IhaveaquestionregardingClause69.1forDefaultofEmployer.WeareexecutingaContractforaProjectinPakistanunderFIDICFourthEdition,1987.TheEmployerhasassignedTheEngineerandalsoanEmployer'sRepresentative.TheEmployer'sRepresentativeisformtimetotimeactinglikeTheEngineerandwouldliketophysicallychecktheworksatsite.TheyarealsoapplyingdeductionsonthecertificatesofTheEngineer,suchasretentionmoneyonescalation,andalsoQuantities,etc.Theamountoftheunauthorizeddeductionsarearound5%ofthetotalamountcertificatesissuedbyTheEngineer.WehaveservedanoticeunderClause69.1and69.4,oftheConditionsofContracttoreducetherateofworkandfurthermore,clarifythattheClause69.1explainsthedefaultoftheEmployer,regardlessofthequantumofamountincaseofEmployer'sfailuretopaytotheContractortotalamountdueunderanycertificateoftheEngineer.DoyouthinkthattheabovestatementistrueanditisacaseofdefaultoftheEmployer?

DependingonwhatiswrittenintheContractandtheParticularConditions,generallyspeakingyouhaveacaseagainsttheEmployer.ThedamageswhichtheContractormayclaimwouldincludeinterestand/orfinancingcharges.However,youmustchecktheprovisionsoftheSubclause2.1Engineer'sdutiesandauthority,toseewhatismentionedthere.ItisnotveryclearwhatisthisEmployer'sRepresentativeandwhatarehisdutiesundertheContract,.However,onewouldsuspectthatyouhaveacaseagainsttheEmployer.

IsitrecommendedtohaveinacontractbasedonFIDIC'sElectricalandMechanicalWorksContractanexternalexpertactingastheEngineer?OristherenoprobleminrecruitingtheEngineerfromamongsttheBeneficiary(inourcasea"public"authority)?Wearesigningacontractshortly.TheEngineerisaccordingtotheRedBook,Clause2.4PartIboundtoactimpartially.ThequestionisifthereisaninternalincompatibilityintherelationshiptohisEmployer.
