PUBLIC HEARING PROCEEDING

As per the Ministry of Environment and Forests Government of India, New Delhi vide its Notification No. S.O. 1533 dated September 14, 2006 and subsequent amendments thereon, Public hearing was fixed for M/s. Esdee Paints Ltd. for setting up of integrated paints industry for manufacturing of various paint products (Phase I), 2,673 a'ncl--Acrylic Co-polymer Resin (Phase II), 130 TPM at Blok No. 174/p & 175/p, Village VasnaChacharvadi, Taluka-Sanand, District-Ahmedabad which is covered under category B of the Schedule 5(h).

A copy of the draft Environment Impact Assessment report and the Summary of Environment Impact Assessment Report were sent to the following authorities to make available the Draft EIA Report for inspection to the public during normal office hours, till the Public Hearing is over.

Other concerned persons having plausible stake in the environment aspects were requested to send their response in writing to the concerned regulatory authorities.

The public hearing was scheduled to be held on 26/09/2017 at 11: 00 hrs, at project site of M/s. Esdee Paints Ltd., Blok No. 174/p & 175/p, Village Vasna-Chacharvadi, Taluka-Sanand, District-Ahmedabad.

An advertisement in English was published in "Indian Express" and in Gujarati in "Divya Bhaskar" dated 25/08/2017.

Shri 5 M Saiyad, Additional District Magistrate, Ahmedabad as representative of District Magistrate and District Collector Ahmedabad supervised and presided over the entire public hearing proceedings.

A statement showing issues raised bv the participants and responses by the representative of the applicant during the Public Hearing

As per the Ministry of Environment and Forests Government of India, New Delhi vide its Notification No. S.D. 1533 dated September 14, 2006 and subsequent amendment thereon, Public hearing was fixed for MIs. Esdee Paints Ltd. for setting up of integrated paints industry for manufacturing of various paint products (Phase I), 2,673 TPM and Acrylic Co-polymer Resin (Phase II), 130 TPM at Blok No. 174/p & 175/p, Village Vasna-Chacharvadi, Taluka-Sanand, District-Ahmedabad which is covered under category B of the Schedule 5(h).

Shri S.M. Saiyad, Additional District Magistrate, Ahmedabad as representative of District Magistrate and District Collector Ahmedabad supervised and presided over the entire public hearing proceedings.

Shri K.R. Upadhyay, Regional officer, GPCB, Ahmedabad (Rural); welcomed all participants present in the Public Hearing. He outlined the various provisions of the Notification and briefed the procedural details for conducting this Public Hearing including various actions taken by GPCB for wide publicity of this Public Hearing and the advertisement published earlier in the local daily newspapers. He announced that as per the provision of Notification, only locally affected persons will be allowed to re-present in the Public Hearing while others having plausible stake holders may give their representation in writing which would be included in the public hearing proceedings.

Regional Offier, GPCB, Ahmedabad (Rural) informed that two written representation were received from (1) Sh. Mahesh Pandya, Parayavarn Mitra (2) Sh. Jitendrakumar Babalbhai Patel & (3) Sh. Prafulbhai, Het Dhara NGO which would be included in the proceedings as Annexure C1 to C3 respectively along with the reply of project proponent as Annexure D1 to D3 respectively.

He then opened the Public Hearing after due permission from Additional District Magistrate. He invited the project proponent to give their introduction and to make the presentation of their proposed project in vernacular language.

Then after, representative of the project proponent gave detailed presentation in Gujarati language covering salient features of the project, technical details of proposed project, Environmental Management System, its impact on

environment along with proposed mitigation measures and social responsi bilities.

After the presentation by the project proponent, Regional Officer, GPCB, Ahmedabad (Rural) with the due permission from the Additional District Magistrate opened the forum for representations/ suggestions from the locally affected people.

Also, we will explore possibilities to construct rain water harvesting structures in nearby villages by consulting with village heads and local authorities.

Total 20 people will get employment in our proposed project. Preference will be given to local people from nearby villages. They will be selected based on their education level and skill sets.

4. What will you do for rain water harvesting?

~ We will install adequate structures for rain water harvesting and ground water \

recharge as per CGWA guidelines.

5. Whether any facility for rain water harvesting available at present? If available

provide photographs of the same.

~ No.

6. It is expected that facilities will be made available by you for more storage of

water in nearby villages' pond.

~ We will keep your request in consideration and plan for the same accordingly.

7. Contaminated storm water will be collcted and sent to Sanand Eco Project Ltd.

for further treatment and disposal. Unit will obtain permission from Sanand

Eco Projects Ltd. for disposal of contaminated wastewater. Where will you

store contaminated storm water? What facilities will be provided for the

same? What will be its storage capacity? Will it be adequate during peak rain

fall?

~ Unit will provide wall gate at the outlet of storm water drainage to avoid

contaminated storm water from flowing outside plant premise. Contaminated storm

water will be collected in a collection tank having 5 m3 capacity. It will be adequate

to store contaminated storm water during peak rain fall.

8. Since last two years, how much wastewater has been sent to Sanand Eco

Projects Ltd. Provide information about the same.

~ Phase I of the plant is commissioned in May 2017 and there is no generation of

effluent from manufacturing process. Unit maintains zero liquid discharge.

9. Whether any show cause and closure notices received to your company for

violation of environmental norms? If yes, provide details.

~ We have not received any show cause and closure notices so far.

10. How will you dispose contaminated chemical resulted from chemical spillage

or leakage from storage tank.

~ Ours is a fully automated plant, hence there are minimal changes of spillage I

leakage of raw materials during manufacturing process. However, in case of any

spillage I leakage spilled material will be scrapped off from the floor or wiped off with

cotton mop. Spilled material and contaminated cotton waste generated will be

collected and disposed off by co-processing at cement industries or at CHWIF site

for incineration. For details refer section 2.10.3, Chapter 2 of draft EIA report.

~ For storage of hazardous chemicals, dyke wall will be provided surrounding the

storage tank with acid/alkali resistant brick lining work and spillage sump with

recirculation pump to recover the spilled mass and to protect the run off area. In

case of spillage of raw material or pipeline leakage, the material will be stored in

drums at ambient temperature and will be recycled in next batch. There will be

provision of two empty tanks of 20 KL to emergency transfer of spilled hazardous

chemicals. For details, refer section 5.3 of Chapter 5, and section 6.5 & 6.6, Chapter

6 of draft EIA report.

~ Out unit has not been issued any show cause 1closure notice or notice of direction so far.

2. Whether company has valid consolidated consent and authorization of GPCB under various acts for its existing unit? Please give CCA and compliance report of consent and authorization.

~ Our project is commissioned in May 2017. We have obtained consolidated consent & authorization from GPCB for our existing plant on 12/07/2017. Copy of the CC&A will be enclosed in the final EIA report. CC&A compliance will be submitted to regulatory authority from time to time.

3. What was the previous land use of the land for proposed project? Has Industry obtained NA permission for the land? Please provide the document.

.~ Land of the proposed project has been converted from agricultural land to non-. agricultural land for industrial use. Copy of NA for the said land is enclosed in Annexure 1 of draft EIA report.

4. Please give copy of the GPCB visit report and air I water I solid waste sample analysis report for the existing unit in last three years.

~ Our project is commissioned in July 2017. GPCB officials have visited the site once but have not collected samples of air I water I soild waste so far. Details of the same can be procured from GPCB officials.

5. Whether unit has submitted Environmental Audit reports regularly to GPCB for existing plant?

~ Environmental Audit is not applicable to our unit.

6. EIA report indicates that the water requirement will be fulfilled by bore well. Has Project proponent take necessary permission from local village panchayat for digging the bore well? Please submit necessary document.

~ As per classification of CGWA, Sanand taluka falls under safe zone. However, unit will apply for necessary permission from CGWA for extraction of ground water.

7. Is there any cost-benefit analysis carried out for proposed project's benefits vs loss of ecosystem including flora, fauna and vegetation?

~ Cost-benefit analysis has not been carried out for proposed project, since SEIAA did not suggest this point during scoping of the project while awarding Terms of Reference (ToRs).

8. What is the regular monitoring plan that shaJI be carried out for odor control by the project proponent?

~ Details of environmental monitoring plan are given in Section 5.6, Chapter 5 of draft EIA report.

9. Please give exact dates of ambient air quality, surface water, ground water, noise monitoring and soil quality monitoring. Why baseline monitoring was started before approval of TOR?

~ Dates of surface water, ground water, noise monitoring and soil quality monitoring are given in iespective s~ctions of Chapter 3 of draft EIA report.

~ Dates of ambient air quality monitoring are given in Annexure 4 of draftEIA report.

10. Please justify domestic water requirement for existing and proposed expansion.

~ Total fresh water requirement for domestic purpose in the existing and proposed expansion will be 3.5 KLD which is considered based on 175 LPCD which is adequate for manpower of 20 persons.

11. What types of precautions will be taken for storage and transportation of hazardous material and waste?

~ Ours is a fully automated plant, hence there are minimal changes of spillage I

leakage of raw materials during manufacturing process. However, in case of any

spillage /Ieakage spilled material will be scrapped off from the floor or wiped off with

cotton mop. Spilled material and contaminated cotton waste generated will be

collected and disposed off by co-processing at cement industries or at CHWIF site

for incineration. For details refer section 2.10.3, Chapter 2 of draft EIA report.

~ For storage of hazardous chemicals, dyke wall will be provided surrounding the

storage tank with acid/alkali resistant brick lining work and spillage sump with

recirculation pump to recover the spilled mass and to protect the run off area. In

case of spillage of raw material or pipeline leakage, the material will be stored in

drums at ambient temperature and will be recycled in next batch. There will be

provision of two empty tanks of 20 KL to emergency transfer of spilled hazardous

chemicals. For details, refer section 5.3 of Chapter 5, and section 6.5 & 6.6, Chapter.

12. Please give name of scrap vendors to whom pigments and extenders will be sold.

~ Pigments and extenders are raw materials used in the manufacturing of paint products. They are not sold to scrap vendors.

13. Please give name of scrap vendors to whom hard resin will be sold. . .

.~ Hard resin is a raw material used in the manufacturing of paint products. It is not sold to scrap vendors.

. 14. What will be the impact of temporary housing availed by labors during construction phase on surrounding environment?

~ Labors will be hired from nearby villages. Therefore, temporary housing will not be availed by labors at project site during construction phase. Hence, there will be no impact on surrounding environment during construction phase from housing of labors.

15. What will be action plan for socioeconomic development of an area by project proponent?

~ Unit will carry out various CSR activities within the area of 5 km from our plant in the field of education and skill development, health, water & sanitation and infrastructure development etc. Details of the same are elaborated in Section 5.5, Chapter 5 of draft EIA report.

16. What activities industry will take up as a part of CSR and what will be the budget for it?

~ Unit has earmarked 60 lacs for various CSR activities. Details of various activities are elaborated in Section 5.5, Chapter 5 of draft EIA report.

17. Please give detail list of people who will be responsible for implementation of EMP?

~ Environmental management cell will be responsible for implementation of EMP. Details of the environmental management cell are elaborated in Section 5.2 of Chapter 5 of draft EIA report.

wise clarification & details as per your requirement,

1. Where is greenbelt located? Give details of type of trees to be planted .

.~ Details of greenbelt development are given in Section 5.3, Chapter 5 of draft EIA

report.

2. Where are you sending waste? Give detaifs.

~ Our existing plant is commissioned in May 2017. Hence, we have not sent any

waste outside our premise so far.

3. In the EIA report, which surveys are carried out and what type of samples are

collected?

~ Monitoring and Sampling of ambient air, water soil and noise were conducted from 5

locations within 5 kms radial distance from project site. Details of the same are

incorporated in Section 3.4, Chapter 3 of draft EIA report.

4. Give details of NABET certificate of consultant.

~ Consultant has filed a case against NABET in the High Court of Gujarat. Details of

the same are enclosed in Annexure 5 of draft EIA report.

5. What is the concentration of TOS in collected water samples. Give details.

~ TDS ranges between 852 mg/L to 1,050 mg/L in collected ground water samples

and 672 mg/L to 798 mg/L for collected surface water samples. For details on the

same refer Section 3.9, Table 3.9, Chapter 3 of draft EIA report.

~ Sanand Taluka falls under safe zone as categorized by CGWA. However, we will
