Every day, Medicare fraud af-fects people with Medicare and their families across the U.S. – regardless of background – robbing them of hard-earned money and peace of mind.

Scammers know the ins and outs of the Medicare system and their attempts can be well thought-out enough that it’s not always easy to know when and where fraud is occurring. By remembering some simple but effective tips, you can pro-tect yourself against scams, in-cluding identity theft and prescription drug fraud. Remembering to protect, detect and report fraud helps every-one, including you.

1. ProtectProtecting your personal infor-

mation is your best line of defense against health care fraud. Treat Medicare, Medicaid and Social Se-curity numbers like credit card num-bers. Never give them to a stranger and don’t carry your cards unless you need them for appointments. Medicare doesn’t call or visit to sell you anything. Outside of a trusted health care setting, never give this in-formation to anyone who asks for it.

2. DetectNo matter how careful you are,

you may be targeted for fraud. Al-ways review your Medicare state-ments closely. Things to look for include charges for something you didn’t purchase or receive, dupli-cate charges and charges for ser-

family, whatever you did — was in pursuit of happiness. Everything that humanity has done on this planet is in pursuit of happiness,” he observes. But these factors can be seen as externally rather than internally driven.

By contrast, another way to achieve sustained, long-term happiness involves starting from the inside. Sadhguru’s latest book, “Inner Engineering” offers guidance on how to achieve long-term happiness by focusing on yourself. The role of an Isha yoga practice, as outlined by Sadhgu-ru, is one element in the process of developing sustained happi-ness.

Isha yoga can help individuals develop happiness from within by build-ing confidence and health.

According to a recent survey of 536 adults who practiced Isha yoga, 98 percent reported improved mental clarity, 94 percent reported improved inner peace, and 92 percent reported improved emotional balance.

In addition, the Inner Engineering course “helps you put your life on self-start so you become in charge of your happiness, joy, and peace,” according to Sadhguru.

The course includes guidance on how to manage all aspects of one’s be-ing: mind, body, emotions, and “the fun-damental life energy within.” Interested individuals who have read Sadhguru’s

There are subjects in life that need to be dis-cussed, but many of us tend to avoid them. Is-sues like mortality and money top the list. As par-ents and children grow older, a must-have con-versation should be the topic of estate planning, but do we know all that we should?

According to Fidel-ity Investments’ “Family & Finance Study,” the an-swer is a resounding — and rather scary — “no.” In fact, seven out of 10 of children underestimated their parents’ estate by an average of $278,000. That’s a big number between knowing what is go-ing on and not understanding at all. It illustrates a breakdown in communica-tion that Kevin Ruth, head of Fidelity’s wealth planning and personal trust, says badly needs addressing through ‘frank conversations” between parents and their adult children.

Talking About Estate Planning Needs To Happen Sooner Rather Than Later

It’s no secret: Americans are des-perate for sleep. In fact, the U.S. sleep aid market is expected to grow to $44 billion by 2020, according to data from Persistence Market Research. However, achieving better sleep may be as easy as changing what you eat.

A survey commissioned by the Cher-ry Marketing Institute and conducted online by Harris Poll in January 2017 among more than 2,000 adults suggests that Americans may be open to alternate sleep solutions. An overwhelming 83 percent of Americans would prefer to im-prove their sleep through diet rather than using over-the-counter sleep aids.

One promising solution that doesn’t require a trip down the pharmaceutical aisle: Montmorency tart cherry juice, which has been scientifically studied for its ability to help improve sleep quality and duration. Montmorency tart cherries

nesses to pass on — most people, could do with some solid estate planning

Plus, there’s the federal government to consider. After all, no one wants the government getting any more money than is legally required. Some think they have knowledge of investments like IRAs and Roth IRAs, but even dis-tributions from these accounts can be problematic if the aim is to “stretch” pay-ments out to beneficiaries, tax deferred or tax free, for as long as possible.

To see what is involved, attorneys and tax advisors can help set up an estate plan. Plus, there are online re-sources like Fidelity’s Estate Planning Overview. Fidelity customers also have access to its new Estate Planner to more thoroughly prepare and educate themselves for a meeting, right down to details like organizing documents and choosing lawyers. While it’s scary to think about life without family members and what that life may look like, ultimate-ly it’s better to have a conversation and get a plan in place. Like the Boy Scouts, it pays to be prepared.

“What is happiness? We can say happiness is this or that, but in terms of life, your life energies are happening in a more exuberant way than it normally happens,” according to yogi, visionary, and thought leader Sadhguru.

Although children are naturally happy with things as simple as an empty box or a bucket of sand and some water, the cost of happiness increases in adult-hood, Sadhguru explains. Many adults find that their happiness depends on outside forces, such as relying on some-one else, obtaining something else, or engaging in additional activities.

“Even in the simplest of family situ-ations, conversations that don’t occur frequently and in detail can result in fairly substantial family disagreements and disconnects,” says Ruth. “Estab-lishing an estate plan is your best bet to ensure your loved ones are taken care of in your absence and that your wishes are carried out the way you want.”

In fact, according to the study, the two generations apparently can’t even agree on whether they’ve already had such detailed talks. Seventy percent of parents surveyed believe they have dis-cussed these issues; more than 50 per-cent of their children claim they haven’t. So what are the benefits of an estate plan?

It allows you to:• Preserve and maintain control over

the transfer of your assets.• Protect your family’s privacy and

possibly avoid probate.• Provide immediate access to liquid-

ity.• Choose how your beneficiaries will

receive assets.• Designate who will execute your

wishes even if you’re just incapaci-tated.These are solid reasons to research

estate planning today. One thing to remember, it’s not just for the very wealthy. Most people have complicated lives and issues that need exploring — with children and maybe step children’s interests to protect, or a family busi-

Much ado has been made about pro-tecting your personal information lately (Thank you, Apple and the FBI, for bring-ing this issue center stage.) And, accord-ing to techies who follow such trends, it would seem that many people are start-ing to take notice—especially when it comes to protecting their children’s pri-vacy using encrypted communications.

The argument against encryption goes something like this: it allows those who would do your children harm to “go dark.” While that may be true, encryp-tion is also a powerful tool that can help protect your children from those same predators, as well as bullies and others who want to harm them. In short, en-cryption is not just for privacy and se-curity, but also for personal safety and peace of mind.

Think of it this way: your phone and other digital devices contain almost all of your personal data — your current and past locations, your home address, in-formation about your family and friends, records of your calls and texts, email messages and every website you’ve ever visited. This means that all that

As extended families spread out throughout the country, it becomes more difficult to get everyone together. Holding a family reunion, then, gives ev-eryone a chance to meet, catch-up and learn a little more about their family his-tory.

Arranging a reunion can be a mas-sive undertaking, and it’s easy to be-come overwhelmed. But with a little planning, anyone can pull off a success-ful family reunion.

Follow these tips to ensure a fun, re-warding family reunion experience:• Createafamilyreunioncom-

mittee. You will need at least two people to plan location, food, ac-tivities, budget, mailings, payments and record-keeping. The better or-ganized your committee, the more smoothly your reunion will run. You can never start planning too early – you will need to start at least a year ahead of time.

• Pick a theme. Designing your reunion around a theme can make planning activities, food and deco-rations more creative. Family history themes, such a celebrating an anni-versary, a birthday or a cultural heri-tage – a Mexican fiesta, for example – are always popular.

• Developabudget. Your budget will influence the rest of your deci-sions regarding housing, food and activities. When in doubt, plan for

affordability – as much fun as a Ca-ribbean cruise might be, it’s unlikely that every family member can afford to attend.

• Planhousing. If possible, choose a location that offers a range of lodg-ing choices. National parks, for ex-ample, often have hotels nearby and may have cabins or tent-camping available, giving your guests plenty of options.

• Keep the kids entertained. Don’t presume that the grandpar-

ents or teenagers will act as babysit-ters for the whole reunion. Ask for vol-unteers, and rotate babysitting duties. Arranging competitions, like three-legged and costume races, will keep kids happy. You can even present the winner with a trophy – Plaquemaker Plus offers a variety of trophies, includ-ing “Trophy Dudes” with bendable arms and legs.

• Create activities. Adults might be content to sit around and chatter, but integrating the whole family can

be a challenge. Try giving each fam-ily member a family tree to fill out, or arrange a friendly game of family trivia. And don’t forget to take a fam-ily photo. Plaquemaker Plus (www.plaquemakerplus.com) can even cre-ate heirloom-quality wooden plaques or acrylic images, so you can offer a unique souvenir to any family member who wants one.

In a world that thrives on bad news and sensationalized storytelling, it can be difficult to find programming con-sisting of genuine and authentic shows about family.

Research suggests that 42 million adults are looking for programming with family in mind.

Enter UP TV, a network whose man-tra is We Get Family, and is staying true to its brand by ushering in shows that bring adult viewers all the fun, dysfunc-tion and love that defines the modern American family.

“With family as our framework, we are filling a void in the media landscape as the brand families trust most to bring them positive programming,” said Char-ley Humbard, president and chief exec-utive officer, UP.

That is how UP is finding its niche with families — through its brand. From shows about a single mom to parents with sextuplets to a family with 19 kids, UP is all about relatable and entertaining story-telling.

“We believe family, whether through blood, friendship or commu-nity, provides us with the most emotional and memorable experiences in our lives. It’s a journey

with highs and lows and everything in between.”

No doubt, with an endless array of choices, it can be difficult to find good, authentic, entertaining stories that viewers can feel great about watch-ing. UP seems to have found its foot-ing through original programming such as Growing Up McGhee, Bringing Up Bates, and Jo Frost: Nanny On Tour, as well as syndicated series such as Par-enthood, Gilmore Girls and America’s Funniest Home Videos.

And for those who are looking spe-cifically for family and faith-affirming content, UP has a subscription-on-de-mand offering, UP Faith & Family. For more information, please visit www.UPtv.com

The NBA DraftThough the NBA Finals are now

underway, it’s never too early to look beyond this season to the stars of to-morrow. That’s right, we’re talking about the NBA Draft, which will take place later this month on Thursday, June 22 starting at 7 p.m. EST. Like previous years, it’s another solid draft class that’s highlighted by a lot of col-lege one-and-done players. Look for Josh Jackson (Kansas; guard), Malik Monk (Kentucky; guard) and Jayson Tatum (Duke; forward) to all go as high lottery picks. Another interesting story-line to keep an eye on is former UCLA point guard Lonzo Ball. Bleacher Re-port’s mock draft has him going No. 3 overall to the Los Angeles Lakers, but the bigger story with Ball is the controversial things his father has said over the past several months. From insinuating that UCLA couldn’t win a national championship because it had too many white players to sparring with NBA analyst Charles Barkley to dissing LeBron James, LaVar Ball has ensured that wherever his son lands later this month, he’s sure to be bringing some baggage with him.

Though summer is mostly synony-mous with the NHL and NBA playoffs, and the heart of the MLB season, vari-ous other sports – even those in the midst of their off-seasons – still make headlines. To catch you up on what you may have missed in these various sports as well as preview some key dates coming down the pike, we’ve put together this sports roundup.

Winners and Losers from the NFL Draft

Though the NFL Draft has become a little too much pomp and circum-stance for many since it ditched its weekend-long format to stretch out over four days, you can’t say that it’s ever uneventful. Take the Chicago Bears for example. What were they thinking trading up from the No. 3 pick to the No. 2 overall pick to draft a quar-terback, Mitch Trubisky, who received mixed reviews during the process? As if swapping first-round picks with the 49ers wasn’t enough, Chicago also sent its 67th, 111th and a 2018 third-round pick to San Francisco to move up one measly spot! Sports Illustrated gave Chicago’s first-round draft selec-tion a “D,” and that may even be too generous.

The Bears were clear losers of the 2017 Draft, but there were plenty of teams that did a whole lot of good. Take Cleveland (yes, the Browns!) for instance. Cleveland used its three first-round picks to fill needs with solid tal-ent. Washington was able to score a great talent at pick No. 17 in Jonathan Allen, and Green Bay, a team that didn’t have a pick in the first round this year- -thanks to trading back, nabbed a great defensive back prospect in Kevin King at pick No. 33.

PGA Tour: The U.S. OpenAfter a great Masters tournament –

the first major of the PGA Tour season – all eyes are now on the second major tournament, the U.S. Open. The Open takes place June 15-18 in Erin Hills, in Wisconsin, and all eyes are on defend-ing champion Dustin Johnson. As you may recall, Johnson had to pull out of the Masters at the 11th hour because of a fluke injury he suffered to his back when he slipped and fell, awkwardly, on site. Johnson returned to action at the Wells Fargo Championship in early May, and the world’s No. 1 golfer ap-pears ready to go full-bore in defending his title at the U.S. Open. He’ll certainly be challenged by fellow up-and-comers Jordan Spieth and Rory McIlroy.

One has to wonder how much longer ESPN can continue to lay off its per-sonnel before it decides that a major brand revamp is necessary. When you can watch professional and college sports for free on Twitter, for instance, why should people pay for it on cable? ESPN has some major challenges in front of it, as rising broadcast rights fees aren’t translating to an increase in subscribers and advertising dollars.

West Coast Worries?Several in sports media have openly

wondered, lately, if sports viewership in general is being held back because arguably the best players in three of the four major sports leagues currently play for West Coast-based teams. There’s Mike Trout of the MLB’s Los Angeles Angels of Anaheim, Connor McDavid of the NHL’s Edmonton Oilers and Steph Curry of the NBA’s Golden State Warriors. Being that the vast majority of the U.S. population lives in EST, and CST time zones, typical Angels, Oilers and Warriors games don’t start until 10 p.m. EST or later, at night. Is this prob-lematic in engaging the fringe sports fan that just wants to watch the sport’s best players and teams? Perhaps. But it’s an interesting observation nonethe-less, especially considering a recent report from MediaPost stating that sports television viewing is down about 3 percent from previous years.

Until next month, we’ll leave you hoping that you enjoy the NBA Finals and Stanley Cup Finals, as well as all of the summer sporting events that are about to happen, like the NBA Draft and the U.S. Open.

The NBA Finals are finally upon us, and this year’s playoff season has been another one full of great individual per-formances, terrific team performances, and yes - as we’ll discuss later - one outstanding coaching rant. So, as you kick back in your recliner this June to see who will be crowned the next NBA champion, let’s take this time to catch you up on some of the top storylines from this year’s playoff season, as well as some things to keep an eye on this offseason:

How Good is Isaiah Thomas?Boston Celtics guard Isaiah Thomas

was selected 60th overall in the 2011 NBA Entry Draft. For those of you keep-ing track at home, that was the very last pick in that respective year’s draft. In other words, Thomas was “Mr. Irrel-evant” of that draft class. It might be six years later, but boy is Thomas making a whole lot of NBA teams that passed on him look foolish. This was punctuat-ed in a 33-point game in Game 1 of the Eastern Conference Semifinals against Washington and a subsequent 53-point game in Game 2 just a few nights later. What made these efforts truly remark-able, however, is that they came just days after Thomas’ younger sister tragi-cally died in a car accident. Bottom line - Zeke Thomas is good, and 29 teams look really dumb right now for not draft-ing him.

The Hot-Mess BullsInjuries, team off-the-court issues

and a trade. What could go wrong? Answer: The 2016-17 Chicago Bulls. Chicago didn’t secure a playoff spot un-til the final day of the NBA regular sea-son, and it was the eighth seed at that. And considering all of the off-the-court chemistry issues, having to split playing time between three point guards and manage numerous injuries, you can see why the Bulls went 41-41 in the regular season and sputtered out in the first round of the playoffs. What’s more is that coach Fred Hoiberg has $15 million left on his contract and is sure to return. Can Hoiberg - and the Bulls - learn from their mistakes and missteps and figure things out next season? Stay tuned. One bright spot from 2016-17 was

able free agents to be this summer, and it’s become ever more likely that he and the Clippers are seeking an amicable split. The results just have not been there. Griffin’s season this year again ended in injury and the Clippers’ sea-son, again, ended in a first-round playoff exit. Both parties are likely to look for a fresh start, and we’re betting that Grif-fin will have no shortage of suitors when free agency officially commences.

Griffin may highlight the free agent class this offseason, but he’s certainly not the only player with value that will be (likely) hitting the market. Some other notable free agents include Dwayne Wade, who is sure to part ways with the Bulls after last season. Utah point guard George Hill and the Clippers’ Chris Paul are also set to hit the market, though the latter has a player option that could be

picked up to stay with Los Angeles and likely will be. Finally, perhaps the two most interesting potential free agents are Steph Curry of the Warriors, who is unrestricted, and Kevin Durant, who has a player option. Both are unlikely to be playing anywhere but with Golden State next season, but you never know. Sports is a business, after all, and a lot of factors can play in to where a play-er sees the best fit, the most money and the greatest chance of winning of championship. Fox Sports has a great rundown of the best unrestricted, re-stricted and player option free agents to keep an eye out for this offseason.

Kudos to One Great Coaching Rant

Has there been a better coaching rant in sports recently than that which came from Memphis Grizzlies head coach David Fizdale after falling behind two games to none to San Antonio in the first round of the NBA playoffs? Fizdale went on a terrific, honest rant regarding the officiating, complete with superb one-liners like “They’re not go-ing to rook us,” regarding the free-throw discrepancy between the two teams. Fizdale brought the epic rant to a fitting close when he abruptly ended the post-game press conference with another great one-liner: “Take that for data.” It’s great to see coaches tell things like it is and it’s unfortunate that it happens so rarely these days. We’re betting that Fizdale scored a ton of points with the Memphis fan base sticking up for his team the way that he did. For evidence of such, just check out the T-shirts that were made following the rant. That’s some good stuff right there.

How Are the Soon-to-be Free Agents Faring?

The NBA playoffs don’t just mark the end of the NBA 2016-17 season, they also mark the final time that many players will be lacing up for their respec-tive squads. Yes, free agency is soon to commence. Blake Griffin (player option) no doubt highlights the list of likely avail-

Just ask any dad, he’s sure to agree: a perfectly seasoned steak flame-kissed to perfection is one of the great plea-sures of summer grilling. This Fa-ther’s Day, you may be able to teach dad a few tricks of your own.

Start by selecting a premium-quality steak like those from Omaha Steaks, which are aged at least 21 days to reach the peak of tenderness then flash frozen to stay that way. Then take that guaranteed quality to the grill and try a new method, such as slow, steady smoking, for an ulti-mate flavor experience.

After you choose a steak, these tips from Omaha Steaks Executive Chef Grant Hon can help you achieve steakhouse-worthy results.1. Proper preparation. Clean and

heat your grill to high. Make sure to oil grates after cleaning.

2. Prepare your steaks. Pat steaks dry and season food before grill-ing. Use sea salt and freshly cracked pepper or a complete steak seasoning or rub.

3. Searing. Sear steaks over high heat and avoid moving them be-fore they’re fully seared on all sides to protect flavor and juiciness.

4. Handling steaks on the grill. Use tongs or a spatula to turn meat on the grill; poking with a fork can damage the meat.

5. Controlling your cook. Close grill cover as much as possible while cooking to maintain a temperature around 450 F. This helps lock in fla-vor and prevent flare-ups. After de-termining the amount of time you’ll need to reach your desired done-ness, use the 60/40 grilling meth-od. Grill 60 percent on the first side then 40 percent after you turn the steak over for an even cook.

6. Juiciness. After grilling, allow steaks to rest tented with foil for 5 minutes between cooking and serving. This lets juices redistrib-ute for the best-tasting and juiciest steak.

7. Finish and enjoy. Garnish steak and serve with style. Add colors, textures and flavors to make per-fectly grilled steak even more memorable. Find more tips to make your sum-

mer grilling great at omahasteaks.com.

Crete’s food is natural and fresh, grown locally or caught in the sea. Consider trying sautéed goat, snails, fennel pies, and sugar-covered cheese turnovers. Tomatoes, straw-berries, watermelons, cheese, and yogurt are found everywhere.

Between 1420 BC and 1375 BC, the Minoans disappeared without ex-planation. The cause was believed to have been the ash and tsunami created by the massive eruption of the volcano at Santorini, just 90 miles away. Now, carbon dating indicates that the eruption occurred about 200 years earlier, but it still may have been a contributing factor in the downfall.

The best time to visit, considering weather, hotel rates, and crowds is from mid-May to late June, and the last couple of weeks of September. The high season is between April and October.

Museum in the capital city, Herak-lion (Iraklion). It maintains the finest collection of Minoan artefacts in the world. It’s a good way to learn about the mythology of Crete and Knossos. The island is said to be the birthplace of Zeus. The Minotaur (half man-half bull) was supposed to have wan-dered around a labyrinth at Knossos.

While Heraklion is a gritty, and not overly-appealing city, Agios Nikolaos is a place to find upscale resorts, and is a good base of operations from which to visit the island. One of the many civilizations that conquered Crete was the Venetians who built an impressive fortress in Heraklion’s harbor.

A laundry list of other civilizations occupied Crete, including the Ro-mans, Byzantines, Ottomans, and even Nazi Germany.

Our stay was too short, dictated by the cruise line schedule. When we return, we’ll head for the hills. We’ll find those peaceful coves, and sus-tain Mediterranean diets at the quaint village tavernas, where the tourists don’t go.

We’d also like to spend time at Matala Beach. It was a hippie com-munity in 1970 when Joni Mitchell vis-

time on 30-year-old, mid-sized cruise ship that traveled between the islands while we slept.

Our ship arrived shortly after sun-rise at Crete’s secondary port of Ag-ios Nikolaos. My first impression was that the area reminded me of Topanga Canyon.

Crete has been continuously oc-cupied since 7000 BC when the mys-terious Minoans arrived during the Bronze Age from what is now Turkey. Our first stop was the unfortified Pal-ace of Knossos, the center of the Mi-noan civilization, which may not have actually been a palace. The Minoans existed from 2700-1420 BC.

Beyond the remains of their struc-tures, little else is known about the Mi-noans because their written language remains undeciphered.

Britain’s Sir Arthur Evans discov-ered Knossos, and began excavating it in 1894. Interestingly, these ancient people did not call themselves Mino-ans. Evans made up the name. Until someone learns to read their writings, we won’t know what they called them-selves.

Evans’ work generated controver-sy because he began restoring parts of Knossos in Art Deco and Art Nou-veau style, instead of leaving the site in its natural state.

One of the famous frescos at Knossos shows men vaulting over charging bulls. These animals were worshipped by the Minoans, and the jumping was likely part of a ritual.

If time permits, visitors to Knossos should first stop at the Archaeological

I’ve often toyed with the thought of where I would

go if I were exiled to an island of my choosing. (Hawai’i not included.) Certainly, Tahiti would be at or near the top of the list. But I’ve now en-tered the Greek island of Crete into the mix.

Located just 250 miles from Africa, Crete is as far south as a person can go and still be in Europe. Like in Los Angeles, the climate is primarily Medi-terranean. There is no crime to speak of. The most common occupants of its small jail are fighting farmers and drunken tourists.

Crete is laced with craggy moun-tains, deep gorges, sandy beaches, and secluded coves. It features one of only two palm tree forests in Eu-rope, healthy meals, one of the lon-gest growing and beach seasons in Europe, and it’s the home of the first advanced civilization in Europe. Not insignificantly, there are no animals on the island that are dangerous to hu-mans. So, what’s not to like?

My wife and I have never been comfortable with the idea of taking a cruise. We prefer to get to our des-tinations quickly, so we can spend more time enjoying local cuisine and creating new experiences. But there aren’t many options when visiting the Greek islands.

The smaller islands don’t have air-ports. It is possible to island-hop us-ing Greece’s excellent system of fer-ries. But we ended up booking a tour that included spending part of the

OK, they never really went away, but with real estate values low, they just

didn’t pencil out. Now, with the price of housing starting to peak again, eq-uity is up and reverse mortgages are back in vogue. You have probably seen any number of celebrities touting reverse mortgages on TV, and in print telling us how we can use the equity in our homes to supplement retirement income.

To qualify, there has to be sufficient equity in a primary residence, and one of the borrowers has to be 62 years of age or older. The “reverse” mortgage simply uses a portion of the home-owners equity and turns it into tax-free cash. Better yet, you don’t need any current income to qualify, and you don’t need to repay the loan as long as you continue to live in the house. Sounds good. But wait, there’s more! What if you could use a reverse mort-gage to buy a home? Stop! Don’t you

THE LAW AND YOUR MONEYPage 12 El Pueblo | June 2017

Q: What’s the point of a pre-nuptial agreement, unless you’re rich?

A: A pre-nuptial agreement can be helpful in setting forth rules that will govern aspects of the marital relation-ship. Also, what if during the marriage you become quite wealthy? The pre-nup agreement can address the clas-sification of assets earned prior to the marriage, how separate property is to be dealt with, and just what is or will be marital property. If you already have children, a pre-nuptial may help to preserve certain assets for them (including if you separate from your spouse). Research further indicates a pre-nuptial agreement can support your estate plan, and set forth ground rules on deciding future matters. Bot-tom line, one of the reasons to have a pre-nuptial is to reduce the potential for conflict. As such, if it works for you and your future spouse, it does not re-quire that you be rolling in dough be-fore you are married. Above all, hav-ing a pre-nup is a personal decision, and consultation with a qualified fam-ily lawyer is advisable.

Q: Are there down sides to a pre-nuptial agreement?

A: There is one potential disadvan-tage to a pre-nup that is not a legal issue: The perception that if you ask for a pre-nuptial agreement you are sending a message you do not have the faith that the marriage will last. In essence, it ain’t romantic... Research suggests, however, that a post-nup -- which you enter into after the mar-riage -- is subject to some restrictions.

California law also may be sufficient for your purposes. Assets you own prior to marriage are separate prop-erty, while those accumulated during the marriage are community property. If this is to a large degree what you would seek to have in a pre-nup, then such an agreement may not be neces-sary. My recommendation, as above: Search your own soul, and consult with a qualified family law attorney. Go over what each of you have, what the pre-nup may accomplish, and what the law provides. If having a pre-nup in place is truly going to give each of you greater peace of mind, then the deci-sion may be less stressful and less dif-ficult to make.

Q: Can a pre-nup set forth child custody and child support?

A: No. Those are areas that remain subject to the authority of the Court in a dissolution proceeding, and de-pend on what is in the best interests of the child. There also are California child support guidelines that typically come into focus. Since the support of a child is a right the child has, it is not something that the parents can simply contract away.

Reverse Mortgages are Back, with a Twist!

have to already own a home to get a re-verse mortgage? Actually, no, you don’t. Let’s see how Fred and Betty can buy a new home using a reverse mortgage while making no monthly payments.

Fred and Betty owned a 2-story home in Los Angeles. They bought it years ago, raised their children, and now empty-nesters, decided to retire. “Fred, let’s get out of the city, maybe buy us a new home where it’s not so congested,” Bet-ty said. Fred thought about it and said, “Betty, it would be nice to have a brand new home, but we’re retired! We need to watch our cash. Do you really want a mortgage payment hanging over your head every month?” Betty picked up a magazine, paged through it, found the article she was looking for, and showed it to Fred. “Look Fred. It says here you can

buy a home using a reverse mortgage. Let’s go talk to someone to see how it’s done.”

The Home Equity Conversion Mortgage (HECM) for Purchase

Fred and Betty went to talk with Harry, a reverse mortgage broker. Harry explained how the “reverse mortgage for purchase” idea adds a new twist to retirement planning. “Imagine buying a new home for half the price and make no mortgage payments,” Harry said. “Yeah, in your dreams,” Fred replied. “Shush Fred. Let him explain it,” Betty said. After asking a few more questions, Harry made some calculations and showed them the following scenario:

“Let’s say you sell your house for $700,000, the current neighborhood value. You then buy a new home, maybe in Hemet or Lake Elsinore, for $450,000, putting down $250,000. Then, as part of the same purchase transaction, you get a reverse mort-gage on your $450,000 home. What just happened? You bought a $450,000 home for $250,000, and the reverse

mortgage uses your $250,000 equity to make your monthly payments.” Fred, looking at the numbers, asked Harry, “what happens if there isn’t any equity left when we die? What if we owe more than what the house is worth? “No wor-ries. The loan is insured. Also, a reverse mortgage is a non-recourse loan, which means the lender can’t go after your es-tate to make up any shortfall.”

The Take AwayIf you want to increase your retire-

ment cash flow you might want to look into a reverse mortgage. And if you want to get some new digs, take a look into Fred and Betty’s scenario. You might be able to get that brand new house, have more retirement income, and maybe even take a dream vacation every other year or so. What’s not to like?
