25.2 The CUC s h a l l not b e l i a b l e f o r i n t e r r u p t i o n s of s e r v i c e o r s h o r t a g e of s u p p l y , nor f o r l o s s o r damage occas ioned t h e r e b y , u n l e s s o c c a s i o n e d by t h e n e g l i g e n c e o r wrongful a c t of t h e CUC.

PROPOSED HOUSING REGULATIONS

I. l e a d furnishtd quarters or a housing allowance w i l l be prwided to the following employees of the Public School System:

1. Employees recruited from outside of the CNMI. 2. Employees who are residents of the CNMI assigned to duty stations beyond normal

commutinp distance from the home islands or their residence and have not been employed by PSS for more than 2 years. Exceptions may be made for hard to fil l positions.

3. Any PSS employee who owns a house or whose spouse owns a house i n the same island as hidher duty station i s not entitled to housing or housing allowance.

4. Persons recruited away from the Senatorial District of which he/she i s a registered voter.

Sec t ion 1. T i t l e . Th is amendment s h a l l be known a s Amendment No. 90988.

Sec t ion 2. Purpose. These r e g u l a t i o n s s h a l l p rov ide f o r t h e i s suance of l i c e n s e s , t h e temporary suspension o r permanent r evoca t ion of l i c e n s e s , t h e p r o h i b i t i o n of l i c e n s e t r a n s f e r s , and t h e s eg rega t ion of poker machines from o t h e r on-premise bus inesses . A new s e c t i o n , Sec t ion 2 . 1 5 0 4 ( a ) ( 2 ) , i s , t h e r e f o r e , added t o Revenue and Taxat ion Regula t ions No. 8301.

Sec t ion 3. Author i ty . The D i r e c t o r of Finance, pursuant t o 1 CMC 2557 and P.L. 5-3, Sec t ion 3 ( c ) and a f t e r c o n s u l t a t i o n wi th t h e D i r e c t o r of Commerce and Labor has t h e a u t h o r i t y t o promulgate t h i s amendment t o Revenue and Taxat ion Regula t ions No. 8301.

Sec t ion 4 . F ind ings . The fo l lowing a d m i n i s t r a t i v e f i n d i n g s c o n s t i t u t e t h e b a s i s f o r t h i s amendment:

( a ) A t t h e t i m e t h a t P.L. 5-3 w a s enac ted , t h e number of poker machines i n e x i s t e n c e exceeded t h e c e i l i n g e s t a b l i s h e d by t h a t law. It i s , t h e r e f o r e , neces sa ry t o e s t a b l i s h an e q u i t a b l e system by which an o r d e r l y r educ t ion of t h o s e machines can be achieved, i f and when e x i s t i n g machines become i r r e p a r a b l e .

( b ) A d e f e c t i v e o r mal func t ion ing poker machine can, i n t h e v a s t m a j o r i t y of i n s t a n c e s , be r e p a i r e d wi th in 24 hours and t h e l o s s of revenue whi le t h e machine i s be ing r e p a i r e d i s minimal.

( c ) Sec t ion 3 ( b ) of P u b l i c Law 5-3 prov ides t h a t upon t h e f a i l u r e of any person t o renew h i s poker machine l i c e n s e , t h a t l i c e n s e s h a l l n o t be re - i s sued t o any person i f it w i l l cause t h e number of such l i c e n s e s t o exceed 200 i n any S e n a t o r i a l Distr ic t . It i s t h e i n t e n t of t h e L e g i s l a t u r e t h a t e v e n t u a l l y no s e n a t o r i a l d i s t r i c t have more than 200 poker machines l i c e n s e d i f t h a t can be accomplished i n a f a i r , r easonable and even-handed manner.

Sec t ion 5. Amendment. Amendment No. 90988 t o Revenue and Taxation Regula t ions N o . 8301 may be c i t e d a s t h e "Poker Machines Regulat ions ." The amendment s h a l l read as fo l lows:

( b ) t h e make, model, year , brand name and serial number of each machine;

( c ) t h e l o c a t i o n (by bu i ld ing , v i l l a g e and i s l a n d ) of each machine;

( d l an a c c u r a t e c o l o r photograph of t h e machine whi le i n ope ra t ion wi th i t s sc reen i l l u m i n a t e d ;

( e ) a n o t a r i z e d s ta tement by t h e a p p l i c a n t of t h e machine regarding---

(1) t h e payout r a t i o of each machine on t h e average,

( 2 ) whether o r n o t t h e o p e r a t o r o r owner can modify t h e payout r a t i o i n subd iv i s ion (1) above, and t o what e x t e n t .

( f ) a s ta tement under p e n a l t y of p e r j u r y t h a t t h e a p p l i c a t i o n d a t a a r e t r u e and c o r r e c t .

(ii) Once an i n i t i a l l i c e n s e i s i s s u e d t o a person f o r a machine, a l l subsequent l i c e n s e s f o r such machine l i c e n s e s s h a l l be renewals and s u b j e c t t o t h e f u l l annual l i c e n s e f e e s .

(iii) A l i c e n s e can be renewed f o r an a p p l i c a n t on ly f o r a machine t h a t was l i c e n s e d t o t h a t a p p l i c a n t i n t h e same s e n a t o r i a l d i s t r i c t t h e prev ious ca l enda r year .

( i v ) The annual l i c e n s e f e e may be p r o r a t e d on a q u a r t e r l y b a s i s f o r t h e i n i t i a l i s suance of l i c e n s e s f o r new poker machines.

(B) Meters

(i) A l l owners of poker machines must modify each machine l i c e n s e d f o r commercial o p e r a t i o n on o r be fo re December 31, 1988 by p l a c i n g a meter i n s i d e t h e machine f o r r eco rd ing t h e number of co ins i n s e r t e d i n t o t h e machine.

(ii) Such meter i s t o be read each t i m e t h e machine i s opened f o r f i l l s and withdrawals . Each r ead ing must be kep t a s a permanent account ing record of a l l poker machine bus ines ses .


(C) Tags

( i ) Licensed poker machines must b e a r a numbered t a g on t h e t o p r ight-hand corner of t h e sc reen o r viewing window o r scoreboard; o r f o r t h o s e machines wi thout viewing window, sc reen o r scoreboard, t h e a r e a des igna t ed by t h e Chief of Revenue and Taxation o r h i s des ignee. This t a g may be removed on ly by t h e Div is ion of Revenue and Taxation. A second i d e n t i c a l t a g s h a l l be placed i n s i d e t h e poker machine.

(ii) No poker machine may be opera ted u n l e s s it has a v a l i d t a g a f f i x e d t o i t s cab ine t . No t a g may be t r a n s f e r r e d from one machine t o another . A replacement t a g w i l l be i s s u e d and a f e e of $25 w i l l be charged and c o l l e c t e d f o r each new t a g . The poker machine owner s h a l l r e p o r t t o t h e Div is ion of Revenue and Taxation whenever a t a g i s l o s t o r defaced, and s a i d t a g w i l l be promptly rep laced by t h e Div is ion of Revenue and Taxat ion a f t e r t h e Div is ion v e r i f i e s t h e t a g number from t h e i d e n t i f y i n g t a g i n s i d e t h e machine and a replacement f e e of $25 i s pa id t o t h e Div is ion of Revenue and Taxation.

( D l I s suance of License

(i) Upon r e c e i p t of an a p p l i c a t i o n f o r a poker machine l i c e n s e o r l i c e n s e renewal, t h e Div is ion of Revenue and Taxation may v i s i t t h e premises des igna t ed i n t h e a p p l i c a t i o n and c e r t i f y t h a t t h e in format ion contained i n t h e a p p l i c a t i o n i s t r u e and c o r r e c t . I f t h e a p p l i c a t i o n meets a l l requirements , a l i c e n s e w i l l be i s s u e d w i t h i n 60 days from t h e d a t e t h e a p p l i c a t i o n i s rece ived . Said l i c e n s e s h a l l be i n w r i t i n g and must be k e p t on t h e premises where t h e machine i s loca t ed f o r i n s p e c t i o n upon demand by t h e Div is ion of Revenue and Taxation. A renewal l i c e n s e can be i s sued on ly f o r a machine t h a t was l i c e n s e d i n t h e ca l enda r year immediately preced ing t h e renewal year . A new machine l i c e n s e d t o r e p l a c e an i n o p e r a t i v e poker machine s h a l l be l i c e n s e d a s a new machine.

(ii) An a p p l i c a t i o n f o r i n i t i a l o r renewal l i c e n s e may be denied i f t h e a p p l i c a n t has v i o l a t e d Pub l i c Law 5-3 and t h e s e r e g u l a t i o n s .

(iii) Before a l i c e n s e i s i s s u e d , a l l charges , t a x e s and f e e s r e l a t i n g t o poker machines must be f u l l y p a i d , i n c l u d i n g a p p l i c a b l e p e n a l t y and i n t e r e s t charges.

(El Replacement of Machines.

( i) For S e n a t o r i a l Dis t r ic t 3 , Saipan and a l l i s l a n d s n o r t h of Saipan, t h e method t o lower t h e number of poker machines t o t h e s t a t u t o r y l i m i t of 200 i s a s fo l lows:

( a ) The t o t a l number of machines l i c e n s e d t o each owner as of t h e e f f e c t i v e d a t e of t h e s e r e g u l a t i o n s , s h a l l be d iv ided by 246. This y i e l d s t h e d i s t r i b u t i o n r a t i o .

EXAMPLE V

During Supertyphoon K i m , 12 of t h e 20 poker machines i n t h e game room of Owner G w e r e soaked wi th s a l t w a t e r . These 12 machines w e r e beyond r e p a i r . S ince Owner G i s r equ i r ed t o reduce i t s machines by 4 , Owner G may be au tho r i zed t o r e p l a c e 8 of t h e broken machines. The e i g h t machines t h a t were n o t des t royed by t h e typhoon and t h e e i g h t new machines b r i n g s t h e number of poker machine t o t h e t a r g e t l e v e l of 16. Should any of t h e 1 6 machines subsequent ly become d e f e c t i v e and need t o be rep laced , Owner G may be au tho r i zed t o make such replacement on a one t o one b a s i s .

(ii) There i s no s p e c i a l r u l e f o r replacement of machines i n S e n a t o r i a l D i s t r i c t s 1 and 2 , Rota and Tinian-Aguiguan r e s p e c t i v e l y . Poker machines i n t h e s e d i s t r i c t s may be rep laced pursuant t o o t h e r s e c t i o n s of t h e s e r e g u l a t i o n s and provided t h a t t h e t o t a l number of machines i n each d i s t r i c t does n o t exceed 200 a t any given t i m e .

( F ) Quota ~ r a n s f e r a b l e .

( i) The d i s t r i b u t i o n r a t i o e s t a b l i s h e d on t h e e f f e c t i v e d a t e of t h e s e r e g u l a t i o n s determine t h e maximum number of machines t h a t each owner should have i n o r d e r t o reduce t h e t o t a l number of machines i n S e n a t o r i a l D i s t r i c t # 3 t o 200.

(ii) I f an owner ma in t a in s h i s poker machine inven to ry a t a l e v e l lower than t h e determined quota f o r t h r e e months, t h e owner s h a l l l o s e t h e r i g h t t o t h a t quota and t h e p o r t i o n s h a l l immediately become a v a i l a b l e f o r use by o t h e r persons , provided t h e maximum number of poker machine i n a d i s t r i c t i s less than 200.

(iii) Such unused quota s h a l l be made a v a i l a b l e t o q u a l i f i e d a p p l i c a n t s based on procedures t o be e s t a b l i s h e d by t h e Div is ion of Revenue and Taxation. The a c q u i s i t i o n of such quota by a q u a l i f i e d a p p l i c a n t simply g i v e s t h e person t h e r i g h t t o apply f o r a l i c e n s e .

( i v ) I f a poker machine bus ines s i s s o l d , t h e quota of t h e former owner i s a u t o m a t i c a l l y t r a n s f e r r e d t o t h e new person.


(GI Movement of Machines. The Div is ion of Revenue and Taxat ion must r e c e i v e w r i t t e n n o t i f i c a t i o n wi th in 10 days a f t e r a poker machine i s moved w i t h i n a S e n a t o r i a l d i s t r i c t from one b u i l d i n g o r l o c a t i o n t o another . The w r i t t e n n o t i f i c a t i o n must c o n t a i n t h e serial number and i d e n t i f i c a t i o n t a g number. The owner of a machine moved wi thout t h e w r i t t e n n o t i f i c a t i o n as providedhere in s h a l l have i t s l i c e n s e suspended f o r no less than 30 days and n o t more than 180 days.

( H ) N o t i f i c a t i o n of Machine Location. Within 30 days a f t e r t h e e f f e c t i v e d a t e of t h e s e r e g u l a t i o n s , each l i c e n s e e s h a l l g i v e w r i t t e n n o t i c e t o t h e Div is ion of Revenue and Taxat ion of t h e l o c a t i o n , by b u i l d i n g , v i l l a g e and i s l a n d of each of i t s l i c e n s e d poker machines.

( I ) Time Deadl ines . A l i c e n s e renewal a p p l i c a t i o n s h a l l be submit ted between December 1 and December 31 of each yea r wi th payment f o r t h e t o t a l number of machines t o be l i c e n s e d . The Div i s ion of Revenue and Taxation s h a l l review t h e in format ion conta ined t h e r e i n and i n s p e c t t h e machines. The poker machines may cont inue i n ope ra t ion d u r i n g t h e review pe r iod u n l e s s t h e l i c e n s e a p p l i c a t i o n i s denied.

(J) Vio la t ion .

(i) I f t h e Div is ion of Revenue and Taxat ion r e c e i v e s a r e p o r t i n w r i t i n g t h a t a machine i s be ing opera ted wi thout a l i c e n s e o r i n v i o l a t i o n of P u b l i c Law 5-3 o r t h e s e r e g u l a t i o n s , t hen t h e Department of Finance s h a l l promptly i n v e s t i g a t e s a i d r e p o r t and t a k e a p p r o p r i a t e a c t i o n t o ensure compliance.

(ii) Poker machines o p e r a t i n g i n v i o l a t i o n of l a w o r t h e s e r e g u l a t i o n s s h a l l be d e a l t wi th i n accordance wi th t h e a p p l i c a b l e C N M I l a w s .

(iii) If an unl icensed machine i s s e i z e d , t h e owner and t h e o p e r a t o r s h a l l be j o i n t l y and s e v e r a l l y l i ab le f o r t h e c o s t of t r a n s p o r t i n g t h e machine, a reasonable s t o r a g e charge of n o t less than $25 p e r day p e r machine, and any l a b o r charges i ncu r r ed i n t h e t r a n s f er.

( i v ) The Department of Finance, t h e Div is ion of Revenue and Taxat ion, and t h e Commonwealth Government s h a l l no t be l i a b l e f o r damages a r i s i n g from t h e s e i z u r e and/or c o n f i s c a t i o n of un l icensed machines, i n c l u d i n g damages occur ing du r ing t r a n s f e r and s t o r a g e , provided t h a t reasonable c a r e i s used i n s e i z u r e and con£ i s c a t i o n .

(K) Trademark and S e r i a l Numbers. A l l poker machines imported i n t o t h e Commonwealth f o r commercial use must have a trademark and a s e r i a l number. Poker machines wi thout a trademark and a serial number s h a l l no t be i s s u e d a l i c e n s e .


( L ) T rans fe r of License.

( i) No poker machine l i c e n s e t a g may be t r a n s f e r r e d from a d e f e c t i v e o r mal func t ion ing machine t o an o p e r a t i v e machine.

(ii) Any poker machine i n S e n a t o r i a l D i s t r i c t #1 o r S e n a t o r i a l Distr ict #2 t h a t i s c e r t i f i e d by t h e Div is ion of Revenue and Taxation a s be ing i r r e p a r a b l e may be rep laced by ano the r poker machine, provided t h e replacement poker machine i s l i c e n s e d by t h e Div is ion of Revenue and Taxation b e f o r e i n s t a l l a t i o n , and provided f u r t h e r t h a t t h e t o t a l number of machines i s wi th in t h e s t a t u t o r y l i m i t .

(MI License Proceedinqs

( i) Denial of an a p p l i c a t i o n of l i c e n s e . Whenever t h e Chief of Revenue and Taxation ("Chief" ) has reason t o b e l i e v e t h a t an a p p l i c a n t i s n o t e l i g i b l e t o r e c e i v e a l i c e n s e , he may i s s u e a n o t i c e of d e n i a l t o t h e a p p l i c a n t . The n o t i c e s h a l l set f o r t h t h e matters of f a c t and law r e l i e d upon i n determining t h a t t h e a p p l i c a t i o n should be den ied , and s h a l l a f f o r d t h e a p p l i c a n t 1 5 days from t h e d a t e of r e c e i p t of t h e n o t i c e i n which t o r e q u e s t a hea r ing t o review t h e d e n i a l .
