Minutes for January 10t\ January 30th and January 31 st wereapproved.

Quarterly Review of Executive Session;

Patrick Menges entertained a motion that Attorney Robert Fredericksbe consulted with and ifhe has no objection the minutes of December13th be made available upon request to anyone who desires to seethem, seconded, Sue Medeiros, all were in favor.

CORRESPONDENCE

Cedar Street New Source Approval from D.E.P. to construct a wellwas read by Patrick Menges. James F. Crowley DOR LawDepartment e-mail response was read by Patrick Menges. PatrickMenges' Response to Message of James F. Crowley was read.

MEETINGS WITH SCHEDULED GUESTS

Discussion was held with Col. (Ret.) Robert Perry and AndrewReid/AECOM reoDiscolored Water. Patrick Menges VOTED; ToDirect Superintendent to profile the filter runs, take samples fromcustomers who have complaints of discolored water, have them testedat a lab recommended by ABCOM, map complaints on a map of theDistrict with the time line, seconded, Sue Medeiros, all were in favor.

Karen Capelo-Zankul Banking; Discussion was held regardingMechanics Co-operative Bank.

SUPERINTENDENT'S REPORT

Patrick's Menges VOTED; Superintendent's report be accepted as areport of progress and that the Superintendent be instructed tofunction as outlined, seconded, Sue Medeiros, all were in favor.

OLD BUSINESS

Human Resources By-Law Revision;

Patrick Menges entertained a motion; that a provision be added to theHuman Resources By-Law under revision, for District personnel tosubmit job descriptions, with job descriptions for licensed treatmentand system operator personnel to incorporate applicable dutydescriptions in the Code of Massachusetts Regulations and standardsof the Department of Environmental Affairs, seconded, Sue Medeiros.Sue Medeiros mentioned for the record a meeting is still owed toreview the by-law. Patrick Menges entertained a motion that furtherrevisions of the proposed Human Resources By-Law be undertaken atthe Commission's March meeting, seconded, Sue Medeiros, all werein favor.

STATUSES

District Seal Design Contest;

Judging possibly Friday after school. Full color, painted version offinal selection for Annual District Meeting. All contestants invited toA.D.M. Entries may be displayed at Meeting Thursday, 16 Feb.,Middle School, 7:P .M. Commission must select suitable prizes forcontestants/winner.

Business with North Dighton Fire District;

Commissioners Menges & Medeiros met with NDFD Board at NDFDForest St. HG on Mon., 20 Jan 2012; very nice meeting. ThreeDighton Water District lots on Forest Street will continue to be taxedby NDFD under an agreement signed by former Superintendent thenCommissioner Leslie 1.Atwood, a copy of which has been furnishedto the Board of Assessors. Superintendents of both Districts willmeet to prepare reports for their respective Districts' Commissions onthe possible advantages of Dighton Water District sale ofCommissions on the possible advantages of Dighton Water Districtsale of water to NDFD which currently purchases its water from theCity of Taunton.

Legislative Petitions to the General Court;

Commissioner Menges entertained a motion; That a letter endorsingan amendment to the District's legislative petitions pending in theGeneral Court, specifically Senate Bill No. 2103, An Act Relative tothe Dighton Water District in the town of Dighton in the town ofDighton, be approved and signed. The proposed amendment wassubmitted at a suggestion of the Department of Revenue byCommissioner Menges. Letter was signed Chairman, Paul Jolyforwarded a copy.

Professional Rates/Fees Study;

Engineer DeFrancesco (AECOM) and Financial Advisor MarkAbrahams (Abrahams Group) will meet at an agreed date and time

next week with Commissioner Menges and District Staff to pinpointDistrict objectives for the study, about to commence. CommissionerMenges will be acting as a subcommittee of the Board and thereforeunder the Open Meeting Law the meeting will be posted 48 hours inadvance. The date is not yet set.

DOR Management Review;

Set to begin next month.

Conference Room Flag Pole Initiative;

Report on this likely next month.

Set Meeting with Union Representative Regarding Call BackClarification;

Meeting to be scheduled.

Mandatory Briefings;

Patrick Menges entertained a motion; The District Clerk have Districtofficers and staff sign for their annual mandatory ethics and sexualharassment policy briefings as required and report completion of thisrequirement to the 13 March meeting of the Commission, and thatCommissioners also receive their Open Meeting Law briefings asrequired, seconded, Sue Medeiros, all were in favor.

Review on implementation of three policy endorsed by the Board.

Report on Cub Scout Tour of Treatment Plant was given by PatrickMenges.

NEW BUSINESS

Gary Willette's Bobcat Operator's License;

Sue Medeiros VOTED; Superintendent, Chuck Cestodio meet withGary Willette to discuss what route to take if he feels he has enoughknowledge and willing to go the route of studying on his own orpulling down the manual taking the test and if not get together withChuck and taking the class this way, seconded, Patrick Menges, allwere in favor. Superintendent to get back to the Board on March 13th.

Approve Reports for Voters for Special 16 February District Meeting;

Patrick Menges VOTED; Financial Statement consist of the projectedDistrict Meeting February 16,2012 balance after action on thearticles, seconded, Sue Medeiros, all were in favor.

Patrick Menges entertained a motion; Commissioner's report thatthose corrections be made initial caps on topic headings, insertion ofthe work construction in the second to last paragraph elimination ofspaces for signatures. Sue Medeiros VOTED; To accept the proposedtext with the changes outlined, seconded, Patrick Menges, all were infavor.

Motions for Special District Meeting;

Sue Medeiros VOTED; To accept motions for February 16,2012Special District meeting to be held at 7:00 P.M. at the DightonMiddle School, seconded, Patrick Menges, all were in favor.

Set 13 March Deadline for Preliminary FY 2013;

Patrick Menges entertained a motion; Commissioners set a deadlineof March 13th for the preliminary FY 2013 year budget and specialsarticles and that they incorporate the cost cutting measures to achieveFY 2013 $190,000 target, seconded, Sue Medeiros, all were in favor.

Water District Participation in Upcoming Dighton TricentennialParade;

Date September 22,2012.

EXECUTIVE SESSION, Potential Litigation, MGL Chapter 30 s.21(a) 3 Action on Remaining Abatements Forwarded by AssessorsSign De-Certification Letter for Assessors

Board signed De-Certification letter for the Assessors in openseSSIOn.

Patrick Menges entertained a motion; Board go into ExecutiveSession for action on remaining abatements forwarded by theAssessors which may bear upon potential litigation in accordancewith the provision ofMGL Chapter 30 s.21 (a) 3 the chair declaresthat the matter involves litigation strategy and is privileged under thatsection this will require decision coming out of Executive sessionwhen done to return to regular session when finished. Sue MedeirosVOTED; To go into Executive Session potential litigation MGLChapter 30 s.21 (a) 3 for action on remaining abatements forwardedby Assessors, go out of Executive Session back into open session,seconded, Patrick Menges.
