of the Live-stock Importation Act, 1898 (9 of 1898), and in supersession of the Pet Food Products of

Animal Origin (Import into India) Order,2005, of the Government of India in the Ministry of Agriculture

(Department of Animal Husbandry and Dairying) vide S.O. number 1842(E) dated 29`h December

2005, except as respects things done or omitted to"be done btfare such supersession, the Central

Government hereby issues the following Order, namely:-

1. Short title and commencement .- (1) This Order may be called the Pet Food Products ofAnimal Origin (Import into India) Order, 2008.

(2) It shall come into force on the date of its publication in the Official Gazette.

2. Definitions . - In this Order, unless the context otherwise requires,-

(a) "consignment" means any quantity of pet food products of animal origin consignedfrom one party to another at one time shipment and covered by a Sanitary Import Certificate,bill of entry of custom or shipping or airways bill or invoice;

(b) "Designated Competent Authority" means the Joint Secretary (Trade), Government ofIndia, Department of Animal Husbandry, Dairying and Fisheries, Ministry of Agriculture orany other officer not below the rank of Director specified by the Central Government in thatbehalf in the Department of Animal Husbandry, Dairying and Fisheries in Ministry ofAgriculture;

(c) "Form" means a form appended to this Order;

(d) "import" means an act of bringing into a designated place in the territory of India anykind of pet food product;

(e) "Import Risk Analysis" means the process of evaluating biological or other scientificand economic evidence to determine for regulating the import of the Dried Processed PetFood and the sanitary and phyto-sanitary measures to be taken against it;

(f) "Inspection Authority" means the In-charge of animal quarantine certification centreat Delhi, Mumbai, Kolkata or Chennai or any other officer specified by the Government bynotification in the Official Gazette;

(g) "pet food product of animal origin" means Dried Processed pet food containing theingredients of meat and meat products from avian species, pig and product of animal originintended for use in animal feeding or other kinds of edible ingredient from animal originfrom nutritional point of view used for feeding the dog or cat and covered under the ITC-HSCode 2309.10.00 relating to dog or cat food put up for retail sale;

(h) "port of entry" means any sea port, airport or land border check post or any other portas specified by the Central Government by notification in the Official Gazette, from time totime;

(i) "Risk Analysis Committee" means the committee of experts functioning under thechairmanship of the Animal Husbandry Commissioner of the Department of AnimalHusbandry, Dairying and Fisheries in the Ministry of Agriculture;

(j) "sanitary conditions" means the conditions laid down by the Risk Analysis Committeeafter conducting the risk analysis for the specified product;

(k) "Sanitary Import Permit" means an official document authorizing importation of aconsignment in accordance with specified sanitary requirements;

(1) "Schedule" means a schedule appended to this Order.

3. General conditions for Import pet food product of animal origin .- Any pet foodproduct of animal origin shall be permitted by the Central Government to be imported into Indiasubject to the following conditions, namely:-

(i) No consignment of pet food product of animal origin shall be imported into India withouta valid sanitary import permit issued under sub-clause (iv).

(ii) All applications for grant of permit to import consignments of pet food product of animalorigin by land, air or sea shall be sent in five copies in Form A or Form B, whichever is relevant,at least one month in advance to the Designated Competent Authority and the application for theimport of each item shall be made separately in Form A or B, as the case may be, in the mannerlaid down in this Order.

(iii) The sanitary import permit shall be issued for import of pet food product of animalorigin if, after a detailed import risk analysis, the concerned authorities are satisfied that the

import of the consignment shall not adversely affect the health of the animal or human beings orboth in India.

(iv) The import of the products shall be allowed against a Sanitary Import Permit to be issuedby the Department of Animal Husbandry, Dairying and Fisheries subject to the Animal HealthConditions as specified in Schedule I on the basis of Import Risk Analysis.

(v) The issue of permit may be refused or withheld by the issuing authority after giving areasonable notice to the applicant to represent against and for reasons to be recorded in writing.

(vi) The import permit shall lay down the specific Animal Health Conditions as specified inSchedule Ito be fulfilled on the basis of import permit.

(vii) The import of the pet food product of animal origin shall be prohibited from thecountries as specified in Schedule II.

(viii) The permit shall also specify the pre and post-shipment /import requirements withregard to quarantine inspections, sampling and testing.

(ix) The import permit issued under this clause shall be valid for a period of six months only.

(x) The import permit shall not be transferable except with the leave of the CentralGovernment.

(xi) No import permit so granted under sub clause(ix) shall be amended or varied unless thecompetent authority so permits for the reasons to be recorded in writing and subject to theapproval of the competent authority .

(xii) Pet food product of animal origin shall be imported into India through the land, seaportsor airports located at Delhi, Mumbai, Kolkata or Chennai or any other place as may be specifiedby the Central Government, by notification in the Official Gazette.

( xiii) The facility of manufacturer may be open for inspection by the veterinary authorities ofGovt. of India at any point of time.

(xiv) The facility of the manufacturer should be accredited by the Govt. of the exportingcountry.

4. Pre-Shipment (Import) Requirement:-

(i) All consignments must be accompanied by the following documents :

(a) A Valid copy of the Sanitary Import Permit(SIP) issued by Government of India.(b) Animal health certificate in original issued by the official veterinarian of the exporting

country, as specified in the Schedule -I of this Order.

(ii) A declaration from the manufacturer pasting the same on each contained with

following detail :

(a) a certificate to the effect that he has ensured traceability of the farms from

which source meat originated; and(b) with a certificate bearing the batch no. of the product to which the

declaration applies which is written in indelible ink .

5. Post -shipment (Import ) Requirements:

i. On arri 'vai at the entry point, the consignment of pet food product of animal origin shau

be inspected by the Officer-in-charge of the Animal Quarantine and Certification ServicesStation or any other veterinary officer duly authorized by the Government of India in theDepartment of Animal Husbandry, Dairying and Fisheries, wherever required, in accordancewith the specific conditions laid down in the sanitary import permit and the general guidelines

issued by that Department from time to time

2. . On arrival, the samples will be drawn for testing for risk analysis pertaining to

diseases/pesticides etc. while allowing the consignment.

3. On import into India, the random samples will be taken from the pet food and sent to HighSecurity Animal Disease Laboratory (HSADL), Bhopal for testing against Avian influenza. In case ofpositive findings, the Department of Animal Husbandry , Dairying and Fisheries, Government of India

shall take appropriate action at the cost of importing agency.

4 Undertaking / or Declaration from the importer :

(a) The labeling of the products should be done in local/or regional language.(b) The label should clearly indicate that at no point of time, the imported product shall find

way to animal food chain other than the dogs and cats.

5. After inspection and testing, wherever required, the concerned Quarantine or veterinaryauthority shall accord quarantine clearance for the entry of the pet food product of animal origininto India or, if required in public interest, order its destruction or its return to the country of

origin.

6. Wherever disinfection or any other treatment is considered necessary in respect of petfood product of animal origin, the importer shall, on his own or at his cost through an agencyapproved by the Government of India in the Department of Animal Husbandry, Dairying andFisheries, arrange for disinfection or other treatment of the consignment, under the supervisionof a duly authorized quarantine or veterinary officer.

6. Responsibilities of importer . - It shall be the responsibility of the importer -

(i). to bring the pet food product to the concerned Animal Quarantine andCertification Services Station, or to the place of inspection, disinfection ortreatment or testing as directed by the Quarantine or veterinary officer duly authorized on

this behalf;

(ii) to open, repack and load into or unload from the Animal Quarantine Station and sealthe consignment; and

(iii) to remove the consignment after inspection and treatment or testing, as the case maybe, in accordance with the directions of the Quarantine or veterinary officer duly authorized bythe Government of India in the Department of Animal Husbandry, Dairying and Fisheries.

7. Power of Central Government to relax conditions .- The Central Government may, inpublic interest, and for reasons to be recorded in writing relax any of the conditions specified inthis Order relating to all or any permit granted in relation to the import of pet food product ofanimal origin into India.

N .B.(a). a separate certificate must be provided for each consignment of pet foods transported in the sameaircraft , railway wagon , lorry or ship and consigned to the same destination.(b). The original of the certificate must accompany the consignment until it reaches the borderinspection post.

(c). It must be completed prior to loading and all time limits referred to relate to will relate to the dateof certification.

(d). The consignment will not be permitted entry into the India in the event of a consignment arrivingin the country either in an unsealed container or in a container the seal of which has been broken orwith evidence of contamination en rout with risk material or with inadequate certification.

M. ANIMAL HEALTH CONDITIONS :

1. The undersigned official veterinarian certify, that the pet food described above:

(I) originates from the meat/meat products of healthy animals.(II) originates from the meat/meat products of animals which have undergone for

ante-mortem and post-mortem examinations.(III) Originates from the birds/ pigs from an establishment which is outside 25 kms

radius of any Avian Influenza(AI) infected area*

*(not required if the country is free from Al or product does not contain poultry or pigorigin ingredients).

(IV) Is the one in which no ingredients of ruminant origin has been incorporated (in the petfood product of animal origin), except for the following, namely:

(a). the milk / milk products

(b). protein free tallow of ovine or caprine origin; and

(c). If ovine or caprine materials or ingredients imported from the countries free from TSE group ofdiseases have been incorporated in the pet food. The following information shall have to be provided:

i). Details of ingredients;

ii). Certificate Number

iii). Country of origin

iv). Name of Animal Health Authority issuing Certificate for the ingredients; and(v). Date of endorsement of the Certificate.

(d) The certified materials or the animal origin components of the product have been processed in amanner to have attained a core temperature not less than 70° C for 30 minutes.

Has been processed through an alternative method offering equivalent guarantees withregards to microbiological safety approved by Department of Animal Husbandry, Dairying andFisheries ( DADF), Government of India.

(V) was examined by a random sampling of at least five samples from each processed batch takenduring or after storage at the processing plant, that complies with the following standards -:

n not more than 5.103 aerobic and facultative anaerobic micro-organisms in I(ml)

n no Salmonella in 25 g (ml )

-activity of water in dehydrated products must not be higher than 0,93.

VI) was not produced from:

Animals kept for agricultural production , which died but were not slaughtered , including stillbornand unborn animals, and, without prejudice to instances of emergency slaughtering for reasons ofwelfare , farm animals that have died in transit,

animals which were killed in the context of disease control measures either on the farm or in anyother place designated by the competent authority,

animal waste including blood originating from animals which showed , during veterinaryinspection carried out at the time of slaughtering , clinical signs of disease communicable to manor other animals,

those parts of animals slaughtered in the normal way which were not presented for post morteminspection, with the exception of hides, skins , hooves, feathers , wool, horn, blood and similarproducts,

meat, poultry meat, fish, game and foodstuffs of animal origin which were spoiled

animal waste containing residues of substance which posed a danger to human or animal health,milk, meat or products of animal origin rendered unfit for human consumption by the presence ofsuch residues,

fish or offal from fish which was excluded from human consumption because of clinical signs ofan infectious disease,

processed animal protein derived from high risk material;

VII) has undergone all precautions to avoid recontamination with pathogenic agents after treatmentand /or processing;

VIII) was packed in new packaging material:

IX) The processing / manufacturing plant of pet food is located outside 25 km radius of any AvianInfluenza infected area (not required if country is free from Avian Influenza).
