Annual Membership Party at the 2300 Club: Tuesday, November 24 at 7:00pm

Our Annual Membership Party will be held on November 24. All members will be given tickets for two free drinks and thereafter a cash bar. There will be free sodas and hors d’oeuvres. It is a great chance to meet and chat with your neighbors, and to join the CHA if you have not already done so. If you have joined the CHA or renewed your membership at any of the three summer picnics, then you are a member until December 31, 2010. There will be an “express” sign in for those who are already members for 2010, so join before the party! If you want to join or rejoin on the day, fill out the member-ship form in this newsletter. Please, write your check (payable to the CHA) in advance so we can keep the line moving! The party is our traditional “kick-off” for the holiday season as well, so the tickets for the Ball and the House Tour will be available. SCHOOL BOARD MESSAGE Greetings, The Mayor has announced his plans for building schools here in Richmond. Now the School Board and citizens must respond. As a long-time resident of the East End, I know that there hasn't been any new public school construction in the 7th District in over 40 years. We must have a new school built here in the 7th in this first phase. I am very encouraged by the cooperation being modeled by Mayor Jones. It is essential that with only $150 million we make a strong start. Please: as the taxpayers of this city, your voices need to be heard! George Mason and MLK were both high on the list in the previous plan. Now, by the Mayor's announcement, the School Board must revisit which schools will be in Phase I or moved to another phase in the process. The positive energy that is all around the East End can only be enhanced by a new school or schools! This is our time as a community to come together and make our case. Timing is crucial. Our children and future children will deserve facilities that are state of the art education and community centers for all citizens. In just three months I will have worked on the newsletter for eight years. So it is time for a change. Not only a change for the newsletter, but a break for me too. However, the Association really does need someone to step up and take on the task before the January issue deadline (in Dec.). Run to the River Makes a Big Splash, Raises Cash!

Nearly 160 runners and walkers helped raise approximately $30,000 in the second annual Rocketts Landing Run to the River. All event proceeds support the Neighborhood Resource Center (NRC). Prizes were awarded to these top fundraisers (also known as “fundrunners”): 1st Place Fundrunner: Liz Cramer (2 night stay to The Homestead Resort) 2nd Place Fundrunner: Brandon Jaycox, representing the Greater Fulton Hill Civic Association (one year membership to Richmond Balance) 3rd Place Fundrunner: Janet Aardema (gift certificate to Comfort Restaurant)

Special Hymn-Singing Event

You are invited to join the Richmond Sacred Harp Singers for an all day old time hymn-sing in Saint John’s Church Parish Hall. Hailing from far and wide throughout the Commonwealth and beyond, shape-note singers will convene at the Parish Hall on Saturday, November 7, from 10 a.m. – 3 p.m., to raise the rafters with vigorous, joyful singing of old hymns from the Sacred Harp Psalter. Even if you do not read music, please come to sing-along and learn about shape-note singing. Plenty of loaner psalters will be available. The convention includes dinner on the grounds and hearty fellowship. Everyone is welcome! The Richmond Sacred Harp Singers, an eclectic group of shape-note singers, has adopted St. John’s Church as its home base. The parishioners and larger Church Hill community are encouraged to attend their practices every third Saturday afternoon and this special all-day event. Don’t leave your car running or spare keys inside. Take personal items in your home/apartment or secure in

the trunk – especially IPod’s, GPS’s and change. Inform your guests about leaving items in the interior of

their vehicles. Burglaries:

Make sure you always lock your doors and windows when you leave home.

If you are working in the rear yard, be sure to lock your front door.

Don’t leave items out that can be used to gain entry through a window, such as ladders.

Keep shrubs and trees trimmed. Make sure sheds and outbuildings are always locked. Get to know your neighbors –keep a watch on each other’s

property and exchange contact numbers in case there is an emergency.

Don’t leave items unsecured in your yard such as bikes and lawn mowers; this sometimes invites criminals onto your property.

Notify the First Precinct at 646-0572 if you are going on vacation or out of town on business.

NEIGHBORHOOD NEWS Confederate Soldiers and Sailors Monument: “the statue would of necessity be Colossal” (Part 2 in it’s entirety) By, Ruth Ann Coski This is the remainder of the second part of a two-part series. It is excerpted from an article in the Museum of the Confederacy Magazine and lightly edited by CHA member Waite Rawls. “Relieved of all embarrassment...” Sir Moses Ezekiel lamented in his memoirs, “my heart was in the Southern cause; I fought for it and risked my life for it, but the injustice that had been done to me was very cruel. The blank ingratitude of my own people, however, could never change what I felt to be my duty towards my home and country.” Ezekiel got another chance to make his lasting mark and contribution on the Confederate landscape when he won the commission for the United Daughters of the Confederacy’s richly symbolic Confederate monument in Arlington Cemetery. President Woodrow Wilson accepted Ezekiel’s masterpiece on behalf of the American people in June 1914. Old soldier that he was, Ezekiel himself was buried in Arlington on March 30, 1921 at the foot of his own monument to the Confederacy. His tombstone bears the simple epitaph, “Moses Ezekiel, Sergeant, Company B, V.M.I. Battalion of Cadets.”

CHA BOARD MEETING MINUTES OF THE SEPTEMBER 30, 2009 BOARD MEETING By CHA Secretary, Pam Prescott President John Johnson called the meeting to order at 7:00 at the 2300 Club. Treasurer’s Report As of September 30, the CHA had $26,466 cash in the bank for a decrease in cash flow of $651 for the month. The 2010 proposed budget will be displayed in the October newsletter for the membership to review. Comments and recommendations will be received at the October membership meeting where a final vote will ensue. Committee Reports Zoning: The Board voted on Waite Rawls to fill the vacancy of the Zoning Committee chair. The motion was carried. Thank you, Waite and the Board looks forward to working with you. Newsletter: No Report Membership: The annual Membership party will be held on November 24 at 7pm at the 2300 Club. Clean and Safe: No Report Nominating: Erika Gay, Nominating Committee chairperson, announced those interested in filling the vacancies on the Board for the 2010 term. All nominees will be posted in the November newsletter and elections will be held at the November Membership meeting. You must attend the November 17 meeting to vote for the 2010

Board. Nominations can also be taken from the floor at the meeting. Holiday: Tickets are available online at the CHA website. Business The proposed revisions to the Church Hill Association By-laws will be reviewed at the October general meeting. The revisions will be posted in the October newsletter for the membership to review prior to the meeting. The Board will receive recommendations and comments regarding the changes and, if time allows, a final vote will ensue. If time does not allow, the revisions will be voted upon at the November membership meeting. The proposed historic plaques are still being reviewed by CAR and no decision has been made. We will keep you informed when CAR releases any information or decision about the proposed size, material and content. All four Welcome to Church Hill signs have been installed around our neighborhood. Thanks to Erika Gay for all her hard working in completing this project. The meeting was adjourned at 9:05pm.

GENERAL MEMBERSHIP MEETING MINUTES OF THE OCTOBER 20, 2009 GENERAL MEMBERSHIP MEETING By CHA Secretary, Pam Prescott In CHA President John Johnson’s absence, John Whitworth called the meeting to order at 7:06pm at St. John’s Church Parish Hall. Announcements New members were welcomed. Recognition and thanks to all the summer picnic organizers: Angelica Volkel, Jody and Thomas Rathgeb and Malou Rawls. Thank you all! The forum of the 7th District Council candidates on October 15 at the Robinson Theatre proved to be an educational one but revealed a disappointing turnout for the event with only approximately 25 people in attendance. The CHA funded $300 for this forum. Nominations for the Most Inspired Gardening contest are being accepted till December 13. The issue concerning our local Fire Station unavailability continues to be an ongoing issue. It was discussed that 10 days out of every 30 days, the Church Hill Fire Station does not provide coverage for our community. Residents can blog and find out more information at http://richmondfirefighters.blogspot.com/ Police Officer A. C. Jenkins provided the Police/Crime Report. She advised the membership to watch vacant areas and houses as crime is increasing there. Church Hill had 5 robberies last month. The police are moving parked cars in the Sugar Bottom area. Church Hill experienced 5 robberies last month and is trending upward. Please call them if you see anything out of the ordinary. Drug usage at the overlook has been reported. Any questions or concerns, please call the First Precinct at 646-0572. The nonemergency number is 646-5100. Committees Treasurer: The proposed 2010 budget was presented to the membership at the meeting. We reviewed the detailed monthly cash flows for the past nine months to September 25, 2009. We started the year with cash of $43.4k and have spent to date $16.9k so our cash balance on 9/25/09 was $26.5k. Of the spend to date $10.0k has been

utilized as part of the $25k cash reduction program approved by the membership earlier in the year due to the need to reduce our cash balances to ensure we keep our non-profit status with the Internal Revenue Service. (We basically had too much cash on hand). So operational cash flow to date is $6.9k adverse. The budget year to Dec 31st '09 called for a break-even cash position. The upcoming Holiday week-end is budgeted to produce a positive cash flow in the last quarter. The news-letter is behind budget year to date ($1.9k loss to date) due to the recession biting into our advertising income. The Board currently feels it would be inappropriate to raise advertising rates, but it will be looked at in 2010. The budget was voted on by the membership with the only addition of a library donation for $250 and the motion was carried. Membership: Benedicte announced that the annual membership party is November 24 at the 2300 Club at 7pm. Newsletters: The membership is saddened by the news of Erika Gay’s resignation as Newsletter Editor. Erika has worked very hard over the years and we thank her for the numerous contributions she’s made to our community. Anyone interested in helping with the newsletter please see any Board member. Zoning: Waite Rawls has been named the new Chair for the Zoning committee. He is actively seeking additional new members for the committee. Thank you for volunteer-ing! Please see Waite or any Board member if you are interested in helping out. Holiday: Liz Steen, Holiday Ball Chairperson, advised the membership that ½ of the available tickets had been sold during the Early Bird Special. Tickets may be pur-chased online on the Church Hill Association website. The Ball will be at the Holocaust Museum on December 12 with a live Band for 2 hours and a DJ for three hours. Eugenia Anderson-Ellis, Co-chair for the Holiday House Tour, announced the committee has finalized the 8 homes for the tour. All the homes will be decorated for the holiday with 2 or 3 floors open for touring. The House Tour on the 13 will also consist of opening the Libby Hill Park house where all the past framed Holiday Weekend posters will be displayed by Holly and Chuck Wren. Refreshments will also be served at the Park House. There

GENERAL MEMBERSHIP MEETING will be horse drawn carriages and carolers throughout the neighborhood during the house tour. The shuttle will also run from the Valentine Museum to St. John’s Church as in previous years. All tickets are available online at the Church Hill Association website: www.churchhillrichmond.com Business: Several Board members along with Randy Bell met with ChildSavers and adjacent neighbors concerning the request for the proposed Special Use Permit (SUP). After meeting with both parties and negotiating, an agreement was

reached. The motion was presented, seconded and a vote ensued. The motion was approved to support the Child-Saver’s SUP. The proposed Bylaws changes were discussed in length at the meeting. The membership debated and ended up voting and approving Articles 1 through 6. We will pick up at the November meeting with Article 7 and move forward. The membership graciously thanked the Bylaw committee for all their efforts with this task. The meeting was adjourned at 9:14 pm.

Church Hill Association By-Law Review What you see below are new changes to the By-Laws, Article I-VI as a result of the October 20 Church Hill General Membership meeting. These changes will be reviewed and approved at the November 17 Membership meeting. On the following pages Articles VII-XI have been re-printed because they were not approved by the membership at the last meeting. We ran out of time. Please attend the November 17 Membership meeting to discuss the Church Hill Association By-Laws with your neighbors. Thank you, the By-Laws Committee New changes:

Article III. MEMBERSHIP

1. Membership shall be open to everyone living in and/or working in the St. John's Church, Church Hill North, and Chimborazo Old and Historic Districts, other residents living and/or working in the East District, and to other interested persons. Membership shall in no way be exclusive.

2. Members shall be those persons who have paid their dues during the current calendar year, being January 1 through December 31. Only members shall be entitled to vote upon any question before the general membership. New members who join at a monthly meeting cannot vote on motions made at the meeting. Any new member who pays their dues after June 1 of any year shall remain a member in good standing until December 31 of the subsequent year.

3. Each member shall have one vote. Proxy voting shall not be allowed.

4. An up-to-date membership roster shall be maintained by the Membership Committee Chair and verified by the Assistant Treasurer. The roster shall be available at each general meeting.

Article VII. BOARD OF DIRECTORS

The Board of Directors shall be responsible for the ongoing operation of the Association. Once the budget is approved at the November membership meeting, the Board may not expend more than five hundred dollars ($500.00) in excess of any amount in the approved budget without the approval of the membership at a membership meeting. Once the budget is approved at the November membership meeting, if timeliness and necessity compel the Board to spend money without approval of the membership the Board may expend no more than five hundred dollars ($500.00). All expenditures for non-budgeted items must be brought to the membership's attention at the subsequent meeting and explained. Board expenditures exceeding five hundred dollars ($500.00) must be approved by the membership at a membership meeting.

Article IX. CONTRIBUTIONS AND FINANCES

The Treasurer shall be authorized to sign any checks under $200. Checks in the amount of $200 or more require two signatures, the Treasurer and either the President or the, Vice President. The Treasurer shall be authorized to sign all checks where the expenditure has been included in the annual budget and approved by the membership. All other checks above $500 require two signatories. The list of authorized signatories includes The President, the Vice President, the Treasurer and the Assistant Treasurer.

ARTICLE VII. BOARD OF DIRECTORS

1. The Board of Directors shall meet regularly each month and at the call of the President. The President shall preside at meetings of the Board. In order to constitute a quorum six members but shall only vote in case of a tie. A majority vote of the Board shall be present. A constitute a quorum. A majority of the Board members present shall be required to pass any measure.

2. The Board of Directors shall be responsible for the ongoing operation of the Association. Once the budget is approved at the November membership meeting, the Board may not expend more than five hundred dollars ($500.00) in excess of any amount in the approved budget without the approval of the membership at a membership meeting.

Any proposal for spending amounts of one thousand dollars ($1,000) or more must be announced to the membership by newsletter or electronic communication flyer before any action of approval at a membership meeting. It is further provided that in any membership vote in this connection, there shall be strict adherence to permitting only currently paid members in good standing to participate, by reasonable safeguard.

The Board shall not act without the approval of the membership, as evidenced by resolution duly moved and seconded at the membership meeting, on the selection of community projects to which Association monies or volunteers will be committed; on changes to the by-laws of the Association; on correspondence espousing support for political or social causes or movements; or supporting or opposing land use issues. Upon the passage of such resolution, the Board may act to carry out the will of the membership as expressed in such resolution.

3. If any officer or Director at Large misses three consecutive or a total of six meetings, the Board of Directors shall be empowered to recommend to the general membership that the officer or Director be replaced. Any Board member desiring to resign shall submit a letter of resignation to the remaining Board members.

ARTICLE VIII. COMMITTEES

1. The following shall be the standing committees of the Association: Budget, Zoning, Membership, and HolidayChristmas Festival. The Chair of each standing committee shall be appointed by the President and approved by the Board of Directors.

Each Chair so appointed shall then appoint all such committee members as may be necessary to effect the work of the committee.

The Board of Directors shall prepare a statement for the guidance of each standing committee; however, the Zoning committee shall meet on the fourth Tuesday of each month. Moreover, the Zoning Committee shall be have the authority to request, without further approval by the Board or Membership, one month's delay or continuance from the Commission of Architectural Review (the “CAR”), on behalf of the Association, regarding items on the CAR agenda under the following circumstances:committee.

1. Requests for zoning changes or Special Use Permits 2. New construction 3. Changes to footprint, façade or roofline of existing structures. 4. Change to setback requirements."

2. The President shall also appoint, subject to the approval of the Board of Directors, an Editor of the Association's newsletter, Block Leader Chair and, Memorial Day Festival Chair, such other positions as may be deemed necessary to carry out the purposes of the association.

3. The immediate-past president may serve as an ex officio non-voting member of the board for a one year term. The chair of the Zoning Committee and Editor of the newsletter shall serve ex officio as non-voting participants at

meetings of the Board of Directors. The other officers of the HolidayChristmas Festival shall be appointed by the Festival Chair subject to the approval of the President, except the Treasurer who shall be the regularly elected Treasurer of the Association.

ARTICLE IX. CONTRIBUTIONS AND FINANCES

1. The fiscal year shall run from January 1 through December 31.

2. The amount of membership dues may be changed upon the recommendation of the Board of Directors and approval by vote of the membership.

3. The membership shall vote at the November membership meeting on the budget prepared by the Treasurer. The budget submitted by the Treasurer shall contain both an operating budget for the day-to-day expenses of the Association, and a special projects budget which shall detail any proposed expenditures of Association funds for community, civic, cultural, and/or historic preservation and/or any other special purpose. No funds shall be expended by the Association unless first approved by the membership as part of the budget, except as provided in Article VII, section 2 above.

4. The Treasurer shall receive all dues and all other receipts and deposit them in a banking account of the Association. A portion of the association’s cash assets may be invested in an interest bearing account.

5. The Board of Directors shall have the authority to authorize the expenditure of monies from the Association's operating account as set out in an approved budget, subject to the provision of Article VII, section 2 above.

6. The Treasurer shall be authorized to sign any checks under $200. Checks in the amount of $200 or more require two signatures, the Treasurer and either the President or the, Vice President. or Treasurer.

7. Requests for community project and capital funds over one thousand dollars ($1000.00) must be completed in writing and submitted to the Board prior to the approval of the budget, as stated in Article IV, Section 6.

ARTICLE X. PARLIAMENTARY AUTHORITY

1. Roberts Rules of Order, Current Edition, shall govern the operations of the Association in all cases to which they are applicable and in which they are not inconsistent with these by-laws. These by-laws shall govern in case of such inconsistency.

ARTICLE XI. AMENDMENTS

These by-laws may be amended at any meeting of the Association by a vote of two-thirds of those present, provided that the proposed amendments have been submitted in writing to the members at least 10 days prior to the date of the regular or called membership meeting. Such submission of the proposed amendments shall be either by mail, newsletter, or electronic communication. by the means ordinarily used to distribute the newsletter.

Guidance Statement for the Zoning Committee of the Association

Under Article VIII, section 1, paragraph 3 of the By-laws as amended, the Board of Directors is to prepare a statement for the guidance of each standing committee. This document is to provide such a guidance statement for the standing committee on zoning based upon the recommendations of the 1995-96 Zoning Committee and the deliberations of the 1995-96 Board of Directors. While this is provided as a guidance document, it is hoped that it will be viewed by future Boards of Directors and Zoning Committees as reflecting the serious intent which produced it.

1. Given the priority for the Association of zoning and land use matters, there should be standing committee status for a Zoning Committee on an ongoing basis.

2. It shall be the responsibility of the Zoning Committee to research and advise the Board of Directors on zoning and land use matters in the city of Richmond related to the St. John's, Church Hill North, and Chimborazo Old and Historic Districts.District.

3. The Chair of the Zoning Committee shall be appointed each year by the President and approved by the Board of Directors. If the Committee deems it useful to its operations, it may wish to designate a Vice-Chair to act as an alternate for the Chair and/or a Secretary to record minutes and assist in correspondence. In selecting a Chair, the incoming President should give strong weight to experience in zoning matters as well as leadership credentials and potential, with preference to members of the previous year's Zoning Committee.

4. Experience has taught that the Zoning Committee requires a mix of experience and fresh ideas, geographic and other diversities and a size of membership large enough to enable performance but not so great as to become unwieldy. While the Committee has functioned with varying sizes of membership, an optimal number may be nine, including the chair. A reasonable balance of diversities and of experience is essential; to that end, in a committee size of nine, it seems desirable to bring in at least three fresh members each year and retain as many as six from the prior year. It also seems desirable to include within the nine members, two or more Board members on the Zoning Committee.

5. Just as continuity is important because of the demands of the subject matter for the Zoning Committee, it is also important that the Committee not become hidebound by lack of turnover. To that end, term limits for service of, e.g., no more than three years service in any five-year period would be an important safeguard.

6. Committee members should be appointed annually, with due regard to the foregoing, by the Chair after consultation with the President and with the approval of the Board. All committee members so selected shall be currently paid members in good standing of the Association and reside in or near the St. John's, Church Hill North and Chimborazo Old and Historic Districts and remain so as to both requirements during their term.

7. The Zoning Committee should normally meet each month in or near the Historic Districts at the call of the Chair, preferably one week prior to the monthly meeting of the Board of Directors. The meetings should be open to observation by currently paid members in good standing of the Association, preferably upon notice to the Chair.

8. Delinquency. If any committee member fails to attend four meetings in a one-year period, the Chair shall be empowered to recommend to the President that the member be replaced in the same manner that any other member is appointed.
