Background: The assessments performed under the Marine Strategy Framework Directive are linked to specific geographic areas within each MSFD marine region or subregion. For the preparation of the 2018 reporting (updating) on articles 8, 9 and 10, a set of MSFD Marine Reporting Units is being prepared, partly by the EEA and ETC-ICM and partly by Member States.

This paper provides an update on progress in preparing a set of MRUs and associated GIS shapefiles, including for MS marine waters.

WG DIKE is invited to:

a. Confirm the information on status of the provision of lists of MRUs, 4geo.xml files, and GIS shapefiles for MRUs and MS marine waters is correct;

b. Where MS have not yet provided these information and data, upload an updated 4geo.xml file and associated GIS files with the Marine Reporting Units to be used for the MSFD 2018 reporting (i.e. those not made available directly by the EEA), including any updated GIS files for MS marine waters, by 31. June 2018.

1) INTRODUCTIONIn June 2017 a spreadsheet with proposed MSFD marine reporting units (MRUs) was sent to Member States. Member States were requested to provide feedback by the end of January 2018 indicating which MRUs they would use for the 2018 MSFD reporting. This paper provides an update on progress in preparing a complete list of MRUs and associated GIS shapefiles.

2) PROVISIONAL LIST OF MRUSA draft list of MRUs has been developed with the feedback provided by countries from June 2017-January 2018. The list compiles the following information from Member States:

- List of MRUs (feedback on the spreadsheet)- Shape files uploaded to the central data repository (CDR)- When no feedback has been provided, the MRUs from the 4geo files submitted before June

Annex I provides the provisional list of MRUs that have been included in the MSFD 2018 reporting test webforms. Annex III provides the dates of submissions of the information used for the list, and Annex IV is a compilation of all the comments and information received from Member States.

3) MARINE UNITS CODESAfter a revision of the feedback provided by Member States on the spreadsheet with the proposed MRUs to be used, it is to be highlighted that some MarineUnitID codes are long and include character spaces or special characters, e.g.:

- “ANS_DK_without Kattegat_outside 12 nautical miles zone”- “25. Göta Älvs_och_Nordre_Alvs_estuarie”- “L2.2.5 + WADDENSEA”

It is recommended to build short MarineUnitIDs, avoiding spaces and characters that can lead to errors in matching code labels.

As defined in the “Guidance for 2012 reporting under the Marine Strategy Framework Directive, using the MSFD database tool”1, the codes should be constructed as follows: Region/subregion code-MS ISO code-Area type code-Sequential number or alphanumeric (e.g. ANS-NL-AA-001; ANS-DK-MRU1-Kattegat).

It is also important to provide the same MarineUnitID codes in the 4geo files and in the shape files. In 2012, only 87 MarineUnitID codes matched in both the shape file and the 4geo.xml (see Table 1). In Annex II, a full comparison of the Marine Unit codes from the 4geo and the shape files is provided.

4) SUBMISSION OF GIS FILESRegarding the submission of spatial files in regards to the preparation of the 2018 reporting, only two Member States have uploaded shape files with updated MRUs.

It is to be remarked that some polygons do not need to be included in the shape files provided by Member States because they are already available or are being prepared elsewhere:

Coastal water bodies and territorial waters reported under the WFD2 (already available in EEA’s website3)

‘Coastal water bodies within RBD’ are neither requested (the layer will be prepared by EEA/ETC) Marine regions and subregions (already available in EEA’s website4) Subdivisions of regions or subregions: available for the HELCOM5 and OSPAR6 areas

In the shape files to be submitted to CDR, Member States should include:

MS part of MSFD region/subregion/subdivision that will be used as MRUs Other MRUs that are not included in the proposed list of MRUs

The submission of updated 4geo and shape files is request by the end of June 2018, the latest. The GIS files need to be harmonised so that they are used to display the information in WISE-Marine. By autumn 2018, it is planned to have draft products displaying the MSFD 2018 reporting information in a test environment, making use of the MRUs.

5) CDR FOLDER TO BE USEDWithin the country folders in CDR, a new folder structure has been created under “European Union (EU) obligations” that is as follows:

The folder to submit the 4geo and shape files for the MSFD 2018 reporting exercise is “MSFD - Article 4 - Spatial data”7.

Annex IV. Comments by Member States in relation to spreadsheet with proposed MRU’s

Denmark (29/8-17) Denmark wants to additionally use the entire Danish waters as one MRU to be used for values collected in relation to the economic and social analysis, e.g. the indicator describing the ESA value of Renewable energy generation

Germany (29/8-2017)

From our point of view there are still a couple questions open on the format of the MRUs-files, e.g. on an extension of the proposed data model to support the web forms best. Therefore we didn’t follow the explanations of the “Guidance for 2012 reporting under the Marine Strategy Framework Directive” consequently and coded the date of creation into the shape-filenames. Please consider the upload as a draft version that will be finalised when all questions are answered”

Estonia (29/8-17) Estonia is planning (no final decision has been made) to use 4 additional reporting units in the 2018 compared to the 2012 reporting. The additional reporting units are the Estonian part of HELCOM level 3 assessment units (SEA-009, SEA-011, SEA-012 and SEA-013).

NL has 2 discussion points for the DIKE 16th meeting:

1 We see in practice that for several reporting obligations the “coastal waters” definition is used in a very different way. (WFD, MSFD, Natura 2000, OSPAR etc). We could like to discuss how these definitions can be harmonized in order to prevent misunderstandings in the future?

We would like to discuss how MS deal with reporting of MPA’s. Is it reported separately or as part(s) of a larger MRU? What is view of the commission/EEA on this issue?

Sweden (31/8-2017)

“As pointed out when we have commented earlier documents Sweden in the 2012 reporting used the Helcom sub-basins, but with Swedish names and a slightly different delineation. The Helcom sub-basins used in the Excel files are those with straight lines and Sweden uses a delineation following the topography in the sea and the Swedish Water Archive. We may in the future call the sub-basins sub-divisions instead of assessment areas. Sweden has asked the Helcom Secretariat to change the delineations in Swedish water, which they also have promised to do, but it has not been done yet”

“Not all the marine units reported by Sweden are in the list (read: 2012 reporting of 4geo.xml), but only one covering the Swedish part of the North

Sea and one covering the Swedish part of the Baltic Sea. Obviously, we should have called our 12 sub-basins for sub-divisions already in 2012, but unfortunately we did not”

“Sweden will use the units we reported in 2012, but with some modification of the boundaries. On behalf of the Government, the Swedish Maritime Agency in 2015 presented coordinates for a new baseline for Sweden after some years of investigations. In June 2017, the Swedish Government made a proposition to the Parliament about a new law concerning the sea territories and maritime zones of Sweden. This includes coordinates for the baseline and also for the one nautical mile and the twelve nautical mile from the baseline and the EEZ. At the time being, we do not know when the proposition will be handled in the Parliament (planned during autumn), but the law is proposed to enter into force 1 March 2018. The new law also means that we will have the delineation of coastal waters, of territorial waters and EEZ digitized and in the same digital format”

“As expressed earlier in the comments on the document “bringing WFD assessments to MFSD-reporting, GES_17-2017-06” Sweden cannot accept a division of coastal waters by the River Basin Districts. The RBDs are based on freshwater catchment areas and not on ecologically relevant marine characteristics. The aggregation of coastal water bodies into coastal water types are, at least in Sweden, based on physicochemical and biological characteristics implying that within the type the “threshold values” for the different quality elements/parameters are the same.

The assessments in the HELCOM Holas II report build upon the coastal water types. Therefore, it is problematic if another principle of division is expected in the reporting of the assessment to the Commission”

Belgium (1/9-17) Belgium has indicated the intention to use between 2 and 5 MRUs (2 ‘Y’ and 3 ‘possibly Y’)

Finland (13/9-17) Finland will follow the HELCOM nested assessment units with the following divisions:

- level 1: Baltic Sea (Finland’s EEZ)- level 2: HELCOM sub-divisions within Finland’s EEZ (Gulf of Finland, Norther Baltic Proper, Åland Sea & Archipelago Sea, Bothnian Sea, the

Quark and Bothnian Bay)- level 3: HELCOM sub-divisions (see level 2) divided to offshore waters and coastal waters (as defined under the EU WFD)- level 4: as level 3 but coastal waters divided to the surface water types of the EU WFD (14 types: FIN-001 Lounainen sisäsaaristo, FIN-002

Finland will select the level of MRUs for specific marine elements as agreed in HELCOM and defined in the Commission Decision 2017/848.

France (31/10-2017)

For France, as long as our visibility is not yet completed about D1 , D6 and D7, 29 MRUs are listed. It could be possible that this list have then to be completed, considering the scientific approach developed for these 3 descriptors. We have to investigate more over how France will consider the species and habitats distribution maps. Marine subregions will also be used only for targets (art. 10) and ESA (art.8) reporting.

Denmark (16/1-2018)

At this point the list is not absolute, which means that it is not certain whether all of the MRUs will be used.


Our general remarks:

The discussion of the MRUs has started during 2017 and is almost finalized. We give you our latest insight information. We will report more detail than we did in 2012 when we only have one reporting unit for the Dutch continental shelf. For 2018 we will making use of the OSPAR (sub)divisions units, a new suggested “Bonn agreement area”, most of the WFD waterbodies and

our continental shelf codes. We didn’t want to use the special MPA’s for the North Sea anymore as we suggested in August ( too much detail as David Connor already

suggested ! ) We want to make use - as much as possible - the (original) WFD bodies (and WFD-codes) for the Coastal Waters for D5/D8. If it is not

(technically) possible we will use the new suggested codes. For the Territorial Dutch Waters we will aggregate it to one complete area + some EXTRA combinations

We will use 3 NCP codes: a) Dutch NCP untill TW-line b) Dutch NCP untill CW-line and c) Dutch NCP – Coastline (the old one) We hope there is still some room for a final discussion on the next TG Data/Dike meeting As soon as these new MRUs definitive, we will report as 4GEO/GIS-files.

Some question-points:

2 Is there some new (extra) information/ notion for harmonization after latest discussions within EC/EEA/OSPAR/HELCOM and/or Mediterranean countries?

3 If more countries will use the same area (part of an OSPAR region) will there still be one code-name or still country related codes ANS-NL XXX…?? We prefer to have 1 general code.

4 Is it possible to use a MRU as a combination of existing area’s/MRUs OR should you define a new “larger” one as an separate one. We have done the latest in our table. Is that correct?


Some extra explanations/background in the underlying points.

WFD bodies as MRUs for Coastal Waters: In our table we had marked the WFD areas with NO related to the old NLxx codes and put a “YES” behind your new suggested codes for the WFD Coastal Waters, because we thought we should only use these new codes. But we hoped that it was possible (and stimulated by the EC/EEA for unambiguity between regulations) to use the old WFD reporting codes (also easy for maintenance).

o SO in the new table you will see that we now have decided to use all the old WFD-codes for the Coastal and Territorial waters (EXCEPT for Oosterscheldt and ZWIN). Additional to these areas we still want to use the 3 EXTRA merged areas Total CW, TW and

We still want to use old MSFD-NCP code ANS-NL-MS-1 and the 2 additional NCP-codes MS-2 and MS-3

USING OSPAR and ICES (sub)region codes as MRU: We didn’t understand your reaction (question-2) about the OSPAR MRU-codes. We know you didn’t have managed the prefilling of the OSPAR assessments, but we hope that all the Northsea Countries shall and will use the mapping and codes for OSPAR (sub)region for their common assessment area’s. You said “assessment for YOUR waters….. with country related codes”, but from the discussions with David we learned that he promoted/stimulated to use the “wider” OSPAR/ ICES regions as MRUs for the common assessment where possible.

o So we hope we could use common OSPAR/ICES region/subregion-codes for: ATL end ANS and Bonn agreement area. the L.2.2.5-OSPAR Southern Northsea area and the ICES-Northern(?)/Central/Southern Northsea area* (incl Waddensea) as

a whole for D9C1*-- The MRU for D9C1 is related to a large part of the Northsea, we thought ICES area NNS(?)+CNS + SNS + Waddensea. We're going to sort it

out and let you know as soon as possible.

Spain (01/02/2018) Attached the file with our MRU proposal list (the list “MRUs_proposal_LIST”), where we have added some MRUs (in green) that we will use for D5.

As you can see, we won’t use the coastal water bodies as Marine Reporting Units, but the coastal water bodies within a RBD.

In summary, we will use:

• Level 1: Regions

• Level 2: Subregions

• Level 3: Subdivisions (L2 4.1 OSPAR)

• Level 4: MS part of (sub)region or subdivision

o Marine Demarcations

o Delimitations for D5 asssesment

• Level 5: 5-Coastal waters within a RBD

We are working now on updating the GIS files for these MRU; as soon as we have them we will send them to you
