Michigan’s Educator Evaluation Law
Purpose of Evaluations
Determine educator effectiveness while ensuring that
ample opportunities for improvement are provided
Provide relevant coaching, support, and professional
learning

Observation Tool Requirements
Ensure and publicly report:
• Research base
• Author(s) and qualifications
• Evidence of reliability, validity, and efficacy or a plan for
developing evidence
• Evaluation frameworks and rubrics
• Process for observations and feedback
• Plan for training of evaluators and observers
Teacher Observations
At least two classroom observations per year unless
effective or highly effective for the two most recent
evaluations
At least one classroom observation must be unscheduled
(starting in 2016-2017)
At least one classroom observation must be conducted by
the administrator responsible for the teacher’s annual year-
end evaluation
Feedback provided within 30 days of observation
Includes, minimally, a review of the lesson plan, content
standard(s), and student engagement in instruction

Teacher Certification Implications
MCL 380.1531k: Beginning immediately, the
state superintendent may not issue or renew
an advanced professional certificate unless
the applicant
Has been rated highly effective for three out of the five
most recent annual year-end evaluations; and
Has not been rated ineffective within the last five
years; and
Meets additional criteria established in administrative
rules.
MCL 380.1531j: Beginning July 1, 2018, the state
superintendent may not issue an initial professional
teaching certificate until an individual has
completed three full years of classroom teaching
AND The individual was rated effective or highly effective on
his or her three most recent evaluations
OR The individual was rated effective or highly effective for
at least three nonconsecutive evaluations AND submits a recommendation for the professional teaching certificate from his or her current district superintendent
Public Act 170 of 2016:
Definition of “Teacher”
“(A)n individual who has a valid Michigan teaching
certificate or authorization; who is employed, or
contracted for, by a school district, intermediate
school district, or public school academy; and who
is assigned by the school district, intermediate
school district, or public school academy to deliver
direct instruction to pupils in any of grades K to 12
as a teacher of record.” (MCL 380.1249(8))
The Challenge
Certain individuals are required to hold teacher
certification for reasons of employment and
placement, but are not required to be evaluated
under MCL 380.1249.
MCL 380.1531j and MCL 380.1531k require
evaluations under MCL 380.1249 in order to
progress and/or renew certain teaching
certificates.
Solutions
Voluntarily meet the evaluation requirements
under MCL 380.1249 for teachers who hold
certification but do not fall under the definition
of “teacher”
Rely on forthcoming changes to teacher
certification administrative rules to ensure that
teachers can maintain certification in absence of
evaluation under MCL 380.1249

Provisional• Initial certification

• May be renewed two times (3 years each)
Professional• Three years of
“satisfactory” teaching experience under a Provisional Certificate
• Valid for five years
• Renewable in perpetuity
• Must meet defined professional learning requirements for renewal
Advanced Professional (OPTIONAL)
• Five consecutive “effective” or “highly effective” ratings
• NBCT or approved teacher leader training
• Valid for five years
• Must meet evaluation requirements for renewal

Additional Notes
Administrator certification is not tied to the administrator
evaluation system defined in MCL 380.1249b.
There will be a special data appeals process for
districts/schools to fix data errors in evaluation label
reporting in fall 2017.
The MDE is working with CEPI to establish a process for
non-public schools that voluntarily establish and use
evaluation systems to report year-end educator evaluation
labels.
The evaluation of shared time teachers must be
conducted by employees or contractors of the employing
public school district.
