1 ABOUT FERNWOOD BUSINESS COLLEGE Fernwood Business College (Pty) Limited, Company Registration No. 2006/033114/07, is provisionally registered as a private Further Education and Training College with the Department of Higher Education and Training until 31 December 2015, Registration No. 2009/FE07/102. FBC has ensured that all learning programmes offered are accredited by the relevant Education and Training Quality Assurance Councils and/or Bodies (ETQA’s). 2.2 List of Definitions and Terms

FBC has developed a List of Definitions and Terms to ensure common understanding for all parties involved in the learning contract. Such definitions and terms are indicated in all College correspondence as being in initial capitals. It is important to note that, since such a List is a living document, it is continually updated and reviewed.

Short Learning Programme

A short learning programme describes all short programmes, whether credits are awarded or not and is inclusive of skills programmes, credit-bearing short courses and no-credit-bearing short courses.

Learning Programme Learning programme means the sequential learning activities, associated with curriculum implementation, leading to the achievement of a particular qualification or part qualification.

Programme Programme means a coherent set of courses, leading to a certain qualification.

Accreditation Means the certification, usually for a particular period of time, of a person, a body or an institution as having the capacity to fulfil a particular function within the broader quality assurance system as organised by the NQF Act 67 of 2008.

Open Learning Is an approach which combines the principles of learner centeredness, lifelong learning, flexibility of learning provision, the removal of barriers to access learning, the recognition for credit of prior learning experience, the provision of learner support, the construction of learning programmes in the expectation that learners can succeed, and the maintenance of rigorous quality assurance over the design of learning materials and support systems.

Distance Learning There are many synonyms used for Distance Learning, such as Distance Education or Distributed Learning. For institutional purposes, Distance Learning can be defined by the following criteria: The facilitator/tutor and learners/students are separated by distance (this distance implies different locations such as hundreds of kilometres apart. The instruction (teaching) is delivered via print, voice, video, or computer technologies. The communication is interactive in that the learner receives support and feedback from the tutor which may be immediate or delayed.

Distance Learning (Synchronous)

Synchronous means that the tutor and the learner interact with each other in ‘real time’. For example, with two-way videoconferences, learners interact via ‘live’ video feed from a tutor. Less complex technologies, such as telephone or online ‘chat room’ conversations, are also synchronous.

Distance Learning (Asynchronous)

Asynchronous delivery does not take place simultaneously. In this case, the tutor may deliver the instruction (teaching) via video, computer, or other means, and the learners respond at a later time. For example, instruction may be delivered via printed matter or CDs and the feedback could be sent via e-mail messages or traditional methods of correspondence.

E-Learning Means flexible learning using ICT resources, tools and applications, and focusing on interaction among tutors, learners, and the online environment and on collaborative learning. E-learning usually refers to structured and managed learning experiences, and may involve the use of Internet, CDs, software, other media and telecommunications.

Terms of Reference in respect of the Committee Structure are as follows:

• The function of the Academic Board enables and ensures active engagement with the day-to-day running of the academic aspects of Fernwood Business College. The Academic Board will report to and take input and advice from EXCO, from time to time, on the academic function and delivery of a high quality product to students.

• The function of the Appeals Committee (a sub-committee of the Academic Board) is to meet, as and when required, to discuss appeals-related issues pertaining to Fernwood Business College. As an agent of the Academic Board, the Committee and its members are mandated to deal with all appeals lodged, as well as all operational or business-related appeals which may arise.

• The function of the Examination Committee (a sub-committee of the Academic Board) is to ensure that assessment-related issues pertaining to the academic programmes at Fernwood Business College are discussed. As an agent of the Academic Board, the Committee and its members will deal with the setting of all assessments and moderation at exit point, as well as evaluation and analysis of assessment data and the recommendation of changes based upon assessment results and findings.

• The function of the Grievance and Disciplinary Committee (a sub-committee of the Academic Board) is to meet, as and when required, to discuss grievance- and disciplinary-related issues pertaining to Fernwood Business College. As an agent of the Academic Board, the Committee and its members are mandated to deal with all grievances lodged, as well as all operational or business-related disciplinary issues which may arise.

• The function of the Library Committee (a sub-committee of the Academic Board) is to ensure that library-related issues pertaining to the academic programmes at Fernwood Business College are discussed. As an agent of the Academic Board, the Committee and its members will deal with the library, books and processes, and external relationships (as well as the management thereof) within FBC.

• The function of the Programme Committee (a sub-committee of the Academic Board) is to ensure that programme-related issues pertaining to the academic programmes at Fernwood Business College are discussed. A report from the Examination Committee, Library Committee and Student Representative Council will inform the Programme Committee’s Agenda. The Programme Committee will report to the Academic Board quarterly of proposed and approved changes to programmes for sign off. As an agent of the Academic Board, the Committee and its members will deal with all programme planning issues relating to curriculum, development, evaluation, and design and quality assurance thereof.

• The function of the Quality Committee (a sub-committee of the Academic Board) is to ensure that quality-related issues pertaining to the academic programmes at Fernwood Business College are discussed. The Committee will report to the Academic Board quarterly on important issues raised and present policies which may have changed for approval and sign off. As an agent of the Academic Board, the Committee and its members will deal with day-to-day academic issues relating to planning, implementation, monitoring and reflection.

• The function of the Recognition of Prior Learning (RPL) Committee (a sub-committee of the Academic Board) is to meet, as and when required, to discuss recognition of prior learning cases and related issues in respect of all academic programmes offered by Fernwood Business College. As an agent of the Academic Board, the Committee and its members are mandated to ensure that there are effective mechanisms and procedures in place to deal with RPL fairly and effectively and for assessing current competence.

• The function of the Student Representative Council (SRC) (a sub-committee of the Academic Board) is to discuss any student-related issues pertaining to academic programmes at Fernwood Business College. As an agent of the Academic Board, the SRC and its members are mandated to ensure that there are effective mechanisms and procedures in place to deal with any student issues which may arise relating to the academic programmes, academic support and such other issues as fund raising and community engagement initiatives.

2.4 Enrolment Criteria, Documentation and Procedure Students who wish to enrol at FBC should adhere to the following enrolment criteria and have the relevant documentation on hand.

A student: • Must be 16 to 18 years or older, depending on which qualification is selected • Must hold a copy of the relevant certificate (as per the entry level requirements), where appropriate, as a

minimum qualification • Must have a copy of a valid South African ID or passport • Should complete the telephonic registration procedure with a Call Centre Agent (which is recorded) or complete

the Application Form in full and sign on each page

A guardian, should the student be under 18 years of age:

• Must be 18 years or older • Must have a copy of a valid South African ID or passport • Should complete the telephonic registration procedure with a Call Centre Agent (which is recorded) or complete

the Application Form in full and sign on each page

Students will receive confirmation of their enrolment with the College via SMS. Thereafter, they are obliged to forward the following documentation to the Institute or College itself, depending on which qualification is selected:

• For any qualifications registered with the Institute of Business Students (IBS), not only must the student meet the specific programme’s enrolment criteria, but also forward the following documentation directly to the IBS: → Copy of ID document → Copy of highest qualification → Completed and signed IBS Examination Enrolment Form → Proof of payment to the IBS of assessment fees

• For any qualifications registered with the Institute of Certified Bookkeepers (ICB), not only must the student meet the specific programme’s enrolment criteria, but also forward the following documentation directly to the ICB: → Copy of ID Document → Copy of highest qualification → Completed and signed Membership Registration Form → Completed and signed Assessment Entry Form → Proof of payment to the ICB of membership and assessment fees

• For any qualifications registered with Fernwood Business College (FBC), not only must the student meet the specific programme’s enrolment criteria, but also forward the following documentation directly to FBC: → Copy of ID document → Copy of highest qualification

Please note: Study material will be dispatched within 10 working days from receipt of first payment made to FBC (either via cash deposit or bank debit order). Should students wish to query the status of their enrolment, they should contact FBC either on [email protected] or 086 188 771.

2.5 Approved Sites of Delivery As a private Further Education and Training provider, the Department of Higher Education and Training has approved Fernwood Business College, in terms of Regulation 12 (5), for the following sites of delivery:

2.6 Mode of Instruction FBC is flexible with regards to the mode of study offered to learners. Qualifications are offered through mixed modes of delivery, including contact, distance learning and multi-mode options. Given the pervasiveness of technology, we are continuously exploring innovative ways of leveraging technology in support of student learning. Please refer to each qualification’s mode of instruction.

2.7 Language of Tuition The rationale for the use of English in all communication with FBC is based on:

• The language policy of FBC is informed by national and provincial policy guidelines, and the needs of employers represented within the public and private sectors and civil society. Such employers and other representatives mostly navigate the multicultural and multilingual reality of South Africa, and of its most important trade and diplomatic partner countries in southern Africa, EU and China, with the use of English as the medium of communication.

• FBC approves the use of English as the medium of instruction and communication at the institution, due to the language's local, regional and international operability, and the strong presence of English in commerce and trade.

• However, the institution is mindful not to discriminate against any student with reference to the requirements for second language academic credits, where an occupational learning programme on NQF Levels 2, 3 and 4 stipulates this as a requirement in its curriculum for fundamental credits. In this regard, it is the right of a student to be assessed in his/her own home language. However, as an educational institution, FBC can only accommodate the Afrikaans language for these purposes. Should a student wish to be assessed in any of the other official languages for second language academic credits, the cost for assessment, including but not limited to the costs of interpreters, translators, typists, proofreaders, assessors and moderators, is for the student’s account.

2.8 Formative and Summative Assessments Students, who register for professional qualifications endorsed by the Institute of Certified Bookkeepers (ICB), will receive their formative assessments or Portfolio’s of Evidence (POEs) directly from the ICB, subject to successful registration for examination; students registered with the Institute of Business Studies or Fernwood Business College (for the Further Education and Training Certificates) will receive their assignments or Portfolio’s of Evidence (POEs) directly from Fernwood Business College. Students are provided with examination (summative assessment) dates and venues upon enrolment, as determined by the Institute of Business Studies or Institute of Certified Bookkeepers. Examination centres are available throughout the major centres in South Africa to ensure that students have the opportunity to write examinations at venues that are easily accessible. For the Further Education and Training Certificates (FETCs), FBC will advise students timeously of the examination (summative assessment) dates and venues, giving due consideration to venues that are easily accessible by students. Invigilators are properly mandated and monitored to ensure that examinations are completed according to assessment principles. With the relative easy access to resources on the Internet and the World-Wide Web (WWW), plagiarism has become a real threat to academic integrity. Acts of illegal copying, abuse of intellectual property or any other form of plagiarism are expressly forbidden and learners will incur hefty penalties for committing such offences. 3 THE LEARNING CONTRACT 3.1 Terms and Conditions

The following is an extract, taken from the FBC telesales script, which refers to the terms and conditions of the Learning Contract:

6. During special months when most people get paid on a different date than normal, as for example over Christmas, or where a deduction fails due to insufficient funds in your account, it is your responsibility to inform us of a new deduction date. Where you don’t inform us and in an attempt to avoid your account going into arrears we will then be allowed to implement early deductions from the 5th of such a month.

7. Should your pay date fall on a Saturday, Sunday or public holiday, we will adjust your Pay Day s to deduct your instalment on the last business day before your Pay Day.

8. Do you - give us permission to deduct your instalment of (state the amount e.g. R385 per month) on or after (e.g. 8th Sept if client wants to make an early payment) and monthly/weekly thereafter, subject to the points explained to you, on or after the (e.g. 27th Sept) thereafter?

9. Should you default on any instalments this agreement will fall under the National Credit Act and we may charge interest.

10. Delivery of the study material will be to the agreed delivery address after receipt of the first instalment. All legal communication will be to the account payer’s address.

11. Please note that the service included in the package will only be available if your payments are up to date.

12. Should you wish to cancel following the conclusion of this call, you may do so, however you will be liable to pay R900 towards admin costs in servicing your request to purchase this product.

13. All cancellation requests can be made by contacting the Fernwood Business College Customer Services number who will advise you accordingly.

14. Once you have the materials, you have up to 5 business days to cancel but will still be liable for the R900 cancellation fee.

15. After this you must give 20 business days’ notice of cancellation; however you will be liable for the full cost of the study materials.

16. You, as the account payer may not transfer to, or substitute with, anyone else, your rights or obligations to this agreement.

4 FURTHER EDUCATION AND TRAINING CERTIFICATES OFFERED BY FERNWOOD BUSINESS COLLEGE

4.1 FETC: Long Term Insurance NQF Levels 4 [SAQA ID: 49649]: FAIS Programme Fernwood Business College’s FAIS Programme meets all three requirements. Amendments to the “Fit and Proper Requirements” of the Financial Advisory and Intermediary Services Act, 2002 (Act 37 of 2002) came into effect on 31 December 2008. In addition to the requirements of honesty, integrity and operational ability, the competency requirement has been expanded. These changes have far-reaching implications as Financial Service Providers, key individuals and representatives who have been appointed, authorised or approved on minimum qualifications will be compelled to improve on their qualifications.

Key individuals and representatives are now required: • Have at least one year’s experience in managing or overseeing a company’s financial services; • Have a qualification that is recognised by the Registrar as appropriate for the category or sub -category for

which the individual is approved. Deadlines for completion of the required qualifications are specified as follows; and → The 2008 deadline to obtain 30 or 60 credits was extended to 31 December 2009, provided that

individuals were registered with the FSB between January 2004 and January 2007; → If individuals were registered with the FSB during 2008, they have until 31 December 2011 to complete

the required 30 or 60 credits, or they can elect to complete the full qualification by 31 December 2013. • Individuals appointed during 2009 are required to complete the full qualification; • Write regulatory examinations; and

→ First Level Regulatory Examinations (core examinations) must be written by 31 December 2011 if individuals were registered with the FSB between January 2004 and December 2008

→ Second Level Regulatory Examinations (product specific) must be completed by 31 December 2013 → Undergo continuous professional development of between 15 to 60 hours over a three year cycle

Where key individuals and representatives do not meet these requirements: • Their categories will be adjusted to that which they are accredited to sell • They will be removed from the representative register and not be able to provide advice regarding long-term

insurance • Failure to comply will result in their debarment

Entry Requirements In order to enter the FAIS Programme of the FETC: Long Term Insurance, students must possess an NQF Level 3 or higher.

Content of the Programme The curriculum has been developed to include workplace (individual and group) activities, workplace assignments and a final summative assessment. The FAIS Programme has been structured to include the following Unit Standards:

Duration of the Programme The Unit Standards making up the FAIS Programme comprises of 31 credits. Each credit equates to 10 hours of learning or notional hours; the total duration of the Programme is, therefore, 310 hours. FBC suggests the following breakdown of these 310 notional hours:

• 88 hours Formal training, including classroom activities • 164 hours Learning in the workplace • 55 hours Completing workplace assessment • 3 hours Completing the final summative assessment

Purpose of the Qualification Upon completion of this qualification, students will have:

• Enhanced their knowledge; and • Completed a skills programme that supports their chosen career path.

Please note: The 31 credits that make up the FAIS Programme will count towards the nationally recognised qualification, the Further Education and Training (FET) Certificate in Long Term Insurance, which is registered at NQF Level 4. 4.2 FETC: Human Resources Management and Practice Support

NQF Levels 4 [SAQA ID: 67463] The Further Education and Training Certificate (FETC): Human Resources Management and Practices Support (NQF Level 4) is aimed at people who support and participate in human resources management and practices. It serves as the initial building block of a learning and career path in the human resources management and practices field.

Entry Requirements To enrol for the FETC: Human Resources Management and Practices Support, students must hold an NQF Level 3 qualification or higher.

Entry Requirements To enrol for the FETC: Marketing, students must hold an NQF Level 3 qualification or higher.

4.4 FETC: Debt Recovery

NQF Levels 4 [SAQA ID: 49021] The Qualification in Debt Recovery is aimed at students who are employed or want to prepare themselves for employment in the debt recovery industry. The debt recovery industry consists of independent debt collection agencies that collect debt on behalf of other parties, as well as the debt collection departments of organisations that sell products and services on credit.

Entry Requirements In order to start the qualification in Debt Recovery, students must possess an NQF Level 3 or higher.

Duration of the Programme The duration is usually 9 months to a year. It is however possible to do it in a shorter space of time, this will wholly be dependent on how quickly the student completes his or hers Formative and Summative assessments and submits his or hers Portfolio of Evidence (PoE).

Purpose of the FETC: Debt Recovery Upon completion of this qualification, students will have attained a Further Education and Training Certificate in Debt Recovery. With the changes looming in the legislative arena, this will assist students to be compliant for registration as Debt Recovery Agents with the Council of Debt Collectors.
