ORDINANCE NO. 28-19 BY:

AN ORDINANCE to amend Section 1105.02 of the Zoning Code of the Codified Ordinances of the City of Lakewood by changing and revising the Zoning Map of the City with respect to certain property as set forth and described as 2022 Lincoln Avenue (PPNs 314-19-094, 314-19-008, 314-19-009, 314-19-010, 314-19-45, 314-19-46, 314-19-47, 314-19-48, 314-19-049)from C2 (Commercial, Retail) to PD (Planned Development).

WHEREAS, it is necessary and desirable to rezone the property which is the site of the former St. Clement’s School to allow for the redevelopment of the property; and

WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits municipalities to exercise all powers of local self-government and to adopt and enforce within their limits such as local police, sanitary and other regulations as are not in conflict with general laws; now, therefore

BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO:

Section 1. Section 1105.02 of the Zoning Code of the Codified Ordinances of the City of Lakewood be and the same is hereby amended by changing and revising the Zoning Map of the City from C2 (Commercial, Retail) to PD (Planned Development) for the following property:

Section 2. The Director of Planning and Development is hereby authorized and directed to make the reclassification change on the zoning map of the City of Lakewood, Ohio, in order to reflect the amendment designated in Section 1 of this ordinance.

It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements.

RESOLUTION NO. 2020-33 BY:

A RESOLUTION to take effect immediately provided it received the affirmative vote of at least two thirds of the members of Council, or otherwise to take effect and be in force after the earliest period allowed by law approving the Tax Budget of the City of Lakewood, State of Ohio for the year 2021, and authorizing the filing of same with the Cuyahoga County Fiscal Officer.

WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of Lakewood, this Council by a vote of at least two thirds of its members determines that this resolution is an emergency measure and that it shall take effect immediately, and that it is necessary for the immediate preservation of the public property, health, and safety and to provide for the usual daily operation of municipal department, in that the Tax Budget must be submitted to the County Fiscal Office on or before July 15, 2020; now, therefore,

BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO:

Section 1. The annual Tax Budget submitted by the Director of Finance of the City of Lakewood, showing the amount of money needed and the necessary expenditures in the various departments of the municipality for the year 2021, be and the same is hereby approved and the Clerk of Council is hereby ordered and directed to file the same with the Fiscal Officer of Cuyahoga County pursuant to the statutes of the State of Ohio.

Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberations of this Council and any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements.

Section 3. This resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, property, health, safety and welfare in the City and for the usual daily operation of the City for the reasons set forth and defined in the preamble to this resolution, and provided it receives the affirmative vote of at least two thirds of members of Council, this resolution shall take effect and be in force immediately upon its adoption by the Council and approval by the Mayor otherwise, it shall take effect and be in force after the earliest period allowed by law.

RESOLUTION NO. 2020-34 BY:

A RESOLUTION to take effect immediately provided it receives the affirmative vote of at least two thirds of the members of Council or otherwise, to take effect and be in force after the earliest period allowed by law requesting the Cuyahoga County Fiscal Officer to draw and the Cuyahoga County Treasurer to pay to the City of Lakewood Director of Finance an advance of all real, personal property and special assessments collected in the year 2021 in such amounts as may be requested and available.

WHEREAS, Ohio Revised Code Section 321.34 (A)(l ) provides that "[W]hen the local authorities by resolution so request, the county auditor shall pay township clerks, treasurers of municipal corporations, the treasurer of any board of education, and the treasurer of any other political subdivision or taxing district whose funds derived from taxes or other sources are payable by law to the county treasurer, any money that may be in the county treasury to the accounts of such local authorities, respectively, and lawfully applicable to the purpose of the current fiscal year in which such request is made. The auditor and county treasurer shall retain any amounts needed to make such payments of obligations of local political subdivisions or taxing districts as are required by law to be paid directly by the county authorities;" and

WHEREAS, Ohio Revised Code Section 321.341 provides that" .. . [A]t any time prior to a settlement under section 5731.46 of the Revised Code, the fiscal officer of a municipal corporation or a township may request the county auditor to make payment to such subdivision from the fund of an amount not to exceed seventy-five per cent of taxes paid into such fund and standing to the credit of the subdivision, including both taxes with respect to which a final determination has been made under section 5731.27 of the Revised Code and taxes subject to review and final determination under section 5731.26 of the Revised Code. Within five days of the receipt of such request the auditor shall draw a warrant in such amount upon such fund, payable to the subdivision;" and

WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the city of Lakewood, this Council by a vote of at least two thirds of its members determines that this resolution is an emergency measure and that it shall take effect immediately, and that is necessary to provide for the usual daily operation of the City in that the Cuyahoga County Fiscal Officer requires the City to file this resolution stating the City's intent to receive advances in 2021 prior to October 1, 2020; now, therefore,

BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO:

Section 1. The Cuyahoga County Fiscal Officer be requested to draw and the Cuyahoga County Treasurer be requested to pay to the City of Lakewood Director of Finance an advance of all real, personal property, estate taxes and special assessments collected in the year 2021 in such amounts as may be requested and available.

Section 2. That the Director of Finance is hereby directed to forward a certified copy of this Resolution upon passage, to the Cuyahoga County Fiscal Officer.

WHEREAS, The Budget Commission of Cuyahoga County, Ohio, has certified its action thereon to this Council together with an estimate by the County Fiscal Officer of the rate of each tax necessary to be levied by this Council, and what part thereof is without, and what part is within the ten mill tax limitation; and

WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of

Lakewood, this Council by a vote of at least two thirds of its members determines that this resolution is an emergency measure and that it shall take effect immediately, and that it is necessary to provide for the usual daily operation of the City; now, therefore,

BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO:

Section 1. That the amounts and rates as determined by the Budget Commission in its

certification, be and the same are hereby accepted.

WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of Lakewood, this Council by a vote of at least two thirds of its members determines that this ordinance is an emergency measure and that it shall take effect immediately, and that it is necessary for the immediate preservation of the public property, health, and safety and to provide for the usual daily operation of municipal departments in that delay could impair the City’s ability to provide necessary services in a timely manner for fiscal year 2020, now, therefore,

ORDINANCE NO. 10-2020. BY:

AN ORDINANCE to take effect June 1, 2020 provided it received the vote of at least two-thirds of the members of Council, or otherwise to take effect at the earliest period allowed by law, amending Section 135.05(c), Traffic Guards, Rate of Pay; Exceptions, of the Codified Ordinances of the City of Lakewood to allow to suspend salaries to Traffic Guards during an emergency where students are no longer attending classes in schools.

WHEREAS, the current threat of the COVID-19 pandemic has caused the Governor of the State of Ohio to declare a state of emergency and the Director of the Ohio Department of Health to issue an order limiting gatherings in an effort to prevent the spread of COVID-19; and

WHEREAS, as a result of the state of emergency and ban on large gatherings, the Governor of the State of Ohio has canceled all in-school classes for the State of Ohio for the remainder of the 2019-2020 school year which alleviates the need to provide Traffic Guards for students walking to school; and

WHEREAS, this Council determines that this ordinance is an emergency measure and that it shall take effect immediately and that it is necessary for the immediate preservation of the public property, health, and safety and to provide for the usual daily operation of municipal departments in that Lakewood is already experiences decreased income tax revenue and it is necessary to cut expenses wherever possible to operate within a balanced budget; now, therefore

BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO:

Section 1. That Lakewood Codified Ordinance 135.05(c) Traffic Guards, Rate of Pay; Exceptions, currently reading as follows:

135.05 Traffic Guards.

(c) Rate of Pay; Exceptions. Traffic guards shall be paid at their hourly rate only for timeactually worked, unless otherwise provided for by ordinance.

(1) If the Lakewood School Board of Education and/or the Cleveland Catholic Diocese, as aresult of inclement weather or other emergency condition, suspends classes for the school system or any portion thereof and, as a result of such closing, traffic guards who would normally be scheduled to work are told not to report, the guards so affected shall be paid at their regular hourly rate as if they had worked their assigned crossings on that date.

(2) During the spring (Easter) and winter (Christmas) school breaks, all regularly assignedtraffic guards who have been continuously employed for at least thirty days immediately preceding the break shall be paid at their regular rate of pay as if they had worked their assigned crossings.

(3) Traffic guards electing to work the summer school session shall be paid their regularhourly rate for a minimum period of two hours per day on those days they are assigned crossings.

Dear Colleagues, Recognizing the importance of trees to the cultural and environmental wellbeing of our City, Lakewood City Council established the Tree Advisory & Education Board in September 2019 to serve as a permanent volunteer body dedicated to the City’s trees. The Board of five members began meeting at the end of 2019 and is working in earnest to fulfill its purpose to promote the City’s tree programs and educate residents on the benefits of trees. The ordinance establishing the Board authorizes Council to appoint an ex-officio non-voting member, which the following resolution proposes to do. Re: 21 Day Racial Equity and Social Justice Challenge

Dear Council,

The roots of racial inequities and social injustice run deep into our nation’s history. The deaths of Ahmaud Arbery, Breonna Taylor and George Floyd have sparked a call for change. To better serve our community and to ensure that all residents are represented we recognize that we should make all efforts to be fully educated on issues surrounding diversity, inclusion, and social justice.

Lakewood is a diverse, but historically white, community with predominately white leadership. We know from listening to residents, activists, researchers, and educators, that to create the universally inclusive and equitable culture that we seek in our community and the broader world that it is our responsibility to fully educate ourselves on the racial inequities in our society. It is not enough to avoid overtly racist actions. We must actively be anti-racist and intentionally socially just.

As stated in the attached resolution, we are committed to completing the YWCA’s 2020 21 Day Racial Equity and Social Justice Challenge1 prior to the end of the year. We invite and encourage all members of council, the Mayor, the Directors and Chiefs, members of the administration, all Lakewood city employees, and residents to join us. This online, asynchronous, and non-partisan program centers around the topical issues of how racial inequities impact voting, education, criminal justice and public health.

We respectfully request immediate adoption of this resolution.

WHEREAS, systemic, institutional racism and discrimination causes extensive psychological, physiological, academic and economic harm to all members of the community, and; WHEREAS, people are often unaware of their own internalized racial biases and prejudices, and how they negatively impact their thinking and decision-making, and; WHEREAS, governmental leaders bare a particular responsibility to identify and work to address their own areas for growth to ensure that they are prepared to lead with anti-racist intention, and; WHEREAS, Lakewood residents have expressed, and city leaders share, an urgent desire to ensure that our community continues to march toward an inclusive, diverse ,and socially just future. Now, therefore,

BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: Section 1. That this Council does hereby declare that, prior to January 1, 2021, each member shall fully participate in and complete the 21 Day Racial Equity and Social Justice Challenge as presented by the Cleveland YWCA. Section 2. That this Council recognizes and commends the Mayor’s intention to commit herself, her Directors and Chiefs, and other administrative team members to do likewise. Section 3. That this Council invites all residents to visit the YWCA of Cleveland’s 21 Day Racial Equity and Social Justice Challenge website for more information on the program and to participate. Section 4. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberations of this Council and any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements.

Re: Policing Policy Review & Racial Equity

Dear colleagues, Lakewood friends & neighbors;

Safe communities are a basic right that should be honored for all. Even as we have worked to keep Lakewood safe from the danger of the COVID-19 pandemic, recent days have reminded us of the ongoing danger to community safety in America, from violence and racism.

Injury and death from violence is an outsized problem in America. As with COVID-19 and many of our society’s ills, the impact is disproportionately experienced by Black Americans. Each of these problems also reveals the powerful impact of policy. Just as policy leadership, or its absence, has made vast differences to COVID-19’s toll on societies, policy leadership can affect incidents of violence and other racial disparities, for better or for worse.

This reality gives impetus to requests from Lakewood residents to review our city’s policing policies. Policy leadership has played a clear role in the variety of communities’ experience, not only with recent protests but with longer-term progress toward safety, nonviolence, trust, and inclusion. The outcomes of policy reforms in cities like Camden and Newark, in New Jersey, present an eye-opening contrast with many other cities, where residents have experienced a catalog of injuries from tactics and weapons which are detracting from safety rather than protecting it.

Accordingly, we support the call of residents, local activists, and leaders throughout the country, to review and respond to local policies in pursuit of solutions for violence and racial disparities. Campaign Zero offers the following eight data-based strategies, known colloquially as #8CantWait that, according to their research report, “are associated with 72% fewer police-involved killings compared to departments with none of these policies in place and a 54% reduction for the average police

department.” Their research also found that, “police departments with more restrictive use of force policies have better outcomes in terms of officer safety and have no impact on crime rates.” We recommend reviewing these eight strategies as places to begin: 1. Ban chokeholds, and strangleholds 2. Require de-Escalation 3. Require warning before shooting 4. Require exhausting all alternatives before shooting 5. Duty to intervene 6. Ban shooting at moving vehicles 7. Require use of force continuum 8. Require comprehensive reporting

More detailed policy suggestions may be found under the Use of Force Policy Language section of the 8CantWait.org website. Additionally, based on recommendations from the NAACP, a group of 25 African-American Councilwomen from across the state of Ohio, and questions raised by recent events, we recommend review of the following strategies:

9. Declare racism a public health crisis 10. Assess penalties for false calls regarding racial profiling, and for abusive and unnecessary use of

local police agency resources 11. Study the use of Lakewood police personnel when responding to calls for assistance from other

cities, and the function of auxiliary forces within Lakewood, to best protect community values in these circumstances

12. Implement a Citizen’s Review Board to support public confidence in police accountability

It’s critical for elected leaders at every level of government to work together, to respond to this national test; it is also critical that we respond to the ongoing interest of the Lakewood community in safety, equity, and good government. We believe Lakewood is capable and prepared to rise to the occasion, and provide leadership that will serve residents, and credit our community in the judgment of posterity. Recently, members of our own Lakewood Police Department knelt in solidarity with protestors seeking to reduce fatal and unnecessary force. Let us give them the tools to achieve this goal. We respectfully request a referral of this communication to the Public Safety Committee, and or any other committee of council’s choosing, for further deliberation in support of appropriate action. June 15, 2020 Dear Colleagues: Belatedly, a great deal has been made of structural racism in our society in recent weeks, including in Lakewood. Thus far I must say I am extremely proud of how Lakewood, especially our young people, have thoughtfully, bravely and safely exhibited their feelings and ideas to promote a more just and equitable Lakewood. At our most recent council meeting, I alluded to a communication addressing racism as a public health crisis, and as I’ve worked on it, I’ve decided that it ought to be personal as well as outward looking. Thus, I have not asked any colleagues to sign on to this with me. I imagine they would agree with many of the following points, but in order for our society to rid itself of racism, I think it is incumbent upon all of us to look at ourselves first and ask if there is anything we can change. Looking within:

• I apologize for the ways I, my privilege or even slowness to act may have promoted or upheld a racist society.

• I recognize that my family and I embody tremendous privilege. I am willing to use that privilege to create lasting change.

• I will continue to work to improve diversity, equity and inclusion within my own workplaces, both in my “day job” and at City Hall through training, new roles and more.

• Diversity, equity and inclusion are not a 9-5 job. I am willing to help build, seek and promote ways to educate my own family, neighbors and friends wherever possible, and not solely in places where it is convenient or expected. This must be a lifestyle change. I should add that my children are teaching me!

While I am technically making a political statement, true change must be viewed in both health and political terms. Therefore, looking outward:

• I call upon and endorse the Cuyahoga County Board of Health to formally name Racism a Public Health Crisis, noting the work already being done - https://hipcuyahoga.org/eliminating-structural-racism/

• I call upon and endorse Cuyahoga County Council and/or the County Executive to name Racism a Public Health Crisis. It is important that our political leaders both within and outside of historic red lines are on board with this, together.

• I support and thank Cleveland City Council for adopting their resolution naming racism a Public Health Crisis 024

• I promote and endorse the voting rights and the proper census taking for people of color, who are often underrepresented.

Lastly, there are resources that are truly incredible and ought to be accessible to as many people of privilege as possible. This is not an exhaustive list, but are resources that I’ve found which could be helpful for others:

• Showing Up for Racial Justice, which has a Northeast Ohio chapter (https://surjneo.org/) says whites need to be “part of a multi-racial movement to undermine white support for white supremacy and to help build a racially-just society. That work cannot be done in isolation from or disconnected from the powerful leadership of communities of color. It is one part of a multi-racial, cross-class movement centering the leadership of people of color. Therefore, SURJ believes in resourcing organizing led by people of color, and maintaining strong accountability relationships with organizers and communities of color as central part of our theory of change.”

Because racism as a health crisis might seem like a foreign concept to some, I encourage you all to seek out additional resources tying trauma informed care and environments to racism. It is well documented how trauma can impact the brain, especially early in life. Any person who is continually subjected to racist ridicule or slander, or who lives in fear of such will inevitably be conditioned for a traumatic response to racism or racist comments or acts. Said more simply, personal health is impacted by repeated and constant racist behaviors, both overt and implied. This makes the case for how racism is a health crisis and not solely a social one. Indeed “the body keeps score”. Thank you again to my colleagues, the Mayor and her administration, my neighbors and Lakewood’s residents for joining in this important conversation. I look forward to all that we can accomplish together. I also encourage all of us to hold each other accountable now and in years to come to assure that these are more than just words. RESOLUTION NO. 2020-38 BY:

A RESOLUTION to take effect immediately provided it receives the vote of at least two thirds of the members of Council, or otherwise to take effect at the earliest period allowed by law, affirming that all funds received from the County Coronavirus Relief Distribution Fund pursuant to S.B. 310 be expended only to cover costs of the City of Lakewood consistent with the requirements of section 5001 of the CARES Act as described in 42 U.S.C. 601(d), and any applicable regulations and guidance.

WHEREAS, the Coronavirus Aid, Relief, and Economic Security Act, 116 Public Law 136, (the CARES Act) was signed into law by the President of the United States on March 27, 2020; and

WHEREAS, the Ohio General Assembly established a process for distributing funds provided by the “Coronavirus Aid, Relief, and Economic Security Act” in Senate Bill 310 of the 133rd General Assembly (S.B. 310); and

WHEREAS, S.B. 310 requires subdivisions receiving funds under Section 1 of the act, to pass a resolution affirming that funds from the County Coronavirus Relief Distribution Fund may be expended only to cover costs of the subdivision consistent with the requirements of section 5001 of the CARES Act as described in 42 U.S.C. 601(d), and any applicable regulations before receiving said funds; and

WHEREAS, Lakewood is requesting its share of funds from the County Coronavirus Relief Distribution Fund; and

WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of Lakewood, this Council by a vote of at least two thirds of its members determines that this resolution is an emergency measure and that it shall take effect immediately, and that it is necessary for the immediate preservation of the public property, health, and safety and to provide for the usual daily operation of municipal departments in that the State of Ohio is under an order of a state of emergency from the Governor and has incurred additional expenses and financial losses as a result of the COVID-19 pandemic; now, therefore

BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO:

Section 1. Lakewood affirms that all funds received from the County Coronavirus Relief Distribution Fund pursuant to S.B. 310 be expended only to cover costs of the subdivision consistent with the requirements of section 5001 of the CARES Act as described in 42 U.S.C. 601(d), and any applicable regulations and guidance only to cover expenses that:

(a) Are necessary expenditures incurred due to the public health emergency with respect tothe Coronavirus Disease 2019 (COVID-19);

Section 2. The Director of Finance, in compliance with S.B. 310, shall take all necessary action

to:

(a) On or before October 15, 2020, pay any unencumbered balance of money in the Lakewood’s local coronavirus relief fund to the County Treasurer;

(b) On or before December 28, 2020, pay the balance of any money in Lakewood’s local coronavirus relief fund to the state treasury in the manner prescribed by the Director of the Ohio Office of Budget and Management; and

(c) Provide any information related to any payments received under S.B. 310 to the Director of the Ohio Office of Budget and Management as requested.

Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were passed in an open meeting of this Council and that all deliberations of this Council and any of its committees that resulted in such actions were in meetings open to the public and in compliance with legal requirements. Section 4. This resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, property, health, safety and welfare in the City and for the usual daily operation of the City for the reasons set forth and defined in the preamble to this resolution, and provided it receives the affirmative vote of at least two thirds of the members of Council, this resolution shall take effect and be in force immediately upon its adoption by the Council and approval by the Mayor, or otherwise it shall take effect and be in force after the earliest period allowed by law.
