1. INTRODUCTIONThe following informative notes are intended to assistBuyers, particularly those inexperienced or new to oursalerooms. All sales are conducted on our printed Conditions of Sale which are readily available for inspection and normally accompany catalogues. Our staff will be happy to help you if there is anything you do not fully understand.

2. AGENCYAs auctioneers we usually contract as agents for the seller whoseidentity, for reasons of confidentiality, is not normally disclosed.Accordingly if you buy your primary contract is with the seller.

3. ESTIMATESEstimates are designed to help buyers gauge what sort of sum might be involved for the purchase of a particular lot. The lower estimate may represent the reserve price and certainly will not be below it. Estimates do not include theBuyer’s Premium or VAT (where chargeable). Estimates are prepared some time before the sale and may be altered by announcement before the sale. They are in no sense definitive.

4. BUYER’S PREMIUMThe Conditions of Sale oblige buyers to pay a buyer’s premium at 15% on the hammer price of each lot purchased.In addition, VAT is chargeable on this premium (see below).Please see note under live bidding on the following page.

5. VAT(*) indicates that there is a VAT element payable by the purchaser at the standard rate within the hammer price as well asbeing payable on the buyer’s premium. This imposition of VAT islikely to be because the seller is registered for VAT within the Euro-pean Union and is not operating the Dealers Margin Scheme orbecause VAT is due on importation into the UK. Lots which appearwithout the above symbol indicate that no VAT is payable on thehammer price. This may be because such lots are sold using theAuctioneers’ Margin Scheme and, if so, it should be noted that theVAT included within the Premium is not recoverable as input tax.

6. CONDITIONS OF LOTS Please note carefully the exclusion of liability for the condition oflots contained in the Conditions of Sale. Intending buyers haveample opportunity for inspection of goods and neither the sellernor we as the auctioneers accept any responsibility for their condition.In particular, mechanical objects of any age are not guaranteed tobe in working order. However, in specified circumstances lots misdescribed because they are ‘deliberate forgeries’ may be returned and repayment made. There is a 3 week time limit. (Theexpression ‘deliberate forgery’ is defined in our Conditions of Sale).

7. CONDITION REPORTSWe may be able to assist buyers unable to view by providing a condition report, but these reports are based solely on ourown opinion and are for guidance only and no responsibility is accepted for their accuracy. Intending buyers are strongly encouraged to view. (Please see our Conditions of Sale).

8. ELECTRICAL GOODSCollectable items which are electrical are sold as ‘antiques’ onlyand if bought for use must be checked over for compliancewith safety regulations by a qualified electrician first.

9. EXPORT OF GOODSBuyers intending to export goods should ascertain (a) whetheran export licence is required and (b) whether there is any specificprohibition on importing goods of that character because, e.g. they may contain prohibited materials such as ivory.

10. BIDDINGBidders are required to register before the sale commences andlots will be invoiced to the name and address on the registra-tion form. You will need a bidding card which is available freeof charge, upon production of current identification that canconfirm your name and address (eg driving licence, passport,utility bill, but please note that we will not accept bank debitor credit cards as identification).Otherwise, a refundable CASHdeposit of £50 must be paid, your deposit will be set againstyour invoice if you are successful with your bid, or refunded toyou once we have established that no bids have been allocatedto your bidding number.

11. COMMISSION BIDDING Commission bids may be left with the auctioneers indicatingthe maximum amount to be bid excluding buyer’s premium.They will be executed as cheaply as possible having regard tothe reserve (if any) and competing bids. If two buyers submitidentical commission bids the auctioneers may prefer the firstbid received. Please enquire in advance about our arrangementsfor the leaving of commission bids by telephone, e-mail or fax.In order for Commission and Telephone Bids to be operated,we will require your credit/debit card details. Confirmation ofany bids taken over the telephone must be made in writing(fax, email or post) by 9am on the day of the sale.

12. METHODS OF PAYMENTGoods can be paid for during the sale.

We accept the following forms of payment:Cash: (up to a limitof £5,000 due to money laundering regulations)

Cheques: goods will only be released on cleared cheques

13. COLLECTION AND STORAGEPlease note what the Conditions of Sale state about collectionand storage. It is important that goods are paid for and collected promptly. Any delay may involve the buyer in payingour storage charges.

GLOSSARY OF TERMS CONCERNING THE ATTRIBUTION OFPAINTINGS AND DRAWINGS(i) The christian name(s) and surname of the artist indicates

in our opinion a work by the artist.

(ii) The initials of the christian name(s) and the surname of theartist indicate in our opinion a work of the period of theartist which may be wholly or in part his work.

(iii) The surname only of the artist indicates in our opinion awork of the school or by one of the followers of the artistor in his style and of uncertain date.

(iv) ‘‘Bears signature’’ indicates in our opinion that this is notthe signature of the artist.

(v) The name of the artist preceded by ‘‘After’’ indicates in ouropinion a copy of the work of the artist.

NOTICE TO BUYERS OF GEMSTONES/JEWELSMany coloured gemstones have been subjected to a variety of treatments designed to enhance their appearance, for exampleheating is regularly used to improve colour or transparency inrubies and sapphires. Other treatments such as oiling, enhancethe clarity of emeralds. Other coloured gemstones may have undergone permanent or semi-permanent treatments such asdyeing, irradiation, coating and impregnation, which may require further re-treatment in order to retain their appearance.The jewellery trade generally accepts these treatments. Prospective purchasers should assume all gemstones will havebeen treated unless statements are made to the contrary.

Recent advancements in technology have led to some diamondsbeing treated in a variety of ways designed to enhance their appearance. These treatments can include fracture filling, laserdrilling, irradiation and coating. Every effort is made to identify suchtreatments, however it is not possible for Morphets to guaranteethat all lots containing diamonds are free of these enhancements.

All dimensions and estimated weights of gemstones have beendetermined without unsetting the stones and are thereforeonly approximate because of limitations imposed by the mount.Estimated weights are normally calculated by applying standardformulae to the measurements taken.

The following twelve lots were bequeathed by Canon John N Dalton to Sir and Lady Forbes-Watsonand then to the vendor by descent.

John Neale Dalton (1839-1931), originally from the Isle of Thanet, Kent, graduated from Clare CollegeCambridge with a degree in Theology. After rapid progression through Church he was appointed toWhippingham on the Isle of Wight where Queen Victoria became aware of him. In 1871 Dalton was appointedas tutor to Queen Victoria’s grandsons, Prince Albert Victor and Prince George, later to become George V. Itwas at Dalton’s suggestion, that the two Princes embarked on a three year world cruise on HMS Bacchantebetween 1879-1882, with Dalton as their guardian, chaplain and tutor. George V held Canon Dalton in suchhigh regard that he appointed him as domestic chaplain for the Royal Family at Windsor where he remaineduntil his death in 1931.

Provenance: This album was part ofthe estate of Surgeon CommanderHerbert Ackland Browning RN andthence by descent to the vendor.Commander Browning servedthroughout the First World War,never married and died at the familyhome in Dawlish in 1955. Herbert’sfather, Captain George Browning RN,was a naval hydrographer andmarried Elizabeth (nee) Kendal,daughter of Dr Marsters Kendal ofKings Lynne, honorary surgeon to the

Prince of Wales, later King EdwardVII, at Sandringham. It is possible thatthe album belonged to him and wasthus lent to the Prince of Wales andothers as annotations indicate.

Footnote: Oscar Gustav Rejlander(1813-1875), known as the Father ofArt Photography, was born inSweden and studied art in Rome,settling in England in the 1840s. Helived in Lincoln and laterWolverhampton, working as an artistand portrait miniaturist. He took anactive interest in photography, seeingits potential for assisting artists and in1853 attended lessons in the Londonstudio of Nicholas Henneman. Thisinspired him to develop his owntechniques experimenting withportraiture although it is hispioneering work in photo-montage,combining several negatives to formone image, that brought him towider renown. His best known workThe Two Ways of Life comprisedthirty-two negatives and took sixweeks to produce. Following itsexhibition in Manchester in 1857 acopy was ordered by Queen Victoriafor Prince Albert. Rejlander became amember of the Royal PhotographicSociety, regularly lecturing andpublishing on the subject and in1862 he moved to London where hebuilt a photographic studio designedto make the best use of natural lightfor his subjects. During his work hecame into contact with Julia

Margaret Cameron, Charles Dodgson(aka Lewis Carroll), Lady Clementina(Maud) Hawarden and CharlesDarwin. In the early 1870s he workedwith Darwin on illustrations for histreatise on The Expression of theEmotions in Man and Animals.

Although Rejlander sold volumes ofhis photography through book shopsand art dealers it is unknown if thealbum in this lot was obtained thusby Captain Browning. One pencilannotation suggests it may havebeen bought directly from thephotographer as it reads ‘Rejlanderhad refused to sell this copy (the onlyone obtained from the negativetaken) at any price: but the offer of£2.2.0 for the Swedish poor was toomuch for his nerves and I obtained itDEO GRATIAS’.

A further annotation inside the frontcover reads ‘This album has thehonour of being submitted in 1866 toHRH The Prince of Wales by ColonelTeesdale (3 weeks), in 1870 at therequest of Cardinal Antorelli to HHPope Pius IXth by Monsignor Pacca (1week), into 1871 to Her Majesty byLady Elgin (several weeks)’.

Some of the prints herein are wellknown examples also held in thecollections of the Royal PhotographicSociety, the Victoria and AlbertMuseum and the MetropolitanMuseum of Art, New York.

Conditions of SaleMorphets carries on business with bidders, buyers and all those present in the auction room prior to or in connection with a sale on the following GeneralConditions and on such other terms, conditions andnotices as my be referred to herein.

1. DEFINITIONSIn these Conditions:(a) “auctioneer” means the firm of Morphets or its

authorised auctioneer, as appropriate;(b) “deliberate forgery” means an imitation made with the

intention of deceiving as to authorship, origin, date, age,period, culture or source but which is unequivocallydescribed in the catalogue as being the work of aparticular creator and which at the date of the sale had a value materially less than it would have had if it hadbeen in accordance with the description;

(c) “hammer price” means the level of bidding reached (at or above any reserve) when the auctioneer bringsdown the hammer;

(d) “terms of consignment” means the stipulated terms andrates of commission on which Morphets acceptsinstructions from sellers or their agent;

(e) “total amount due” means the hammer price in respectof the lot sold together with any premium, Value AddedTax chargeable and any additional charges payable by adefaulting buyer under these Conditions;

(f) “sale proceeds” means the net amount due to the seller,being the hammer price of the lot sold less commission atthe stated rate, Value Added Tax chargeable and anyother amounts due to us by the seller in whatevercapacity and however arising;

(g) “You”, “Your”, etc. refer to the buyer as identified inCondition 2.

(h) The singular includes the plural and vice versa asappropriate.

2. BIDDING PROCEDURES AND THE BUYER(a) Bidders are required to register their particulars before

bidding and to satisfy any security arrangements beforeentering the auction room to view or bid.

(b) The maker of the highest bid accepted by the auctioneerconducting the sale shall be the buyer at the hammerprice and any dispute about a bid shall be settled at theauctioneer’s absolute discretion by reoffering the Lotduring the course of the auction or otherwise.

(c) Bidders shall be deemed to act as principals.(d) Our right to bid on behalf of the seller is expressly

reserved up to the amount of any reserve and the right to refuse any bid is also reserved.

3. INCREMENTSBidding increments shall be at the auctioneers sole discretion.

4. THE PURCHASE PRICEThe buyer shall; pay the hammer price together with a premium thereon of 15% plus VAT on the premium at the rate imposed by law. Any bids made via www.the-saleroom.com live auction service will be subject toan additional 3% commission on the hammer price.

5. VALUE ADDED TAXValue Added Tax on the hammer price is imposed by law onall items affixed with an asterisk. Value Added Tax is chargedat the appropriate rate prevailing by law at the date of saleand is payable by buyers of relevant Lots. (Please refer to“Information for Buyers” for a brief explanation of the VAT position).

6. PAYMENT(1) Immediately a Lot is sold you will;

(a) give to us, if requested, proof of identity, and (b) pay to us the total amount due in cash or in such otherway as is agreed by us.

(2) Any payments by you to us may be applied by us towardsany sums owing from you to us on any account whateverwithout regard to any direction of you or your agent,whether express or implied.

7. TITLE AND COLLECTION OF PURCHASES(1) The ownership of any Lots purchased shall not pass to you

until you have made payment in full to us of the totalamount due.

(2) You shall at your own risk and expense take away any lotsthat you have purchased and paid for not later than twoworking days following the day of auction after which youshall be responsible for any removal, storage and insurancecharges.

(3) No purchase can be claimed or removed until it has beenpaid for.

8. REMEDIES FOR NON-PAYMENT OR FAILURE TOCOLLECT PURCHASES

If any Lot is not paid for in full and taken away in accordancewith these Conditions or if there is any other breach of theseConditions, we as agent for the seller shall at our absolutediscretion and without prejudice to any other rights we mayhave, be entitled to exercise all or any of the following rightsand remedies:(a) to proceed against you for damages for breach of contract;(b) to rescind the sale of that Lot and/or any other Lots sold by

us to you;(c) to resell the Lot (by auction or private treaty) in which case

you shall be responsible for any resulting deficiency in thetotal amount due (after crediting any part payment andadding any resale costs). Any surplus so arising shall belongto the seller;

(d) to remove, store and insure the Lot at your expense and, inthe case of storage, either at our premises or elsewhere;

(e) to charge interest at a rate not exceeding 2% aboveBarclay's Bank P.L.C. base rate per day on the totalamount due to the extent it remains unpaid for morethan two working days after the sale;

(f) to retain that or any other Lot sold to you until you paythe total amount due;

(g) reject or ignore bids from you or your agent at futureauctions or to impose conditions before any such bidsshall be accepted.

(h) to apply any proceeds of sale or other Lots due or infuture becoming due to you towards the settlement ofthe total amount due and to exercise a lien on any ofyour property in our posession for any purpose.

9. THIRD PARTY LIABILITYAll members of the public on our premises are there at theirown risk and must note the lay-out of the accommodationand security arrangements. Accordingly neither theauctioneer nor our employees or agents shall incur liabilityfor death or personal injury (except as required by law byreason of our negligence) or similarly for the safety of theproperty of persons visiting prior to or at a sale.

10. COMMISSION BIDSWhilst prospective buyers are strongly advised to attend theauction and are always responsible for any decision to bidfor a particular Lot and shall be assumed to have carefullyinspected and satisfied themselves as to its condition we willif so instructed clearly and in writing execute bids on theirbehalf. Neither the auctioneer nor our employees or agentsshall be responsible for any neglect or default in so doing orfailing to do so. Where two or more commission bids at thesame level are recorded we reserve the right in our absolutediscretion to prefer the first bid so made.

11. WARRANTY OF TITLE AND AVAILABILITYThe seller warrants to the auctioneer and you that the selleris the true owner of the property consigned or is properlyauthorised by the true owner to consign it for sale and isable to transfer good and marketable title to the propertyfree from any third party claims.

12. AGENCYThe auctioneer normally acts as agent only and disclaims anyresponsibility for default by sellers or buyers.

13. TERMS OF SALEThe seller acknowledges that Lots are sold subject to thestipulation of these Conditions in their entirety and on theTerms of Consignments as notified to the consignor at thetime of the entry of the Lot.

14. DESCRIPTIONS(1) Subject to the next following Condition concerning

deliberate forgeries, any representation or statement byus in any catalogue as to authorship, genuineness, origin,date, age, provenance, condition or estimated sellingprice is a statement of opinion only. Prospective buyersare given ample opportunities to view and inspect before

any sale and prospective buyers must satisfy themselves as to all such matters. Neither the auctioneer nor itsemployees or agents nor the seller accept liability for the correctness of such opinions and all conditions andwarranties, whether relating to description, condition or quality of Lots, expressed, implied or statutory arehereby excluded.

(2) Private treaty sales made under these Conditions aredeemed to be sales by auction for purposes of consumer legislation.

15. FORGERIESNotwithstanding the proceeding Condition, any Lot whichproves to be a deliberate forgery (as defined) may be returnedto us by you within 21 days of the auction provided it is in thesame condition as when bought, and is accompanied byparticulars identifying it from the relevant cataloguedescription and a written statement of defects. If we aresatisfied from the evidence presented that the Lot is adeliberate forgery we shall refund the money paid by you forthe Lot including any buyer’s premium (but not the amount ofany consequential loss, damages, expenses or interest)provided that;(1) if the catalogue description reflected the accepted view of

scholars and experts as at the date of sale or (2) you personally are not able to transfer a good and

marketable title to us, you shall have no rights under this condition.

GENERAL

16. We shall have the right at our discretion, to refuseadmission to our premises or attendance at our auctions by any person.

17. Any idemnity or exclusion under these Conditions shallextend to all actions, costs, expenses, claims and demandswhatsoever suffered or incurred by the person entitled tothe benefit of it and the auctioneer declares itself to be atrustee of the benefit of every such clause so far as it isexpressed to be for the benefit of its employees and agents.

18. Any notice to any buyer, seller, bidder or viewer maybe given by first class mail or Swiftmail in which case itshall be deemed to have been received by the addressee48 hours after posting.

19. Special terms may be used in catalogue descriptions ofparticular classes of items in which case the descriptionsmust be interpreted in accordance with any glossaryappearing within the catalogue.

20. Any indulgence extended to buyers or sellers by usnotwithstanding the strict terms of these conditions or ofthe Terms of Consignment shall effect the position at therelevant time only and in respect of that particularconcession only; in all other respects these conditions shallbe construed as having full force and effect.

21. English law applies to the interpretation of these Condition
