84. NARRATIVE OF THE FACTUAL BASIS FOR PROBABLE CAUSE: The undersigned certifies and swears that he/she has just and reasonable grounds to believe that the heretofore named defendant did commit the violations of law as stated above and the factual basis for this belief is as follows:

Your Affiant is Law Enforcement Senior Inspector Steven Donaldson of the Office of the Inspector General, Florida Department of Corrections.

Your Affiant has probable cause to believe that on December 6, 2018, at approximately 5:56 AM, FDC Correctional Officer Misty Sue Clemons (known to FDC as Misty S. Cruce on official records, also known as Misty Sue Padgett) DOB�--� did commit the crimes of; one count of Introduction, or possession of certain articles unlawful F.S.S. 944.35 (1)(a)6, eleven counts of Unlawful use of a two-way communication device F.S.S. 934.215, twelve counts of Introduction or possession of certain articles unlawful written or recorded communication or currency F.S.S. 944.47(1)(a)1 on Florida Department ofCorrections Property while acting in her official capacity as a Correctional Officer at the Florida State Prison.

Due to information being received from Florida State Prison regarding the incident concerning Officer Padgett/Cruce an Office of the Inspector General Investigation was initiated revealing that evidence of Officer Padgett/Cruce in a romantic relationship with Florida State Prison Inmate Todd D. Patterson DC#X12770. Officer Padgett/Cruce was communicating with Inmate Patterson via love letters hand delivered, as well as written communication via electronic J-Pay facticious account she created. Officer Padgett/Cruce was sending monies to Inmate Patterson via the inmates J-Pay account from her facticious account she created. On December 1,

2018, Officer Padgett/Cruce stated in an electronic message "And save it ������ ..I love you and I miss you most! Unconditionally" The phone number of - was Officer Padgett/Cruce personal cell phone number on file with the FDC records. In other messages Inmate Patterson provided his illegal inmate cell phone he was in possession in prison after being transfered to Jefferson Correctioanl Institution. Prison Officials proveded information Officer Padgett/Cruce was communicating with Inmate Patterson on December 6, 2018, at approximately 4:30 AM leading up to 8:30 AM while Officer Padgett/Cruce was on­duty inside a prison tower armed with firearms. Inspector Donaldson accompanied with Florida Sytate prison officials entered said prison tower on FDC prison property and requested Officer Padgett/Cruce personal cell phone which she provided.

Your Affiant respectfully submits that probable cause has been established that Correctioanl Officer Misty Cruce aka Misty Padgett aka Misty Clemons did commit the criminal offense of Introduction, or possession of certain articles unlawful F.S.S. 944.35 (1)(a)6, eleven counts of Unlawful use of a two-way communication device F.S.S. 934.215, twelve counts of Introduction or possession of certain articles unlawful written or recorded communication or currency F.S.S. 944.47(1)(a)1 on Florida Department of Corrections Property while acting in her official capacity as a Correctional Officer at the Florida State Prison.
