    DPPS RESPONSE TO POST ELECTION VIOLENCE RAPE VICTIMS CASE.

    The Office of the Director Of public Prosecutions today filed an affidavit before

    the High court in response to a petition by the Coalition on Violence against Women

    (COVAW) and 11 others.

    The petitioners allegednegligence and discrimination in the meting out of justice

    on Post Election Violence (PEV) cases of Sexual and Gender Based Violence (SGBV)

    victims.

    The DPPs response stands that no formal complaint was made to the

    office.

    In the past, the DPP appointed a multi-taskforce agency in April 2012to

    reevaluate the Post-election violence files including SGBV cases. COVAW (The 1 st

    petitioner) was among those invited to participate. However, none of those invited

    participated.

    Various results ensued from 369 cases of SGBV, where investigations and

    prosecution were undertaken based on available evidence. It can therefore not be said

    that the DPP was passive about the aforementioned matter.

    If the eight individuals in the petition formally complained to the DPP, there

    would have been a directive to the Inspector General of Police (IG) to act accordingly.

    Nevertheless, since the matter has been brought to DPP through the filed

    petition sworn on 21st January 2013, the DPP is still willing to act accordingly.

    In accordance with the constitutional mandate under article 157 of the

    Constitution; the DPP may institute and undertake criminal proceedings

    against any person before any court (other than a court martial) in respect of

    any offence alleged to have been committed.

    The matter has been set for hearing on the 25th March, 2014 where the

    petitioners are expected to produce evidence before the High Court.
