Codycrh (Mon, 30 Sep 2019 at 12:49 PM)

Derek Pohl, an employee of the County Road Administration Board, conspired with WA Board of Registration for Professional Engineers and Land Surveyors (BORPELS) to perform illegal grassroots lobbying efforts for 2019 SB 5443 & HB 1776. In support of the illegal lobbying activities, tax payer resources including machines, software, office space, and unauthorized reimbursement using tax funds for lobbying work during regular working hours occurred.

Our bill (SB 5443) is scheduled for a hearing on Tuesday March 19, 2019 at 1:30 PM before the

House Consumer Protection and Business Committee.

One very interesting point, the executive session has already been scheduled for the following day at

1:30 ???? So the point of my email is that we would like to have the full committee (13 members)

vote positive on moving this out to the floor which may allow for us to bypass the appropriations

committee (and save us time, and reduce the chance it could be stalled out). Therefore, it would be

great if each committee member were to get letters via emails, from the public including you, asking

for their support in this important bill. Keeping it very simple and in their own words:

· SB 5443 administratively fixes the statue with the attorney general’s findings that the Board of

Registration for Professional Engineers and Land Surveyors has the authority and standing

to operate as a separate State agency.

· These law changes will allow for the Board to operate, as intended by the legislation, to align

budget authority with the regulatory responsibility.

· The Board is self-funded thru license fees

Would each of you send a brief letter (email) to the committee members asking for their support? It

would be best for a brief email giving your background and history with a strong request to support.

WOSSA with the input of this group of individuals is willing to approve of and supportthe legislation unanimously with one addition. Under the section where the Governor appointsan executive director our board feels that the Governor should be able to choose from threecategories: engineer, PE, and onsite designer.Section 15(3) The governor shall appoint an executive director of the 30 board. The executivedirector must hold a valid Washington license as 31 a professional engineer, professionalland surveyor or on-site designer.This is in keeping with WOSSA's commitment to involve professional engineers on its Boardeven though engineers represent a proportionally smaller amount of on-site designs. Dear Chairman Ormsby,

Thank you for considering supporting SB 5443 which has been assigned to the House Appropriations

Committee. I have been in the Engineering and consulting field for over 30 years (mostly in the

private sector with Boeing, Weyerhaeuser, My own firm, and Young life) and have gained a great

respect for our Engineering and Land Surveyor Board. I have a residence in Lakewood, WA. Last year I

took on my current assignment, when the Board ask me to help in raising the ethical bar in our

professions as well as gaining a proactive and strategic influence within our State’s professions we

regulate. This pursuit led us to request the changes in statues included in this bill.

SB 5443 is a refinement to the mid-1900’s legislation which formulated the regulatory board to set

the qualifications and practice statutes and rule of the engineering and land surveying professions in

Washington State. The original statute created the board as an independent agency but did not

clearly set the budget authority, therefore the workings of our budget has been managed by the DOL

within an interagency agreement which has been confusing and inefficient. In simple terms, if

successfully signed into law, this bill will give the Board the budget management over the 024

account which will allow for a significant focus on outreach, ethics, and proactive education to the

public and our professionals, as well as continue to allow the great services the DOL does within the

licensing and certain administrative functions thru an interagency contract. Our funding is fully

covered by fees collected from our professions and there should be no fiscal impact to the State

General Fund.

Thank you very much for your time and service to the citizens of the State of Washington. On a

personal note, I managed the construction, as a consulting engineer to the State of Washington, for

the Washington State History Museum which won the 1997 NW Masonry Award.

Dear Sara, Dan, and Scott,

This year BORPELS decided to pursue a legislative fix to our budget authority complexities with DOL.

The Bill is SB 5443 and has been gaining support (passed the Senate 44/4/1) and made it thru our

first house committee (13/0) to move onto the House Appropriations Committee. I have attached

the 1986 AG’s opinion which verified that the Board is a separate and standalone agency, but realize

the fees, and budget were assigned to the Director of DOL many years ago creating an inefficient

and somewhat complex separation of the responsibilities and authority.

This action will officially grant BORPLES its independence but allow for us to continue to contract

into DOL for administrative and licensing services. The Board will be able to manage the budget

(within State guidelines thru DES) and assign resources to strategic plans with education and

outreach into the professions and the public as a first priority.

I realize this email comes with a bit of a shock, but I would appreciate you all sending emails to the

Chair Timm Ormsby and a few of the legislators on the committee requesting their support.

I have spoken with Cliff Webster regarding the best path forward for this bill. Hesuggested a “grass roots” letter (email campaign) to all of the committeemembers.

All of us have already started this so it may be a bit late to change up. I amattaching a excel sheet with all of the house appropriations committee memberswith emails and LA contacts (for the D’s, the R’s do not show these) and acondensed bio along with suggested assignments. If you are willing to write 10 orso emails please do so, if you have already sent out emails then credit yourself.

Cliff suggested not using the Portal, which is shown as the access for most of the“D’s”. It is best to send an email directly to the Representative and cc their LA’s(for the D’s). I have had good luck with getting letters to them. In reality theLegislative assistants are the ones who pick up the emails and brief theRepresentatives.

Keep it very brief with a personal touch.

responsibility for the health and safety of Washington citizens. I am a registered

professional engineer with over forty years in the consulting business in

Spokane. I have been serving on the Board for nearly nine years and have a

keen understanding of the importance of this bill with regard to the ability of the

Board to carry out its legislative charge.

SB 5443 is a refinement to the mid-1900’s legislation which formulated the

engineering and land surveyors regulatory board to set the qualifications and

practice statutes and rule of these professions in Washington State. The original

statute created the board as an independent agency but did not clearly set the

budget authority. Consequently, the administration of our budget has been

managed by the DOL with an interagency agreement that has been somewhat

confusing and inefficient. In simple terms, if successfully signed into law, this bill

will give the Board the budget management over the 024 account which will allow

for more significant and timely focus on outreach, ethics, and proactive education

to the public and our professionals, as well as continue to allow the great

services the DOL offers within the licensing and certain administrative functions

through an interagency contract. The Board is fully and independently funded

Cliff suggested not using the Portal, which is shown as the access for most of the“D’s”. It is best to send an email directly to the Representative and cc their LA’s (forthe D’s). I have had good luck with getting letters to them. In reality the Legislativeassistants are the ones who pick up the emails and brief the Representatives.

I have been in the Engineeringand consulting field for over 30 years (mostly in the private sector withBoeing, Weyerhaeuser, My own firm, and Young life) and have gaineda great respect for our Engineering and Land Surveyor Board. I have aresident in Lakewood. Last year I accepted my current assignment,when the Board ask me to help in raising the ethical bar in ourprofession as well as gaining a proactive and strategic influence as ourcountry is seeing a need to step up our professional ethic in ourprofessions. This pursuit led us to request the changes in statuesincluded in this bill.

Hi Dan,

Would you have a bit of time to contact your local representatives on the House Appropriations

committee to ask for them to move SB 5443 out of committee and onto the floor. We presented this

to the appropriations committee on Saturday and up until that hearing we had no negative

comments. One PE spoke at the hearing in the nay, and right after that things stalled out.

This bill fully separates the BORPELS budget from DOL. Let me know if you are willing and need a bit

more information.

As President of the Washington Society of Professional Engineers (WSPE), I am requesting your support ofSubstitute Senate Bill 5443 concerning the Board of Registration for Professional Engineers and Land Surveyors(BORPELS).

An affiliated state society of the National Society of Professional Engineers, WSPE consists of 189 individualmembers who are registered Professional Engineers (PEs) or Engineering Interns on the path to become PEs. Whilewe represent all the main fields of engineering, we are bound by a common ethical obligation to “hold paramountthe health, safety, and welfare of the public” in our engineering practice.

As our licensing board, BORPELS serves a vital function in helping us keep the residents of our state safe fromunscrupulous, incompetent, and unethical engineering practice. It also helps in spreading awareness of our ethicaland legal responsibilities as engineers, educating the public about our profession, and preparing new generations ofgraduating engineers for entry into the profession. By clearly delineating the statutory functions of BORPELS andestablishing it as an independent agency, SSB 5443 will free it to focus on these functions in which it excels, thusenhancing its ability to serve its constituency of current and aspiring professionals, as well as the residents of ourstate.

As an engineering educator, I consider one of my greatest obligations to be the preparation of my students forlicensure as Professional Engineers. With the knowledge and tools to bend nature to our will, engineers have thecapacity to do great harm as well as great good. Licensure serves as a means of holding my profession accountablefor the consequences of its practices. For that, we need a strong, independent state board. For us, that board isBORPELS. Please vote “yes” on SSB 5443.

Thank you everyone for all of your work and support for SB 5443. As of this morning the bill is stalled out in theappropriations committee of the house and it looks like it is "dead on the vine". I have not received official wordbut according to the House rules and calendar if it not did get pulled out of committee and onto the floor today it isdead.

I have a few calls out to legislative staff to determine exactly what in the bill wasn't acceptable or was it just a caseof numbers (too many bills) that it was left in committee. I will know more in the near future.

Thank you everyone for all of your work and support for SB 5443. As of this morning the bill is stalled out in theappropriations committee of the house and it looks like it is "dead on the vine". I have not received official wordbut according to the House rules and calendar if it not did get pulled out of committee and onto the floor today it isdead.

I have a few calls out to legislative staff to determine exactly what in the bill wasn't acceptable or was it just a caseof numbers (too many bills) that it was left in committee. I will know more in the near future.

Good morning Drew,

I transmitted a call to you last week and want to follow up with you regarding HB 1176 with

amendments, which may be on the Governor’s desk for his consideration.

HB 1176, originally was a concise cleanup of language in a few of the professional licensing statutes

including RCW 18.43, which is the Engineer’s and Land Surveyor Act. During the final reading and

floor vote of HB 1176, the Senate amended the bill by adding language from a stalled out bill, in

House appropriations, SB 5443 onto it. The amended bill passed both chambers (45/1/3) and

(96/0/2).

This bill has strong support from the Board, the Licensed Professional Engineers, Land Surveyors, and

Onsite Waste Water designers as well as the professional associations representing them. The

amendments to HB 1176 aligns the budget authority, of the appropriations funded thru fees

collected from the 3 professions, to the operating and regulatory authority already conferred to the

Board of Registration for Professional Engineers and Land Surveyors (BORPELS) thru RCW 18.43. The

bill create BORPLES as a fully operating stand-alone small agency, but continues certain DOL

administrative and licensing functions thru an interagency contract model (which, other than

budget) is how it currently functions.

I will answer Bruce’s questions in Red..

· Will this entail budget and staff changes? For example, are BORPELS funds

earmarked before being disbursed to the DOL?o Budget will remain the same. (The State functions in a two year budget cycle

Biennial Year ‘BY’) Legislation appropriated to the 024 account “engineersand land surveyors”, separate from any other funds to DOL, currently (BY17/19) is just under $4 million and the proposed Senate appropriation forBORPLES (BY 19/21) as a small agency is just under $4 million. DOL hasbeen given control over the appropriation, which will revert to BORPLES ifthe bill becomes law.

o Currently BORPLES is allocated 11.7 FTE’s (Full time equivalent) thru DOL. 1Position (Executive Director) is a Direct report FTE to BORPLES theremaining 10.7 FTE’S are a mixture of the Business and Professions Division(BPD) staff and managers providing various services and functions.Currently all 11.7 FTE’s are assigned DOL overhead costs of roughly 26percent, which includes costs of enterprise computer systems, cloud, webservices, payroll and accounting..

o Under the proposed new structure, 4 direct FTE’s will be BORPLESemployees. (Executive Director, Administrative Lead, Outreach/Educationand communications Leader, Deputy Director which potentially will beanother licensee). Contracting back into DOL for 6 FTE’s as a mixture of theBusiness and Professions Division staff and managers providing variousservices and functions. The roles and responsibilities of each program task,process, and function are being developed and divided into clear lines toassure the administrative functions of BORPLES continues. The budgetappropriations will not change.

· Do the two entities share any costs that would now need to be separately and fully

funded by the BORPELS?o Cost sharing will continue as we will co-locate with DOL BPD. Currently most

costs are broken out and tracked separately (contracts, printing, officesupplies, travel, % of salaries and benefits for each portion of assignedemployee, leases, computers and equipment, Exam costs, dues, web site,telecommunications, State Attorney General Costs, payroll, etc..) which willmake this easier to split and identify the future shared costs.

o Under the proposed new structure the roles and responsibilities of eachprogram task, process, and function will be developed and divided into clearlines to the 4 direct BORPLES employees and assignments to DOL’s 6FTE’s. DOL will continue to provide Web services, email, space leases andutilities, computers, software, public record service, translations services,legislative counsel, training, etc., as they currently provide, which BORPLESwill pay for as a stand-alone item for the 4 direct employees and will beincluded in an overhead (burdened rate) for each of the 6 DOL positions.

o Direct Program costs and Overhead costs for the 4 BORPLES Employees and

Board functions will be direct to BORPLES (accounting and HR services willbe contacted thru the Small Agency Division of Department of EnterpriseServices). We are working on processes and functions to be assigned to theDOL BPD 6 FTE’s and the cost sharing portions.

· Will the authority of the BORPELS relative to other State agencies remain as is, or

could it be diminished by no longer being associated with the DOL?o The authority of the BORPLES relative to other State agencies is dependent

on our relationship with the agencies as well as what the Statutes and Rules,they are in responsible charge of, prescribe. My charge is to continue todevelop the relationships with other agency’s rule making leadership, to gainan understanding of the issues in the Statues and Rules they are inresponsible charge as it relates to our professions, PE, PLS, On-Sitedesigners. I realize the connections with the Directors at the executivecabinet level (DOL, DES, WSDOT, Ecology…) may change in functionalalignment. However, the current Director of DOL, Teresa Berntsen, and herstaff have continued to promote a strong partnership with BORPLES as thisprocess has moved forward, independent of the bill’s outcome. I do notbelieve the bill will change the working relationships with the other agencies

Answers to your LSAW questions;

The "Board of Trustees" has been changed to the "Board of Directors" to reflect the true legal

capacity recognized by the State. Most simply, it is a name change.

The "Executive Committee" has always existed, heading the Board of Directors/Trustees. In

essence, you are correct in the general concept of the Executive Committee and BOD "being

one in the same".

Hello all:Pardon my ignorance, but am I to assume the LSAW Board of Directors, LSAW Board ofTrustees and the Executive Committee are all one and the same? If not, please set mestraight.I would like to consider the merits of SB 5443, but am finding the document in the linkprovided, as well as the bill itself, insufficiently illuminating for me to render a reasonably-informed opinion. The statements in the BORPELS.pdf are too abstract. Will this entailbudget and staff changes? For example, are BORPELS funds earmarked before beingdisbursed to the DOL? Do the two entities share any costs that would now need to beseparately and fully funded by the BORPELS? Will the authority of the BORPELS relativeto other State agencies remain as is, or could it be diminished by no longer beingassociated with the DOL? Some before and after numbers and structural functional detailwould be helpful.Also, what is the time-window for our response?Thank you for your consideration.
