The Bihar Special Survey and Settlement (Amendment) Rules, 2019

Survey and Settlement Act, 2011 (as amended from time to time), the StateGovernment hereby makes the following Amendment Rules to amend the BiharSpecial Survey and Settlement Rules, 2012:-

1. Short title, extent and Commencement- (1) These rules may be called"The Bihar Special Survey and Settlement (Amendment) Rules, 2019".

(2) It shall extend to the whole of the State of Bihar.(3) It shall come into force with immediate effect.

2. Rule-2 of the said Rules, 2012 shall be substituted by thefollowing.-Rule-2(1), In these Rules unless there is anything repugnant in thesubject or context-

(i) "Special Survey" means the construction of digital map andconstruction and maintenance of record of rights to be made on the basisposition of the property and ownership relating to the land with the help ofmodern technology by using aerial Photographs/ Satellite Images - taking latestposition of land;

(ii) "Map" means the map of land that is say configuration preparedvillage wise of all the existing plots Revenue village with total numbers khesrasand boundaries and all necessary details with the help of modern technology/E.T.S or human technique by using Aerial Photographs/Satellite Images;

(iii) "Control Point" means the control points established by theDepartment of Survey of India, mainly made for control points for the Survey inthe context of primary, secondary, tertiary.etc;

(iv) "Amin Diary" means Amin diary maintained in the prescribedformat for verification and examination in work of survey, by Amin/SpeicalSurvey Amin described in Serial no.-XI of sub-section (2) of section-2, of theBihar Special Survey and Settlement Act, 2011 during field visit within thedifferent stages of land survey for recording the proceeding of measurement andland survey;

-=(v) "Yaddast Register" mean~a Register maintained in the.prescr~bed

t format by Amin and Kanungo for entering the claims and other deta~lsreceIvedfrom Raiyats with respect to their land under sub-section (1) ofSectlOn-5 of theBihar Special Survey and Settlement Act, 2011 (as amended from time to time);

(vi) "Pedigree" means Pedigree prepared in the prescribed formatLand Statement basis claim entered in it received from raiyats prepared byAmin/Kanungo within their jurisdiction clarifying their relationship withoriginal KhatiyanilJamabandi Raiyats under the provisions of sub-section (1) ofsection-5 of the Bihar Special Survey and Settlement Act, 2011 (as amendedfrom time to time);

(vii) "Deputy Collector Land Reforms" means an officer appointed bythe State Government as Land Reforms Deputy Collector for discharging duties

~and liabilities described for maintenance of land-records during land survey asper procedure described in the Bihar Special Survey and Settlement Act, 2011(as amended time- to- time) and the Bihar Special Survey and Settlement Rules,2012;

(viii) "Circle Officer-" means an officer appointed by the StateGovernment as Circle Officer to discharge the duties and liabilities described inthe Rules and the Act;

(ix) "Special Survey Amin- " means Special Survey Amin working asan Amin for Special Survey works for discharging the duties and liabilities ofAmin described in the Rules and the Act;

(x) "Special Survey Kanoongo-" means Special Survey Kanoongoworking as kanoongo for discharging the duties and liabilities of Kanoongodescribed in the Rules and the Act;

(xi) "Special Survey Assistant Settlement Officer- " means an officerworking as Special Survey & Settlement Officer to discharge the dutiesliabilities of the Assistant Settlement Officer in Special Survey as described inthe Act and Rules.

(xii) "Electronic Total Station-" means the modem equipmentmeasuring the land in conformity according to criterion as prescribed by the

Government and in conformity with the standards determined by the

Government;

(xiii) "Differential Global Positioning System-" means the modemequipment to indicate Specific Co-ordinations of Specific Place and correctpositions on the Earth by linking the signals received from the Satellite with

Ground Co-ordinates;

(xiv) "Tie-Line- " means the line connecting the smaller Survey Blocks

on the main Survey Line;

(xv) "Teriz-" means the statement prepared by recorded informations ofthe entries in the Khatiyan- currently in use;

(xvi) "Land Parcel Map-" 'means a map depicting one parcel as part of

specific land portion.

(2). Words and expressions used but not defined in these Rules shall havethe same meaning which have been assigned to them in the Bihar SpecialSurvey and Settlement Act, 2011 (as amended from time to time).

(3). The words "Licensed Surveyor" used in the Bihar Special Surveyand Settlement Rules, 2012 shall be substituted by the words"Amin/Special Survey Amin"

(4). In view of section-2 (1) of the Bihar Special Survey and SettlementAct, 2011, unless otherwise requires in the context the definitions provided inthe Bihar Tenancy Act, 1885, the Bihar Land Reforms Act, 1950, the Surveyand Settlement Manual, 1959, the Tenant holding (Maintenance of Records)Act, 1973 and Bihar Mutation Act, 2011 shall be applicable.

3. Sub rule (3), (4), (5), (7) and (8) of rule-6 of the said Rules, 2012shall be is substituted by the following respectively :-

"(3) A land holder/Raiyat may .submit before the Assistant SettlementOfficer in survey office or camp office, a self declaration in respect of land heldby him in Form-2 and Pedigree in prescribed F'Jrm-3(1).

(4) Self declaration shall be received by the Assistant Settlement Officeras per provisions provided in sub-rule-(l) and the same shall be verified withthe help of different Revenue records of right. l' \~/'/"

(5) Assistant Settlem~l~t OHicer shall ~erify details of self declar~tion, with the help of different records of right such as last ~urvey kh~t1yan,

lamabandi Register, Khesra Register, last consolidation khatlyan, contmuous

khatiyan and other available revenue records.(7) After verification of self declaration, concerned Assistant Settlement

Officer shall prepare verification certificate in Form-3.(8) Any self declaration which could not be verified by the Assistant

Settlement Officer due to non availability of the relevant records or due todisputes a brief reason for non verifications shall be maintained in a separate

register in Form-4.4. Sub-rule-(l) of Rule-8 of the said Rules, 2012 shall be substituted by

the following and sub-rule-(3) shall be deleted:-(1) Revenue village wise Khanapuri parties shall be constituted by the

Settlement Officer of the concerned district consisting of the following :-(i) Assistant Settlement Officer/Special Survey Assistant Settlement

Officer.(ii) Kanoongo/Special Survey Kanoongo.(iii) Amin/Special Survey Amin.Sub-rule-(3) of The Bihar Special Survey Settlement Rules-2012-

deleted.5. Amendment in Rule-9 of the said Rules, 2012.-(1) Sub-rule-(2) of

Rule-9 of the said Rules, 2012 is deleted.(2) Sub-rule-(3) of Rule-9 of the Bihar Special Survey and Settlement

Rule-2012 is substituted by the following:-"(a) Such self declaration which could not be verified earlier by the

Assistant Settlement Officer, shall be verified by the Khanapuri party on thebasis of available records of right such as last Survey Khatiyan, updatedkhatiyan, consolidation khatiyan, Khesra register, continuous khatiyan,Jamabandi register and other revenue records of right,"

(3) New sub-rule-(3)(b) is added after sub-rule-3(a) of the BiharSpecial Survey and Settlement Rule-20l2.

"(b) The khanapuri party, having regard to such facts, shall determinethe infrastructure in record of rights, such-as khesra register right of cultivationand ownership shall be as follows: ..

(i) Account uptodate ground realities- property based ownership foundin course of Land verification and on the basis of papers related to property,position of possession;

(ii) Changes-position of Geographical changes in land plots in due courseoftime; . \~ // .

(iii) Transf~rs-Position of ownership on the land/land plots on the basisof land settlement, Bhoodan Praman Patra, sale-purchase, gift, perpetual lease

etc. by the Government; . . .(iv) Sub-division- up to date position of land/Land plots after division of

rayati land on the basis of mutually signed consent, on the basis of registereddeed and order passed by the civil court in property suit/partition suit.

(4) Provision of Sub-rule-(4) of Rule-9 shall be mentioned as clause(a) and thereafter the following clauses (b), (c) and (d) shall be inserted:-

"(b) If concerned raiyat is not found present at the time of spotverification during khanapuri stage, then the Amin shall enter the same in theYaddast register and proceed serial-wise. If such raiyat makes his presence afterfixed due date, then the land details of such raiyat shall be entered by Amin withhis signature and date in the yaddast register "Form-3(2)".

Details of revenue records/ documents/evidences shall be entered in the•Yaddast register on the basis of which khata has been opened during khanapuri

stage in the name of concerned raiyat.(c) Before initiating khanapuri works, concerned Amin shall prepare

pedigree of all raiyats khata-wise on the basis of Terij of khatian under thesupervision of Kanoongo. Pedigree shall be prepared of all survey relatedvillages in the presence of general public arid assistance will be sought fromlocal public/representatives as per requirement. Signatures will be procured onthe pedigree that of raiyats/general people/public representatives. If land isfound to have been transferred by the original raiyat or his real heir, thenconcerned raiyat shall enter his details on the other page of the pedigree. Suchprepared pedigree shall be randomly examined by the Assistant Settlementofficer also. Share of raiyats shall be determined on the basis of pedigree as perprovisions laid down in Hindu Succession Law/Muslim Succession Law orwhatever is applicable.

(d) After receipt of information related to khanapuri parcha, concernedraiyat shall file his claim/objection against the entries in Form-8 withinmaximum of 15 days."

6. Following sub-rule (la) shall be inserted after sub-rule-(I) of Rule-11 of the above Bihar Special Survey and Settlement Rules, 2012 :-

"(1a) Checking of Maps and record of rights prepared in view of theprovision ofsub-rules-(l), (2), (3), (4), (5), (6), (7), (8), (9), (10), (11) of Rule-9and sub-rule-(1), (2), (3), (4) of Rule-l 0 shall be completed during recess underRule-14. Recess work shall be completed in two sections-(i) records and areasection and (ii) khesra section.

7. New sub rule-(5a) shall be inserted after sub-rule-(5) ofRule-14 of'4f" the Bihar Special Survey and Settlement Rules, 2012 :-

"(5a)(i) After publication of draft of record of rights, AssistantSettlement Officer shall prepare Settlement Rent Roll in Form-18(a) on thebasis of rent table fixed by the State Government for every raiyat of theconcernedrevenue village. Annual rent roll shall be prepared as per following:-

(a) Homestead Land- Rs.l.OOper decimal.(b) Agriculture Land-Rs.0.75 per decimal.(c) Bhit Land - Rs.0.60 per decimal.(d) Chaur, Diyara, Pathrili and Sandy land - Rs.0.50 per decimal.(e) Different Government land and land controled by different

Government Departments - Rs.l.00 per acre.(f) Urban land - Rs.5.00 per decimal.(g) Commercial Land-as per provisions laid down III the Bihar

Agriculture Land (Conversion for Non-Agriculture Purposes) Act,2010.

If the Commercial land is not put to commercial use in future or the sameis exempted from Commercial use, then rent shall be fixed in view of its actualuse.

(ii) After preparation of rent roll of the concerned village as per landdetails and its nature, owned by all raiyats, concerned Assistant SettlementOfficer shall publish draft rent roll for receipt of objections and claims and suchobjections shall be received within 15 days from the date of its publication.

(iii) Claims and objections received during the publication of draft rentroll shall be disposed of after giving reasonable opportunity of hearing toconcerned parties. Records of proceedings shall be maintained as case record&other formalities shall also be completed.

(iv) After disposal of claims & objections received in view of theprovisions of subrule-(5) (i) of Rule-14 and rent roll prepared in view ofsubrule-(5)(ii) of Rule-14, the Charge Officer shall examine rate of settlementrent roll as submitted by the Assistant Settlement Officer. The Charge Officershall examine the settlement rent roll and if it is found correct, he shall submit itto the Settlement Officer for confirmation and sanction.

(v) The Settlement Officer may sanction Raiyat wise settlement rent rollwith or without correction in view of subrule-(5)(a)(iv).If correction is requiredin settlement rent roll, the same shall be returned to the Assistant SettlementOfficer for reconsideration.

For amendment in rent Table Raiyatwise of concerned Revenue Villagereceived for reconsideration, the Assistant SettlementOfficer shall issue notices

..to concerned parties for amendment in Raiyat wise rent roll and after hearingconcerned parties, his findings shall be recorded in case record. After hearingand completing other formalities correction will be made in concerned rent rolland rent shall be incorporated in the relevant columns of Form-20 of Record ofRights of the land owned by concerned Raiyat/Raiyats .

(vi) After final sanction by the Settlement Officer, Assistant SettlementOfficer shall prepare settlement rent roll with respect to land/land plots ownedRaiyat wise and after proper verification systematically arrange & incorporateand publish the same in view ofsubrule-(5) of Rule-14.
