1. Executive Summary
One of the focal points in international trade are a country’s borders and the efficiency of the performance of
Customs and other border agencies in clearing goods entering and exiting the country. A Time Release Study (TRS)
is a unique tool and method for measuring the performance of Customs and other border agencies related to
trade facilitation at the border. TRS measures relevant aspects of the effectiveness of operational procedures that
are carried out by Customs and other regulatory actors in the standard processing of imports, exports and in
transit movements. It seeks to accurately measure these elements of trade flows so that related decisions to
improve such performance can be well conceived and carried out effectively. The study also helps to address the
concerns of trading community regarding delays in the clearance process and recommends ways to respond to
them.
Studies conducted by various international organizations have shown that the decreasing of trade barriers
increases domestic productivity and helps to encourage foreign investment. This includes the relationship of
customs procedures and other practices that may add to the cost or time requirements of trade. Article 6.1 of
Trade Facilitation Agreement addresses conducting a Time Release Study such as the one conducted in Kosovo.
Article 6.1 reads “Members are encouraged to measure and publish their average release time of goods
periodically and in a consistent manner, using tools such as, inter alia, the WCO Time Release Study.”
A Time Release Study was carried out in Kosovo at selected border crossing points and inland terminals in the fall
of 2016. The World Bank Group (WBG) supported this effort, which was led by the Kosovo Customs
Administration.
The TRS was carried out in accordance with World Customs Organization (WCO) and World Bank Group
methodology. It documented procedures and measured processing time of commercial road traffic passing
through selected border crossing points (BCPs) and inland terminals. WCO TRS software was used for data
collection and analysis. In order to facilitate data collection a standardized questionnaire was used (see
Appendices 6, 7 & 8). The questionnaires were given to the driver of the truck when the conveyance arrived at
the BCP and attached to the document package (SAD or T1) and remained with it until goods were released. 1
The data collection followed the Customs declarations. Enumerators were used to ensure that the questionnaires
were being completed – either by retrieving it at each step and filling in the appropriate part or by simply ensuring
that the completion was done by the relevant border agency officials and customs brokers/freight forwarders.
Selected enumerators were used to input the collected data into the WCO TRS software.
A TRS pilot was carried out on September 26 and 27, 2016.
The actual TRS data collection was carried out from October 10 – 15, 2016, at the BCP Kosovo/Albania (Vermica);
BCP Kosovo/Macedonia (Hani i Elezit); BCP Kosovo/Serbia (Merdare); Inland Terminal Hani i Elezit; Inland Terminal
Prizren; Inland Terminal Pristina; Inland Terminal Ferizaj. These border crossing points and inland terminals

represent the top 5 terminals with the most volume in 2016.

1.1. Summary of Results
i. For import, the average time between the date and time the conveyance arrives at the BCP and the date
and time the conveyance leaves the BCP is 6 minutes. The average time between the date and time the
conveyance arrives at the inland terminal and the date and time the Release Order is issued is 4 hours and
6 minutes.
ii. For export, the average time between the date and time the conveyance arrives at the inland terminal and
the date and time the conveyance leaves the inland terminal is 33 minutes. For export, the average time
between the date and time the conveyance arrives at the BCP and the date and time the conveyance leaves
the BCP is 1 hour 10 minutes.
iii. The average times listed above show the total time required for all procedures including the Food and
Veterinary Agency (FVA) broker and bank processing.

1.2. Recommendations
The analysis of the data collected during the TRS shows that there are no major bottlenecks or impediments that
affect the release time for transactions and contributes to trade facilitation.
However, there is room for improvements to be made and the following recommendations are offered for
consideration:
Short term:
▪ Expand the number of commodities/traders authorized to use the Simplified Release procedures; ▪ Expand the hours of operation at the inland terminals (some of the outliers were due to carriers arriving at
the terminal late in the day);
▪ Ensure uniform application of policy and procedures by reviewing the procedures at the inland terminals as
there are in part significant discrepancies amongst the terminals in the time taken for various procedures.
Medium to long term:
▪ Continue to work on and implement an Authorized Economic Operator (AEO) Program that is currently under development. With this program in place, trucks would by-pass the inland terminal and proceed directly to the traders’ premises;
▪ Develop a single unified ICT system with interconnectivity between Kosovo Customs and Food and
Veterinary Agency. This would help eliminate the requirement for hard copies of documents and would help
reduce the time needed for FVA processing as this could be done online resulting in online approval;
▪ Consider separating release from payment of duty (a deferral of duty payment based on posted guarantees);
▪ Consider developing an electronic Single Window to facilitate issuance of licenses, permits and certificates.

2. The Kosovo Time Release Study
2.1. Methodology and Process
Methodology followed in conducting the Kosovo TRS

The phases followed in conducting the Kosovo Time Release Study were:
1. Preparation of the Study including process mapping, development of Study tools and sampling
2. Briefing and sensitizing the stakeholders including public relations initiatives
3. Pilot testing
4. Conducting the actual Study
5. Analyzing and validating data followed by data cleaning
6. Report preparation with key findings and recommendations
The WCO’s “Guide to Measure the Time Required for the Release of Goods Version 2“ and the WCO software
were used in the conduct of this survey.
Preparation of the Study
This phase included the design of the questionnaires, the determination of scope and the design of the Study
(methodology, sampling etc.) and mapping of the various processes.
University interns were hired by IFC to assist in the carrying out of the TRS. The interns’ role was to:
▪ Assist in the collection of the required data
▪ Ensure all questionnaire forms are completed fully and accurately

▪ Input the collected data from the questionnaires into the TRS system designed by WCO
▪ Ensure the integrity of the collected data by conducting a validation exercise.
It was decided that the TRS would be conducted for a period of six regular working days, Monday to Saturday,
which is when the inland terminals are operating. The Time Release Study was conducted from October 10-15
between the hours of 8:00am to 4:00 pm at the BCPs with Macedonia (Hani i Elezit) and Albania (Vermica), and at
the inland terminals, Prizren, Pristina, Ferizaj and Hani i Elezit. Border crossing points across Kosovo are open 24h,
however, the Customs operating hours for clearance are open from 8:00 to 18:00. Questionnaires were also
distributed at the border with Serbia during the last two days of the survey period in order to meet a target of
distributing 500 questionnaires.
The Study covered all consignments except those under simplified procedures. Simplified procedures constituted
20.27% of all shipments imported in 2016.
Business process maps detailing import, export and transit procedures were developed for all BCPs and inland
terminals to be included in the study. The process maps were validated by Customs as were the questionnaires.
Based on these maps, questionnaires were developed to collect data on the import and export processes.
The questionnaires were designed to capture time data for the processing procedures in the order that they occur
and to record times taken by the FVA in approving an application (see Appendices 6, 7 & 8).
Briefings and sensitizing the stakeholders
On September 22,2016, a briefing session was given to representatives of Kosovo Customs, other border agencies, terminal operators as well as freight forwarders. The purpose of the TRS and the WCO methodology were explained in detail to the participants. It was explained that the TRS is a method for measuring the actual time and steps required from the arrival of goods until their clearance and release into the domestic market. All inland terminals and border crossings where the TRS Study was undertaken, were visited and Customs Officers, customs brokers and terminal operators were briefed on the study.
Pilot testing
A pilot test was conducted on September 26 and 27, 2016 at Hani i Elezit.
Pilot tests are important in order to ascertain if the data collection can be done as prescribed. They also provide
the opportunity to remedy any problems that might be encountered due to a lack of understanding by the
personnel collecting and recording the data.
The specific objectives of the pilot test were to:
- determine if the proposed methodology of collecting data would work operationally; and
- acquaint the brokers with their tasks of completing the import and export questionnaire.

The results of the pilot indicated that the questionnaire was appropriate and that its completion would provide
the data necessary for an analysis of the time required for release of goods.
Sampling Process
The statistics for the number of T1s processed during one week in August 2016 (a time period that is representative of the declaration volumes during the same time period of the Study) at the BCPs that would be involved in the TRS were reviewed to ascertain whether or not a sampling process should be used. The statistics showed that the volume of imports was approximately 350 and the volume of exports approximately 150. These figures represented the volume of declarations that were processed in the normal procedure rather than simplified procedures.
Based on these statistics, it was decided not to use a sampling methodology but rather to record data on all import
and export transactions that were not subject to Simplified Procedures.
Distribution of questionnaires started on October 10, 2016.The table below shows how many questionnaires were
collected per inland terminal.

Data Analysis
As shown above in Table 1, the total number of questionnaires collected for import was 441 and the total for
export was 279. The data from these questionnaires was entered into the WCO TRS system.
The WCO TRS software can run data validation reports. This program was run to identify any anomalies, and any
identified errors were corrected. All questionnaires were checked to ensure accuracy of the data reported.

2.2. Findings
The analysis of the data collected during the TRS shows that there are no major bottlenecks or impediments that affect the release time for transaction and contributes to trade facilitation. All stakeholder processes that were included in the study (brokers, FVA, banks) were carried out expeditiously.

Note: One will note that the number of surveys reflected above in the first row is 382 for elapsed time for arrival
of a truck at BCP and issuing of Release Order, yet the number of surveys for the second row is 427. The reason is
that of all the surveys collected only 382 had responses to the questions defining the interval being measured (in
this case, the date the truck arrives at the BCP and the date the Customs issues the Release Order at the inland
terminal). There were 427 surveys that had responses that corresponded to the interval “arrival of the truck at
the BCP to the truck exiting the BCP”. This type of variation applies throughout the various sections. The figure of

Processing time by phase
Detailed statistical breakdowns of the intervals involved in processing import declarations are reflected in Appendix 9 and Appendix 10 provides the statistical breakdowns for export processing.
Comments
In September 2016 the IFC conducted a mission to work with FVA to establish a risk management policy. During the meetings with the FVA we learned that there are sometimes problems with the clearance of perishable goods particularly on weekends and public holidays. Some of the frustrations occur as the bank is not open for the payment of charges and others occur with the coordination between the Customs and FVA clearance process. A review of the clearance of perishables such as 1 day old chicks and other highly sensitive goods would be worthy of further investigation.

2.3. Conclusions
One of the main purposes of the TRS is to identify bottlenecks and impediments to the timely release of goods and to make recommendations for actions to remove them. The analysis of the data presented in Appendices 9 and 10 indicates that there are no major bottlenecks or impediments. Rather, by implementing the simplified procedures program and owing to the manner in which yellow channeled declarations are processed, Kosovo Customs is ensuring that the release of cargo in both regimes of import and export is facilitated expeditiously.
Time Release Studies should be conducted on a regular basis at least every 24 months to ensure that processes
are efficient or after major policy changes or modernization initiatives have been implemented. This study
provides baseline statistics which can be used to provide an objective baseline measurement against which the
impacts of reforms and modernization can be measured and evaluated over time.
2.4. Recommendations
The following recommendations are offered for consideration:

Appendix 1: Kosovo Customs Today
Background and context
Kosovo is part of the Balkan Peninsula situated in Southeastern Europe. It is bordered by Macedonia and Albania
to the South, Montenegro to the west and Serbia to the north and east.
Customs Service of UNMIK was established in August 1999, to ensure the application of fair and uniform customs regulations and other provisions applicable to goods, which are subject to customs supervision. On 12 December 2008 Customs Service UNMIK became Kosovo Customs. A new Customs Code was adopted on 11 November 2008 by the Kosovo Assembly. The Customs Code is in full compliance with the legal standards of the European Union and among others has the economic development of the Republic of Kosovo as an objective.2
Aside from customs duties Customs also collects VAT and excise tax. Besides the collection of revenues, Kosovo Customs protects society from smuggling of drugs and other prohibited goods.3
Kosovo started to organize its border checkpoints with the help of the United Nations Mission in Kosovo (UNMIK)
interim administration and European Union (EU) in 1999. Nowadays, there are 13 border crossings and 10 inland
terminals functional with 622 employees across Kosovo.
Kosovo Customs collects about 70% of revenues to the Kosovo Consolidated Budget. The IMF has repeatedly praised the performance of the Customs and considers it in line with Western European services.4

Border crossings used in Kosovo TRS:
Hani i Elezit Border Crossing Point - located in the southern part of the Republic of Kosovo, in the 70th kilometer
of the highway between Prishtina and Skopje, Macedonia. It is the customs station with the highest inflow of
passengers, vehicles and trucks that carry commercial goods for Kosovo markets. Hani i Elezit is includes two
partswhere Kosovo Customs operations are performed: the Border Crossing Point and the Terminal.5
Vermica Border Crossing Point – an official international border crossing between Kosovo and Albania. It is the
only border crossing point between Kosovo and Albania that serves commercial goods, and has the highest volume
of passengers entering or exiting Albania.6
Merdare Border Crossing Point- is located at kilometer 37 of the highway Pristina to Nis, Serbia. in the North-
East of Kosovo. It started operating in 2001. In 2002, a customs terminal was opened in Podujevo to complete
the clearance of goods, while the border crossing deals with documentary checks. and clears goods contained in
passengers’ baggage.7

Appendix 3: Customs Processing
Overview of the Customs clearance process
Kosovo Customs uses ASYCUDA World as its declaration processing system. Declarations are submitted electronically to Customs for processing. However, when clearance by FVA or physical examination is required by Customs, the agent is required to submit hard copies to the appropriate unit.
Kosovo Customs has two forms of Customs clearance which dictate where the clearance procedures will take
place. Customs has implemented simplified procedures for certain declarants and specified commodities (see
Appendix 11). Commodities that are subject to simplified procedures are cleared at the Border Crossing Point
(BCP) and can proceed directly to the trader’s premises.
Commodities that are not subject to simplified procedures are transported to inland terminals for Customs
clearance. The trader can choose to have his goods cleared at any inland terminal. The inland terminals are
privately owned.
AYCUDA World categorizes declarations into four channels (both import and export) depending on risk analysis.
The green channel indicates an immediate release without Customs intervention (declarations covering goods
subject to the simplified procedures are treated as green channel); declarations in the yellow channel require a
document review by Customs; the red channel indicates that the goods covered by the declaration require a
physical exam; and the blue channel indicates that the declaration is subject to audit after the release of the
goods.

Appendix 4: Import and Export Processing
Import processing
The following steps are carried out at the BCP:
▪ On arrival of the conveyance at the BCP, police checks including immigration checks are performed; ▪ The Customs officer verifies that the T1 (a T1 is a transit document used to transport goods under bond
from one Customs office to another – it is used for both internal domestic transit and international
transit) is in the system; if it is not, the conveyance is held until a T1 is submitted;
▪ Conveyances can be weighed if necessary and the weights are recorded;
▪ Physical inspections of cab can be done if deemed necessary by the Customs Officer;
▪ The conveyance is released from the BCP – if the declarant and imported commodities qualify for
simplified procedures, the conveyance remains at the BCP area for a minimal amount of time and if there
is no further Customs intervention within that time delay, it may proceed to the importer’s premises;
▪ For loads that do not qualify for simplified procedures, the conveyance is released from the BCP and it
proceeds to the inland terminal.

The following steps are carried out at the inland terminals
▪ The terminal operator confirms arrival of the conveyance at the terminal;
▪ The freight forwarder confirms the T1 and registers the manifest;
▪ If shipment requires clearance of FVA, hard copy SAD is submitted to appropriate FVA unit for clearance
– FVA Inspector performs documentary check and indicates if physical examination is required – FVA
Inspector stamps SAD to indicate declaration has been reviewed;
▪ SAD is registered in AW;
▪ Declaration subjected to AW risk assessment/selectivity;
▪ GREEN channeled declarations routed to blue channel, payment order issued, payment received, exit note
created in AW and printed by freight forwarder, conveyance proceeds to exit gate, documentation verified
and conveyance exits terminal;
▪ YELLOW channeled declarations – conveyance remains in terminal to allow time for document review and
resolution of any queries. Not all yellow channel declarations are subjected to document review – if the

Appendix 5: Food and Veterinary Agency Processing
Plant and animal products entering Kosovo require an import permit and clearance by FVA. Kosovo law requires
that KVA processing be done before Customs clearance. In order to ensure that all consignments requiring KVA
processing are cleared by KVA before release is given, Customs has crossed referenced in ASYCUDA the tariff codes
pertaining to KVA requirements and will not release consignments with those codes unless there is a FVA stamp
on the declaration indicating a FVA clearance.
The FVA processing steps are as follows:
▪ consignment transported from BCP;
▪ Freight/forwarder submits a hard copy of the declaration and supporting documents to the FVA office at
the terminal;
▪ FVA inspector undertakes a mandatory document check and liaises with FVA headquarters to request an
import permit – import permits for meat imports are issued by the Chief Veterinary Officer;
▪ documentary check will determine if a physical check is required and the extent of the extent of such
examination;
▪ physical examinations are carried out with Customs;
▪ if there is identified risk from examination or the declarant is a new importer or if the consignment is
known to be high risk, the inspector will take three samples of the goods for laboratory analysis; one
sample returned to importer, one sent to laboratory and one retained at office;
▪ consignment is held until laboratory results are received the FVA inspector at the office;
▪ Customs processing of the declaration can be done pending receipt of laboratory analysis – however
consignment will not be finally released until Customs receives FVA clearance;
▪ FVA does not hold consignment at inland terminal pending laboratory results – consignments are held
intact at either importers premises or approved warehouse;
▪ if laboratory results negative, the consignment is released;
▪ if laboratory results positive inspectors at all border crossings are advised to take samples of same
commodities for laboratory testing;
▪ FVA will perform another test to verify results of first test - if same results Importer may have second test
performed at accredited laboratory at his expense;
▪ if import is refused by FVA, consignment is re-exported or destroyed.
▪ Animal importations are processed by qualified veterinarian.

Appendix 11: Summary of Simplified Procedures
Simplified procedures are an important part of modern customs administration. Simplified procedures
can make the customs treatment of imported goods much less complicated and also, according to the type of
procedure, less time-consuming.
The Customs and Excise Code of Kosovo (2008 code number 03/L109) authorizes simplified procedures in
Articles 80 to 87. The Code was amended in 2011 (Law No. 04/L-099) to authorize additional simplified procedures
in connection with Authorized Economic Operators and the use of summary declarations. In addition, the Kosovo
Customs Service has the Administrative Instruction №23/2016, regarding simplified procedures.
There are 18 articles in the Administrative Instruction. These articles consist of detailed information how to
be admitted to the simplified procedures, the types of goods that can be processed under the simplified procedure
and the simplified procedure itself. The purpose of these instructions is to provide for release of imported goods
in free circulation or the export of goods in a more simplified manner through a Single Goods Declaration.
A trader must be authorized to use the simplified procedures. In order to be authorised, a request must be
submitted to customs regional office. The requester must meet certain criteria such as providing guarantees for
Customs debt coverage that may incur, appointing a specific contact responsible for the simplified procedure,
ensuring that any invoices produced for the simplified procedure contain all the elements necessary for Customs
clearance, the ability to transmit data electronically to Customs, maintaining books and records and providing
written evidence that it is not under investigation for any criminal charge related to economic activity and that it
is not subject to bankruptcy procedures.
The Simplified Declaration Procedure is given for consignments of goods that have tariff number, technical
characteristics and trade nomenclature of the same type; that are easily identified and for such goods that do not
required additional documents for being classified accordance to TARIK or for the determination of origin as well
as the acceptance of the value presented on the invoice.
The following conditions concerning the goods also apply:
- the goods are imported in deliveries that consist of only one item (one kind of good for one delivery).
However, an authorization may be given to cover some types of goods, as well as may be given for more
than one authorization (exm. an authorization for a customs branch) for the same declarant;
- they are of low level danger related to the entries;
- they are not subject to any form of excise tax;
- they are not submitted trade policies measures according to TARIK;
- goods are packed in a standard package that is easily counted;
- transported in that form that may be examined easily without being discharged; and
- the value of goods per loading is not bigger that 6000 EURO, excepting the specifics of the case due to the
nature of the goods.
All the goods which are admitted to the simplified procedures are contained in a list which is developed

by the Kosovo Customs Service and annexed to the Administrative Instruction. The mentioned list can be amended
with a reasoned request by organizational units of Kosovo Customs and with approval of Director General. Most
of the goods admitted to the simplified procedures are construction items.
When the cargo comes to the BCP of Kosovo with the goods, which are admitted under the simplified
procedures, a simplified declaration for release in free circulation or the export of the goods may be done by
presenting an incomplete declaration T1accompanied by:
1. two copies of the invoice;
2. a document that serves as an evidence for the origin of the good;
3. other mandatory documents for implementation of provisions that regulate the release in free circulation
of declared goods;
4. in the respective column of incomplete declaration shall be stated the invoice value and the number of
the invoice that accompany the goods;
5. in the respective column of incomplete declaration second subdivision, shall be mentioned the amount
which covers customs debt;
Also, simplified declarations from authorized customs agents, must be deposited in the ASYCUDA World
system before import. When the goods arrive for import at the entry point, the Customs Officer will verify
that:
(a) the subject is authorized to use simplified procedure declaration;
(b) the declared good correspond with specific conditions in Authorization;
(c) the import is covered with financial guarantee.
All deliveries that pass through simplified procedures, are submitted to the risk analysis system on the event of
ESP declaration. According to the Administrative Instruction on simplified procedures, the cargo which admitted
to simplified procedures stays no more than 60 minutes in the area of the Customs terminal awaiting the approval
from Customs to proceed under the simplified procedures. Imported goods released under simplified procedures
shall be declared for final Customs clearance and the payment of the debt, not later than the first following day
of work after the presenting of goods in Customs.
