Appointment,powers,duties of inspector

APPOINTMENT - For enforcement of the provisionsof the act, the state govt is empowered to appointInspector having prescribed qualifications.This may

be done by notification. They may be assigned suchlocal limit as the state govt may think fit.

Status

Every chief inspector , additional chief inspector,jointchief inspector ,deputy chief inspector, inspector andother officer appointed shall be deemed to be publicservant within meaning of indian penal code,[1860],and shall be officially subordinate to such authorityas the state govt may specify in this behalf.

POWERS OF INSPECTORSaccording to section9, an inspector is vested with thefollowing powers, which he may exercise within the locallimits under his control.the powers are to be exercised inaccordance with the roles framed for this purpose.

1.He may enter any premises which is used or which hehas reason to believe is used,as a factory. He may be

accompanied by such assistants, who are in the serviceof the govt or any local or public authority or with anexpert as thinks fit;

2. Make examination of the premises, plant,machinary

,articles or substanace.

3.Inquire in to any accidents or dangerous occurence ,whether result in in bodily injury, disability or not, andtake on the spot or otherwise statements of any person

which he may consider necessary for such enquiry;

4.Require the production of any prescribed register or anyother document relating to the

factory.

5.Seize or take copies of register, record or otherdocuments or any portion thereof as he may considernecessary in respect of any offence under this act,whichhe has reason to believe, has been committed;

6.Direct the occupier that any premises or any part thereofor anything lying therein shall be left undistributed[whether generally or in particular aspects] for so long asis necessary for the purpose of any examination ;

7. Take measurements and photographs and make suchrecording as he consider necessary for the purpose of anyexamination ,taking with him any necessary instrument orequipment;

8. In case of any article or substance found in any

premises,being an article or substance which appears to himas having caused or is likely to cause danger to the health orsafety of the workers, direct it to be dismantled or subject itto any process or test [but not so as to damage or destroy itunless the same is in circumstances necessary for carryingout the purpose of this act] and take possession of any sucharticle or substance or apart thereof and detain it for so longas is necessary for such examination;

9. Exercise such other power as may be prescribed;

Duties of Inspector

1.to carry out duties as laid down under section

2.to ensure that statutory provisions and rulesframed are carried out properly;and

3.to launch prosecutions against factory -ownersunder the provisions of chapter x of the act.

Certifying surgeons

APPOINTMENT

Section 10 empowers the state govt to appointqualified medical practitioners as certifying surgeonsfor the purpose of the act.these surgeons are

appointed to discharge duties within the local limitsplaced under their control or for such factory or classor discription of factories as may as may be assignedto them . The certifying surgeons with the approval

of the state govt may appoint qualified medicalpractitioners to exersize any of his power for suchperiod as he may specify.

Duties of certifying surgeons--the certifying

surgeons shall caarry out such duties as maybe prescribed in connection with-

1.Examination and certification of young persons

under the act;

2.the examination of persons engaged in suchdangerous occupations or processes as may beprescribed;

3.the exercising of such medical supervision for anyfactory or class or descripcrtion of factories where-

3.The exercising of such medical supervision for anyfactory or class or description of factories where-

a. cases of illness have occurred which it isreasonable to believe are due to the nature of themanufacturing process carried on, other conditionsof work prevailing therein;

b. By reason of any change in the manufacturingprocess carried on or in the substances usedtherein or by reason of the adoption of any

manufacturing process; there in a likelihood ofinjury to the health of workers employed in themanufacturing process;

c. young persons are about to be employed in anywork which is likely to cause injury to their health
