5 There shall be no establishment of a site compound, site clearance, demolition,

excavation or depositing of material in connection with the construction on the site until proposals have been submitted to and approved in writing by the Local Planning Authority for the provision of:

(i) on-site parking capable of accommodating the unloading and loading of all

construction and contractor vehicles clear of the public highway. (ii) on-site materials storage area capable of accommodating all materials required

for the operation of the site. The approved areas shall be kept available for their intended use at all times that

7 A minimum of four of the residential units hereby approved shall be built to meet the

3 The advice below is from the North Yorkshire Police Designing Out Crime Officer. Access Control Consideration should be given to fitting any communal entrance doors with an

Lighting It is accepted that light pollution may be a consideration; however, lighting or the

7 Unless otherwise agreed by the Local Planning Authority, development other than

that required to be carried out as part of an approved scheme of remediation must not commence until sections A to D have been complied with. If unexpected contamination is found after development has begun, development must be halted on that part of the site affected by the unexpected contamination to the extent specified by the Local Planning Authority in writing until section D has been complied with in relation to that contamination.

A. SITE CHARACTERISATION An investigation and risk assessment, in addition to any assessment provided with

the planning application, must be completed in accordance with a scheme to assess the nature and extent of any contamination on the site, whether or not it originates on the site. The contents of the scheme are subject to the approval in writing of the Local Planning Authority. The investigation and risk assessment must be undertaken by competent persons and a written report of the findings must be produced. The written report is subject to the approval in writing of the Local Planning Authority. The report of the findings must include:

(i) a survey of the extent, scale and nature of contamination; (ii) an assessment of the potential risks to: * human health, * property (existing or proposed) including buildings, crops, livestock, pets, woodland

and service lines and pipes, * adjoining land, * groundwaters and surface waters

* ecological systems * archaeological sites and ancient monuments; (iii) an appraisal of remedial options, and proposal of the preferred option(s). This must be conducted in accordance with DEFRA and the Environment Agency's

'Model Procedures for the Management of Land Contamination, CLR 11'. B. SUBMISSION OF REMEDIATION SCHEME A detailed remediation scheme to bring the site to a condition suitable for the

intended use by removing unacceptable risks to human health, buildings and other property and the natural and historical environment must be prepared, and is subject to the approval in writing of the Local Planning Authority. The scheme must include all works to be undertaken, proposed remediation objectives and remediation criteria, timetable of works and site management procedures. The scheme must ensure that the site will not qualify as contaminated land under Part2A of the Environmental Protection Act 1990 in relation to the intended use of the land after remediation.

C. IMPLEMENTATION OF APPROVED REMEDIATION SCHEME The approved remediation scheme must be carried out in accordance with its terms

prior to the commencement of development other than that required to carry out remediation, unless otherwise approved in writing by the Local Planning Authority. The Local Planning Authority must be given two weeks written notification of commencement of the remediation scheme works.

Following completion of measures identified in the approved remediation scheme, a

verification report that demonstrates the effectiveness of the remediation carried out must be produced, and is subject to the approval in writing of the Local Planning Authority.

D. REPORTING OF UNEXPECTED CONTAMINATION In the event that contamination is found at any time when carrying out the approved

development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken in accordance with the requirement of section A, and where remediation is necessary a remediation scheme must be prepared in accordance with the requirements of section B, which is subject to the approval in writing of the Local Planning Authority.

Following completion of measures identified in the approved remediation scheme a

verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority in accordance with section C.

8 All building and construction work in respect of the development hereby permitted

shall only take place during the following hours: 0730 to 1800 Monday to Friday 0800 to 1300 Saturdays No work shall take place on Sundays or Public Bank Holidays.

9 Prior to the construction of any foundations of the development hereby permitted, full details of any measures required to prevent surface water from non-highway areas discharging on to the existing or proposed highway together with a programme for their implementation have been submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority. The works shall be implemented in accordance with the approved details and programme.

10 Prior to the occupation of the development hereby permitted the access to the site

shall be set out and constructed in accordance with the published Specification of the Highway Authority and the following requirements:

(ii)(b) The existing footpath outside the site must be resurfaced to the satisfaction of

the Local Highway Authority. HI-03 INFORMATIVE – Condition HC-07 You are advised that a separate license will be required from the Highway Authority

in order to allow any works in the adopted highway to be carried out. The ‘Specification

for Housing and Industrial Estate Roads and Private Street Works’ published by North

Yorkshire County Council, the Highway Authority, is available at the County Council’s offices. The local office of the Highway Authority will also be pleased to provide the detailed constructional specification referred to in this condition. INFORMATIVES 1 Cherry (blossom tree) - This tree is not covered by the TPO or conservation area,

therefore consent to remove is not required. The tree has therefore been removed from the application.

Sycamore - Trees should not be crown reduced as the stress involved increases the trees

vulnerability to disease and can lead to premature death, in particular mature specimens which are slower to react to major structural changes than young trees. The crown reduction of trees involves the removal of the upper canopy of the tree, the area most important to the tree for carbohydrate production. The loss of the upper canopy puts the tree into a stressful position as it produces new shoots at the point of the reduction quickly growing to the height from which it was reduced. This new growth adds additional stress to the tree as it has to draw on energy reserves further weakening the tree leaving it susceptible to disease and pathogenic attack. The crown reduction works involve the creation of numerous wounds that then become the entry point for disease and decay, further weakening the tree as it uses energy reserves in an attempt to protect itself from these attacks.

At a recent Arboricultural Conference, crown reduction formed part of a paper

submission as part of the conference seminars. That paper concluded that reducing the crown has negative consequences for the physiological health of the tree, disrupting water relations and depleting the resources available to increase stem strength through adaptive growth. In essence, reducing the wind load of a tree that is already perfectly capable of carrying that load therefore has only negative consequences due to this physiological impact.

Recommendations to reduce wind load via a crown reduction without quantifying

the load or attempting to assess the load that a tree is able to carry, which forms the basis of the current tree work application, is deemed as a precautionary approach. The summary of the Arboricultural Conference paper defines a precautionary approach as one being based on a lack of information. This uncertainty, and the reaction to it (i.e. the crown reduction), has serious negative consequences for trees with defects. In the worst case, trees that might have maintained acceptable safety

factors for decades despite decay become vulnerable to being tipped into a spiral of decline.

Individual assessments, applying the principles of statics to more than 200 trees

over 13 years, have shown that whilst strength loss attributable to defects (such as stem and root decay) can be clearly demonstrated to have had a negative impact on the structural integrity or stability of a tree, safety factors often remain acceptable and frequently remain reassuringly high. For late mature trees with large stem diameters, residual safety factors (after defects are taken into account) are higher than safety factors for defect-free trees in earlier life stages with smaller stem diameters. The management recommendation that has been made, with great confidence, for the majority of the trees assessed using static load tests over the last 13 years, is therefore to simply retain the tree and to do nothing further than monitor (Muir, P. 2019).
