GOVERNMENT OF PUNJAB

NOTICE

1. Sealed Item rate(s) are invited from firms/agencies of repute in museum design and display with experience of museum work at National / International level with sound financial background for the work of setting up Archaeological Museum, Sanghol under the Department of Directorate of Cultural Affairs, Archaeology and Museums, Punjab, Chandigarh.

The work is estimated to cost of 84.00 Lacs approximately for the following works

a) Gallery Furnishing and Furbishing b) Exhibit fabrications including dioramas and other Artistic worksc) General & Contextual reference display materials and museum

interpretational signaged) Light design for galleries & outdoore) Security Systemsf) Audio-visual/multi-media inputsg) Composite Museum Displayh) Landscapingi) Any other item of works specified in the conceptual design & technical

drawings

The contract is on item rate(s) basis. Quantities set out in schedule of quantities are near approximate. Agencies(s) shall quote rates for each item based on their own assessment of conceptual drawings, technical drawings and specifications enclosed along with this bid document. The amount to be filled in the column of amount quoted will be adopted as final and will form the basis of bills.

2. The time allowed for carrying out the work will be 180 days from the date of acceptance letter from the bidder or from the first day of handing over of the site, whichever is later, in accordance with the phasing, if any, indicated in the bid documents. The time period for the execution of works may be extended by the competent authority in case of delay in exceptional circumstances.

3. The last date of the receipt of Technical and Financial Bid is 10 August 2011_ by 3.00 P.M hours.

4. Agencies are advised to inspect and examine the site and its surroundings

and satisfy themselves before submitting their bids as to the form and nature

of the site, the means of access to the site, the accommodation they may require and in general shall themselves obtain all necessary information as to risks, contingencies and other circumstances, which may influence or affect their bid. Agencies shall be deemed to have full knowledge of the site whether he/she inspects it or not and no extra charges consequent upon any misunderstanding or otherwise shall be allowed. Agencies shall be responsible for arranging and maintaining at his own cost all materials, tools & plants, access facilities for workers and all other services required for executing the work unless otherwise specifically provided for in the contract documents.

Submission of a bid by a agencies implies that he has read this notice and all other contract documents and has made himself aware of the scope and specifications of the work to be done and of conditions and rates at which stores, tools and plant etc. will be issued to him by the Government and local conditions and other factors having a bearing on the execution of the work.

5. The competent authority, does not bind himself to accept the lowest or any other bid and reserves to himself the authority to reject any, part or all of the bids received without assigning any reason(s). All bids, in which any of the prescribed conditions are not fulfilled or any condition including that of conditional rebate is put forth by the agencies, shall be summarily rejected.

6. Canvassing whether directly or indirectly, in connection with bids is strictly prohibited and the bids submitted by the agencies that resort to canvassing will be liable to rejection.

7. The competent authority reserves to himself the right of accepting the whole or any part of the bid and the agencies shall be bound to perform the same at the rate quoted.

8. The notice inviting bid, all documents including special conditions, particular specifications and drawings, if any, forming the bid as issued at the time of invitation of bid and acceptance thereof together with any correspondence leading thereto, shall be the part of the agreement.

9. The Agencies shall quote his rates keeping in mind the specifications; terms & conditions; particular specifications and special conditions etc. and nothing shall be payable extra whatsoever unless otherwise specified. If the agencies does not quote the rate for any item, leaving the space blank, whatsoever, it will be presumed that the agencies have loaded the cost of this/ these item(s) on other item(s), and he will execute this /these items at zero cost, and the bid will be evaluated accordingly.

10. Earnest money of 3% of the total value of the bid in the shape of Demand Draft of a Scheduled / Nationalised Bank issued in favour of Directorate of

Cultural Affairs, Archaeology and Museums, Chandigarh, Punjab has to be submitted by the agency(s) along with the financial bid. Demand Draft shall be returned to the unsuccessful bidder(s) on the same day of the opening of the bid. Whereas, the earnest money, thus submitted by the successful bidder (s) shall be retained by the employer for a duration of one year as a performance guarantee.

11. The department shall deduct Income Tax (TDS) on the value of work done from each bill of the agencies as per prevailing Government instructions / orders. In lieu, the department shall issue a certificate of deduction of the tax at source to the agencies, in relevant forms.

12. The Competent Authority reserves the right to accept or reject any or all bids without assigning any reason whatsoever.

INFORMATION & INSTRUCTIONS FOR APPLICANTS

SECTION I

1.0 GENERAL:

1.1 All information called for in the enclosed document should be furnished against the relevant columns in the forms. If for any reason, information is furnished on a separate sheet, this fact should be mentioned against the relevant column. Even if no information is to be provided in a column, a “nil” or “no such case” entry should be made in that column. If any particulars / query is not applicable in case of the applicant, it should be stated as “not applicable”. The applicants are cautioned that not giving complete information called for in the application forms or not giving it in clear terms or making any change in the prescribed forms or deliberately suppressing the information may result in the applicant being summarily disqualified. Applications made by telegram or telex and those received late will not be entertained.

1.2 The application should be submitted in the prescribed format as enclosed along with the bid document. The applicant should sign each page of the application.

1.3 Overwriting is not accepted. Correction, if any, should be made by neatly crossing out, with signature and date.

1.4 References, information and certificates from the respective clients certifying suitability, technical know how or capability of the applicant should be signed and submitted.

1.5 The applicant may furnish any additional information, which he thinks is necessary to establish his capabilities to successfully complete the envisaged work. He is, however, advised not to furnish superfluous information. No information shall be entertained after submission unless the Employer calls it for.

1.6 The amount mentioned in the financial bid should be mentioned in words and also in figures in rupee value

1.7 The document in prescribed form duly completed and signed should be submitted in a sealed cover. The sealed cover super-scribed “Setting up of the Archaeological Museum, Sanghol” shall be received by the Director, or his authorized representative up to 10th August 2011 by 3.00 P.M hrs.

1.8 As specified a Pre – Bid meeting is arranged on 28 th July 2011 at 11.30 a.m. in the Office of Director of Cultural Affairs, Archaeology and Museums, Sector 38-A, Chandigarh - 160036. All clarifications should be sought on that day. No request for clarification will be considered after the Pre – Bid meeting.

DEFINITIONS:

2.1 In this document the following words and expressions have the meaning hereby assigned to them.

2.2 EMPLOYER: Means the Director of Cultural Affairs, Archaeology and Museums, Punjab, Plot No. 3, Archives Bhawan, Sector 38-A, Chandigarh – 1600014.

2.3 APPLICANT: Means the individual, proprietary firm, firm in partnership, limited company private or public or corporation.

2.0 METHOD OF APPLICATION:

3.1 If the applicant is an individual, the application shall be signed by him above his full typewritten name and current address.

3.2 If the applicant is a proprietary firm, the application shall be signed by the proprietor above his full typewritten name and the full name of his firm with its current address.

3.3 If the applicant is a firm in partnership, the application shall be signed by all the partners of the firm above their full typewritten names and current addresses, or alternatively by a partner holding power of attorney for the firm. In the latter case a certified copy of the power of attorney should accompany the application. In both cases a certified copy of the partnership deed and current address of all the partners of the firm should accompany the application.

3.4 If the applicant is a limited company, a corporation, a consortium, the application shall be signed by a duly authorized person holding power of attorney for signing the application accompanied by a copy of the power of attorney. The applicant should also furnish a copy of the Agreement between consortiums / Memorandum of Articles of Association duly attested by a Public Notary.

4.0 FINAL DECISION MAKING AUTHORITY

The employer reserves the right to accept or reject any application and to annul the biding process and reject any one or all applications at any time, without assigning any reason or incurring any liability to the applicants. Lowest Bid shall not be the final criteria. Other aspects like financial soundness, domain and technical expertise, infrastructural facilities and past work shall be considered.

5.0 PARTICULARS PROVISIONAL

The particulars of the work mentioned in section – I are provisional. They are liable to change and must be considered only as advance information to assist the applicant.

6.0 SITE VISIT

The applicant is advised to visit the site of work, at his own cost, and examine it and its surroundings himself to collect all information that he considers necessary for proper assessment of the prospective assignment.

7.0 AWARD CRITERIA

A single-stage procedure shall be adopted in evaluating the proposals. Consultants qualifying in technical proposal will be eligible for financial evaluation.

7.1 Technical Proposal

After checking responsiveness of the Technical proposal in terms of having provided the requisite data, certificate of incorporation/ registration, relevant experience documents and information etc, authorization letter, earnest money, the Technical Proposals shall be evaluated as per point system noted below. A proposal shall be rejected at this stage if it does not respond to the important aspects of EOI and it fails to achieve minimum technical score indicated in evaluation criteria.

The number of points to be assigned to each of the positions or disciplines of the key professional staff mentioned above shall be determined considering three sub-criteria and relevant percentage weights:

The minimum technical score “St” required to pass shall be: 70 points

7.2 Financial Proposal

After the evaluation of technical proposal is completed, the department may notify those consultants who have qualified. Financial Proposals of non-responsive bids will be returned unopened after completing the selection process. The department shall notify the consultants selected by the above process, indicating the date and time for opening the Financial Proposals. The Financial Proposals shall be opened publicly in the presence of the agencies or their representatives who choose to attend. The quoted amount shall be read and recorded.

The L1 Agencies shall be invited for contract.

8.0 ARBITRATION

8.1 Any dispute or differences whatsoever arising out or in connection with this Contract, including any question regarding its existence, shall be mutually resolved in the first instance and if not resolved the same shall be referred to and finally resolved in terms of the Indian Arbitration Act 1996 and the award made in pursuance thereof, shall be binding on the parties.

8.2 This Contract shall be governed in all respects by the Laws of India Union in Force.

8.3 The present Contract shall be valid till the party or parties agree to work jointly or decide otherwise.

8.4 Notices shall be sent to either party by Registered A/D mail at the respective addresses as provided at the header of this Contract and a notice would be considered received fourteen days after it was sent.

8.5 The Competent Courts of Chandigarh shall only have the Jurisdiction for settlement of disputes.

9.0 WARRANTY / ANNUAL MAINTENANCE CONTRACT

9.1 That the agencies shall provide a warranty of one year from the date of installation to all works for its fabrication defects only.

9.2 That the agencies shall attend the maintenance and any other kind of works pertaining to the galleries on actual payment basis, if required after the expiry of one-year term for a period of three years thereafter under AMC.

SECTION II

10. INITIAL CRITERIA FOR ELIGIBILITY FOR AGENCIES

10.1 With a view to ensure a thoroughly professional implementation of the initiative; the Agency must have the association of such individual(s) / domain expert(s) of archaeology / art / history / museum background. This is an essential requisite.

10.2 The intending Company / firms/ individual(s) should have the requisite ability to follow the designs and drawings to execute the work, ability to manage complex situations and to effectively coordinate the work with the concerned offices / officers of the department. The interested parties should have academic, technical and financial capabilities on the lines, mentioned below.

(i). Experience – The company and its associates should have a minimum of 10 years experience in executing museum works, having handled projects related to museums works at National / State level.

a). Domain Expertise - List of associated / employed panel of domain expert(s) with museum & archaeology background to provide the project a professional & right direction.

b). Technical Expertise - List of associated / employed panel of artists, fabricators, casters, modelers, painters, sculptors, graphic designers with sound background & experience in their respective fields of artistic works, exhibit fabrication, display, graphics & interpretational signage.

(ii) Financial soundness – Average turnover of Rs. 50 lakhs of the Company / firms / individual(s) during the last 5 financial year.

10.3 The applicant should have sufficient number of Technical personnel and Domain Experts for the proper execution of the contract. The applicant should also attach consent letters of the list of associated / employed panel of domain expert(s) with museum, archaeology & art history background.

GENERAL CONDITIONS

GENERAL

1. The Project is for setting up of the Archaeological Museum at Sanghol, Punjab.

1.1 The site is situated at Sanghol (Uccha Pind), Punjab.

The Museum display works include works related to museum furnishing and furbishing, display works, exhibit fabrications, artistic works and other works are to be executed within a time frame in a phased manner from the date of signing the agreement as per approved conceptual design(s) and technical drawing(s). 1.2 The agency shall take into account that the work is to be carried out on site in

such a manner, so as to cause least possible disturbance.

1.3 Any minor work (civil / electrical), which comes in the way by design, would to be suitably diverted without any damage at no extra cost.

2. Mobilization Period

2.1 Within 10 days of work order agencies shall submit to the Director Cultural Affairs, Archaeology and Museums, Punjab, Chandigarh. his proposed layout of site offices, stores, godowns, fabrication yards, water tanks, electric points, etc. required for the approval of the Employer.

2.2 Following activities shall be completed in the mobilization period.

- Temporary site offices for agencies.- Tapping of electric connection and arranging water supply for

construction.- Godown- Obtaining approvals of local authority wherever required- Establishing of workshops

3. Definitions

3.1 The following person(s)/firm(s) shall include their legal representatives or in the event of their ceasing, person(s)/firm(s) as nominated by the Employer, not being a person(s)/firm(s) to whom the agencies shall object for reasons considered sufficient by the Employer. Provided always that no person(s)/firm(s) subsequently appointed under this contract shall be entitled to disregard or over rule any decision or approval or direction given or expressed in writing by the Director Cultural Affairs, Archaeology and Museums, Punjab, Chandigarh.

4. Employer

4.1 Employer means Director Cultural Affairs, Archaeology and Museums, Punjab, Chandigarh who will employ the agency(s) and who shall perform the functions as provided in the contract. This project shall be executed under the guidance of the Employer /Museum Consultant.

5. Site – in – Charge

5.1 In-Charge at Site shall be appointed by the agency(s) in consultation with the Director Cultural Affairs, Archaeology and Museums, Punjab, Chandigarh and shall be responsible for the day to day works at the site.

6. Project Manager(s) / Supervisor(s)

6.1 Project Manager(s) / Supervisor(s) appointed by the agency(s) in consultation with the Director Cultural Affairs, Archaeology and Museums, Punjab, Chandigarh shall attend to site periodically for the duration of the project for supervising execution of project

8. Jurisdiction

8.1 In case of any litigation under this Contract, the courts of law in Chandigarh only shall have the jurisdiction.

9. POWERS AND DUTIES

9.1 Employer

Employer shall accept the bid, award the contract and make running and final payments etc. on the recommendation and satisfaction of Director Cultural Affairs, Archaeology and Museums, Punjab, Chandigarh.

9.2 Museum Consultant

Museum Consultant shall be responsible for overall supervision of the project unless otherwise specified.

9.3 Museum Consultant

He shall carry out following works with the assistance of Officer(s) nominated by the Employer

- Ensure that the work is carried out generally in accordance with approved conceptual designs, drawings and specifications

- Provide Interpretation of drawings- Advise the Site – in – charge regarding materials for furnishing

furniture, fixtures, lighting decorative items, ceiling finish, interior designing and decoration materials, colour scheme etc.

- Render every assistance, guidance and advice in general to the Site – in – charge on any matter concerning the technical aspects of the project.

- Non-approval of work due to bad workmanship, - Non-approval of work due to use of non approved materials.- Matters of urgency involving the safety or protection of persons or

property.- Progress of work and certification of bills

9.4 Employer

a) Director Cultural Affairs, Archaeology and Museums, Punjab, Chandigarh shall be responsible for coordinating between the Museum Consultant and Agency(s) with regard to the issue of clarifications on drawings and other instructions. He shall also coordinate works of other agencies appointed by the Employer for the pursuance of this project and timely completion.

b) Director Cultural Affairs, Archaeology and Museums, Punjab, Chandigarh shall hold regular site progress meetings at site for

evaluation and executions of programme accepted and submit periodical reports by Museum Consultant.

c) Works under this Contract, shall be executed as per specification and workmanship as laid down in Contract, under the direction, supervision and approval of Museum Consultant. He shall be entitled to direct at what point or points and in what manner work is to be commenced and from time to time to be carried on. But such directions and instruction do not in any way exonerate the agencies from obligation to remedy any defects which are brought to the notice of the agencies by the Employer and Museum Consultant or his representative(s) at any stage of the work or after same is completed.

d) Museum Consultant shall carry out jointly with agencies or their representative, measurements for works executed. Bills thus prepared shall be submitted to the Employer.

e) Employer or his representative(s) decision in this regard shall be final.

- Interpretation of drawings- Interpretation of Specifications- Approval of Variation orders- Approval of Running Bills

10. INITIAL ADVANCE

The Maximum Initial Advance of 20% of the bid amount can be provided subject to Bank Guarantee of similar amount from any Scheduled / Nationalized Bank.

11. PAYMENT SCHEDULE

Payment up to 80 % shall be made

(a) Against material supplied at site.

(b) Against supply of finished product at site.

(c) Against progress of work (i.e. 40%, 75% and 100%).

(d) Full and final payments shall be done after final bills are submitted and works certified by the competent authority as per approved design, drawings and specifications.

12. EXTRA WORK / VARIATIONS

12.1 All additional works and variance from those shown on the drawings and accepted by Employer shall be treated as extra items of work. These shall be expressly ordered by Employer or Museum Consultant or his representative in writing with prior approval of the competent authority prior to start of such

works by agencies. The agencies shall be paid, at the rates included in the schedule of quantities where applicable. Otherwise, if no such item is available, actual rate analysis shall be prepared considering market rates of labour and materials with agencies’ profit at 20% added to such cost thus arrived plus wastage and contingency of 5%. Agencies shall have to produce quotations to support the rate analysis. Rate approved by Employer or his representative for such items shall be final.

12.2 Authority for fixing compensation for extra work / variations.

13. DRAWINGS

13.1 All Technical Drawings will be supplied by the Museum Consultant or his representative to the Agencies.

14. STANDARDS

14.1 All the standards will be as per the Specification list and other codes.

15. TAXES, LEVIES, DUTIES

15.1 Agencies shall be responsible to pay to appropriate authority, all taxes, custom duties, levies, sewerage fees, royalties, octroi, sales tax, vat, income tax, etc., as applicable from time to time.

16. WATER SUPPLY

16.1 Agencies will be provided with water at one point on the site. He shall make arrangement to tap the water required for construction and for drinking needs for his staff and labour. He shall get the water checked to ensure that water is suitable for construction and for drinking purposes.

16.2 If required, the agencies shall at his cost provide adequate storage of water required for the work and for drinking etc to carry out work as per schedule. No claims for hold up or delay in work on this account shall be entertained.

16.3 If water supply is arranged by the Employer, no recovery for water supply shall be made from the work done amount and nothing will be deducted from any bill.

17. ELECTRIC SUPPLY

17.1 Electric power, both for Construction and lighting shall be made available to agencies at the point specified by the agencies, at the employers’ expense.

17.2 Afterwards the agencies shall arrange at his own cost the necessary switchboard, and other Switchgears etc., and shall be responsible for their

maintenance. Requirement of power shall be given by the agencies within 7 days of receipt of letter of intent / work order.

17.3 Further distribution shall be done with approval by the agencies at his cost. He shall provide required clearances for overhead lines to facilitate easy movement of machinery. These shall be shifted and rerouted at agencies cost during execution of work if the same are found to obstruct any other work of any agency working at site or requires shifting due to unforeseen reasons.

17.4 On completion of the work the agencies shall remove all wiring installed by him and make good any disturbance or damage done, to the satisfaction of Employer.

17.5 The agencies shall employ certified electrician for carrying out this work.

17.6 Agencies shall have his own standby DG set to meet his requirement of power when supply from Employers system is disturbed and no claim whatsoever on account of disruption of electric supply will be entertained.

18. SITE DRAINAGE/CLEANING/NUISANCE

18.1 Water, which may accumulate on the site during the progress of the work, shall be removed from the site to the satisfaction of the Employer or Museum Consultant or his representative at the agencies’ cost.

18.2 Site shall be maintained free from rubbish. Proper stacking of all materials, etc. needed for work on day-to-day basis shall be organized in proper stacks. Heaps in unplanned manner and un-orderly fashion shall not be permitted. Museum Consultant decision in this matter shall be final.

18.3 The agencies(s) shall not, at any time, do cause or permit any nuisance on the site or do anything, which shall cause unnecessary disturbance or inconvenience to Employer, tenants or occupiers of other properties near the site and to the public in general.

19. SAFETY CODE

19.1 The agencies shall, at his own expense, arrange for the safety provisions as required by the Employer or Museum Consultant or his representative, in respect to all labour directly or indirectly employed for performance of the work and shall provide all facilities in connection therewith. In case the agencies fails to make arrangements to provide necessary facilities as aforesaid, the Employer or Museum Consultant or his representative shall be entitled to do so and recover the cost thereof, from the agencies.

20. WATCHING AND LIGHTING

20.1 The agencies shall provide and maintain at his own cost all areas fully ventilated, lighted, guarded. Any instruction in this regard given by Employer or Museum Consultant or his representative for the protection of the work or

for safety and convenience of those employed on the works or the public shall be carried out at agencies’ cost.

21. FIRE PRECAUTIONS

21.1 The agencies shall comply with regulations of the controlling authority in force at the site of the works relating to the precautions to be taken against fire hazards.

22. ACCIDENTS

22.1 The agency shall be responsible for compensation / insurance for any type of accident or injuries for his employees / workers and shall attended at its own cost. The employer shall not be responsible for such incident and shall bear no liability for compensation / insurance etc.

23. USE OF SITE

23.1 The agencies shall not use any portion of the site for purpose not connected with the works without the prior written approval of the Employer or Museum Consultant or his representative. He shall maintain permanent and site access roads free of spillage and shall not interfere with the flow of traffic. The site shall only be used for works and accommodation for the craftsman.

24. PROTECTION

24.1Adequate protection against any form of damage or deterioration shall be provided for all sections of the works. This shall include protective tapes, casings, guardrails and the like, which shall be provided if necessary. Particular care shall be taken to self-finished surfaces during the application of adjacent insitu work. Steps taken in pursuance of this clause, the agencies shall carry out all as directed and instructed by Employer or Museum Consultant or his representative to his satisfaction.
