INTRODUCTION

Before the enactment of the consumer Protection

Act 1986 a person aggrieved by the defective

goods in service had to approach the ordinary civil

court to get his grievances redressed. The

procedure in the ordinary civil court is very

complex, expensive and time consuming. In order

to give more protection to the interest of the

consumers of goods and service the parliament

enacted the Consumer Protection Act 1986.

The law relating to Consumer Protection is

contained in the Consumer Protection Act 1986. It

was enforced from 10th june 1986 in India.

Amendments were made in 2002. The act covers

private, public and co operative sectors. The act

applies whole of India except Jammu & Kashmir.

The CPA is an complementary to other laws of

protection of consumers.

COMPLAINT

Unfair trade practices has been adopted by an

trade or service provider.

The goods bought by him or agreed to be bought

by him suffer from one or more defects.

A trader or a service provider, as the case may be

has charged for the goods a price in excess of the

price displayed or fixed.

One or more consumers where there are numerous

consumers having same interest.

WHO CAN FILE A COMPLAINT ? If consumers have suffered loss as result of any unfair

trade practices adopted by the trader.

If consumers have been charged a price in excess of the

price displayed or fixed.

Unlawful goods which is hazardous to life.

Advertisement leading to confusion.

Short supply of goods and services.

Incorrect weight or quantity

Lack of awareness.

Legal limitations

Remedies under CPA

To withdraw the hazardous goods from being offered for

sale.

To cease from manufacturing of hazardous goods.

Issue of corrective advertisement.

Provision of adequate costs to parties.

Not to offer hazardous goods for sale.

Things to remember

Look for the “BEST BEFORE” or “EXPIRY DATE” when

buying food or medical products.

Always look for standard marks like ISI, FRO, AGMARK

etc.

In the consumer force “ The consumer is always strong”

Always insist on cash memo.

Conclusion

Consumer Protection Act provides for the better

protection of the interest of consumers and for that

purpose to make provision for the establishment of the

consumer councils and other authorities for settlement on

consumer disputes and for matters connected there with.
