    Explanatory Note

    This Act amends the Greenhouse Gas Reduction Targets Act to hold back additional compensation for

    members of the Executive Council if greenhouse gas emissions targets are not met.

    GREENHOUSE GAS REDUCTION PENALTIES ACT, 2016

    HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province ofBritish Columbia, enacts as follows:

    1 The Greenhouse Gas Reduction Targets Act, S.B.C. 2007, c.42, is amended by adding the following

     section:

    Salary holdback

    4.1 (1) The salary otherwise payable under section 4 of the Members' Remuneration and Pensions

     Act  to each member of the Executive Council must be reduced:

    (a) Beginning in 2016, by 18%;

    (b) Beginning in 2020, by 33%;

    (c) Beginning in 2050, by 80%; and(d) Beginning in a target year named by order of the minister under section 2 (3), by the

    same rate as the BC greenhouse gas emissions reduction target established for that year.

    (2) A reduction in salary, under this section, of a member of the Executive Council, becomes due

    and payable on the next day after the progress report prepared under section 4 for that calendar

    year is made public, if the target for that calendar year established under section 2 has been

    achieved.

    (3) If total salary reductions for a member of the Executive Council under this section, section 3 of

    the Balanced Budget and Ministerial Accountability Act  and section 5 of the Carbon Tax Act  

    exceed 100%, the total holdback shall be 100%.

     2 Commencement

    This Act comes into force on the date of Royal Assent.
