As REALTORS® we certainly know the benefits of home ownership and stable housing. The news media constantly states how important the real estate market is to the health of

our economy. Lately, we have heard that the real estate re-sale market has been the lowest in years. Yet, the benefits of home ownership still remain. It is not just about the personal tax benefits or the spending of dollars in the communities where we live.

There are substantial benefits of home ownership beyond the economic ones. Families develop roots where they live; people are more invested in the civic, educational and social issues that affect their communities. There is greater participation of people if issues affect them directly in how they live and work.

We, as REALTORS® truly have a direct affect on home ownership. Buyers and sellers look to us for our expertise and professionalism when it comes to buying or selling a home. For instance, buyers want to know about schools or school districts or how to get a loan; sellers want to know what to do to make their house sell for the best price possible. The concept of buying or selling a home may be a simple concept to understand. The reality is that there is much more involved, whether it is economically and/or emotionally. That is why despite the fact that a large percentage of buyers begin their home search on the internet they still need a REALTOR® to carry out that goal.

As it was stated in a recent article from NAR, “Home ownership has been an essential element of the American Dream for decades and continues to be so even today.” Truly, we as REALTORS® have the very serious responsibility to make that dream happen!

If you had the opportunity to attend one of the sessions on our future lock box options that samcar hosted recently you saw some pretty intriguing possibilities. If the volume of e-mail I have received

as result of these presentations is any indication, many samcar members are extremely interested in the new possibilities we have open to us.

Some time back samcar established a lock box taskforce to review our options prior to expiration of current lock box agreement in March of 2012. The presentations that occurred at samcar revolved around updating our current supra lock box system. As any practicing agent knows about half of the lock boxes currently in use in samcar’s territory are the older gray boxes and half are the newer blue boxes. supra is on the verge of releasing an even newer box as well.

Continued use of the gray boxes precludes us from updating to newer keys that update themselves automatically and do not need to be cradled. Another advantage of all blue boxes is that infrared enabled cell phones can be programmed to open lock boxes. These cell phones also would update themselves automatically.

supra will be unveiling a new lockbox in the first part of 2011. This box features a bigger key safe, and is compatible with both infrared and Bluetooth technology. This would open up the possibility of using many more devices as lock box keys.

As we review our options cost and compatibility are also key consid-erations. We always want to keep the cost of doing business as low as possible for samcar members. We also know that you may frequently travel to other jurisdictions to show property and that being able to use your key there is important to you, so we are working towards a solution that allows for the greatest possible compatibility between Boards.

We have not signed a contract yet and are still investigating all of our options. So, by all means feel free to drop me an e-mail ([email protected]) and let me know what your thoughts are.

This is to advise that South San Francisco’s Fire Department is charged with the responsibility of code enforcement. When you call for a smoke detector inspection, please note the following three items will be inspected:

» Smoke detectors» Water heaters (strapped, and raised 18 inches)» Quick release safety bars on windows

As well, the City is actively reviewing the properties entered on its “Abandoned and Distressed Residential Properties Registration” list.

Fire Chief Philip White met with Government Affairs and has provided assurances that the Department will work with REALTORS® to ensure that any code violations and the necessary repairs do not obstruct the sale of the home, whenever possible. to that end, the city has hired a liaison toassist rEaltors® and property owners: Aimee Grecosafety inspector& distressed Property specialistmay be reached at (650) 829-4327.

At the Combined Tour meeting on September 7 Steve Rush, (President, On-Site Inspections) shared information with the attendees about the requirements for ensuring compliance with the lead paint requirements.

Mr. Rush shared a flow chart of information created by the EPA called “The EPA’s Lead Program Rule At A Glance” that helps REALTORS® determine if a certified lead paint renovator needs to be contacted to do a renovation project that disturbs painted surfaces on a pre-1978 house and/or if you are required to distribute a lead paint pamphlet. The Rule sheet points out that if the reno-vator is getting paid they must know if they have to distribute the lead based paint information pamphlet or comply with training, certification, and work practice requirements. certified renovators must perform renovations.

The rules are the most stringent on homes, apartments or childcare facilities that have children under the age of 6 residing there. Here are key points from the EPA flow chart:

if renovation work needs to be performed on a pre-1978 home, a certified lead paint renovator doEs NoT need to be utilized if: 1. The work only consists of minor repairs or maintenance that disturbs less than 6 square feet of painted surfaces per room for interior activities or 20 square feet for painted surfaces in an exterior area. 2. The dwelling has been determined to be free of lead-based paint by either a certified inspector or risk assessor, or the renovated components have been determined to be lead free by an inspector using a certified EPA testing kit. 3. Housing is a zero-bedroom dwelling, (studio apartments, dormitories, etc.) 4. Housing is for the elderly or disabled and no children under six reside or are expected to reside there.5. The work is a lead abatement project.

ProposedSewer Lateral Inspectionat Point of SaleThe City of San Carlos was sued by SF Baykeeper because of sanitary sewage overflows (SSOs) into the San Francisco Bay. Pursuant to a consent decree, the City has to reduce its number of annual SSOs down to 2, by 2017.

At the September 27 City Council meeting, the Public Works Department presented the Council with a comprehensive sewer lateral inspection ordinance that in part, would require inspection and repair of private laterals at the point of sale.

saMcar strongly opposed the point of sale provision, explaining to the Council that it was an inefficient method, since less than 2 percent of the homes in San Carlos sell each year. We also noted the inequity of a point of sale mandate, since it places a community-wide burden on the shoulders of a small group: those buying or selling a home. SAMCAR also encouraged the City to take more proactive, aggres-sive steps to reduce the number of SSOs by 2017, because relying upon point of sale would place the City in jeopardy of getting sued again.

The Council heard all of SAMCAR’s concerns and in a unanimous 5-0 vote, stripped the point of sale mandate from the proposed ordinance.

Health care tax Does Not Alter

Capital Gains ExclusionsMisinformation has been spreading around the Internet that the Obama Administration will finance the new health care legislation with a tax on real estate.

C.A.R. would like to clarify. the new law imposes a 3.8% tax for households in the top tax brackets on “unearned income.” this includes capital gains. However, this will not impact the exclusion on capital gains earned from the sale of a primary residence up to $250,000 for individuals and up to $500,000 for married couples. the 3.8% tax will only apply to capital gains above the normal exclusion.

No MandatoryRetrofits in energy and Security billMisinformation has been spreading around the Internet regarding HR 2454, the “American Clean Energy and Security Act”. CAR would like to clarify, HR 2454 would impose the following:

» No mandatory retrofit requirements! Retrofits are incentivized through financial programs but are not mandatory. Because these programs are subsidized with taxpayer money, should a homeowner choose to do a retrofit and take advantage of the taxpayer subsidized program, then they would have to do an inspection before and after the improvement to ensure the taxpayers are getting their money’s worth. Again, this is optional and is not mandatory.

» The labeling program is only for NEW properties. Existing properties will not have to have energy labels.

» The national building code requirement is weaker than what is already in California, and in fact the bill allows other states to adopt California’s building code to be in compli-ance with the new national standard.

» The term “Cap & Trade” in fact has absolutely nothing to do with real estate and is in reference to the section of the bill that deals with industrial emissions.

» The bill was well over a 1,000 pages, but NAR and CAR stayed focused on the real estate related provisions, a minor section of the bill, and were successful in ensuring their impact on real estate was not harmful to the industry.

NAR Hails Bill to Hasten lender response toShort Sale RequestsHomeowners who are underwater with their mortgage may find that relief is on the way from a bill strongly supported by the National Association of Realtors® that would impose a deadline on lenders to respond to short-sale requests.

The legislation, H.R. 6133, “Prompt Decision for Qualification of Short Sale Act of 2010,” was offered on September 16th in Congress by U.S. Reps. Robert Andrews (D-N.J.) and Tom Rooney (R-Fla.). The bill would require lenders to respond to consumer short sale requests within 45 days.

“The short sale, which requires lender approval, is an important instrument for homeowners who owe more than their home is worth,” said NAR President vicki Cox Golder, owner of vicki L. Cox & Associates in Tucson, Ariz. “While the lending community has worked to improve the size and training of their short sales staffs, they still have a long way to go on improving response times.”

“As the leading advocate for homeownership issues, NAR believes that quicker attention to the short sales process is vital to help homeowners who are underwater and their communities, as well as the nation’s economy,” said Golder.

The number of potential short sale properties is rising across the country. According to NAR data, in the second quarter of 2010, Nevada, California, Florida and Arizona are states where significant shares of all properties on the market are potential short sales: 32 percent, 28 percent, 27 percent and 24 percent, respectively.

In fact, it was a very special evening as 170 attendees came together to raise $9,000 for the SAMCAR Foundation and the San Bruno Fire Fund. “The Special Events Committee worked hard to set a special tone to the Spaghetti Feed this year in light of the fundraising effort for the San Bruno Fire Fund. Special thanks to John Marshall and Marsetti Landscaping for designing and donating the beautiful table centerpieces which were sold to attendees to directly benefit the Fire Fund,” said Ann Palermo, Special Events Com-mittee Chair. “The Committee volunteers and SAMCAR staff really dedicated themselves to promoting the event to make the

“What’s a REBarCamp?” many members asked as they learned of a new way to learn about real estate technology. 100 REALTORS® attended the first REBarCamp San Mateo County in Redwood City on September 20 to find out what the “un-conference” experience was all about. Here are a few highlights from the event:

education»16 social media/internet marketingseminars were offered throughout day.» The sessions covered topics gearedtowards both the 101 level and theexperienced tech user. » Presenters/moderators were professional consultants, all of whom came for free.» The session rooms were abuzz withconversation, sharing and questions. » We received great feedback aboutpeople learning new technology, andgaining a better understanding of social media, like Facebook, to grow theirbusiness and seeing new technologydemonstrated live, such as QR codes.

cool facts» SAMCAR is the first real estate Association to have actively sponsored and imple-mented a REBarCamp in California. (In fact, the California Association of REALTORS® has seen the value of REBarCamps and is co-sponsoring one the day before the CAR Expo in October, and a REBarCamp is planned for the day before the NAR confer-ence in New Orleans.» A Facebook business page and blog were created around the event. Over 135 “fans” are on the business page and over 150 peo-ple came to the event blog for information and to register. » SAMCAR is actively engaging in these

types of events to showcase the Asso-ciation as a leader in providing real estate technology education to our REALTOR® members.
