1.0. LOCATION Upper Buckton Farm is situated in the centre of the hamlet of Buckton, between the villages of Brampton

Bryan and Leintwardine in North Herefordshire. A location plan is attached at the end of these Particulars.

2.0. DESCRIPTION Upper Buckton Farm forms part of the Harley Estate. The property briefly comprises of a range of modern

agricultural buildings together with approximately 144.44 hectares (356.91 acres) of arable and pasture land.

The Farmhouse, its outbuildings and paddock will be available to let by separate negotiation.

3.0. PARTICULARS Lot 1 is located to south of the road through Buckton and comprises of approximately 88.91 hectares (219.71

acres). It is broadly classified as Grade 2 and 3 according to the Agricultural Land Classification Map for England.

The land is a mixture of arable (89.75 acres) with grass leys (54.06 acres) and permanent pasture (66.81 acres).

There are small wooded areas and the River Teme flows through the middle of the block. The land also includes

the point-to-point racecourse. The Landlord will reserve the right to utilise the racecourse and parking areas for

up to three meetings per annum. In addition, the racecourse must remain in permanent pasture. The plan

annexed to these Particulars identifies the location of the racecourse and parking areas.

Lot 1 also includes a range of farm buildings a schedule and block plan are attached at the end of these

Particulars.

Lot 2 is located to the north of the road through Buckton and is mainly arable land with some arable reversion

and smaller parcels of permanent pasture. The land is also classified as Grade 2 and 3 according to the

Agricultural Land Classification Map for England.

A field schedule and plan for each lot is provided at the back of these Particulars.

4.0. TENANCY AGREEMENT The Letting will be subject to a detailed Farm Business Tenancy (FBT) agreement, a copy of which is held at the

Balfours LLP Hereford office and is available for inspection by prospective tenderers during normal office hours

or as an Adobe PDF document via email upon request. The tenancy document agreement contains inter alia the

following heads to Agreement:

4.1. Term – The FBT agreement will be for a period of five years with effect from 1st November 2019, subject

to holdover by the current Tenant. The agreement will include a break clause at the end of year one

exercisable by either party on four months’ notice.

4.2. Rent – Will be payable monthly in advance by banker’s standing order. The first instalment of rent will be

due on the signing of the tenancy agreement followed by payments on the 1st day of each month. Rent to

be reviewed with effect from third anniversary of the commencement date of the tenancy.

4.3. Outgoings – The Tenant will be responsible for all other outgoings if appropriate for the holding including

water, electricity charges, drainage rates etc.

4.4. Repairs and Maintenance – The Tenant will be responsible for keeping the holding in good agricultural and

environmental condition together with all the fields, field boundaries including fences, gates, gate posts

and hedges including cutting or trimming. Repairing obligations are set out in more detail in a copy of the

FBT agreement and will be in accordance with the Agriculture (Maintenance, Repair and Insurance of

Fixed Equipment) Regulations 1973 (SI 1973/1473) as amended. In the event of a Tenant not carrying

out the appropriate work as referred to above and as incorporated in the agreement, the Landlord will be

entitled to carry out the work and charge the Tenant the cost for doing so at normal contract rates.

4.5. Insurance – The Tenant will be responsible for the insurance of his own livestock, plant machinery and

equipment.

4.6. Tenancy Agreement – The Tenant will be required to sign the tenancy agreement together with statutory

notices within 28 days of acceptance of tender.

4.7. Record of Condition – A photographic record of condition is to be drawn up at the commencement of the

tenancy.

5.0. SPORTING RIGHTS All sporting and hunting rights are reserved by the Landlord who may exercise the rights personally or may

authorise some other person to exercise them on his behalf.

6.0. EASEMENTS AND WAYLEAVES The right to grant easements and wayleaves to third parties is reserved to the Landlord who will be entitled to all

the payments received for any new and all existing easements or wayleaves.

7.0. TIMBER/WOODLAND All timber and other trees are reserved to the Landlord, but broken/fallen branches may be removed by the

Tenant. If not removed within a reasonable time, the Landlord reserves the right to remove the trees subject to

making good any damage caused.

8.0. WATER We understand that mains water is available to some of the fields in Lot 1 but the farm buildings and remaining

land in Lot 2 are served by a private water supply.

9.0. CROPPING The Tenants will be free to crop the land as they wish subject to the following provisions:

9.1. Permanent Pasture – to remain as permanent pasture unless re-seeding becomes necessary in such

circumstances the Landlord’s consent will be provided subject to the necessary Environmental Impact

Assessment/Screening provisions being approved by Natural England.

9.2. Genetically Modified Crops – only permitted with Landlord’s prior approval.

9.3. Potatoes – Potatoes must not be grown in rotation more than one year in five. The seed shall be certified

and/or virsus tested and disease free. Consent will be given to sublet land for the growing of potatoes

subject to an additional payment to the Landlord of 20% of the rent received by the Tenant.

9.4. Buffer Strips – Buffer strips/Grass margins are to be maintained as existing and must not be ploughed. 9.5. In-Field Trees – There must be no ploughing/cultivations under the canopy of any in-field trees. 9.6. Point-to-Point Course – The course must be maintained as permanent pasture, kept topped and weed free.

The parking areas must also be maintained as permanent pasture.

The last five-year cropping for each field is attached at the end of these Particulars.

10.0. FIELD DETAILS Field details for Basic Payment Scheme purposes will be made available where possible.

11.0. BPS ENTITLEMENTS There will be approximately 33 entitlements transferred with the land. Further Basic Payment Entitlements may

be available by separate negotiation with the outgoing Tenant. The incoming Tenant is responsible for making

arrangements for their own entitlements.

12.0. AGRI-ENVIRONMENT SCHEMES All the land is currently entered into an Entry Level with Higher Level Environmental Stewardship Scheme which

runs until 31st September 2020. A copy of the scheme can be made available at request via email from the

Agents. The incoming Tenant for Lots 1 and 2 will be responsible for the transfer and compliance with the

scheme until it terminates. The scheme is broadly outlined in a schedule attached to these Particulars.

13.0. IN-GOING VALUATION There will be no in-going valuation. Cropped fields will be left in stubble.

14.0. EARLY ENTRY The incoming Tenant will be permitted Early Entry to the arable fields, once the outgoing Tenant has harvested

any crops and removed any straw, provided that they have signed and returned the tenancy agreement.

15.0. HOLDOVER The outgoing Tenant will have access to the land to complete the 2019 harvest, remove any straw and hold a

farm disposal sale.

16.0. HEDGES, BOUNDARIES AND GATES Tenants will be responsible for keeping field boundaries stock proof and maintained to a high standard including

hedge cutting on an annual basis. Roadside hedges and other hedges must be trimmed annually with care taken

to preserve and improve their existing shape. No hedges to be cut back beyond the annual

growth, without prior Landlord’s approval and otherwise in accordance with Cross Compliance Rules, and in

accordance with the current stewardship scheme.

17.0. PUBLIC RIGHTS OF WAY A number of footpaths pass through the property, the route of which is clearly delineated by waymarking and

arrows and as shown on the plan attached to these Particulars. These must be maintained by the Tenant in

accordance with the regulations.

18.0. VERMIN CONTROL Tenants will be required to control rabbits, pigeons, rats, moles and other pests on the holding. In the case of any

shooting, prior notification must be given to the relevant gamekeepers.

TERMS OF THE TENDER

1. Tender to be submitted on the form supplied at the back of these Particulars and to be signed and

dated by the individual that wishes to take the tenancy.

2. The Tenders must be for a specific sum, no escalating tenders will be acceptable.

3. The Estate does not bind itself to accept the highest or any tender.

4. The Tender forms attached hereto to be sent to W R A Shuttleworth, Balfours LLP, The Estate Office,

The Vallets, Whitfield, Hereford. HR2 9BA and marked FBT Land Tender on the outside of the

envelope to arrive by Noon on Friday 17th May 2019.

5. The land on offer is let subject to these conditions and subject to faults and defects, whether a condition

or otherwise and neither the owners nor their agents are responsible for any such faults or defects or for

any statement contained in these Particulars.

6. The successful Tenderer will be deemed to acknowledge that he has not entered into this tender in

reliance on any of the said statements contained in these Particulars.

7. Any error or omission or misstatements in any of the said statements shall not entitle the successful

tenderer to rescind or be discharged from his Tender or entitle either party to conversational damages

nor in any circumstances give ether party cause of action.

8. Tenants shall be deemed to have full knowledge of the boundaries and neither the owners nor the

letting agents will be responsible for defining the boundaries of ownership thereof.

10. The successful tenderer will be required to undertake a credit reference check the cost of which will be
