In reply to your phone call last week on the 17/06/11 requesting additional information on the recent DAS application Find attached the following :

1) When was the last dredging campaign ? : according to information received from the ESB prior to the sale of the site to Endesa, the last dredging campaign occurred in 2006. See pdf copy of DAS permit no 375 which i found in the files.

2) Confirmation of quantities units ? : 10,000 tonnes

3) Confirmation of co-ordinates of DREDGE site ? : see attached PDF with co-ordinates

1. The Minister for Communications. Marine and Natural Resources, in exercise of the powers conferred on him by section 5 of. the Dumping at Sea Act 1996 (as mended), and after consultation with the Minister for the Environment, Heritage and Local Government, and the Minister for Enterprise, Trade and Employment, hereby grants this permit to the €38 Tarbert Generating Station, Tarbert, Co. Kerry.

2. "here is hereby authorised by this permit:-

(a) the loading at Tarben Generating Station onto the "Curraghgow IT" during the period from 1" September 2006 to 31' December 2006 of up to 1,800 tonnes daily, up to a maximum of 4,500 tonnes, of dredge spoil.

(bf the dumping from the "Curraghgour 11" in that part of the sea bounded by:

6) Latitude 52d 35'33" and Longitude 009d 21'30",

(ii) Lalitude 52d 35'38" and Longitude 0096 Zl'IO",

(iiil Latitude 52d 35'21" and Longitude 0096 21'12", and

(iv) Latitude 52d 35'27" and Longitude 009d 20'49'

during the period from 1'' September 2006 to 31" December 2006 of up to 1,800 tonnes daily, up to a maximum total of 4,500 tonnes, of dredge spoil,

3. This permit is granted upon and subject to the following conditions:-

(a) The substance or material to which this p e d t relates shall be dredge spoil from maintenance dredging at Tarbert Generating Station.

(b) Dumping shall be effected by release through the hull of the vessel.

(C) The following information in relation to each load of the substance or material intended to be dumped, and put on board the vessel, shalt be entt;red in a register relating to the dumping which shall be maintained by the holder of the permit:

(i) the name of the vessel;

(ii) the source of the substance or material;

(iii) the date, time and position at which the voyage for the putposes of dumping began and the place at which it began (in lat.Aong.);

(iv) the date, time and position at which dumping began (in 1at.ilong.) ;

(v) the date, time and position tit which dumping ended (in lat./long.);

(vi) the quantity, stated in metric tonnes, of the substance or material dumped:

(vii) the date, time and position at which rhe vessel completed the voyage for rhe purpose of dumping and the place at which it was completed (in 1at.Aong.).

(d) Entries in a register or lag required so be made pursuant to this permit shall be made as soon BS may be after the evenu to which they relate, The register or log shali be retained for not less than three years after the expiration of this permit and mpies af any such entries made during the period of validity of this pernit shall be sent to the Minister for Communicauons, Marine and Natural Resources, Leeson Lane, Dublin 2 as soon tis may be after 1 January 2007.

The cost of any tests, sampling, analysis and monitoring which the hhister for Communications, Marine and Natural Resources may require in relation to the dumping of the substance or material the subject of this permit shall be borne by the permit holder. Fu~ermore, the cost of any tests. sampling, analysis and monitoring surveys carried out by an aufhorised officer on behalf of the Minister for Communications, Marine and Natural Rcsourcw in rtlation to the dumping of 3 subsrancc or matcrid the subject of this permit shall also be borne by the holder of the permit.

operations. They shall permit and facilitate the carrying out by the officer of hisfher functions under the Dumping at Sea Acts 1996 and 2004, and shall comply with the provisions of these ACE in relation to the officer and those functions.

A marine position recorder in accordance with the specifications of the Department of Communications, Marine and Natural Resources shall be wmmissioned and mainmined on the dumping vessel. Information regarding dumping voyages shall be automatically recorded to allow monitoring of the dumping operation by the Department of Comunicatiom, Marine and Natural Resources.

The ESB shall undertake my other analysis and monitoring requirements specified by the Department of Communications, Marine during the term of this permit.

The ESB shall adhere to a11 the requirements of the Underwater kchamlogy Unit of the Department of Environment, Heritage and Local Government.

All VaSSdS used in connection with the dredging and dumping activity that is the subject of this permit must meet with the requirements of the Marine Surveyors Office for the purposes stated in this permit.

All vessels used in the dredging / dumping operations must comply with statutory regulations.

The ESB shall comply with all the recommendations of the Marine Surveyors Office.

An independent observer, with relevant expertise, shall accompany the dredge / dump vessel to monitor and record &e activity of dolphins during the duration of the works to which lhis permit relates. A buffer zone of 2.5km (approx. 1 .S nautical miles) shall be imposed around the dredge / dump vessel and all dredging / dumping will be suspended i f dolphin activity occurs within this zone (for the duration that such acrivity occurs within this zone}. A repon of the monitoring to which this condition refers shall be forwwded to the Coastal Zone Management Division of the Department of Communications, Marine and Natural Resources.

The ESB shall indemnify and keep indemnified the Stare, the Mjnister for Communications, Marine and Natural Rewurces, his officers, servants or agents against all actions, loss, damage, costs, expenses and any derriarids UI' claims howsoever arising in
