What does your company specialize in: Cargills purpose is to be the global leader in nourishing people. We work towards this purpose by collaborating with farmers, food makers and industrial customers to bring fresh ideas to the table and to nourish people around the world. We work to leverage our depth of knowledge to help our customers succeed and communities thrive. What services/products does your company provide: Cargill provides grain marketing solutions & marketing advice for our producer customers & end use-customers. We strive to collaborate with our customers to help them manage risk in todays volatile marketing environment. ProPricing is one of the many grain contracts that we offer that producers entrust bushels to Cargill to establish the futures price. ProPricing has grown into the single largest type of grain contract that is traded today. What is something unique about your company? Cargill Incorporated is a privately held family & employee owned business that will celebrate its 150th year of doing business in 2015. How long have you been in the grain business? For as long as I can remember. How did you get started in the grain business? I had the opportunity and great fortune to be born into a family grain, feed, & crop input business. From my earliest memories, I spent time at the family business. Starting at the truck scale, probing & grading trucks, then unloading & loading grain, and eventually hauling grain to destination markets, I was able to learn the foundation of the grain business. I continued my education at Kansas State University with a degree in Ag Business and was fortunate to start with Cargill in 1994. Where do you consider your hometown or where you grew up? Madison, KS. A small town on the eastern edge of the Flint Hills.

What KGFA services are the most valuable to you and your company? We value the KGFA staff as they work with the industry to help fend off threats and to identify and support various opportunities that arise throughout the state. KGFA staff is always very supportive in working with our business for the betterment of Kansas Agriculture. Cargill is a proud sponsor and promoter of the TAL program. As a TAL graduate, I continue to encourage our employees to apply to the TAL program on an annual basis as we see value in the program for not only the employee, but our company and KGFA.

LEGISLATIVE REPORT

New Scales Tax Avoided through KGFA

Statehouse Efforts The final budget approved by the Governor includes $270,000 from the state general fund to bolster the Kansas Department of Agricultures Weights and Measures Division. The budget enhancement proposed by Gov. Brownback will allow for the

hiring of additional KDA inspectors to increase the agencys oversight through increased spot-checks. KGFA successfully lobbied in support of this enhancement in order to circumvent a new tax on scales. The budget became effective on July 1, 2014.

Bill Clarifying Classification of Commercial

and Industrial Machinery Signed into Law On May 14, Governor Brownback signed HB 2643 into law. This bill, effective July 1, 2014, clarifies legislative intent from a 2006 law exempting certain commercial and industrial machinery and equipment from ad valorem property taxation. The intent of this bill was to create a global solution to the issue of misclassification of commercial and industrial machinery and equipment as real property. House Bill 2643 states that, in determining the classification, a county appraiser must follow the factors set forth in the personal property valuation guide prescribed by the director of property valuation division (PVD). In making the classification determination, county appraisers would be required to conform to the definitions of real and personal property provided elsewhere in Kansas law. A detailed explanation can be found on KGFAs website.

Board of Tax Appeals Changes Approved On May 14, Governor Brownback signed SB 231 into law. Effective July 1, 2014, this bill makes a number of changes to the power, duties and functions of the Court of Tax Appeals (COTA). The intent of this bill is to make the court more responsive to the needs of taxpayers and to treat the court/board in a manner that is more consistent with the Kanas Administrative Procedures Act. Principally, the bill renames the court as the Board of Tax Appeals (BOTA), renames the court officers as board members rather than as judges, and makes several other changes that explained in detail on KGFAs website.

OSHA Study Approved On May 12, Governor Brownback signed HB 2616 into law. Effective July 1, 2014, this bill will require the Secretary of Labor to study and make recommendations concerning whether the State should propose a safe and healthful employment plan to the federal government that is at least as effective as the standards set by the federal Occupational Safety and Health Act (OSHA).

CDL Education Approved for Community

Colleges and Technical Colleges On May 12, 2014, Governor Brownback signed Senate Sub. for HB 2693 into law. Effective July 1, 2014, this bill requires the Secretary of Revenue to authorize community colleges and technical colleges, upon request, to administer the skills tests required for a person to obtain a commercial drivers license. The bill also requires the Secretary to grant priority status to any community or technical college with a truck driver training course in place on July 1, 2014. The Secretary will authorize testing that complies with federal requirements in an agreement between the requesting community college or technical college and the state. The Secretary will also be required to adopt rules and regulations to implement the testing procedure by January 1, 2015. The bill requires the Secretary to accept the results of a persons skills tests administered by either a community college or a technical college. Finally, the bill specifies that third-party drivers license examiners will not be required to be included within the classified service under the Kansas Civil Service Act.

KDA Bill Allows Programs to Continue On May 14, Governor Brownback signed SB 286 into law. Effective July 1, 2014, this bill extends the sunset from July 1, 2015, to July 1, 2018, on various fees that are currently charged by the Kansas Department of Agriculture (KDA). Without extending the sunset, KDA would have lost $700 million in revenue and would not have been able to administer its programs. The bill also establishes the Local Food and Farm Task Force. The Task Force will be responsible for preparing a local food and farm plan containing policy and funding recommendations to increase locally grown food production. In addition, the bill designates the last Saturday in July of each year as National Day of the Cowboy in the state.


LEGISLATIVE REPORT

Governor Signs Trespass Law The Governor signed into law the conference committee report for HB 2447 , a bill dealing with trespass liability. Effective July 1, 2014, the bill states that anyone in possession of any fee, reversionary or easement interest in real property, including the owner or lessee, owes no duty of care to a trespasser except for those circumstances in which a common law or statutory right of action existed on or before July 1, 2014. KGFA testified in support of this bill.

Tort Reform Signed by Governor The Governor signed into law SB 311. This bill addresses the concern from the Kansas Supreme Court regarding caps in non-medical practice cases and the fact that caps on non-economic damages had not been increased for some time. SB 311 proposes an increase from the current $250,000 cap to $350,000 over the next eight years. Additionally, the bill includes a pro-business tort reform initiative by Daubert expert evidence standard (eliminate "junk science" opinions). KGFA was key in getting this bill approved. The law became effective on July 1, 2014.

Overweight Container Law Implemented The Governor signed into law, SB 344. This bill fixes several concerns that came to light after the opening of the new BNSF Intermodal and Logistics Park in Edgerton in October 2013 regarding over-dimension or overweight non-divisible loads. KGFA lobbied hard for passage of this bill. The bill went into effect April 24, 2014.

Farm Implement Bill Law Signed The legislature approved and the Governor signed into law HB 2715. This bill would create a law related to transportation of farm implements by implement dealers on the highways. During the committee process, your association was able to amend the bill so our members were not inadvertently affected by the bill. The bill allows an implement dealer who obtains a permit for an oversize or overweight vehicle would be allowed to move or transport farm tractors, implements of husbandry, combines, fertilizer dispensing equipment, or other farm machinery on certain highways in Kansas. The bill would create an annual permit available to an implement dealer and would specify an implement dealer could use a single-trip permit for this purpose.

Such movement would be required to meet certain conditions related to load size, would be restricted to daylight hours, and could not use any highway that is part of the Interstate. The bill would allow the equipment or machinery to be moved on a trailer or semi-trailer, pinned to a truck or truck tractor and traveling on its own wheels, or under its own power. The bill would allow an implement dealer or its employees to move farm machinery when towing such machinery behind a farm tractor within a 100-mile radius of the implement dealers place of business when both the farm tractor and the equipment or machinery are equipped with flashing lights on both the front and rear; any machinery designed for or normally moved at speeds less than 25 miles per hour would be required to clearly display a slow-moving vehicle emblem. The bill would define an implement dealer as a person or business that buys, sells, or services farm tractors, implements of husbandry, or other farm machinery in the regular course of business. The bill went into effect on July 1, 2014.

KGFA Hosts Fundraiser for Brownback In June, KGFA held a successful fundraiser for Governor Sam Brownback at the Association Office. Several association members were in attendance and sponsored the event, including Board Chairman Ted Schultz and his wife, Joyce. All attendees were given the opportunity to have in-depth discussions with Governor Brownback and share many concerns facing the industry.

2014 ANNUAL MEETING

Annual Meeting Attracts 200 Members to Wichita Over 200 members gathered in Wichita on April 14-15 for the 2014 KGFA Annual Meeting. The event started with the popular Prime Rib Dinner and hospitality receptions, where members networked with other industry pro-fessionals. KGFA was honored to have first district U.S. Senator Pat Roberts, John Miller, BNSF, Group Vice President, and Ag Comedian, Damian Mason, as speakers. Members then headed to Crestview Country Club to wrap up the meeting with a golf tournament.

STAFF HITS THE ROAD

Staff Conducts No-Ties Tour Ron Seeber, KGFA Senior VP, conducted a no-ties tour in July. While visiting members, Ron was also able to receive an update from the Kansas Water Office on their preliminary thoughts on the Governors 50-year water vision at a forum in Garden City. Also during the tour, Ron and many KGFA members were able to deliver a number Kansas Agribusiness Council Political Action Committee (PAC) contributions to several of agribusiness friendly legislative candidates.

KGFA Facilitates Industry Tour for Taiwan

Dignitary, Congressman In June, U.S. Congressman Tim Huelskamp asked KGFA to arrange for a roundtable discussion with Kansas agricultural concerns and a tour of a Kansas grain elevator for himself and Mr. Jack Yang, Director General of the Taiwan Consulate in Kansas City. MKC Manhattan location manager, Darin Marti, graciously offered the use of the grain elevator and board room for the roundtable and tour. Following an initial private meeting between the Congressman and Director General Yang, a meet and greet and open discussion session were held with participants from various industries. Following the open discussion portion, Darin Marti lead a group tour of the entire MKC facility. Marti graciously and methodically explained to Director General Yang the various segments of a modern grain storage operation and agricultural retail facility.

Congressman Huelskamp was appreciative of the industrys hospitality. It was a successful event, and one that presented Kansas grain elevators and the agricultural industry in a beneficial light.

Canton Slip Nears Completion Earlier this year, KGFA staff toured the MKC slip construction of the Canton Rail Terminal located West of Canton. The grain shuttle loader facility should be completed this fall and has the potential to load 110-car unit trains in less than 12 hours. Upon completion, on-site storage will be in excess of 3 million bushels. The new facility will provide two scales; state-of-the-art automation; easy access and an easily maneuverable traffic pattern for all truck sizes; three truck pits, two of which will accommodate semis; one rail pit; and the ability to receive up to 60,000 bushels per hour. The facility is owned equally by MKC and CHS and will become a member of Team Marketing Alliance (TMA).

Industry Advises KDOT on Freight Needs On behalf of KGFA, Ron Seeber, Senior VP, and Brent Emch with Cargill and a KGFA Board Member, provided input to the Kansas Department of Transportation as members of the agencys Freight Advisory Committee. KDOT established the committee citing the need for a better understanding of the demands of expanding freight within the state. Seeber and Emch expressed the necessity for short line rail maintenance, the need for congruency in truck axil weight sizes between Kansas and neighboring states, and the importance of multimodal freight infrastructure improvements. The committee will meet again in August. After the meetings conclude, a report will be developed better advising KDOT on where the agencys resources should be focused.

ASSOCIATION HAPPENINGS

KGFA Leaders and Staff Meet with CFTC KGFA President Tom Tunnell and several board officers met with Deputy Director of the Commodities Futures and Trade Commission Charles Marvine. The meeting was a chance to give an introduction of KGFA and discuss the make-up of the CFTC, Dodd Frank rulemaking and the CFTC budget.

Over 100 applications were received and considered by an independent Scholarship Selection Committee made up of association members. Each year, KGFA awards one $500 Dub & Inez Johnson Memorial scholarship and seven $1,000 KGFA scholarships. KGFA also awards one $1,000 John Cranor Memorial scholarship, whose winner is selected by the Kansas State University Foundation. The KGFA Board of Directors voted at their April 14 board meeting in Wichita to add an additional four $500 KGFA scholarships for the 2015-2016 school year, increasing the organizations total annual financial assistance from $8,500 to $10,500.

Email changes to [email protected]. KGFA is based on a strong committee structure that thrives from input and active participation from all sectors of the industry. Thank you to everyone that has committed to serve.

Board, Staff Plan for Future of KGFA The KGFA Board of Directors participated in a day-long strategic planning session on April 16 in Wichita. The purpose was to look to the future and chart the course for KGFA over the next 5-10 years. Participants assessed KGFAs current situation, discussed its fundamental purpose and strategy, and analyzed programs and operations. Several long term goals and short term objectives were set. Staff then had the opportunity to review the boards recommendations during a follow-up strategic planning review in July.
