Sampling PolicyAt Arvicon International, we have gained diversified experiences in our journey of 70 years, in the Indian natural stone industry. In the initial days, we invested good sum of money in offering free samples, courier cost etc. But to the contrary, the final result was not profitable rather it hardly tuned any query to a deal. We did not receive any feedback from the parties regarding approval or dis-approval of the samples sent or the price quoted, thus leading to disappointments and discouragement on our part.

With time we decided to modify our sampling practices and started with paid samples. Wherein, the customers were required to pay for samples of expensive stones such as Black Galaxy, Sun Mint etc., and also for the courier charges. For stones that were not very expensive, we are charged the courier cost only or sent the samples through customers' desired courier or from their account on to-pay basis. The results were were astonishingly positive. We started receiving quick response from the customers and in most inquiries turns into business. We did good business with the said sample policy.

However, we have amended the above policy to serve our customers, better. Presently, we are charging for samples of very expensive stones along with the courier cost or only courier cost if the products are not very expensive.The cost of aforesaid samples and courier is reimbursed to our esteemed customers once they place their order with us. We ensure that our customers do not suffer the initial sample or courier cost and always receive value-for-money spent.

This revised policy works out very nicely and most of the inquiries turns into business. The win-win situation between both the parties leads to to long term business associations and we hope all our esteemed clients will co-operate with us and understand the prima for our customer oriented sample policy.

Natural Stones from IndiaIndia is the home of exquisite natural stones. Indian natural stones have been used for centuries in constructing architectural marvels not only in India but other parts of world too. Almost all varieties of most popular natural stones are available in India. Some of them are marble, sandstone, granite, limestone, travertine, quartz and slate. The deposits of these natural stones are situated across the entire length and breadth of India, where the variety or type varies greatly from state to state. A brief overview of natural stone availability in India is given below:

Marble Reserves & Availability : A wide variety of Marbles with different surface appearance is available mostly in Western part of India in states of Rajasthan and Gujarat.

Granite Reserves & Availability : It is an estimate that about 25% of world's total granite deposit is available in India. Maximum concentration of deposits is recorded in Southern Peninsula at Karnataka, Andhra Pradesh, Tamil Nadu and Kerala. Recent surveys and findings reveal granite sources in Eastern, Western and North Western India i.e., at Rajasthan, Gujarat, Maharashtra and Orissa.

PRE-SHIPMENT FINANCE

ARVICON uses Pre Shipment which is issued by a financial institution when the seller want the payment of the goods before shipment. The main objectives behind preshipment finance or pre export finance is to enable exporter to:

Procure raw materials. Carry out manufacturing process. Provide a secure warehouse for goods and raw materials. Process and pack the goods. Ship the goods to the buyers. Meet other financial cost of the business.

Types of Pre Shipment Finance

Packing Credit Advance against Cheques/Draft etc. representing Advance Payments.

Preshipment finance is extended in the following forms :

Packing Credit in Indian Rupee Packing Credit in Foreign Currency (PCFC)

Requirment for Getting Packing Credit

This facility is provided to an exporter who satisfies the following criteria

A ten digit importerexporter code number allotted by DGFT. Exporter should not be in the caution list of RBI. If the goods to be exported are not under OGL (Open General Licence), the

exporter should have the required license /quota permit to export the goods.

Packing credit facility can be provided to an exporter on production of the following evidences to the bank:

1. Formal application for release the packing credit with undertaking to the effect that the exporter would be ship the goods within stipulated due date and submit the relevant shipping documents to the banks within prescribed time limit.

2. Firm order or irrevocable L/C or original cable / fax / telex message exchange between the exporter and the buyer.

3. Licence issued by DGFT if the goods to be exported fall under the restricted or canalized category. If the item falls under quota system, proper quota allotment proof needs to be submitted.

The confirmed order received from the overseas buyer should reveal the information about the full name and address of the overseas buyer, description quantity and value of goods (FOB or CIF), destination port and the last date of payment.

Quantum of Finance

The Quantum of Finance is granted to us against the LC or an expected order. The only guideline principle is the concept of NeedBased Finance. Banks determine the percentage of margin, depending on factors such as:

The nature of Order. The nature of the commodity. The capability of exporter to bring in the requisite contribution.

Different Stages of Pre Shipment Finance

Appraisal and Sanction of Limits

1. Before making any an allowance for Credit facilities banks need to check the different aspects like product profile, political and economic details about country. Apart from these things, the bank also looks in to the status report of the prospective buyer, with whom the exporter proposes to do the business. To check all these information, banks can seek the help of institution like ECGC or International consulting agencies like Dun and Brad street etc.

The Bank extended the packing credit facilities after ensuring the following"

a. The exporter is a regular customer, a bona fide exporter and has a goods standing in the market.

b. Whether the exporter has the necessary license and quota permit (as mentioned earlier) or not.

c. Whether the country with which the exporter wants to deal is under the list of Restricted Cover Countries(RCC) or not.

Disbursement of Packing Credit Advance

2. Once the proper sanctioning of the documents is done, bank ensures whether exporter has executed the list of documents mentioned earlier or not. Disbursement is normally allowed when all the documents are properly executed.

Sometimes an exporter is not able to produce the export order at time of availing packing credit. So, in these cases, the bank provide a special packing credit facility and is known as Running Account Packing.

Before disbursing the bank specifically check for the following particulars in the submitted documents"

a. Name of buyerb. Commodity to be exportedc. Quantity

d. Value (either CIF or FOB)e. Last date of shipment / negotiation.

The quantum of finance is fixed depending on the FOB value of contract /LC or the domestic values of goods, whichever is found to be lower. Normally insurance and freight charged are considered at a later stage, when the goods are ready to be shipped.

In this case disbursals are made only in stages and if possible not in cash. The payments are made directly to the supplier by drafts/bankers/cheques.

The bank decides the duration of packing credit depending upon the time required by the exporter for processing of goods.

The maximum duration of packing credit period is 180 days, however bank may provide a further 90 days extension on its own discretion, without referring to RBI.

Follow up of Packing Credit Advance

3. Exporter needs to submit stock statement giving all the necessary information about the stocks. It is then used by the banks as a guarantee for securing the packing credit in advance. Bank also decides the rate of submission of this stocks.

Apart from this, authorized dealers (banks) also physically inspect the stock at regular intervals.

Liquidation of Packing Credit Advance

4. Packing Credit Advance needs be liquidated out of as the export proceeds of the relevant shipment, thereby converting preshipment credit into postshipment credit.

This liquidation can also be done by the payment receivable from the Government of India and includes the duty drawback, payment from the Market Development Fund (MDF) of the Central Government or from any other relevant source.

In case if the export does not take place then the entire advance can also be

recovered at a certain interest rate. RBI has allowed some flexibility in to this regulation under which substitution of commodity or buyer can be allowed by a bank without any reference to RBI.

Overdue Packing

5. Bank considers a packing credit as an overdue, if the borrower fails to liquidate the packing credit on the due date. And, if the condition persists then the bank takes the necessary step to recover its dues as per normal recovery procedure.

Special Cases 

Packing Credit to Sub Supplier

1. Packing Credit can only be shared on the basis of disclaimer between the Export Order Holder (EOH) and the manufacturer of the goods. This disclaimer is normally issued by the EOH in order to indicate that he is not availing any credit facility against the portion of the order transferred in the name of the manufacturer.

This disclaimer is also signed by the bankers of EOH after which they have an option to open an inland L/C specifying the goods to be supplied to the EOH as a part of the export transaction. On basis of such an L/C, the subsupplier bank may grant a packing credit to the subsupplier to manufacture the components required for exports.On supply of goods, the L/C opening bank will pay to the sub supplier's bank against the inland documents received on the basis of the inland L/C opened by them.

The final responsibility of EOH is to export the goods as per guidelines. Any delay in export order can bring EOH to penal provisions that can be issued anytime.

The main objective of this method is to cover only the first stage of production cycles, and is not to be extended to cover supplies of raw material etc. Running account facility is not granted to subsuppliers.

In case the EOH is a trading house, the facility is available commencing from the

manufacturer to whom the order has been passed by the trading house.

Banks however, ensure that there is no double financing and the total period of packing credit does not exceed the actual cycle of production of the commodity.

Running Account facility

2. It is a special facility under which a bank has right to grant preshipment advance for export to the exporter of any origin. Sometimes banks also extent these facilities depending upon the good track record of the exporter. In return the exporter needs to produce the letter of credit / firms export order within a given period of time.

Preshipment Credit in Foreign Currency (PCFC)

3. Authorised dealers are permitted to extend Preshipment Credit in Foreign Currency (PCFC) with an objective of making the credit available to the exporters at internationally competitive price. This is considered as an added advantage under which credit is provided in foreign currency in order to facilitate the purchase of raw material after fulfilling the basic export orders.

The rate of interest on PCFC is linked to London Interbank Offered Rate (LIBOR). According to guidelines, the final cost of exporter must not exceed 0.75% over 6 month LIBOR, excluding the tax.

The exporter has freedom to avail PCFC in convertible currencies like USD, Pound, Sterling, Euro, Yen etc. However, the risk associated with the cross currency truncation is that of the exporter.

The sources of funds for the banks for extending PCFC facility include the Foreign Currency balances available with the Bank in Exchange, Earner Foreign Currency Account (EEFC), Resident Foreign Currency Accounts RFC(D) and Foreign Currency(NonResident) Accounts.

Banks are also permitted to utilize the foreign currency balances available under Escrow account and Exporters Foreign Currency accounts. It ensures that the requirement of funds by the account holders for permissible transactions is met. But the limit prescribed for maintaining maximum balance in the account is not

exceeded. In addition, Banks may arrange for borrowings from abroad. Banks may negotiate terms of credit with overseas bank for the purpose of grant of PCFC to exporters, without the prior approval of RBI, provided the rate of interest on borrowing does not exceed 0.75% over 6 month LIBOR.

Packing Credit Facilities to Deemed Exports

4. Deemed exports made to multilateral funds aided projects and programmes, under orders secured through global tenders for which payments will be made in free foreign exchange, are eligible for concessional rate of interest facility both at pre and post supply stages.

Packing Credit facilities for Consulting Services

5. In case of consultancy services, exports do not involve physical movement of goods out of Indian Customs Territory. In such cases, Preshipment finance can be provided by the bank to allow the exporter to mobilize resources like technical personnel and training them.

Advance against Cheque/Drafts received as advance payment

6. Where exporters receive direct payments from abroad by means of cheques/drafts etc. the bank may grant export credit at concessional rate to the exporters of goods track record, till the time of realization of the proceeds of the cheques or draft etc. The Banks however, must satisfy themselves that the proceeds are against an export order.

EXPORT procedure and documents

Export procedure involve several activities. These activities are classified into five stages:-

1>PRELIMINARIES:-

IMPORTER-EXPORTER CODE NUMBER(IEC NUMBER):

Individuals and business firms intending to export services should obtain an importer exporter number from the regional licensing authorities, unless exempted by DGFT. Thus number mentioned is shown in documents.

MEMBERSHIP IN CERTAIN BODIES:

After obtaining the IEC number, the exporter may obtain membership in certain bodies like Export Promotion Council. Membership in these organizations, help the exporters regarding information and documentation.

REGISTRATION:

The exporter have to register themselves with the export promotion council, sales tax authorities etc,

2>OFFER AND RECEIPT OF CONFIRMED ORDER:-

Offer is the proposal submitted by an exporter expressing his intention to export specific goods at a specific price with specific terms and conditions. Exporter usually makes an offer in the form of a “Proforma Invoice”

The proforma invoice includes the following items:

NAME OF THE BUYER:

The complete name and address of the buyer

DESCRIPTION OF GOODS:

A brief description of goods indicating technical, physical and chemical features.

PRICE:

Unit wise and total price of the goods in internationally accepted currencies or mutually agreed currencies. It should also cover the quantity discounts and cash discounts both in unit wise and total.

CONDITIONS OF SALE:

Conditions of sale should be incorporated in detail. Important among them are:

Validity, escalation clause, delivery schedule, inspection, force majeure clause.

PAYMENT TERMS:

Payment terms like letter of credit, bill of exchange etc. should be included.

OTHER OBLIGATION:

Other obligation of the following nature should also be included:

Post sales services to be provided by the exporter. Providing spare parts. Warranty/guarantee for the equipment/technology.

CONFIRMED ORDER:

The buyer sends the confirmed order to the exporter by signing the duplicate copy of the invoice by the importer becomes the confirmed order.

EXPORT LICENCE:

The exporter has to obtain the export licence from authorities concerned, if the items to be exported require a licence.

3> PRODUCTION/PROCUREMENT OF GOODS:

The exporting house after obtaining a confirmed order should produce the goods exactly as specified in the invoice. If the exporting house does not have production facilities, it has to procure the products from others.

PACKING AND MARKING:

After the goods are procured, the exporter should arrange for packing and marking as per the international standards prescribed by various bodies. The Bureau of Indian Standards has prescribed packing standards for certain items.

QUALITY CONTROL AND PRE-SHIPMENT INSPECTION:

The exporter has to arrange for quality control and pre-shipment inspection in order to ensure the quality of products as indicated in the invoice.

EXCISE DUTY REBATES:

Government has exempted the goods meant for exports from the imposition of excise duty. Exporters can export the excisable goods either under claim for rebate of excise duty or in bond without payment of duty. Exporter has to submit the following forms for rebate after the excise duty is paid.

Gate pass, GP-1 AR-4 Form

4>SHIPMENT:

Transporting the goods is done by ship. Regarding it our company contact with shipment companies for space, after getting the confirmed order. The shipping company issues shipping advice or shipping order, depending upon the requirement.

CUSTOMS CLEARANCE:

The company has to get custom clearance of the goods before, they are loaded on the ship. Customs authorities accord their formal approval after scrutinizing complete set of shipping documents,copies of shipping bill etc.

CARTING ORDER:

Once the goods are ready for export and the shipping order is available, the company approaches the superintendent of the concerned port trust for the latter’s permission to move the goods physically inside the port area. The superintendent of the port trust issues the order for moving the goods in to port area after verifying the shipping bill and shipping order.

CUSTOMS EXAMINATION OF CARGO AT DOCKS:

The customs authorities after checking the documents, check the products to be exported at the docks. The company arranges for physical check of the products in his factory or warehouse. The custom appraiser after checking the consignment, will seal the packages, after his satisfaction. Such packages are generally not checked again at the port, unless the bonafides of the exporter are doubtful.

LET SHIP:

After getting the approval from the customs officials, the exporter arranges for loading the products on the ship. Before loading takes place, the exporter’s forwarding agent has to get the permission from the preventive officer of the customs department. This permission is called the “LET SHIP ORDER”

MATE’S RECEIPT:

After the goods are loaded on the ship, the caption of the ship furnishes a document to the port superintendent. This document is called MATE’S RECEIPT.

PORT TRUST DUES:

The port trust authorities after receiving the Mate’s Receipt, from the caption of the ship, issues the Bill Of Lading to the exporter.

BILL OF LADING:

The company’s forwarding agent collects the Mate’s Receipt, and submits the same to the authorities and in turn collects the bill of lading from the port authorities.

The company’s forwarding agent provides the following documents to the exporter at this final stage. They are:

A copy of the invoice duly attested by the customs Drawback copy of the shipping bill Export promotion copy of the shipping bill Full set of ‘clean on board’ bill of lading together with the non-negotiable

copies The original letter of the credit Customer’s order or contract Duplicate copy of the AR-4 form

The company submits the relevant documents to his banker for getting the payment for the goods exported. Submission of relevant documents to the bank and the process of getting the payment from the bank is called ”Negotiating The Documents”. The set normally includes:

COMMERCIAL INVOICE:

This is the basic document in an export transaction. A commercial invoice is a bill for the goods from the buyer to seller. It contains a description of goods, the address of the buyer and seller, and delivery and payment terms. Commercial invoice may be prepared according to mutual agreement between the buyer and seller.

FREE ON BOARD(F.O.B) COST,INSURANCE AND FREIGHT(C.I.F) COST AND FREIGHT(C$F) FREE ALONG SIDE(F.A.S) EX.(NAMED POINT OF ORIGIN)

CONSULAR INVOICE:

A consular invoice sometimes is required by countries as a means of monitoring imports.

PROFORMA INVOICE:

A proforma invoice is an invoice, like a letter of from the company to the importer outlining the selling terms, prices and if the goods are actually shipped.

G.R.FORM:

This form has been prescribed by the Reserve Bank of India under FERA to ensure that the foreign exchange receipts in respect of exports are impatriated to India.

LETTER OF CREDIT:

A letter of credit is a document containing of a bank to honour drafts drawn on it by an exporter, under certain conditions and upto certain amounts, provided that the beneficiary fulfills the stipulated conditions.

BILL OF EXCHANGE:

A bill of exchange is a means of collecting payment from the foreign buyer through the banking channel. It is also a method of extending credit. There are the following important types of bill of exchange:

SIGHT BILL OF EXCHANGE ARRIVAL BILL OF EXCHANGE DATE BILL DOCUMENTARY BILL OF EXCHANGE

SHIPPING BILL:

This is a custom document. In fact, it is the main document on the basis of which the customs permission for export is given. The following three forms of the shipping bill are available with the custom authorities:

Shipping bill for free goods, for which there is no export duty Dutiable shipping bill for goods for which there is export duty Duty drawback shipping bill which is required for claiming the customs

MARINE INSURANCE POLICY:

The goods that are exported may be subject to certain maritime pertails. The risks of such perils may be covered under MARINE INSURANCE POLICY.

BILL OF LADING:

A BILL OF LADING is a receipt for goods delivered to the common carrier for transportation, a contract for the services rendered by the carrier and a document of a title.

MATE’S RECEIPT:

This document is got from the caption of the ship or the mate, who is his assistant, and who can not allow the shipping of the goods unless the shipper presents to either of them a copy of the shipping bill and shipping order.

CERTIFICATE OF ORIGIN:

A certificate of origin indicates where the product originate from and usually is validated by an external source.

PACKING NOTE AND LIST:

An export packing list indicates that the type of package itemizes the material in each individual package indicates the type of package and is attached to the outside of the package. A packing note includes the following things:

CERTIFICATE OF INSPECTION:

It is a certificate issued by the export inspection agency. This agency certifies that consignment has been inspected under the Export Act 1963.

G.P. FORMS:

A G.P.FORM is a gatepass for the removal of excisable goods from a factory or warehouse. Form GP 1 is used for the removal of excisable goods or payment of duty , GP 2 form is used for the removal of excisable goods without payment of duty.

CAR TICKET:

A car ticket is prepared by the company and includes details of the export cargo

LICENCE:

Export licenses are additional document frequently in export trade.

SHIPPER’S EXPORT DECLARATION:

A shipper’s export declaration is used by the exporter’s government to monitor exports and to compile trade statistics.

6> EXPORT INCENTIVES:

DUTY DRAWBACK:

Company is eligible to get back the excise duty and central excise paid on all raw materials, components and consumables used in the production of goods exported, under this scheme

EXCISE DUTY REFUND:

Company is eligible for refund of the excise duty. He/she can recover it after export, if he paid at the beginning. He/ she can also can execute a bond with the excise authorities without making the payment.
