Garrison Diversion Conservancy District’s Red River Valley Committee met by video conference on June 29, 2020. The meeting was called to order by Chairman Jay Anderson at 2:45 p.m.

READING OF THE MINUTES Motion by Director Bischoff to dispense with a reading of the April 17, 2020, Red River Valley Committee minutes and approve them as distributed. Second by Director Fenstad. Upon voice vote, motion carried.

RRVWSP UPDATE The committee reviewed items covered during the LAWA Board meeting that was held prior to today’s committee meeting, at which time a presentation was provided as an update on the StateMod. A recap was also given on the Red River Valley Water Supply Project (RRVWSP) Biennium Strategy Workshop.

The committee also discussed the Draft Interim Finance Agreements that the Negotiation Team has developed, splitting out the two cost share plans into two agreements for the RRVWSP. Duane DeKrey, Secretary, informed the committee that a request has been submitted to the State Water Commission for the $7.5 million in funding for early-out construction. Mr. DeKrey stated it may be a good idea for directors to talk to their legislators, stressing that continuing to invest in infrastructure is important for the state’s economy and creates jobs. Chairman Anderson asked if there are any preliminary things that could be done while waiting for the NDPDES permit. Kip Kovar, District Engineer, Garrison Diversion, replied if everyone believes construction of the Missouri River Intake is important, certain work items need to begin soon, such as the geotechnical borings. The next thing in line would be the design task order, which leads to the construction contract. Merri Mooridian, Administrative Officer, Garrison Diversion, said another thing that ties into all this besides the 25% cost share is the State Water Commission putting project funding on hold. The RRVWSP did receive legislative intent, but the $7.5 million has not been approved. The committee further discussed the importance of moving ahead with the early-out projects and various funding scenarios. Motion by Director Fenstad to recommend approval to move ahead with the geotechnical boring at the Missouri River Intake in the amount of $600,000 to the full board. Second by Director Bischoff. Upon roll call vote, the following directors voted aye: Anderson, Bischoff, Fenstad, Kaiser, Royse and Vein. Those voting nay: none. Motion carried. Motion by Director Fenstad to recommend authorizing Black & Veatch to prepare the task order for design of the Missouri River Intake to the full board. Second by Director Vein. Upon roll call vote, the following directors voted aye: Anderson, Bischoff, Fenstad, Kaiser, Royse and Vein. Those voting nay: none. Motion carried. Ms. Mooridian reported the agreement with Aon for insurance services will be sent out to the RRV Committee to review. If there are no questions or concerns, the general manager will sign it. OTHER There being no further business to come before the committee, the meeting was adjourned at 3:20 p.m.

I. BACKGROUND

1. The Red River Valley Water Supply Project (RRVWSP) will provide a supplemental water supply

to eastern and central North Dakota (ND) in the event of drought conditions in the Red River

watershed. The RRVWSP as envisioned by the Garrison Diversion Conservancy District (Garrison

Diversion, the Owner) will supply additional water to support industrial development as well as

provide an environmental benefit to local rivers during drought conditions by augmenting

natural stream flows. The source water will be withdrawn from the Missouri River and conveyed

to a new biota water treatment plant. A multi-county pipeline will then convey flows from the

biota water treatment plant roughly 167 miles east to the Sheyenne River. Lake Ashtabula

located downstream will provide storage allowing for controlled releases to the Red River Valley

when flow augmentation is needed.

2. The source of supply for the RRVWSP is the Missouri River. A Missouri River Intake (MRI) will be

constructed to take water from the river approximately six miles south of Washburn, McLean

County, ND. The MRI will operate year-round at varying flow rates and river elevations. The

design minimum maintenance flow of the RRVWSP is 4 cubic feet per second (cfs) and the design

maximum flow is 165 cfs; the size of the Missouri River Intake Pumping Station (MRIPS) wet well

is such that it can function hydraulically up to 185 cfs. A part of the MRI – the MRIPS – will be

constructed on the east bank of the Missouri River. The MRIPS wet well will function as a suction

well for eight vertical turbine pumps: four high-flow and four low-flow units.

3. The MRI consists of the following components with location as shown in Figure 1:

• Intake in the Missouri River

o Screen Structure

o Barrel screens

• Tunnel from the Wet Well to the Screen Structure (also referred to as a Crib)

• Missouri River Intake Pumping Station

o Wet Well (also functions as tunnel shaft)

o Superstructure

o Mechanical and electrical systems

• Site improvements, including utility extensions and access road improvements

4. The MRI is going to be built in separate construction contracts potentially as follows:

• Contract 1 – MRIPS Wet Well and Site Development

• Contract 2 – MRI Screen Structure and Tunnel

• Contract 3 – MRIPS and Site Utilities

• Contract 4 – MRIPS Drives and Pumps (potentially combined with Contract 3)

5. Under an authorization for professional services with an effective date of June 21, 2016,

Engineer completed a permit-level design of the MRI and applied for a Nationwide 12 permit

from the U.S. Army Corp of Engineers (USACE). The application was submitted to USACE on

March 7, 2017 and a Nationwide Permit 12 – Utility Line Activities was secured from USACE on

September 7, 2018. The permit expires on March 18, 2022, with a one-year extension

automatically granted if work commences prior to the expiration.

6. Under an authorization for professional services, with an effective date of March 1, 2018,

Engineer provided the following services under Task Order 2220 – Intake Preliminary Design:

A. Had a scale model of the wet well built and conducted physical modeling of the permit-

level design concept off site to verify that the proposed circular configuration, diameter,

and pump arrangement within the wet well is suitable for eight pumps and a flow up to 185

cfs.

B. Undertook a geotechnical investigation of the proposed MRIPS site (excluding those areas

below the river’s ordinary high-water mark), completed laboratory analysis of soil borings,

and documented findings in a geotechnical data report (GDR) that will be used for the

pumping station and associated on bank structures’ foundation designs.

C. Completed preliminary design of the components of the MRI listed in paragraph I.3 and

delivered a Basis of Design Memorandum to Garrison Diversion dated November 16, 2018.

D. Developed biddable plans and specifications for Contract 1 – MRIPS, Wet Well and Site

Development, Contract 1, which were approved by the Lake Agassiz Water Authority

(LAWA) and Garrison Diversion in March 2020 and April 2020, respectively. An

advertisement for bids and letting of Contact 1 will likely take place in the fourth quarter of

2020 based on currently available information.

7. Task Order 2320 – Missouri River Intake Geotechnical Investigation and Reporting, with an

effective date of January 1, 2020, was developed so that authorization could be given to

Engineer to obtain soil borings in the Missouri River for the tunnel and screen structure’s

foundation design. A GDR will be developed under this authorization for the marine borings.

Engineer was given a notice to proceed with this work on July 6, 2020 and borings were

completed during the weeks of August 23, 2020 and August 30, 2020.

II. TASK ORDER OBJECTIVES

1. The objective of this Task Order is to complete the design of the MRI screen structure, tunnel, and

shaft liner. Figure 2 shows a section of the shaft delineating the excavation support system that will

be built under Contract 1 and the shaft liner included in Contract 2.

Once designed, Engineer will deliver biddable Contract Documents (CDs) to Garrison Diversion

so the Project (Contract 2) can be built under a future general contractor construction contract.

The MRI screen structure and tunnel were previously designed to an approximate 30-percent

completion level under Task Order 2220 discussed above. Soils information gathered from

borings and laboratory analysis completed under Task Orders 2220 and 2320 will be used to

complete the structures’ foundation design and tunnel’s civil design.

2. A geotechnical baseline report (GBR) will be developed by Engineer under this Task Order. The

report findings and conclusions will be based on the information gathered from previously

completed soil borings and laboratory analysis conducted under Task orders 2220 and 2230.

Engineer will use its professional judgement to establish baseline subsurface conditions at the

location of the screen structure and along the alignment of the tunnel that bidders are to base

their bids upon.

III. GENERAL REQUIREMENTS

1. Under this Task Order, Engineer will provide services in accordance with the Standard Form of

Agreement between Owner and Engineer for Professional Services dated January 17, 2008

(Agreement).

2. General Description of Activities. The Basic Services to be performed by Engineer consist of

professional design services associated with development of CDs for installation of a tunnel

under the Missouri River and construction of an intake screen structure in the Missouri River

south of Washburn, ND.

3. Construction Procurement. CDs developed by Engineer will be of enough detail for Garrison

Diversion to obtain bids through a conventional bidding process (design-bid-build). The Work (a

screen structure, tunnel, shaft liner, and other miscellaneous improvements) will be built under

a single construction contract by one Contractor termed herein as “Contract 2.” Contract 1

previously designed was for construction of the Missouri River Intake Pumping Station wet well

(also referred to as the tunnel shaft) and initial site development. There will be some

coordination required between the Contract 1 and Contract 2 contractors as Contract 1’s

completion date is anticipated to finish after the start date for construction of Contract 2.

4. Work outside Basic and Special Services. Engineer agrees to provide the Basic Services and

Special Services identified herein. Work not specifically discussed herein as part of Basic Services

or Special Services is considered Additional Services. Additional Services will only be performed

with proper separate authorization such as an amendment to this Task Order or a new separate

Task Order.

5. Capital Cost Opinions. Opinions of probable construction cost developed will generally follow

the recommendations of the Association for the Advancement of Cost Engineering (AACE)

International Recommended Practice No. 18R concerning methodology and accuracy. The cost

opinions’ level of accuracy presented by Engineer for the various deliverables will be as noted

in subsequent paragraphs of this Task Order under Basic or Special Services.

6. Document Production Standards and Procedures. Engineer will prepare CDs using the 48-

division, 3-part Construction Specifications Institute (CSI) format for technical specifications;

Engineer’s drawing standards; and Engineer’s design procedures and criteria, AutoCAD drafting

standards, and standard construction details. Original drawing files will be three dimensional.

7. Front-End Documents. Standard Division 0 and 1 specifications (also known as front-end

documents) developed for early-out projects bid in 2020 will be used as the basis for the front-

end documents for this project. The standards will be reviewed, and project-specific information

edited as appropriate with the type and method of construction required for Contract 2. Front-

end documents will be developed to correspond to a two-part geotechnical report consisting of

a GDR and GBR, which will both become part of the CDs.

IV. BASIC SERVICES

Basic Services of this Task Order are organized into major tasks as follows:

• Task 1 – Task Order Management and Administration

• Task 2 – Special Project and Third-Party Meetings

• Task 3 – Land Services

• Task 4 – Field Services

• Task 5 – Final Design Services

• Task 6 – Bidding Phase Services

1. Task 1 – Task Order Management and Administration

This task includes overall management and development of a Task Order Management Plan

specific to the Work. The overall objective of this task is to keep the Task Order on schedule and

on budget. This task includes overall management and development of a Work Plan specific to

the Work.

A. Task Order Setup and Work Plan Development. Engineer will develop an overall scope for

the Project and a Project work plan that includes the scope, schedule, and budget. Engineer

will conduct an overall Project kick-off meeting with the team.

B. Task Order Management. Engineer will provide management services necessary for

execution of the Task Order, including efforts required for proper resource allocation,

schedule development and monitoring, budget review and control, Owner coordination,

and other standard and customary activities required for timely completion of the Work.

Engineer will:

i. Perform general administrative duties associated with the Task Order, including

general correspondence, day-to-day contact and coordination, administration, and

monthly invoicing in a form that is acceptable to Owner.

ii. Prepare monthly progress reports that identify the Work that has been performed in

the period, work activities anticipated in the upcoming period, and action items or

decisions required of the Owner. Identify therein variances or potential variances from

the Task Order’s Basic and Special Services. The reports, in the Engineer’s standard

format, will be submitted with each invoice.

iii. Prepare a baseline Gantt chart schedule at Task Order’s inception. The schedule will

be periodically updated comparing actual progress by task/subtask to the baseline

schedule.

iv. Management of Subconsultants. Engineer will monitor subcontractor progress, review

and approve invoices, oversee adherence to the approved quality assurance/quality

control (QA/QC) plan, monitor adherence to document preparation standards, and

generally oversee subconsultants’ performance.

2. Task 2 – Special Project and Third-Party Meetings

The overall objective of this task is to keep stakeholders apprised of Task Order status and to

provide a forum for stakeholders input. Engineer will prepare an agenda and provide meeting

notes documenting discussions and action items. The following meetings are anticipated:

A. Special Project Meetings.

i. Internal Planning Meeting. Engineering will conduct an internal Task Order planning

meeting with key staff and Subconsultants to plan project execution from initiation

to completion. Key discussion points to be included on a preliminary agenda include:

scope of work, responsibilities of those to be engaged, budget obligations, schedule

commitments, critical success factors, projects risks, permitting requirements, etc.

ii. Client Initiation Meeting. Engineer will conduct a Task Order Initiation Meeting with

Garrison Diversion and subconsultants to review the overall approach to the Work,

the schedule by which the work will be prosecuted, and other relevant coordination

and management items necessary for a successful outcome.

B. Third-Party Meetings and Calls

i. Design Coordination Meetings. Engineer will provide agenda and summary notes of

meetings. Engineer will schedule and meet with the following agencies.

(a) Two meetings with the U.S. Army Corps of Engineers and the U.S. Fish and Wildlife

Service as it pertains to the Nationwide 12 permit.

(b) One meeting with the North Dakota State Water Commission.

(c) One meeting with the North Dakota Game and Fish Department

(d) Two meetings with local power cooperative

ii. Stakeholder Meetings and Conference Calls. Engineer will attend and present

Project information for meetings with the following stakeholders:

(a) LAWA

(i) Two Technical Advisory Committee (TAC) Meetings

(ii) One meeting with the LAWA Board of Directors.

(b) One meeting with Garrison Diversion Board of Directors

(c) Two conference calls with AON Insurance Company

(d) One conference call with Vogel Law Firm

3. Task 3 – Land Services

The purpose of the Land Services task is to secure access to the site so that necessary field

investigations can proceed during design and ultimately all property can be obtained on which

to build the MRI facilities. Property surveys were completed and surveyor certificates were

prepared for the 3-acre MRIPS site under Task Order 2220 – Intake Preliminary Design.

Easement drawings and surveyor certificates have also been prepared for some temporary and

permanent easements; prepare remaining surveyor certificates. Assist Garrison Diversion in

reaching agreements with land owners and recording those easement agreements with the

McLean County recorder.

A. Right-of-Entry Agreements. Engineer will assist Garrison Diversion in obtaining right-of-

entry (ROE) agreement(s) from up to four property owner(s) if not previously secured or if

existing agreements have expired. ROE agreements will be necessary to complete field

visits during design if easements and/or property have not yet been acquired.

B. Temporary Easements. Areas required for material laydown, construction staging, and for

direct access will be necessary along the tunnel alignment and along the embankment of

the Missouri River adjacent to the location of the screen structure. Under this task,

Engineer will review, define the areas, and prepare and acquire the temporary easements

needed. For the purposes of fee development, up to three temporary easements will be

provided under Basic Services. Parcel information includes:

C. Permanent Easements. Prepare permanent easement exhibits with Public Land Survey

System (PLSS). For the purposes of fee development, up to four permanent easements will

be provided under Basic Services. Permanent easements will be required on the following

parcels:

Obtaining new permanent easements will involve the following tasks:

i. County courthouse and tax office research to update and verify current ownership.

ii. Prepare permanent easement exhibits with PLSS data previous surveyed to include:

(a) Legal description of the new permeant easement

(b) Bearings and distances of the new permanent easement tied to the PLSS

(c) Licensed surveyor signature and seal

iii. Mark easement corners in the field.

iv. Provide easement documents for Garrison Diversion to file in County Recorder’s office

in compliance with North Dakota Century Code.

D. Landowner Coordination and Communication. Provide engineering team support to meet

with the four landowners for the purposes of establishing the final locations/alignments

and for establishing the locations of material laydown and construction staging areas. This

information will be incorporated into the CDs developed.

4. Task 4 – Field Services

The purpose of the Field Services task is to perform miscellaneous on-site activities to support

the Final Design. These field efforts will be used to refine topographic information and to define

and precisely document locations of land access, staging, and material storage areas.

A. Limited Topographic Surveying. Where necessary to reduce change order risk by more

precisely locating utilities and other features present on the proposed site, provide limited

field surveys to establish horizontal coordinates and vertical elevations of utilities or other

topographic features impacting structure and tunnel design.

B. Bathymetric Surveys. Surveys of the proposed location of the screen structure and along

the alignment of the tunnel beneath the Missouri River will be undertaken to define the

river bed location and water depth. Bathometric surveys will first be completed once this

Task Order is authorized secondly immediately prior to completion of the CDs.

C. Unmanned Aircraft System Surveys. Complete two aerial surveys of the site to document

Missouri River geomorphology. Use the video to identify if any substantive changes occur

between the start and finish of the Project. Compare data gathered to historical aerial

photographs of the site.

i . Generate Oblique View Video. The objective of this task is to provide an oblique view

video for the MRI screen structure site in the Missouri River using an unmanned

aircraft system (UAS). The intake site oblique view video will fly along a predetermined

radius path around the site.

ii. Fly UAS and Capture Video. Complete UAS flight due diligence and apply for Federal

Aviation Administration (FAA) waivers, as needed. When all required waivers are in

place, complete the UAS flight at the intake site. Perform flights under the FAA’s Small

UAS Rule (14 CFR Part 107) on site with a two-person field crew.

iii. Manage and Process UAS Data. Manage and coordinate the flight. Configure the data

for use within GIS applications. Transfer the oblique view video the geographic

information system (GIS) server, and process for use within GIS applications. Convert

the format of the video to MISB standard compatible with a full-motion video (FMV)

add-in module.

iv. Implement UAS Data with Desktop GIS. Install the FMV add-in module at Garrison

Diversion’s computers and set up GIS map documents to reference the oblique view

video within ArcGIS Desktop.

v. Incorporate Video within ArcGIS Workflow Manager (WMX). Integrate the oblique

view video into the RRVWSP WMX. Include an inset map to show the overview

location. Add general flight information text to the start and end of each video. Finally,

upload the video to WMX.

D. Plan-In-Hand Reviews. The design engineers will visit the tunnel alignment and the

proposed construction staging areas after completing the 60- and 90-percent deliverables.

The purpose of these sites visits is to verify facility layout and design details, evaluate

potential constructability issues, help to identify conflicts, etc.

E. Nationwide Permit No. 12 Threatened and Endangered Species Assessments. To make sure

the Project complies with the Federal Endangered Species Act, Engineer will review the

Nationwide Permit 12 (NWP 12) requirements and advise the design team of its impacts to

the anticipated construction schedule. The species to be assessed include those species

identified in the USACE notification (e.g. Piping Plovers, Least Terns, Bald Eagles, Whooping

Cranes, Pallid Sturgeon, and Northern Long-eared Bats).

5. Task 5 – Final Design Services

The purpose of final design is to develop CDs by which Garrison Diversion will select a Contractor

to build the desired facilities. Engineer will provide final design services and CDs for the screen

structure and tunnel as shown in the Basis of Design Memorandum dated November 16, 2018.

The CDs will be prepared for the purposes of obtaining competitive bids, selection of the lowest

and best bid, and construction of the Work. Intermediate deliverables will be prepared and

submitted to Garrison Diversion upon development of the 60-, 90-, and 99-percent design

completion stages. Final CDs will be prepared for bidding purposes. Engineer’s services under

the Final Design Phase will be considered complete on the date when the final design submittals

identified in Deliverables are provided.

A. Design Team Conference Calls. Engineer will schedule and lead conference calls with

Garrison Diversion and its team. Calls will be scheduled, and content organized to coincide

with other Task Orders for efficient utilization of staff time.

i. Owner Conference Calls (up to 12 calls assuming a 6-month design duration). Engineer

will conduct bi-weekly conference calls with Garrison Diversion to review overall

progress, exchange ideas and information, and coordinate activities.

ii. Task Order Coordination Calls (up to 12 calls). Engineer will have bi-weekly Project

conference calls with the technical team during the active design phase of the Project.

These calls will be conducted after Project initiation until delivery of the 90-percent

deliverables.

B. Permitting. This subtask encompasses applicable governmental approvals, including

McLean County and utility permits and approvals necessary to construct Contract 2.

i. Engineer will obtain in conjunction with the Garrison Diversion necessary approvals

from the appropriate utilities, city, county and state agencies having jurisdiction over

the Work.

ii. Engineer will incorporate into the project schedule action items, decision points,

milestones, reviews, and approvals required to complete permitting. Engineer will

communicate status of permits to Garrison Diversion.

iii. Contractor-Provided Permits. Engineer will provide in the CDs a list of the permits that

must be obtained by the Contractor. Based upon preliminary design, it is understood

that the following permits, at a minimum, will be the responsibility of the Contractor:

• Erosion and sediment control; land disturbance; stormwater permits

• Dewatering operations discharge

• Temporary boat dock

iv. Owner-Provided Permits

(a) Engineer will aid Garrison Diversion in obtaining the following permits from

government agencies, utilities, pipeline companies, and other entities as noted

below:

• Highway crossing permit(s)

• County road closing/detour(s)

• County road crossing

(b) Assistance provided by Engineer for the above listed permits will include:

(i) Preparation of applications, exhibits, drawings, and specifications ready for

the Owner’s execution and transmittal.

(ii) Furnishing additional information about the Task Order’s design, as

required, by the permitting authority.

C. Front-End Documents Review and Editing

i. Prepare and deliver draft front-end documents using standard documents of the

Engineers Joint Contract Document Committee (EJCDC) and Engineer’s standard

supplements, including general conditions and special conditions.

ii. Conduct a review conference call with Owner to discuss and receive comments on the

draft front-end documents.

iii. Revise front-end documents addressing Owner’s comments and incorporate

modifications, if any, into subsequent CD deliverables.

D. Geotechnical Reports

i. Geotechnical Data Reports Compilation. Two separate geotechnical investigations

have been undertaken, and reports written. One investigation was for the land-based

borings adjacent to the tunnel shaft in support of Contract 1. The second investigation

was for the marine and land-based borings in support of Contract 2. A GDR was

developed for each summarizing the information obtained from soil sampling and

laboratory testing. The work was completed by Materials Testing Services, LLC of

Minot, ND under subcontract with Engineer. Engineer will review these reports and

will update information for consistency and congruency with the geotechnical baseline

report (GBR) developed herein. The GDR from the second investigation in support of

Contract 2 will be included as a CD.

ii. Geotechnical Baseline Report Development. The GBR is a single source document that

includes contractual statements that will describe the geotechnical conditions

anticipated to be encountered during construction of the tunnel between the Wet

Well and the Screen Structure. The GBR establishes baselines that will be used as a

basis for the contractor’s bid as well as for use in resolving disagreements, disputes,

or claims relating to differing site conditions associated with tunnel construction.

Therefore, the GBR will also be included as a CD. The GBR will be prepared as

recommended by the American Society of Civil Engineers Underground Technology

Research Council’s Suggested Guidelines for Geotechnical Baseline Reports for

Construction. Engineer will complete the following under the development of the GBR:

(a) Prepare and deliver a draft GBR

(b) Conduct a review conference call with Owner to discuss and receive comments.

(c) Revise GBR addressing Owner’s comments and incorporate modifications, if any,

into subsequent CD deliverables.

E. Corrosion Protection System Evaluation. Engineer will formulate an approach and develop

in detail a corrosion protection system for the Project. Engineer will evaluate the data

coming from corrosivity testing completed and reported under Task Orders 2220 and 2230

with the latest field activities and resistivity testing undertaken in August 2020. From this

information, develop drawings and specifications for the corrosion protection system

incorporating them into the CDs. Drawings and specifications will be developed for 60-, 90-

and 99-percent, and Final deliverables. The 60-percent deliverable consists of the design of

essential components of the corrosion protection system. Final client comments will be

incorporated into the 99-percent and Final deliverable.

i. Prepare a draft and final corrosion protection system technical memorandum.

ii. Prepare and deliver the design of essential corrosion protection system components.

F. MRI Screen Structure. Missouri River geomorphology has changed since the original screen

structure concept was developed as part of the permit-level design. The permit-level design

was submitted to the USACE for coverage under the Nationwide Permit No. 12 and then

was used advanced as the preferred concept during preliminary design. Because of changes

to the river bed from sediment accumulation, it is be necessary to re-evaluate the location

and physical configuration of the screen structure.

i. Compare Historical Survey Information. Several bathymetric surveys of the proposed

MRI screen structure site have been undertaken over the past five years. Review

historical information and compare against bathymetric surveys completed in 2020 to

determine what changes have occurred, if any, and the magnitude of those changes.

ii. Evaluate Configuration and Location. Evaluate the current screen structure design

relative to the new information and determine if the preliminary design concept needs

to be adapted to new conditions. If so, develop design drawings showing the revised

configuration.

iii. Document Design Modification Recommendations. Summarize the data gathered

from bathymetric surveys and discuss the evaluation of the screen structure given the

current Missouri River geomorphology. Compose a technical memorandum (draft and

final) documenting the information gathered, evaluations completed, and change

recommendations, if any.

iv. Determine Impacts to In-Hand Permits. Should changes to the MRI screen structure

be proposed, determine through discussions with regulatory and permitting agencies

potential impacts to in-hand permits. If modifications are necessary, seek to

implement design refinements that would not necessitate a permit modification.

Conduct conference calls and meet up to two times with the USACE and the ND State

Water Commission to facilitate those discussions.

G. 60-percent CDs (Level 2 Design)

i. Level 2 design will commence upon receipt of an executed Task Order. The design will

be based upon the preliminary design set forth in the previously completed BDM. The

content of Level 2 deliverables is as follows:

• Most of the drawings

• Most of the technical specifications

• Draft GBR

i. Level 3 design will commence after Garrison Diversion has accepted Level 2

deliverables. The content of the Level 3 deliverables is as follows:

• Complete drawing review set

• Complete technical specification review version

• GBR review version

• Corrosion protection system technical memorandum review version

• Front-end documents review version

• Opinion of probable construction cost update

• Constructability review results

• Internal quality control review and refinement

• QA/QC plan and log update

• Task Order schedule update

ii. Provide specifications and drawings for Owner review.

iii. Host a conference call or meeting with Garrison Diversion to receive and discuss the

Owner’s review comments. Document comments received in a log and distribute to

meeting attendees.

iv. Revise documents according to mutual agreement reflecting decisions taken at this

level incorporating design modifications into subsequent deliverables.

i. Level 4a design will commence after Garrison Diversion has accepted Level 3

deliverables. The content of the Level 4a deliverables is as follows:

• Opinion of probable construction cost update

• Final GBR

• Final corrosion protection system technical memorandum

• Internal quality control review and refinement

iii. Host a conference call or meeting with Garrison Diversion to receive and discuss the

level incorporating design modifications into subsequent deliverables.

J. Final CDs (Level 4b)

i. Preparation of the Final CDs will commence after Garrison Diversion has accepted

Level 4a deliverables.

ii. Provide Garrison Diversion a record copy of Final CDs that are sealed, signed, and

dated by the Engineer of Record.

K. Opinions of Probable Construction Cost (aka Cost Opinions, Cost Estimates, or OPCC).

Engineer will update the cost opinion presented in the PDR at the various stages of final

design submitting updates for the Owners information and use as follows:

i. After transmittal of the 60-percent deliverable, update cost opinion commensurate

with an AACE Class 2 estimate. The expected accuracy will be -5 to -15 percent on the

low end and the expected accuracy on the high end will be from +5 to +20 percent.

ii. After transmittal of the 90-percent deliverable, update cost opinion commensurate

with an AACE Class 2 estimate with standard accuracy.

iii. After transmittal of the 99-percent deliverable, update cost opinion commensurate

with an AACE Class 1 estimate. The expected accuracy will be -3 to -10 percent on the

low end and the expected accuracy on the high end will be from +3 to +15 percent.

iv. After transmittal of final deliverable, update cost opinion commensurate with an AACE

Class 1 estimate with standard accuracy.

L. Quality Control Program. Engineer will provide QA/QC services necessary for execution of

the Task Order. QA/QC reviews will be provided for each deliverable furnished. Reviews

will be completed by Engineer’s or Engineer’s Subcontractor’s independent senior staff.

Engineer will log QA/QC reviews and maintain records of said reviews in its files. In addition,

Engineer will log comments received from Garrison Diversion and provide a log of

comments and Engineer responses for the following events:

• 60-percent CDs

• 90-percent CDs

• Draft front-end documents

• 99-percent CDs

6. Task Order 6 – Bidding Phase Services

The purpose of Bidding Phase Services task is to publicly advertise and receive competitive bids

from contractors to build the Project based upon the CDs developed during the Final Design

Phase. Engineer will also tabulate and evaluate bids received providing a recommendation of

award to Garrison Diversion. Bidding Phase Services will begin upon Garrison Diversion

notification to Engineer that it intends to proceed with public advertisement. Engineer’s services

under Bidding Phase Services will be considered complete upon Garrison Diversion’s execution

of a construction contract or its issuance of a notice to proceed to the contractor to begin

construction.

A. Advertisement and Bid Letting

i. Finalize Front-End Documents. Finalize front-end documents incorporating

information as it relates to the bid letting date, location, time, and other necessary

and relevant information.

ii. Invitation to Bid. Place the Invitation to Bid in Owner-selected publications. Identify

potential contractors and suppliers, review with the Owner, and distribute copies of

the Invitation to Bid electronically. Maintain a record of prospective bidders to whom

the invitation has been sent.

iii. Production of CDs. Produce digital copies of CDs, addenda, and geotechnical reports

for Owner’s use and distribution.

iv. Pre-bid Conference. Conduct, at a date and time selected and a place provided by the

Owner, a pre-bid conference to:

(a) Confirm the types of information required by the CDs and the format in which

bids must be presented.

(b) Review special Task Order requirements and CDs in general.

(c) Receive requests for interpretations for which responses will be issued to plan

holders via addendum.

(d) Prepare agenda for and minutes of pre-bid conference; issue to plan holders and

pre-bid conference attendees along with the pre-bid meeting sign-in sheet.

v. Interpretation of Bidding Documents. Interpret bidding documents; prepare and issue

up to two addenda to the CDs, as required. More addenda will be provided as

Additional Services.

vi. Update cost opinion and furnish Engineer’s Opinion of Probable Construction Cost

(OPCC) to Garrison Diversion for its use at the bid opening.

vii. Bid Opening. Conduct bid opening on behalf of Garrison Diversion after bids are

received. Make a preliminary tabulation of bids, and review questionnaires, as

applicable, and bids for completeness.

B. Pre-award Services to be Provided as Basic Services. The level of effort for pre-award

services involving a well-qualified bidder and suppliers will be of a limited nature with the

level of effort as stipulated in Attachment A – Engineering Fee Estimate Worksheet(s).

i. Questionnaire(s). Examine questionnaire(s) to identify any supplier whose equipment

or material may not conform to the CDs. This examination will be based on the

knowledge and experience of the Engineer.

ii. Qualifications of Apparent Successful Bidder. Review and evaluate the qualifications

of the apparent successful bidder and the proposed major or specialty subcontractors.

The review and evaluation will include financial resources, and a check of up to five

references from completed projects similar in size and character.

iii. Bid Tabulation and Recommendation of Award. Prepare and distribute formal bid

tabulation sheets, evaluate bids, and make a written recommendation to Garrison

Diversion concerning contract award.

iv. Services include a review of the Contractor’s bonds and forwarding to Garrison

Diversion for approval; furnishing the Contractor unsigned CDs; and transmitting the

CDs to Garrison Diversion for signature and distribution. Engineer’s review is only for

the purpose of determining if the Contractor provided the required bonds; it is not a

legal review to determine if Contractor is compliant with CDs requirements.

VII. ADDITIONAL SERVICES

1. The professional services listed below are not included in the scope of this Task Order nor does

the fee shown in Article IX include any labor and direct expenses for items identified as

Additional Services. Should Owner want to include services listed under Additional Services in

Engineer’s scope of work, an amendment to this Task Order or execution of a separate Task

Order with a definition of the new work and associated fee provided. The following items are

specifically excluded from Basic and Special Services:

A. Extensive evaluations of bidders qualifications, experience, financial condition, bonding,

insurance, etc. or evaluations of multiple bidders qualifications, experience, etc.

B. Support provided to Garrison Diversion in the event of a contested bid or a bid protest.

C. Standard engineering services during construction, including those professional services

provided by a Resident Project Representative (RPR).

VIII. SPECIAL RESPONSIBILITIES OF OWNER

1. Interim Deliverable Review Requirements. Owner commits to review periods for interim

deliverable of not more than 30 calendar days after receipt of deliverables from Engineer. A

review meeting will be scheduled and conducted by Engineer no more 14 calendar days after

receipt of Owner review comments, unless a mutually agreed upon date outside this schedule

window is selected.

2. Permit Application Fees. Owner agrees to pay directly to the permitting organization all

necessary fees to secure applicable permits, except those permits required to be obtained by

the Contractor.

3. Land Acquisition Costs. Fees paid to all property owners necessary to purchase property,

easements, or ROEs are the responsibility of the Owner.

4. Recording Fees. Fees payable to McLean County for recording easements and land acquisition.

5. Project Advertisement Fees. Once the design is complete, the Project will be advertised publicly

in order to obtain bids from contractors. An Invitation to Bid will be published in periodicals with

the fees for said advertisements paid directly by the Owner.

6. Notice of Intent to Publicly Advertise Project. Garrison Diversion will notify Engineer of its intent

to proceed with a public advertisement of the Project. Engineer with proceed with Bid Phase

Services only upon receipt of said notification.

IX. FEE

The total fee for Basic Services provided under this Task Order is One Million Eight Hundred Eighty-

Four Thousand Dollars ($1,884,000). A worksheet showing the fee estimate and level of effort by task

is included in Attachment A.

X. PERFORMANCE SCHEDULE

Basic and Special Services of this Task Order will be completed by June 30, 2021 provided Engineer is

given a Notice to Proceed or a fully executed Task Order prior to October 31, 2020.
