Shri B G Prajapati crs, Additional Collector & Additional District Magistrate, Bharuch andchairman olPublic Hearing committee has presided over the entire public Hearing process.

Shri H c solanki, Regional officer, GpcB, Bharuch and the representative of the MemberSecretary, GPCB Gandhinagar - a panel member of the public Hearing commiftee; welcomed allpresent to the Public Hearing. He outlined the various provisions of the Notification and briefedabout the procedural details for conducting this pub\ic Hearing, including act'rons taken by GpcBfor wide publicity of this Public Hearing and the advertisement published earlier in the local dailynewspaper. He announced that, as per the provision of Notification, only locally affected personswill be allowed to make their representation in the Pubtic Hearing while others having piausiblestake may submit their representation in writing which would be included in proceedings. He alsomade it clear to the gathering that the Committee is responsible only for preparation ofproceedingsofthe meeting covering all the concerns raised during the public Hearing.

The Regional officer, GPCB, Bharuch further informed the forum that, seven writtenrepresentations were received prior to public Hearing. The first was received from Shri MaheshPandya Paryavaran Mitra, Ahmedabad, second from Shri Dharmesh Mistry, Bharuch, third from H.Madhubabu, Hyderabad, fourth from pratik Shanna, Advocate, Surat, fifth from Miss Kiran verma,Surat, sixth from Jayeshbhai patel, Khedut Samaj Gujarat and seventh from Raj AjitsinhBalawantsinh, Bharatiya Kisan Sangh, vagra at which would be incruded in the proceedings arongwith the reply ofproject proponent.

Then after, with due permission of Additional Collector, Regional officer stalted the proceedings ofPublic Hearing. He then invited the project proponent to give their introduction and to make thepresentation oftheir project in local language.

The representative of the project proponent welcomed the gathering. Then after, he madepresentation in Gujarati language covering introduction of the company, technical information aboutproject, information on baseline environment, impact due to project and its environmental mitigationmeasures, safety measures and benefits due to the proposed project etc.

First, let us appreciate, tweet, #askvuijayrupani programme was very successful,but some or otherhow, GPCB core issue was not discussed on 23 September2016, MAY BE A TIME CONSTRAINT,

We have a high regards for a good governance of Gujarat Govt, and goodgovernance of GPCB , but, we fail to understand, then how some of the coremandatory requirements of ACCREDITED CERTIFICATE, is loose shunted, andwithout a proper vigilant checks, some, other documentsm which has NO WORDLIKE A CERTIFICATE, are accepted as a CERTIFICATE, without clarirying 'whohas permitted in writing' to accept this, and why this was not incorporated?Details on @ are summarized in table 1.

MoEF has approved -one and only one agency- QCI-NABET, New Delhi, issuingACCREDITED CERTIFICATE , only to those environment consultants, after,satisfying all requirements, & consultant can NOT prepare EIA rcports, if theyDO NOT possess a valid accredited CERTIFICATE. & there is no qp!!g.even mandatory ToR does not specifies this, so GPCB has no voluntarv choice.

MoEF/SLEAC-GUJ, invariably demands under their mandatory ToR; as,proponent has to submit ONLY accredited certificate) in EIA report, onespecimen copy down loaded from one EIA report is attached as a readyreference - pl. refer page 11.

lnvariably, we have been observing 'non conformances' on documents beingaccepted by MS-GPCB, / RO-GPCB, AS A QCI- NABET ACREDITED

do not find any word like a CERTIFICATE on such documents, ref page 6,7,10 And the fact is that , for any statutory requirements, one, can NOT accept any logical OR philosophical explanation, Core question is with whose written permission, MS-GPCB/ RO-GPCB HAS accepted such EIA reports, and also obtain a date for environment public hearings , and up loaded such EIA reports on GPCB web site for public viewing -all over the globe. Supporting documents of so called CERITIFATES , down loaded from EIA reports are attached herewith for a ready reference. just to cite few examples, PL. REFER TO TABLE 1 & subsequent pages. 6,7,10 If CM can re-varify all the EIA reports, probably through some out side, third party, experts, ( because GPCB must have already verified) OR if you refer past MoM of environment public hearings, at least, effective 1 June 2014, there can be many more such examples , on that basis, environment public hearings were conducted and environment clearance also must have issued- projects will be commissioned-and- at later date- GPCB only ,will be issuing a closure notices on account of project is not being environmentally sustainable one !!! Is it not surprising !!!

Just to cite an example, we submit herewith two classical examples of forthcoming environment public hearings, at Dahej, as under Table 1.

We also attach a specimen copy of CERTIFICATE, where, we find a word like a CERTIFICATE, page 11 so, you only can visualize ,how CERTIFICATE looks like, We wonder how MS-GPCB / RO GPCB is not aware of this, before accepting such documents, otherwise, such letter would have NOT come to CM directly.. is it known to GPCB, that QCI-NABET has only uploaded a note on their web site, As BEWARE OF FAK pl. refer page A 12, Let us hope, this is not the case in Gujarat- BUT one has to verify and confirm. Sorry to write this letter to you, as , in past, we have been informing GPCB in writing, in advance, but we have not recd. any written reply from GPCB, whether such documents are also a CERTIFICATE, as desired in ToR, , never informed who has permitted in writing to accept it, and never clarified this in minits of meeting, We presume, GPCB has enough well qualified and well experienced staff to ensure, whether all the mandatory ToR has a cent % compliance, and then only must have requested to Dist. 3 The consultant please takes health statesof village people in 10 km radius aroundare must, why because it is very useful infuture.
