldn’t have worried. Arceneaux was an associate editor of the IndIana Law RevIew and graduated summa cum laude.

Law School Advice Remembered:Alumnus Wants to Pay It Forward—and Back

made a prediction—and gave some advice. William F. Harvey, Carl m. gray Professor of Law emeritus, said that students would someday find themselves surrounded by stacks of files, facing deadlines and managing countless details.

Today, his practice is in business litigation, which includes representing and advising clients in a variety of non-compete, contract and other business disputes. “I enjoy what I do,” he says. “I help solve people’s problems.”

Arceneaux’s relationship to the school continues. He’s a member of the board of directors and past president of the Alumni Association. for the past 10 years, arceneaux has been the law school’s Law Firm Campaign chair at Ice miller and he served on the steering committee of the capital campaign for the current building.

giving helps pay back the investment in his legal education by Indiana taxpayers and donors, he says. Arceneaux remembers being awarded a $500 scholarship, a modest amount that made a big difference.

“It was from a donor I never met, and who never met me,” Arceneaux says.

The economic reality for today’s law school students is tougher than when he began clerking at ice Miller in 1991, so giving is also a way of “paying it forward,” Arceneaux adds.

“Law students need our support to make sure they have the best opportunities,” he says.

Hall render not only hires many of the school’s top graduates, but those alumni give back to the school by volunteering time and donating money to help law students become well-versed in the area of health law. The law school’s William S. and Christine S. Hall Center for Law and Health enjoys an excellent reputation in the health law field thanks in part to the support of Hall render and its attorneys. John C. render, Jr., ‘71, a partner at Hall render and a graduate of the law school, accepted the award on behalf of the firm.

Hall render provides health care organizations with full service legal representation. From the time William S. hall, ’51 founded the firm in 1967, hall render has focused its practice in health law and is now recognized as one of the nation’s preeminent health law firms.

Charles bantz and several hundred community and civic leaders gathered for the twenty-first annual spirit of Philanthropy awards Luncheon, sponsored jointly by The Center on Philanthropy at Indiana University, the IU Foundation, and the IUPUI campus. each school on the Indianapolis campus honored individuals or entities that provided exemplary voluntary service or financial support to the school.

More than 100 hall render attorneys represent 500-plus organizations in a range of health care-related issues from fraud and abuse to real estate contracts to HIPPAA and tax regulations.

Faculty A key measure of any law school

is the quality of its faculty. In order to attract

and keep superior teachers and scholars, we

need unrestricted Annual Fund contributions

that will support faculty recruitment,

retention, and professional development.

Law Library Gifts help maintain one of

the largest and most highly automated legal

collections in Indiana. The library serves law

students, faculty, members of the bar, and

citizens of Indiana.

Students Unrestricted gifts to the Annual

Fund help to defray the high cost of tuition

and other fees and assist student groups

and programs with their initiatives. Gifts also

enable student representatives to attend

national and regional conferences and

competitions.

Additional Support Private

unrestricted gifts are essential for funding

guest lecturers, professional development

programs, student recruitment, publications,

alumni events and commencement.

each year, alumni in a number of law firms and corporations participate in the Annual Law Firm and Corporate Campaign. A volunteer chair is recruited from each firm or corporation, and they are asked to solicit contributions from fellow alumni in their office. This annual campaign is vital to the law school’s annual fund and is, by far, our most successful fund raising drive of the year. Thank you to the 2008-2009 Campaign Chairs and everyone who participated in the 2008-2009 Law Firm and Corporate Campaign. mAry HArTer mITCHeLL was born March 9, 1953 in Ashland, Ohio, and grew up in Anderson, Indiana. Her parents were Nathan F. r. Harter (Lutheran minister) and mary Harter. mary is survived by husband, Frank burch brown; ex-spouse, Dan mitchell; daughters, Clara Hope mitchell and Sally Hope mitchell; siblings, elisabeth Jones, rachel Harter, Susanna Harter, Nathan Harter, William Harter, and John Harter. She was predeceased by sister rebecca Harter.

mary was a devoted mother who gave generously of herself to her daughters, Sally and Clara, whom she home-schooled in highly creative ways. She encouraged their love of literature, dance, and theatre.

a Professor at the law school since 1980, Mary taught contracts as well as courses in elder law, law and religion, rape law, prisoners’ rights, and prison literature. She had served on virtually every faculty committee and as faculty advisor for many student organizations. mary was the author of Legal Reference for older Hoosiers and recipient of an IU Trustee’s Teaching Award in 2003. mary also regularly took graduate courses as a non-degree student at Christian Theological Seminary, Indianapolis.

The law school mourns the death of Professor Mary Harter Mitchell who passed away on November 4, 2009 at the age of 56. Professor Mitchell, who was named the Alan

H. Cohen Professor of Law in 2004, was well loved by everyone in the law school family. The following tribute was published in a memorial booklet at a service in her

honor on Sunday, November 8 at First Friends Meeting in Indianapolis.

Remembering Professor Mary Harter Mitchell (1953-2009)

She was a member of First Friends (Quaker) meeting, Indianapolis. A strong advocate for peace, she lived her faith through service to others. mary had a lifelong commitment to social justice and to women’s rights. mary was currently at work on a substantial article on the concept of human dignity in law.

as a poet, Mary had a gift for finding the sacred in unexpected places, for tracing the amazing peculiarities and delights of love, and for at once protesting and ultimately affirming the mysterious but often painful paradoxes of life and death.

Newly wed to CTS religion scholar and musician Frank burch brown, mary and Frank shared a keen interest in religion, poetry, music, architecture, and other arts, as well as the natural world. mary collected rocks, especially fossils. She was fond of canoeing on Sugar Creek in Indiana and she loved the mountains and rocky deserts of the West. She eagerly traveled abroad.

mary was beloved by the numerous students she taught and by the many people whose lives she touched. mary’s sudden and untimely death leaves all who knew her in a state of shock and grief—but also with boundless gratitude for the gift of her life and for her compassionate, passionate, and ever generous spirit.

Law School Welcomes Veteran IP Litigator to Direct IP Center

JOHNR.SCHAIBLEy,IIIwill join the iu school of law–indianapolis as executive director of the school’s Center for intellectual property law and innovation in January. schaibley is retiring from Baker & daniels after more than

25 years of litigation experience. much of his recent practice has been on intellectual property matters. his focus included patent litigation, including infringement and licensing disputes, as well as complex breach of contract actions and arbitrations, often involving complex technology issues. he also has extensive experience with trademarks, copyrights, trade

regulation, administrative law and environmental issues. he has worked with major corporations in the medical device, pharmaceutical, electronics and other industries, while representing clients in federal and state courts, including the u.s. supreme Court.

“i think John schaibley is a tremendous addition to our ranks,” says law school dean Gary r. roberts. “What he can and no doubt will do for our ip program here, which is so important to the local bar and business community, is tremendous. i am very happy and excited that he is coming aboard.”

a graduate of purdue university (B.a., 1975), schaibley graduated first in his law school class at indiana university (J.d., maurer school of law, 1981), where he was executive editor of the IndIana Law JournaL. he is a member of the order of the Coif and was a member of the order of the Barristers. he has received West publishing Company hornbook awards three times and american Jurisprudence awards four times. he received the edwards Fellowship and was also the recipient of the american College of trial lawyers medal for excellence in advocacy.

schaibley served as a law clerk at all three levels of the federal judiciary. he clerked for Judge Jesse e. eschbach in both the u.s. district Court for the northern district of indiana and the u.s. Court of appeals for the seventh Circuit, and for Justice John paul stevens in the u.s. supreme Court. his honors include being chosen for “the Best lawyers in america” for 2009-2010, and “indiana’s Best lawyers” (2009).

he will teach a course on patent litigation in the spring 2010 semester.

CyNTHIAADAMS made a presentation on “the pedagogy and methodology of incorporating lawyering skills into a Contracts Course” at an international conference of judges, lawyers, and educators at the university of pretoria, south africa, in July 2009; participated in a panel presentation on “Bringing the law school Curriculum into the new Global reality,” at the southeastern association of law schools’ annual meeting, in palm Beach, Florida, in august 2009; and made a presentation, “prometheus unbound: using myths, Folktales, and legends to Convey legal Concepts in the Global Classroom,” at the Global skills Conference iV at Georgetown university school of law, in may 2009.

CyNTHIABAKER received a two-year appointment to the indiana Commission for higher education. she was appointed as the statutorily-authorized faculty member to the Commission by Governor mitch daniels. professor Baker’s term will conclude in July of 2011. additionally, she presented The Big Objectives and Fine Print of State Energy Policy to the participants in the 9th annual program on law and state Government Fellowship symposium, state law and energy policy: initiatives and ideas powering the Future, on october 2, 2009.

CHANCELLOREMERITuSGERALDL.BEPKO was recognized with the Chancellor’s medal at the iupui 40th anniversary Breakfast on september 23. other 40th anniversary recipients of the medal are senator richard lugar, former state senator and lt. Governor John mutz, former state senator larry Borst, former state senator dr. ned lamkin and former City-County Council president, rozelle Boyd. at the same event the university, through Chancellor Charles Bantz, presented the Chancellor emeritus Bepko sculpted personal bust mounted on a pedestal which has now been placed in the iupui university library.

Chancellor emeritus Bepko served as host and speaker at the october 10 dinner for the Bepko Fellows, a group of 14 indiana university graduate students in medicine, engineering, science, Business, education, informatics, philanthropy and law. these graduate students were Bepko scholars as iupui undergraduates.

he has been named Chair of the rhodes scholars selection Committee for the 2009 selections for indiana, kentucky and ohio. the selection sessions took place november 20-21, 2009. Chancellor emeritus Bepko also serves as Chair of the Committee on succession for the office of Chair of the Board of the lumina Foundation for education, march 2009 through december 2009. additionally, he continues to serve as an at-large member of the indiana Commission for higher education, and on its strategic directions Committee.

on June 11, he met with FBi director robert mueller, in his office and at his invitation, on the 41st anniversary of incurring severe injuries on surveillance duty in new York as an FBi agent. recently, he visited the iu school of medicine and purdue university as a member and secretary of the showalter trust selection Committee which awards support of roughly $1.5 million each year for research, primarily at the iu school of medicine and purdue university, but also the methodist research Foundation.

Chancellor emeritus Bepko was named honorary Co-Chair of the Committee for the Celebration of Bishop t. Garrott Benjamin’s 40th anniversary as a pastor. Benjamin is pastor of light of the World Christian Church in indianapolis.

on august 2-4, 2009, SHAWNBOyNE, along with professors EMILyMORRIS and MAXHuFFMAN, presented at the Fourth annual Big ten aspiring scholars Conference, hosted by the university of illinois College of law in Champaign. professor Boyne also was interviewed by WiBC radio and FoX news, to provide expert comment on legal issues in the news.

on october 1, GEORGEE.EDWARDSgave a presentation in rome, italy at the Commission for Cultural Exchange between the United States and Italy (Commissione per gli scambi Culturali fra l’italia e gli stati uniti), which is an affiliate office of the u.s. department of state and houses the u.s.-italy Fulbright Commission. the presentation focused on american legal education, and highlighted opportunities for italian students to receive master of laws (ll.m.) and other advanced degrees in the united states. attendees and participants included Fulbright staff, representatives from

italian law schools, and staff of educationusa (another us state department affiliate).

While in rome, professor edwards was also a delegate to the 137th meeting of the united nations Food and agricultural organization (Fao) Council held at Fao world headquarters september 28-october 2. the Fao Council is the executive organ of the Fao Conference, which is the supreme governing body of the Fao that meets in regular session every two years. the 49-member council has powers delegated to it by the Conference, and exercises functions dealing with the world food and agricultural situation and related matters, current and prospective activities of the organization, and other matters.

JOHNHILL’s book, The Political Centrist, was released by Vanderbilt university press in november. the book argues

that liberalism and conservatism are defunct ideologies— that what passes for “liberalism” today is increasingly a statist idea advocating all-encompassing government that runs counter to true liberalism, and that “conservatism” is really simply the older liberalism brigaded with a moralistic social agenda. the book advances centrist solutions to some of

the major problems of our time, including the death penalty, immigration reform, affirmative action, abortion and the problem of judicial activism, among others.

professor hill delivered a talk at the unlV law school on oct. 14th on the history of liberalism and conservatism. the talk was entitled, “the paradox of liberalism, the dilemma of Conservatism.”

his article, “the Constitutional status of morals legislation,” was published at 98 KentucKy Law JouRnaL 1 (2009) in november.

MAXHuFFMAN presented his abstract, “revisiting rescission,” at the university of illinois Untenured Faculty Workshop in august. he completed and has submitted for publication a paper, “iqbal, twombly, and the expected Cost of False positive errors,” together with professor mark anderson, and presented the paper to the faculty at the law school through the lunchtime colloquium series. in october, professor huffman traveled to dublin, ireland, for the fourth Antitrust Marathon, where he presented a discussion paper titled “Competition law and Consumer protection.” a revised version of that paper will be published in the euRopean competition JouRnaL. on december 2, professor huffman organized and participated in a debate with dean Gary roberts and professor antony page regarding American Needle v. NFL, which addresses the question whether the nFl is a single entity or a

group of competitors for antitrust purposes. also in december, together with professor eleanor kinney, professor david orentlicher, and the hall Center for law and health, professor huffman hosted several antitrust and health law experts from across the united states for a brainstorming session and panel discussion on health care and antitrust, with an emphasis on health care reform legislation. that event was planned in cooperation with the Washington, d.C., think tank, american antitrust institute. professor huffman then traveled to the Washington university in st. louis school of law to present a draft of “revisiting rescission,” which deals with the rescission remedy in consumer contracts. he is also working on a paper, “Behavioral exploitation and antitrust,” which deals with firms’ abilities to gain and preserve market power through exploiting known shortcomings in consumer decision making. professor huffman has been named a dean’s Fellow for 2009-10.

ROBERTKATz presented two works-in-progress at the midwestern law and economics association annual conference, held at notre dame law school on october 9 and 10: “You make me sick: repugnance and efficiency in human tissue transplantation,” and “right now it’s only a notion: Giving Form to social enterprise”(with prof. antony page).

on october 22, professor katz gave a presentation and participated in a panel discussion on federal tax exemption for nonprofit hospitals at the Community Benefits Symposia, held at iupui and sponsored by the hall Center for law and health. on october 26, professor katz presented a work-in-progress on social enterprise in the healthcare industry at the iu Center for Bioethics’ predictive health ethics research (predicter) program.

on november 19, professor katz presented a paper at the annual conference of arnoVa (the association for research on nonprofit organizations and Voluntary action), held in Cleveland, on “Channelling towards Charity: presumed Consent to organ donation as a Case study in pro-social default rules.” Finally, on november 30, professor katz presented a paper on “notion-Building: Giving Form to social enterprise,” at the Workshop in Political Theory and Policy Analysis, held at indiana university in Bloomington.

in July, NORMANLEFSTEIN, professor and dean emeritus, testified as an expert witness in a case in miami concerning the overwhelming number of cases that an assistant public defender was being assigned to represent. as he explained to the trial court, no lawyer could furnish competent representation consistent with rules of professional Conduct when seeking to represent simultaneously well over 100 clients, virtually all of whom were charged with felony offenses. in august, the american Bar association house of delegates adopted a detailed policy statement on public

defense workloads for which professor lefstein served as the reporter. the statement is known as the ABA Eight Guidelines of Public Defense Related to Excessive Workloads, available at www.indigentdefense.org. in september, professor lefstein was part of a small group of persons invited to meet at the department of Justice in Washington, d.C., with attorney General eric holder to discuss issues related to indigent defense nationwide. in november, he met in harrisburg with a pennsylvania committee appointed by the legislature to make recommendations concerning the delivery of defense services for the indigent in criminal and juvenile cases in that state. also in november, during the annual meeting of the national legal aid and defender association in denver, professor lefstein spoke at two programs on matters concerning public defense.

Professor Andrew R. Klein was nominated by the Indianapolis Bar Foundation as a Distinguished Fellow. Klein, who joined the law school in 2000, is the Paul E. Beam Professor of Law. He is an active scholar, having published articles in a number of leading law journals. He is co-author of a casebook, Torts: Cases, Problems and Exercises (Lexis/Nexis 2nd ed. 2005). In addition, Professor Klein is a dedicated classroom teacher who has won eight student teaching awards during his career. Professor Klein also is a national lecturer on tort law for BarBri Bar Review.

Alumni members of the Marion County Bar Association met at the law school on August 19, 2009 along with Dean Gary R. Roberts, representatives from the Indiana University Alumni Association and faculty and administrators from the law school. Many ideas were discussed about ways to increase the law school’s minority student population and to help minority students complete their degrees and ultimately find jobs. The school is looking forward to putting many of the excellent ideas generated during this meeting to work!

Justice Richard M. Givan, ‘51

The Honorable Richard M. Givan, ‘51, passed away July 21, 2009. Justice Givan served the State of Indiana through public service that included 26 years as a jurist on the Indiana Supreme Court, including nearly 13 years as Chief Justice. In addition to his remarkable legal career, he is remembered fondly by court staff as a loyal friend and great storyteller. Justice Givan was Indiana’s ninety-sixth justice. He was elected to the Court in 1968 and served continuously until his retirement in December 1994. He was the founding chairman of the Indiana Judicial Center, which provides education to judges across the state. While on the Court, Justice Givan heard nearly 6,000 cases, authored more than 1,500 majority opinions and dissented in more than 400 cases.

Those in attendance at his retirement dinner in January 1995 were amused to find his favorite “Givanisms” printed for them to take home. Justice Givan commonly used sayings including, “you pile on too many apples, you can’t shove the cart” and “it’s not that he doesn’t know there’s a problem, it’s that he doesn’t know that he doesn’t know that there is a problem.” The colloquialisms continue to remind colleagues and friends of Justice Givan’s colorful personality.

Born June 7, 1921, in Indianapolis, Richard Givan graduated from Decatur Central High School in 1939. Justice Givan received an LL.B. from Indiana University in 1951 and was admitted to the Indiana bar in 1952. While a law student, he was assistant librarian for the Indiana Supreme Court, later becoming a research assistant for the Court. He was the first person to serve as a law clerk at the Court. He was appointed deputy public defender of Indiana after graduation from law school and served in that post until 1954. From 1954 to 1966, he was Assistant Attorney General of Indiana, pleading cases before both the Indiana and U.S. Supreme Courts. In 1967, he was a Representative and a ranking member of the Judiciary Committee in the House. He was also chairman of the board of directors of the Indiana Judicial Conference from 1974 to 1987, served on the board of managers of the Indiana Judges Association from 1975 to 1987, and became an Indiana Judicial College graduate in 1989.

In addition to his legal career, Justice Givan served as a pilot in the U.S. Army Air Corps during World War II and was later a flight instructor with the Air Corps Reservists.

Deborah K. Hepler, ‘94

Deborah Hepler, 56, of Carmel, Indiana passed away October 5th, 2009. Born November 8, 1952 in Mishawaka, Indiana, she graduated summa cum laude from the law school in 1994.

Deb served as a judicial law clerk for Judge Larry J. McKinney of the U.S. District Court, as a senior associate at Locke Reynolds LLP, and as an Adjunct Professor of Law for the IU School of Law-Indianapolis. At the time of her death, she was General Counsel for the Indiana Housing and Community Development Authority, as well as a member of the board of directors for the Indiana Coalition against Domestic Violence, Indiana Legal Services, Inc. and the Domestic Violence Network of Greater Indianapolis. In 2000, Deb Hepler founded the Protective Order Pro Bono Project of Greater Indianapolis, a project providing free legal services to victims of domestic violence. In recognition of those efforts, she was honored as the 2005 Outstanding Alumna of the Year by the law school’s Alumnae Network.

Her other awards include the 2005 Chancellor’s Community Award for Excellence in Civil Engagement and the 2001 Prelude to Light Award from the Domestic Violence Network of Greater Indianapolis. Hepler will be remembered as a passionate defender of individual protection and rights. Deb recently celebrated 37 years of marriage to her husband, Jay Hepler, who survives; as well as her two children, Eric and Anne Hepler.
