3. We shall display our PELP-covered products with the appropriate DOE Energy Labels.

4. We shall establish and maintain a system of addressing complaints filed by customers concerning the certified products and maintain records thereof. The minimum information required would include: a) product/s covered by the complaint, b) Nature of the complaint, c) Corrective action/s done, d) Place of purchase.

5. As part of the annual market verification, and whenever possible, samples of certified products may be drawn from the market by the DOE Monitoring Team, in coordination with our representatives. All expenses incurred during the drawing of samples from the market shall be shouldered by our company.

6. We shall inform DOE, in writing, of any change/s of management, legal status, identification file reference number of the product, content related to energy labels (i.e., any change significantly affecting the product's performance and efficiency, business name, brand and/or other product literature, etc.) within thirty calendar (30) days after the effectivity of such changes. Also, we will submit all pertinent documents/requirements that need to be updated annually (i.e. Business Permit).

7. We shall pay the applicable fees and charges as billed or stipulated by DOE. 8. We shall comply with the PELP Guidelines on the use of Energy Labels. 9. We adhere that any infraction of these Terms and Conditions shall constitute sufficient

grounds for the institution of administrative sanctions and/or fines against our company, without prejudice to the penal provisions of the Republic Act 11285, EEC-IRR and PELP Guidelines.

Company Application Procedure for Compliance to PELP

The following refers to the general procedure for the company application of PELP as

administered by DOE. These procedures shall apply to all companies whose products and

equipment are covered under PELP and its PPRs, including manufactured and imported

institutional products.

Request for Order of Payment

1 Applicant shall fill-out an online form, through a link found in the DOE Website, to request an Order of Payment (OoP) and provide basic information about their company.

Payment for the processing of the application

DOE-EPRED shall issue an OoP to the applicant via e-mail. Applicant shall pay the corresponding amount indicated in the OoP to the DOE. Applicant shall provide the photocopy/electronic copy of the official receipt/confirmation receipt to DOE-EPRED. DOE-EPRED shall validate the payment through the DOE Treasury Division

Submission of pertinent documents to DOE-EPRED

DOE-EPRED shall provide a link to the PELP Online System to the applicant. Applicant shall submit online the following duly accomplished documents to DOE: • PELP IG Annex A. Form No.1 (via online form) • PELP IG Annex A. Form No.2

Energy Label Issuance Procedure for Compliance to PELP

The following refers to the general procedure for the issuance of energy labels as

administered by DOE. These apply to all products and equipment covered under PELP

and its PPRs.

2 DOE-EPRED generates the energy label based on the product data retrieved from the DOE PELP online platform, as validated by an authorized DOE personnel during the product registration phase. The QR Code shall be automatically generated and will be included in the energy label file.

Notifying the Applicant DOE-EPRED informs applicant of the availability of the Energy Label.

C.1 Foreword

Pursuant to Republic Act No. 11285, the EEC-IRR, DOE DC2020-06-0015 (PELP) and DOE DC2020-06-0016 (MEPP) this document is prepared for the guidance of DOE personnel and all concerned importers, manufacturers, distributors, dealers, retailers and other stakeholders in the enforcement, monitoring and verification under the Philippine Energy Labeling Program (PELP) and the Minimum Energy Performance for Products (MEPP).

C.2 Scope

This document contains guidelines for the enforcement, monitoring and verification pertaining to energy labeling requirements and the compliance to MEPP.

C.3 Definition of Terms

For the purpose of this document, definitions in the Implementing Guidelines (IG) and Particular Product Requirements (PPRs) apply including the following:

1. Applicant - refers to any natural or juridical person engaged in the manufacturing, importing, distributing, or dealing of ECPs who registers with the DOE in compliance with the requirements of PELP

2. Acknowledgement of Drawn Samples (ADS) – for the purpose of verification, an ADS is a DOE form accomplished by the applicant and is presented to a retail store owner notifying the same that he or she has been credited a replacement unit for the product that will be collected by the DOE monitoring team for verification testing

3. Basic Model/Type – a product model whose main component and other design components are distinct as to voltage rating, power input, frequency, light output, etc.

4. Control Number – a set of numbers issued by the DOE for a particular model of product which is printed or stamped on the energy label

5. Energy Label – refers to the prescribed tag / sticker / marker that bears the DOE logo and essential energy performance ratings (i.e. efficiency, energy consumption. etc.) compliant to the PPR

6. Enforcement – refers to an activity or operation, including on-site inspections, where DOE detects violations for the purpose of seeing to it that these comply with the provisions of PELP

7. Generic Models - refer to a range of models similar to the base model where all have the same major physical characteristics, construction, system design and other performance characteristics

8. Model – a specific unit or variety of product

9. Monitoring – refers to an activity where the DOE systematically observes, checks and keeps record of the compliance with the requirements of PELP

10. Retailer - refers to any natural or juridical person engaged in the business of habitually selling consumer products such as various ECPs directly to consumers

11. Test – a laboratory procedure to determine one or more characteristics of a given product according to a specified methodology

12. Test report - a report generated by the laboratory in testing the energy performance and other requirements of the PPR

13. Verification test – test conducted on the product drawn from the market to verify the claims of the customer

C.4 Monitoring

The following check points shall be referred to during the conduct of monitoring of compliance of energy consuming products (ECPs) covered by PELP:

C.4.1 Monitoring Check Points

• Information from competitors or consumers

• Applicant / Retailer websites, brochures, online marketing

• Geographical selection

C.4.2 Energy Label Check Points

The checking of compliance for each product shall be in accordance with the respective PPR of the ECP and aligned with the market monitoring data indicated in Appendices C.9.3-6.

C.4.3 DOE Monitoring Team

The DOE monitoring team shall be composed of a core group of personnel from the DOE and/or its authorized representatives to assist the agency in the conduct of monitoring and verification activities.

C.4.4 Monitoring Frequency

Monitoring the compliance of Applicants and retailers with the PELP requirements in various regions of the country shall be conducted by the DOE monitoring team at least once a year.

C.4.5 Monitoring Forms

The monitoring forms included in the Appendices of this Annex shall be used during monitoring of the subject products.

C.4.6 Monitoring Reports

C.4.6.1 The head of the DOE monitoring team shall be responsible in the consolidation and submission of the monitoring report.

C.4.6.2 Any monitoring activities conducted by the DOE Field Offices, and other authorized agencies, shall be reported and submitted to the DOE-EUMB.

C.4.6.3 The monitoring report shall be submitted to the DOE-EUMB within 15 working days after the conduct of the monitoring activity.

C.4.7. Inter-agency Support

Monitoring of the products shall be conducted in coordination with the DTI-BPS.

C.5 Verification

For verification of the claimed efficiency rating of a particular ECP, random samples of selected product models per specific brand shall be drawn by the DOE monitoring team at least once a year, following a risk-based sampling procedure.

The following criteria shall be applied in the selection of product models for verification testing.

C.5.1 Basic criteria for selection of product for verification testing

• Market entry

• Product records

• Sector-specific targets (based on retailer category)

• Energy savings

• Market shares

• Product tested by Applicants in their own laboratory

• Reports and/or complaints from other applicants and/or consumers

C.5.2 Collection of products for verification testing

During verification activities, samples shall be drawn from the retail stores. If it is not possible to draw samples from retail stores, then the sample may be drawn from the Applicant’s warehouse/s. The number of samples to be collected shall be in accordance with the respective PPR of the product. Samples may be drawn from different retail stores, as may be necessary. In the case of verification at Applicant’s warehouse/s, the DOE monitoring team shall identify lot numbers for specific products for sampling. The team shall then draw the identified samples from their respective storage locations.

For products with generic models, the team shall have the prerogative to draw samples for verification testing of either the base or the generic models declared by the Applicant. A model cannot be considered generic if:

• There is a difference in its major components

• There are other variations that may affect energy performance. C.5.3 Replacement of samples taken from retail stores

Upon DOE’s request, the Applicant shall accomplish the “Acknowledgement of Drawn Samples” (ADS) form prior to the sampling activity. The DOE Monitoring Team shall present the ADS to the duly designated representative of the retail outlet and proceed with the drawing of verification samples.

After the verification activity, DOE shall submit a copy of the signed and acknowledged ADS form to the Applicant. The Applicant shall replace the samples taken by the DOE monitoring team, as indicated in the ADS. (see Appendix C.9.2 for the ADS Flowchart)

C.5.4. Test method and procedures

Verification samples shall be transported to either the DOE-LATD or a DOE-recognized testing laboratory, which is independent of the Applicant, for testing.

Test methods and procedures shall be in accordance with the standard method of testing specified in the respective PPR of the product sample.

C.5.5 Test Reports

Test reports from verification testing shall contain the minimum information for DOE to adequately evaluate the compliance of a particular product with the requirements of the PPR.

C.5.6 Challenge Test

C.5.6.1 An applicant who has claimed to have fully and properly tested a sample unit product model of another Applicant, in accordance with the standard test methods and tolerances provided in the PPRs, and has concluded misrepresentation of the claimed ratings may initiate a challenge, provided that a formal report shall be submitted to DOE-EUMB which would include, but shall not be limited to, the following:

• Brand and Model

• Test method used and corresponding test results

• Specifications/name plate rating of test samples, including pictures

• Date and Place of Sampling

• Date of Testing

• Name and address of the Testing Laboratory where the test was conducted

C.5.6.2 If the DOE finds that the report constitutes substantial proof of non-compliance to the PPRs, the said brand and model shall be subjected to Verification Testing; provided that the following conditions shall be followed:

• DOE-EUMB shall likewise notify the challenged party that somebody is challenging its claimed ratings. Thus, a sampling shall be conducted in the presence of both the challenging party and the challenged party whenever possible.

• Both parties may witness the conduct of the testing if requested.

• If the result of the challenge test is not in favor of the challenged Applicant, the challenged Applicant shall

shoulder all costs in connection with or incidental to the challenge test and the appropriate procedure for the imposition of penalties for the said non-compliance shall be imposed.

• If the result of the challenge test is in favor of the challenged Applicant, all costs in connection with or incidental to the challenge test shall be shouldered by the challenging Applicant.

C.6 Payment for Transport and Testing of Market Samples

C.6.1 The cost for transport of samples shall be borne by the Applicant at a computed cost and shall be supported with the necessary receipts.

C.6.2 The cost for market sample testing shall be borne by the Applicant.

C.6.3 Retrieval of tested samples

C.6.3.1 Applicant shall retrieve the samples after the conduct of testing by LATD or a DOE-recognized testing laboratory within thirty (30) days upon the Applicant’s receipt of the Notice of Retrieval. If not claimed within the prescribed period, samples will be deemed abandoned and will be subjected to disposal.

C.6.3.2 If the test results show non-compliance with the requirements of the applicable standard, tested samples shall be kept by the laboratory for ready reference within sixty (60) days after testing. Applicant may contest the test result within sixty (60) days upon the receipt of the said results. This provision shall be applicable to products that are not subjected to destructive testing.

C.7 Enforcement

C.7.1 Non-compliance to PELP by industry players during market monitoring shall be based on the following:

Types of Non-Conformance / Prohibited Acts

1. Failure to comply with energy labels.

2. Removing, defacing or altering any energy label on the ECPs before the product is sold to the first retail purchaser or leased to the first lessee.

3. Failure to provide accurate information or the provision of false or misleading information as required to be submitted under the EEC Act and the EEC-IRR.

4. Selling, leasing or importing of ECPs that do not comply with MEPP.

5. Willfully refusing to submit to an on-site inspection.

6. Failing or willfully refusing to submit any of the reports required.

7. Failure to comply with issued orders of the DOE in the discharge of its enforcement powers.

8. Failure to register PELP-covered ECPs.

9. Violating any provisions of the EEC Act, EEC-IRR, codes and guidelines.

C.7.2 Pursuant to Section 81 of the EEC-IRR, upon the determination that an establishment has committed any of the prohibited acts, the DOE may consider the following measures prior to the imposition of the appropriate fines and penalties. Establishment may refer to a manufacturer, importer, distributor or retailer of the PELP-covered ECP.

a) Require an explanation supported by reports, returns and other documents to rebut the alleged commission of the prohibited act.

b) In cases where an explanation has been issued but the DOE finds a violation because of materially insufficient reports, false returns, non-submission of required documents, provide a recommendation to the said person or entity;

c) Disclose the name of the establishments after it has received a recommendation and comply with such recommendation; and

d) Issue an order in cases where the said establishment fails to follow or comply with the recommendation of the DOE. The failure on the part of the establishment to comply with the order shall be a valid ground for the imposition of the administrative fines and penalties in accordance with Annex B. Schedule of Fines and Penalties of the PELP DC and/or the MEPP DC, as applicable.

C.8 Publication

C.8.1 DOE shall maintain a biannually updated list of compliant products

C.8.2 Non-compliant products shall be published in the DOE website within 72 hours from the date of issuance of the order of non-compliance and biannual in newspapers of wide-circulation, including the name of the Applicant or Retailer with the brand name and model to whom the violation applies and who failed to remedy the citation received from the DOE;

C.8.3 Outcome of the implementation of the PELP shall be included in the Annual Report of the DOE, highlighting the improvement in the compliance rate by Applicants and Retailers with energy labeling requirements as well as improvement in the energy efficiency of products sold to consumers in the Philippines.

Foreword

This Particular Product Requirements shall be an integral part of the Department Circular No.

DC2020-06-0015 entitled “PRESCRIBING THE GUIDELINES OF THE PHILIPPINE ENERGY

LABELING PROGRAM (PELP) FOR COMPLIANCE OF IMPORTERS, MANUFACTURERS,

DISTRIBUTORS AND DEALERS OF ELECTRICAL APPLIANCES AND OTHER ENERGY-

CONSUMING PRODUCTS (ECP)”.

This PPR provides the detailed technical requirements for television sets covered by PELP,

particularly requiring the attachment of an energy label as prescribed in D.3.11.

This PPR was adopted from the PPR developed by Technical Working Group 07 and was approved by the EUMB. Any clause in this PPR not affected by amendments made in the PELP, MEPP and Implementing Guidelines shall remain effective.

D.3.1 Scope

This PPR covers Television sets with screen size up to 1,524 mm (60 inches) and has

a tuner.

D.3.2 Definition of Terms

For the purpose of this PPR, the following definitions shall apply:

1. Applicants – refers to Manufacturers / Importers / Distributors / Dealers

2. Basic Model / Type – a product model whose main component and other design components are distinct as to voltage rating, power input, frequency, light output, etc.

3. Emergency Warning Broadcast System (EWBS) – a system that shall be activated to alert and guide the public of an impending or ongoing emergency situation by delivering warning information through an audible sound.

4. Energy Efficiency Factor (EEF) – refers to the ratio of the viewing screen area or the luminous area in square meters to total energy consumption in kWh.

5. Energy Efficiency Performance Rating (EEPR) - product’s star rating, which is based on the EEF and is displayed on the energy label.

6. Energy Efficiency Rating - as indicated in the energy label pertains to the rated EEF of Television sets.

7. Generic Models - refer to a range of models similar to the base model where all have the same major physical characteristics, construction, system design and other performance characteristics.

8. Luminous Area – refers to the measured viewing screen area determined by the length multiply by width of the luminous area with white pattern video input signal. The unit express in m2.

9. Television Sets - an appliance for the display and possible reception of television broadcast and similar services for terrestrial, cable, satellite and broadband network transmission of analogue and/or digital signals.

D.3.3 Normative Reference

The Television Sets covered under this PPR shall be tested, as applicable, according

to, but not limited to, the following standards and their future amendments.

1. PNS IEC 62087:2013 3rd edition – “Methods of Measurement for the power consumption of audio, video and related equipment” contains provisions, which through reference in this text form part of this national standard. At the time of publication of this standard, the edition indicated was valid.

2. PNS 378:2000 - “Television Receivers and Video Monitors – Viewing Screen Dimensions – Methods of Measurement”

3. IEC 62301- “Standby Power Measurement”

Considering the regular updating of standards, the latest edition of the PNS shall be used as

reference. It is understood that future amendments of the PNS indicated in this PPR shall be

after its promulgation. A transition period shall be provided to give ample time to all

stakeholders to adjust and conform to the new requirements, if any. This period shall be

discussed with the TWG and the stakeholders.

D.3.4 Sampling Method for Verification Testing

D.3.4.1 Three (3) units of base model or its generic model shall be randomly

taken from the sampling location. The procedure in PELP IG Annex C.5

– Verification applies.

D.3.5 Specific Guidelines for the Conduct of Verification Testing

D.3.5.1 Test methods to verify conformity to the claimed information in the label shall

be as specified in D.3.3.

D.3.5.2 Test method for measuring viewing screen size shall be in accordance

with D.3.3.

D.3.5.3 The luminous area shall be determined by multiplying the measured width

and the measured height using a white pattern signal through radio

frequency (RF) or baseband input. Measurements are in millimeters

(mm). However, the final result of the luminous area should be in square

meters (m2) rounded-off to the nearest 0.001 m2.

D.3.5.4 Samples shall be tested at a standard test voltage of 230V~+1%, 60Hz

+1%.

D.3.5.5 Television sets must be reset to default settings, Home mode or the

“Out-of-the-box” mode. The picture level settings, if it exists, shall be as

originally set as that of the manufacturer/importer. Other features such

D.3.5.6 Power consumption test methods shall be in accordance with

Po_broadcast: On (average) mode power consumption using dynamic

broadcast content video signal according to the normative reference.

The measurements shall be performed after the television set has

achieved a stable condition with respect to power consumption. The full

duration of the dynamic broadcast-content video signal issued for

measuring TV power consumption when the television is used for

viewing typical broadcast TV content. The measurement shall be the

average power consumed over ten consecutive minutes.

D.3.5.7 Measurement of standby power shall be as specified in D.3.3.

D.3.5.8 The ambient temperature in all tests shall be maintained at 23 °C ± 5.

D.3.5.9 The verification testing shall be conducted by DOE-LATD or its

recognized testing laboratory.

D.3.5.10 Conformance shall be evaluated according to the cases shown in Table
