SITE REQUIREMENTS

Site survey

Hugh King & Co will carry out a site survey at an early stage of the contract to discuss and advise the most suitable location for placing the silo and to ensure that access for all placement and delivery vehicles is safe and suitable. No silo will be placed without this happening. Comprehensive method statements and risk assessments are available for the placing procedure. This service is included in the agreed material price. Servicing is carried out in line with manufacturer’s recommendations. Silos cannot be provided to sites that do not comply with these requirements.

The Base

The customer should ensure a 3 x 3 metre level base is constructed from 35N 150mm thick concrete and designed to support a minimum of 35 tonnes. The area must be free from the affects of running water and erosion. This construction is the responsibility of the customer but full advice and detailed drawings are available if required, especially if more than 1 silo is being placed. In addition no movement of the silo must be carried after placement without the

permission of Hugh King & Co. access to the silo must be maintained at all times in areas controlled

by site the silo measures 7.2 metres from the top of the foundation to the

top of the silo the site is responsible to provide safe access for deliveries and

collections and all signage relating to that.

ELECTRICAL REQUIREMENTS

3 phase mains

The silo arrives ready to be connected to an industrial 3 phase 5 pole switched socket provided by the site. This socket must be 16A 5 pin weather proof (supplied from a 16A 3 phase motor rated MCB type C or D). The electrical supply to the silo must also be protected by a 30mA RCD exclusively for the silo. This should be placed within 5 metres of the silo legs. The link cable, plus and socket should be of a suitable rating and mechanically protected (SY type). The plug and socket should have an IP rating of no less than 67 to prevent water ingress. It is the responsibility of site to provide these items and ensure they are protected from damage and the elements when not in use.

Single phase mains

The connection from the mains requires a 32A single phase 3 pin industrial socket which must be provided from a 32A motor rated MCB type C or D. The electrical supply must be protected by a 30mA RCD exclusively for the silo. 3 phase is always recommended so check for the availability of single phase if there is no other option.

Generator

Where no power is available a 3 phase generator with a minimum capacity of 12 kVA (fitted with a 16A 5 pin industrial socket from a 16A 3 phase motor rated MCB. type C or D) is also sufficient to run the silo. It is essential when this is used the control panel isolator is switched off before the generator is shut down. Failure to do this will result in costly repairs to the electric components of the control panel. Likewise the generator must be started before the control panel isolator is switched on.

Note

All installations must be installed to current IEE Regulation Requirements for Electrical Installations (BS7671:2001) with attention being paid to the special location section relating to construction sites – section 604.

Water requirements

A standard ½” tap located within 5 metres of the silo is required and the integral water pump on the control panel will provide the necessary pressure for the mixing unit. If the direct pressure from the mains supply is sufficient it can be fed via a 25mm hose.

Where poor pressure is experienced a 60 litre storage barrel controlled by a ball cock can be fitted to provide a steady flow of clean water.

Silos can be run off a bowser. Our representative can advise of this and the relevant connections.

SITE SET-UP

Ordering

All orders can be placed with Hugh King & Co offices on 01294 557515 or with your agreed contact. Please allow up to 72 hours for delivery. Every effort will be made to make delivery within this time scale but cannot be guaranteed.

Delivery Your silo will usually arrive containing 14 tonnes of material and will be refilled by tanker when required with 20 tonne loads.

To prepare for delivery there should be:-

unobstructed access to the silo at all times a hard level surface capable of carrying a gross weight of 40 tonnes headroom of 4.2 metres minimum width of 3 metres minimal delay after conforming to site rules

All unreasonable delays will be chargeable under the terms and conditions of the contract.

Re-ordering

Please allow 72 hours for delivery of your re-order of mortar. Deliveries within this time are not guaranteed. When re-ordering provide the office or representative with your site location your silo no eg:- K2219 your name and contact no day required any changes to the site set-up

All deliveries are assumed to be 20 tonnes unless previously agreed. It is the responsibility of site to order within the quantities of an official order. Any material ordered beyond that will be expected to be paid for through an amendment or re-issue of the original order. Your silo will require to be checked regularly for the level of mortar within it. This will be done either

manually by gently tapping the side by means of a low level indicator a digital read-out monitor silo

How to carry this out will be part of the operator training. You can also monitor this by easily calculating your tub use. Each 0.25m3 tub contains approx. 340 kg of mortar so 10 tubs is approx. 3.4 tonnes used. It is the responsibility of site to monitor these levels through their trained operator(s). Any material over-ordered cannot be credited and may incur disposal charges.

Training

All relevant personnel will be trained by our Engineers. A Training Certificate will be issued to all those trained. Only these authorised individuals should operate a silo to ensure safe and efficient working practices. The full induction procedure covers mixing operations cleaning, daily and weekly safety and maintenance optimising water levels to suit site conditions fault diagnosis

Continual monitoring of site practices will be done during routine maintenance and extra training can be provided by arrangement which may be chargeable.

DAILY USE

The silo should not be used until it is fully commissioned and operators training certificates issued.

The following is a reminder/summary of the full operating instructions that form the induction procedure.

Start-up

When using for the first time and every subsequent use place the tub under the discharge tube connect power cable and switch the control panel on connect the water run the mixer to check the direction is OK run the mixer open the butterfly valve on the silo adjust the water as required

The mixer works mostly off a timed run started by pressing the green button. It will stop automatically after the set time. Please ensure there is sufficient space in the tub to ensure the mixer outlet does not choke.

Daily Cleaning At the end of the day and before collection you must close the butterfly valve on the silo run out all the remaining material in the mixer run mixer empty for approx 5 minutes until clean water is discharged disconnect the water and remove the control panel to overnight store

Weekly Cleaning This procedure is essential to avoid repair bills carry out the daily cleaning procedure isolate from the power source remove the front mixing tube and screw clean thoroughly reassemble to keep dry

Cold Conditions Freezing water can cause serious damage to the panel and fittings and serious downtime on site. In addition to storing the panel in a frost free environment when not in use, also turn off the water supply uncouple the water supply pipe uncouple the pipe from the mixing chamber open the drain taps turn the control switch to brush position drain the water completely

Warm Weather / Lime Mixes With warm weather and / or lime mixes material can start to set if left for 30 minutes or more. This will overload the motor and cause problems when used again. To prevent this close the butterfly valve and run all the material out of the mixer each time it runs. Notes report all damage or changes to the silos immediately follow the procedures to ensure smooth running work with your contact to avoid chargeable repair

Following these steps and with trained staff, you will enjoy perfect mortar every mix.

SILOS

CONDITIONS OF HIRE / USE Revised: June 2013

1. Definition

“Owner” means Hugh King & Co. “The Hirer” means the person, firm or company or other party taking the plant on hire. “The Equipment” shall mean the equipment hired by the Hirer including all associated parts and accessories. “Week” means from midnight Sunday until midnight the following Sunday. 2. Commencement and Termination of Hire

(a)The minimum period of hire shall be one week (b)For the purpose of determining the Hirer’s responsibility for hire charges the period of hiring shall be deemed to commence when the Equipment is delivered to the Hirer’s site (“the start date”) and terminates on the date when the Equipment is removed from the Hirer’s site (“the termination date”). (c)Hire charges will be at the rate given on the quote for one week starting on the start date. The Owner reserves the right to vary that charge giving not less than one week’s notice. 3. Passing of Risk

Subject to these conditions all liability for loss or damage to the Equipment supplied by the Owner to the Hirer shall pass from the owner to the Hirer on the start date. In the event of loss of or damage to or a claim arising which prevents the operation of the Equipment hire charges will continue until termination of the hire in terms hereof. 4. Notification of Defects, Safe Keeping of Equipment

(a)The Hirer or his representative shall inspect the Equipment on delivery. The plant shall be deemed to be in good order (save for latent defects and defects not reasonably ascertainable by inspection) and no claim for loss and damage shall be entertained by the Owner unless the Hirer gives written notice to the Owner of an alleged defect within 48 hours of delivery. (b)The Hirer or his representative shall keep himself acquainted with the state, condition and use of the Equipment and shall ensure its safekeeping, shall use it as per the Owner’s instructions and return it at the termination date in the same condition it was delivered (fair wear and tear excepted). (c)The Hirer shall fully indemnify the Owner in respect of all claims arising from and in connection with use of the Equipment. From the start date of hire the Hirer shall, at his own expense, insure the Equipment against loss and damage however caused at a sum specified by the Owner. Evidence of this must be produced if required. 5. Care of Equipment

(a)The Hirer shall not sub-let the Equipment or any part of it without the Hirer’s prior consent in writing (b)The Hirer shall allow the Owner and his employees and/or agents access at all reasonable times for the purpose of inspecting, testing, adjusting the Equipment. In the event of a breakdown not readily repairable the Owner shall be entitled to supply substitute Equipment of a similar type and condition. If the Owner is not in a position to do so the hire shall be terminated as from the date of the breakdown. (c)Any breakdown or unsatisfactory working of the Equipment must be notified to the Owner within 24 hours of its discovery by the Hirer. (d)Subject to notification having been made to the Owner in accordance with the immediately foregoing condition, no charge will be made on the Hirer for any stoppages due to breakdown of Equipment caused the development of an inherent fault or fair wear and tear nor for stoppages for normal working repairs, but no allowance will be made for stoppages resulting from any other cause for which the Owner is not responsible. (e)Any repairs or replacements to the Equipment shall be carried out by the Owner and the Hirer shall upon demand reimburse to the Company the cost thereof.

(f)The Hirer shall not without written prior consent of the Owner make any alterations, additions or improvements to the Equipment and any such alterations shall remain the property of the Owner without cost to the Owner. (g)The Hirer shall not use the Equipment in any location other than the location specified. (h)The Equipment may only be moved by the Owner’s specialised lifting equipment. A charge will be made for moving the Equipment within the Hirer’s site. 6. Repairs and Adjustments

The Hirer shall not repair or adjust the Equipment or attempt to do so without the Owner’s written consent. 7. Determination of Hire

Where the hire is for a fixed period it shall terminate on the date of termination provided for. Where the hire is not for a fixed period, or where it is continued after the expiry of the fixed period without any new period being determined, the hire shall be terminated by either party giving the other 2 days notice in writing. 8. Consequential Loss

Save in respect of the Owner’s negligence if any and that only where death or bodily injury to any persons results the Owner shall not be liable for any consequential loss or damage due to or arising as a result of the Hirer having entered into this contract and the Owner’s prices are set accordingly. 9. Sale of Goods

The Owner agrees and declares that the contractual rights (if any) which the Hirer enjoys by virtue of the Sale of Goods and Supply of Services Act 1980 are in no way prejudiced by any of the provisions of this Agreement. 10. Failure to Pay

(a)If the Hirer shall fail to pay any sum if and when it may become due, the Owner may forthwith and without notice retake possession of the Equipment for which purpose it shall be lawful for him to enter into or upon any premises or site where the Equipment may be. Such retaking of possession shall not prejudice any right of the Owner under the terms and conditions of hire. (b)The occurrence of any of the following events shall in each and every case result in this Agreement being automatically and without notice be terminated. (i)If the Hirer acts as per clause 10 (i)-(iii) of the Owners general terms and conditions (ii)Loss or damage to the Equipment (iii)On inspection of the Equipment the Owner is dissatisfied with the manner of erection of the Equipment or its condition. (c)If after becoming aware of events that permits the Owner to terminate the agreement the Owner does not exercise that right it shall continue in full force but the all monies regarding rent and materials become due immediately. 11. Supply

(a)Safe and easy access is required. The Owner reserves the right to refuse to deliver or collect if this or the ground is unsuitable. The Owner shall be entitled to recover any extra costs associated making such arrangements (b)The Owner retains title to the goods supplied to the Hirer until such time as they are paid for in full. (c)At the end of the contract, silos should be emptied by the contractor ready for collection. Any remaining material will incur a disposal charge. 12. Conditions of Business

GENERAL (i) In these terms and conditions “Seller” means Hugh King & Co., “Goods” means the goods or services. “Buyer” means the purchaser of the Goods. (ii) Unless otherwise agreed in writing all the Seller’s quotations and contracts and all deliveries of goods are subject to the Conditions set out below and on the face of this document and orders will be fulfilled only upon and subject to these conditions. No amendments or modifications to these conditions and’ in particular, no terms or conditions of purchase of the Buyer shall form part of the contract unless expressly agreed to in writing by the Company. (iii) Any concession or waiver made by the Seller at any time shall not prejudice the exercise of its rights hereunder. (iv) The Buyer is deemed to have satisfied himself that the Goods are suitable for the purpose and capable of performing the function and use to which it is intended to put them. Accordingly the Seller as to the fitness or suitability of the Goods gives no warranty or representation for any particular purpose. (v) The Seller reserves the right to correct any clerical errors made by its employees at any time. (vi) Each of the clauses of these terms and conditions and every part hereof shall be separate and severable to the extent that if one clause or one part thereof shall be unenforceable the other clauses and other parts of the clause respectively shall be effective. (vii) Each delivery of Goods under this contract shall be deemed to constitute a separate contract to which the terms and conditions hereof shall apply, provided that these terms and conditions shall be subject to and shall in no way affect the Seller’s rights under clauses 5, 10 and 11 below to suspend or terminate the whole contract in the circumstances there mentioned. 2. PRICES/CHARGES (i) Unless otherwise stated on the face of the quotation/delivery docket, all prices are as delivered to the Buyer’s site exclusive of VAT duties or other Government taxes. (ii) The prices quoted on the face hereof are based on the current price of materials, labour, transport and other prime costs. In the event of any increase in any such costs prior to delivery the Company reserves the right to increase its price by an amount related to the increase in such costs. (iii) The Company reserves the right to make additional charges for Goods supplied outside normal working hours, i.e. 7:00 to 16:30 Monday to Friday and any delay beyond an acceptable discharge time for the vehicle. 3. PAYMENT TERMS (i) Where the Buyer has an approved account with the Company invoices will be submitted and are payable within 30 days of the date of invoice. (ii) The Buyer shall not be entitled to withhold or set off payments for any reason. (iii) The Seller shall be entitled to charge interest at a rate of 4% above base rate per calendar month on the day to day outstanding unpaid balance. (iv) Where the Buyer does not have an approved account with the Company, terms are cash with order before manufacture or order placed through an agreed Builders Merchant. 4. DELIVERY (i) Each delivery shall be made in accordance with instructions given by the Buyer or its daily representative. Such instructions may be verbal or in writing but, if verbal, the Buyer shall accept full responsibility for such instructions provided that the Company acts reasonably. (ii) Save as aforesaid, deliveries shall be made to the nearest accessible point to the works as determined by the driver or an employee of the Company. An employee or agent of the Buyer shall accept delivery and sign the delivery note. (iii) Claims for damages or shortages must be made verbally as soon as reasonably practicable and confirmed in writing within three working days. Signing the ticket as “Goods received unchecked” will nullify any subsequent claim unless made within that time. If the Buyer shall fail to give notice accordingly the Goods shall be deemed to be in all respects in accordance with contract and, without prejudice to earlier acceptance by the Buyer, it shall be bound to accept and pay for the same accordingly. (iv) Any time and dates quoted for delivery are approximate only and are not guaranteed, and the Seller shall not be liable for any delay in delivery of Goods howsoever caused. Any time or date for delivery shall not be of the essence unless previously agreed by the Seller in writing. (v) In the event of a valid claim for non-delivery, loss, damage or non-compliance with the contract, the Seller undertakes at its option either to reprocess or replace the Goods at its expense, or alternatively refund any of the contract price paid, but shall not be under any further or other liability to any person in connection with such a claim. (vi) If for any reason the Buyer is unable to accept delivery of the Goods at any time when the Goods are due and ready for delivery, the Seller may at its sole discretion and without prejudice to its other rights store the Goods at the risk of the Buyer and take all reasonable steps to safeguard them at the cost of the Buyer provided that the Buyer shall be informed thereof immediately.

(vii) The Seller shall have the right to make delivery by instalments of such quantities and at such intervals as it may decide, and express provisions as to instalments in the contract shall be in addition to and not in derogation of this right. (viii) Where delivery is to be made by instalments the Seller shall be entitled to invoice each instalment as and when delivery thereof has been made and payments shall be due in respect of each instalment whereof delivery has been made notwithstanding non-delivery other instalments or any default on the part of the Seller. 5. SUSPENSION OF DELIVERIES The Company reserves the right to suspend deliveries without involving any responsibility upon the Company during delays caused by circumstances beyond the control of the Company and/or its suppliers or if accounts rendered by the Company to the buyer are overdue for payment. 6. LIMITATION OF LIABILITY (A) The Company’s liability in respect of any apparent defect (including failure to comply with the specifications) is limited to the cost of the removal and replacement, provided that: - The Company has been given an opportunity of investigating any alleged defect and site practices and of making representations as to any remedial action to be taken. (B) Save as aforesaid, the company will not accept any liability whatsoever in respect of a delivery unless the Buyer has notified the Company in writing of a complaint within 7 days of the time of delivery. This includes short deliveries. (C) Where the Buyer does not act in accordance with the sub-paragraphs (A) and (B) above, any claim or right in respect of any such defects or delivery error shall be deemed to have been waived and to be absolutely barred. The Company shall not be liable in any circumstances for indirect or consequential damage or loss in relation to any defect or delivery error or breach of contract. 7. PASSING OF RISK AND TITLE (i) The risk in the Goods shall pass to the Buyer when the Seller delivers the Goods, save when condition 4.(vi) applies. (ii) The Goods shall remain the property of the Seller until all sums due from the Buyer to the Seller for this contract between them has been paid in full. Until such payment the Seller reserves the right to dispose of the Goods and if payment is overdue in whole or part the Seller may (without prejudice to any of its other rights) recover or resell the Goods and may enter upon the Buyer’s premises by its servants or agents for that purpose. (iii) The Buyer shall if so required by the Seller store the goods in such a way that they may be readily identified as the property of the Seller. (iv) If the Goods are sold by the buyer to a third party before payment in full of all sums due from the Buyer to the Seller has been made in accordance with sub clause (ii) hereof then all rights of the Buyer against the third party in respect thereof shall be deemed to be assigned to the Seller. 8. STORAGE The Buyer shall be solely responsible for providing safe and suitable storage for the Goods and will indemnify the Seller against any damages, claims, expenses or other costs which may arise as a result of the buyer’s failure to observe such a condition. 9. INSTALMENTS For the purpose of these conditions each delivery is treated as a separate contract. 10. BREACH If the Buyer: - (i) makes default in or commits any breach of his obligations to the Seller hereunder, or (ii) commits an act of bankruptcy, becomes apparently insolvent, makes an arrangement or composition with creditors or (being a company) has had convened a creditors’ meeting, has a receiver, administrator or liquidator appointed or a resolution has been passed or a petition presented to any court for winding up of the Buyer or any proceedings have commenced relating to the insolvency or possible insolvency of the Buyer, or (iii) causes or threatens to cease to trade or if serious doubt arises as to the Buyer’s solvency then in any such case the Seller shall immediately become entitled (without prejudice to its other claims and rights under this contract) to suspend further performance of this contract (for such a time not exceeding 6 months) and to treat the contract as wrongfully repudiated by the Buyer and forthwith terminate the contract. The Seller will notify the Buyer of the exercise of its option to this right within a reasonable time of becoming aware of such facts. 11. FORCE MAJEURE If events beyond the Seller’s reasonable control prevent the Seller from performing its obligations hereunder the Seller may without liability cancel this contract. 12. ORIGINAL WORK Where the Seller carries out original work, the Goods are submitted in confidence and unless otherwise agreed in writing the copyright and other commercial rights in them still remain the Seller’s property. 13. JURISDICTION The laws of Scotland shall govern this contract and the parties hereto submit themselves to the non-exclusive jurisdiction of Glasgow Sheriff Court or the Court of Session, Edinburgh.
