The Auction – A Buying GuideWe have outlined below all the information you will need tounderstand how to buy at auction. If you have any questions weare here to help. Email addresses and telephone numbers areprovided in this catalogue, or if you are at the sale please ask amember of staff.

The BasicsViewingOur viewing times are shown at the front of the catalogue.Cataloguers are on hand to help with enquiries about the sale andspecific lots. Most items are openly displayed in the saleroom;others are stored in secure cabinets. We ask that you take carewhen viewing the sale. If you need assistance to view large or heavyobjects please ask a porter to help. Please note when handling anyitem at the view or at the sale you do so at your own risk.

The CatalogueAll lots carry a description and pre-sale estimate of price.Estimates suggest the price that the lot may reach. Vendors’reserves may be set, they are confidential, but they will not exceedthe bottom estimate figure. Estimates do not include the buyers’premium. Lots may carry abbreviations, e.g. S/D (some damage)or A/F (as found, considerable damage). We make every effort tonote damage and restoration; the absence of any such note doesnot imply the lot is without defect. All customers should satisfythemselves of both conditions and descriptions. Any weights andmeasurements given are approximate. Any amendments to thecatalogue are shown in Saleroom notices which are postedaround the viewing/auction rooms. For further information oncataloguing terms used in the paintings and prints section pleasesee our terms and conditions of business.

Saleroom facilitiesThe saleroom has a café open on the Thursday and Friday prior tothe sale and on the day of the sale.

RegistrationAnyone wishing to bid should register at the sales office and willreceive a bidding or paddle number before the start of the sale.The number should be shown when bidding and paying andshould be returned to the cash office at the end of the day. Atpresent registration is carried out on the day of the sale only.

Auctioning the lotsThe speed of the auction will vary between auctioneers. Typicallywe will cover approximately 140-150 lots per hour. Bidding stopsafter the fall of the hammer and the auctioneer’s decision is final.

Bidding at the saleBidders should use the paddles they have been assigned for theday and will need to show them clearly to the auctioneer whenbidding. Invoices will only be raised to the name assigned to thepaddle. We cannot transfer lots to other names or numbers afterthe fall of the hammer.

Absentee or commission biddingIf you are unable to attend the sale but wish to bid on a lot, we cando this on your behalf. You will need to fill in a commission bidform; one is included in this catalogue. You should complete thecontact details, list the lot and the maximum price you wish to pay,excluding the buyer’s premium. The form should then be submittedto our offices or a member of staff. The bid will be carried out by usand is entirely confidential. All bids are executed at as low a priceas is permitted by other bids left and/or reserves set. Bids may besubmitted by telephone or email, [email protected],and must be received before 9am on the day of the sale.Successful buyers will receive an invoice after the sale; paymentand collection details will be enclosed. Please note, this service isoffered as a convenience. We take every care in carrying out bidsleft with us, however we cannot be held responsible for errorsmade or failure to execute bids, therefore commission bids are leftat the bidder’s risk. Neither requests to “buy” nor rolling bids can beaccepted. (Before leaving bids please see “conditions of absenteebidding” on the enclosed bid form).

Telephone biddingWe can offer a limited number of telephone bidding lines on saleday enabling absentee bidders to bid “live”. This facility is onlyavailable on lots which carry a bottom estimate of £400 or more.Requests for telephone bids must be made by close of businessthe day before the sale and are allocated on a first come firstserved basis.

PaymentPayment can be made during or immediately after the sale. Thesuccessful buyer should take the bidding number to the cashoffice for processing. Payment can be made by cash, debit card,credit card or bank transfer (please ask for details). Payments over£500 are not taken over the phone and invoices must be paid inperson or by bank transfer (please quote the buyer reference givenon your invoice). Please note that credit card payments carry a surcharge of 2.5%on the total invoice. In accordance with financial regulations we donot accept single cash payments over £9,999.Once payment has cleared, goods may be collected. Small itemsmay be collected during the sale at the discretion of the porters,furniture may be removed at the end of the sale. Accounts staff areavailable to answer any enquiries regarding payment prior to andat the sale. Sold items not collected or paid for within seven daysof the sale will incur storage charges of £2 per day per invoice.

Package and shippingWe offer a limited packing service within the U.K. only and at theauctioneer’s discretion. For information please contact us. Allliabilities are with the buyer. Fieldings Auctioneers LimitedTerms and Conditions of BusinessThe Company provides the services of auctioneers subjectto these Conditions (which can only be varied in writingwhere signed by a director of the Company).

Buyers1. These conditions, together with any additionalconditions appearing in the catalogue, are the terms andconditions subject to which Fieldings Auctioneers Ltd. (TheAuctioneers) as agents for the vendor shall sell goods tothe purchaser (The Bidder) and all other conditions,whether express, or implied at common law, or by statute,as are capable of lawful exclusion are hereby excluded. Byparticipating in this sale all vendors and purchasers agreeto be bound by these conditions and are deemed to haveread and have full knowledge of them.2. The highest bidder shall be the buyer at the hammerprice except in the case of a dispute. If during the auctionthe auctioneer considers that a dispute has arisen, he hasabsolute discretion to settle it or to re-offer the lot.3. The Auctioneers have the right to divide any lot, tocombine any two or more lots together or to withdraw anylot or lots from sale, regulate the bidding, refuse bids orcancel the sale without giving any notice or reasonwhatsoever.4. The Auctioneers have the right at their discretion torefuse entry to their premises or attendance at theirauctions of any person.5. Whilst The Auctioneers make every effort to ensurethe accuracy of their catalogue and description of any lotthey do not accept responsibility regarding authenticity,attribution, genuineness, origin, authorship, date, age,period, condition or quality of any lot. All goods are soldwith faults and imperfections and errors of description. Ifthey have been instructed in writing by the vendor to certifya lot. The Auctioneers do so as agents of the vendor andare not themselves responsible for such claims. Allstatements whether printed in the catalogue or made orallyare statements of opinion and are not to be taken as beingor implying any warranties or representations of fact. AllBidders should rely on their own judgment as to mattersaffecting any lot.6. The Auctioneer shall only accept bids from thepurchasers who have, to the auctioneers’ satisfaction,completed a registration form and obtained a biddingnumber.7. Persons attending the auction site and premises doso at their own risk. Except in respect of death or personalinjury caused by the Auctioneers’ negligence, theAuctioneers shall not be responsible for any loss ordamage that may occur on the auction site or premises.8. The bidder shall pay to the Auctioneer a premium of21% VAT inclusive* on the hammer price. The Premium isNOT negotiable and is payable by ALL purchasers.Deposits for exceptional lots maybe requested by theauctioneer immediately at the fall of the hammer. Thebidder also agrees that the auctioneers may also receivecommission from the Vendor in accordance clause 20.8a. In accordance with Money Laundering Regulationsand the Criminal Justice Act of 1993 Fieldings AuctioneersLtd will no longer accept single cash payments exceeding£9999.00.8b. In accordance with Artists Resale Rights Regulations2006 all lots marked 3 which sell for €1,000 or more aresubject to a resale royalty charge (“Royalty”). This Royalty ispayable by the Bidder. The Royalty will be charged at a rateof 4% of the total hammer price (exclusive of Bidder’spremium which is payable under clause 8a) for lots sellingfor amounts up to €50,000. For lots selling in excess of€50,001, the Royalty shall be calculated at a reduced rate(details available on request). The Royalty is not subject toVAT and is payable in sterling calculated on the day of saleat the prevailing rate of exchange. Payment shall be passeddirectly to the Design and Artists Copyright Society (DACS)33 Great Sutton Street, London EC1V 0DX. Immediately after a lot is sold the Bidder shall: give tothe Auctioneers his name and address, and, if requested,proof of identity; and pay to the Auctioneers, all sums dueto the Vendor and the Auctioneers in respect of such lot.10. In all cases lots shall remain at the risk of the Vendorsave that lots shall be at the sole risk of the Bidder form thefall of the hammer, and such lots shall be taken away withall faults, defects and errors of description, of any naturewhatsoever. Neither the Auctioneers, nor their servants oragents shall at any time be responsible for any loss or

damage to lots whether caused by negligence orotherwise. No purchaser shall be entitled to remove any lotuntil he or she has paid for the whole of the lots purchased.11. All lots shall be removed ON THE DAY OF THE SALEunless prior arrangement has been agreed with TheAuctioneers. Items not collected shall be liable for storagecharges at £2.00 per day. Neither the Auctioneers nor anythird party shall be responsible for any damage, theft orloss occurring during this period. All items stored by theAuctioneers shall be at the risk of the Bidder.12. If the Bidder fails to comply with these conditions, anydeposit paid by the Bidder shall be forfeited to the Vendorof the lot, he paying out of it all just expenses of theAuctioneers and the lot shall be resold by public auction orprivate sale and the deficiency (if any) arising upon theresale together with the expenses of it shall be due as adebt from the Bidder in default upon the first sale.13. a) Ownership in each lot shall not pass to the Bidderuntil full payment has been made (in cleared funds) of allsums due to the Vendor and the Auctioneers pursuant tothese Conditions.b). Until such time as ownership of the lot passes to theBidder the Vendor and the Auctioneers shall be able toenter onto any premises of the Bidder, or any third partywhere the goods are being stored and repossess thegoods or be entitled at any time to require the Bidder todeliver up the Goods to the Vendor and/or the Auctioneers.14. Any payments by the Bidder to the Auctioneers maybe applied by the Auctioneers towards any sum owing fromthe Bidder to the Auctioneers, without regard to anydirections of the Bidder or his agent, whether express orimplied as to how that payment should be applied.

Vendors15. The vendor warrants to the Auctioneer and to theBidder that he/she is the true owner of the lot or is properlyauthorised to sell the lot by the true owner and is able totransfer the goods and marketable title to the lot free fromany third party claims, liens or encumbrances.16. The Vendor warrants to the Auctioneers and theBidder that the goods as described and in particular as tothe provenance and condition. The Vendor further warrantsthat any damage or non working parts have been fullydeclared to the Auctioneers and that the Vendor hasprovided the Auctioneers with all the information the Vendorhas concerning the provenance of the property.17. The Auctioneers act throughout as agents only andare not responsible for any default by either the Vendor orthe Bidder. The Auctioneers shall not be liable for paying forpaying the Vendor until they have received settlement in full(in cleared funds) of all sums due from the Bidder.18. A vendor who enters a lot or lots for auction which arean asset of his/her business must disclose to theAuctioneers whether or not they are registered for ValueAdded Tax, at the current rate.19. The vendor shall be entitled to place prior to the salea reserve on any lot, being the minimum hammer price atwhich the said lot may be treated as sold. Where areserve has been placed the auctioneer may bid on behalfof the vendor.20. Commission shall be charged at a rate of 18% VATinclusive* for sale entries, in each case, of the hammerprice. Special rates are negotiable for large consignmentsof items. The Vendor hereby authorizes the Auctioneers todeduct all commission payable from the hammer price and

acknowledges the Auctioneers right to retain the premiumpayable by the Bidder in accordance with clause 8 above.A “sale entry / internet marketing” charge of £5-00 (VATinclusive) will be applied to all lots, sold or otherwise, oneach sale offering. The auctioneers shall remit the proceedsof the sale to the Vendor (subject to the deduction of allsums i.e. commissions and charges, due from the Vendorto the Auctioneers) no later than three weeks after receivingpayment in full from the Bidder. In the event of the lotsremaining unsold the vendor shall be liable to pay theAuctioneer the above “sale entry / internet marketing”charge on each lot.21. The Auctioneers do not undertake the collection ofgoods but shall however if desired instruct a contractor onthe Vendors behalf and at his expense. The Auctioneersshall not be liable for any damage, loss, or unauthorisedremoval of goods and for any damage to premises by suchcontractors.22. The Auctioneer shall not be liable for any lots deliveredto their premises without sale instruction and reserve theright to make a housing charge, this charge is alsoapplicable to lots that have been requested to be collectedby the Auctioneers. If not removed within two workingweeks the Auctioneers hold the right to sell the items inorder to recover any costs incurred by them.23. Unless instructed by accompanying written notice, allgoods, which the Auctioneers deem to have no saleablevalue, will be disposed of at the Auctioneers discretioneither to a charity or by consignment for destruction.24. The Vendor will indemnify the Auctioneers, its servantsand agents and the Bidder against any loss or damagesuffered by either in consequence of any breach of clause15 and/ or 16 above or otherwise of these Conditions onthe part of the Vendor.25. Any sums due, but unpaid, by the Vendor or theBidder pursuant to these conditions shall carry interest(as well as after judgment) at the rate of 4% above RoyalBank of  Scotland plc base rate from time to time fromthe due date until payment, such interest to becompounded monthly.26. Cataloguing Terms:• All lots marked with an asterisk (*) denote Value Added

Tax at the current rate on the hammer price.• The word “style” within a lot description denotes that,

in our opinion, the item is a more recent copy of aperiod item.

• “S/D” after a description denotes “Slight Damage”.• “A/F” after a description denotes “As Found”.• “Bears name/signature” in our opinion possibly, but not

necessarily, by the hand.
