Dependant on the size of the area you are tryingto cover the following are a few plantingcombinations that would work for you. Acer‘Bloodgood’ (Japanese Maple) would make alovely backdrop to the corner, this particularvariety has a rich purple foliage. In front of thiswe would plant Dicentra spectabilis (BleedingHeart) which flowers in early spring with pink andwhite flowers, Evergreen ferns, these give a lovelysoftening effect. Astilbe fanal produces the mostamazing claret red plumes in early summer.Geraniums in variety (perennial type not bedding)these come in a selection of leaf and flower colour.Heuchera ‘Obsidian’ this has a rich plum colouredleaf which would pick up the colour of the Acerand bring the corner together. Anemone‘Serenade’ produces double pink flowers in latesummer going through into the autumn.This selection of plants would give you colour formost of the year.

Introducing colour to your garden is not problemto us, actually it is our specialty. The following

would be a few of our favourites; Alstroemeria,the Princess Lilies, these varieties only grow toabout a foot in height and produce flowers allsummer long in a selection of colours. Anthemis‘Tinpenny Sparkle’ is a daisy which has largewhite flowers all summer long. Fuchsia, the hardytype, flower from July right through the autumn.Nepeta faasenii produces a soft blue flower withsilver foliage. Rudbeckia ‘Goldstrum’ has a strongyellow daisy flower which holds up very well toheavy rain.

Don’t forget you can fill your pots with some ofthese plants to bring colour nearer your house.

Herbs are a wonderful addition to your gardenand most are exceedingly easy to grow.Rosemary is a great herb for cooking and alsolooks great in the garden producing stem full ofsky blue flowers in spring. Lavender is anotherold reliable, it will flower for you all summer long.Parsley is one that sometimes gives people trouble,we find that if you plant it in a terracotta containerand place in a sheltered bright position it will dowell, you can then bring it in for the winter tolengthen the growing season. Other easy to growherbs outside include thyme, available in aselection of varieties, sage, oregano, chives and ofcourse bay leaf.

Basil and coriander are really Mediterraneanherbs and need to be grown inside, out of ourconstant rain and in a bright position.

Access is defined as time that the nonresident parent has with their children ona weekly and annual basis, and anaccess plan is a form of contract puttogether that states when each parentwill have time with their respectivechildren. The plan must be in the best interest ofthe child or children concerned. The benefits ofthe plan is to form a routine timetable thatchildren can get used to, and it helps bothparents plan ahead, and to structure othercommitments in life, such as work etc. The accessplan can also be used as a proposal to the otherparent or to the Court when one has applied foraccess. The access plan must also work aroundyour general rights and responsibilities as aparent. It gives both parents a chance to be partof all aspects of the child’s life.

Factors to be considered when developing anaccess plan are the age of the child, any physicalor mental disabilities of the child, the child’s owncommitments, and how far away the noncustodial parent lives to name but a few.

It is helpful to break your access plan into 2sections weekly and annual. Weekly is the timespent with children each week for example afterschool, over night, and weekends etc, Whereasannual covers special occasions such asChristmas, Halloween, Easter, and St. Patricksday. Annual access also covers family occasionssuch as birthdays christening, communions,conformations, family get together, or schoolplay, parent teacher meeting, sports day etc. It isimportant to note that annual access shouldalways over rule weekly access to preventconfusion. So for example if it is one parentsusual night as part of the weekly access plan andthat night happens to be Easter Sunday and it isthe other parents turn to have the child that Easterthen the child should go with that parent and soon.

One thing I want to mention and I think it’s a veryimportant factor. Please remember extendedfamily and long term partners of each parent

especially when your children have a goodrelationship with them regardless of how you feelabout them. Please try, when putting your plantogether, to include time for grandparents, aunts& uncles, cousins, and friends. If this is notpossible I would like to point out that it is possiblefor grandparents especially to apply to theDistrict Court for separate access to theirgrandchildren, and if the Judge feels it is in thebest interest of the child, he will grant itaccordingly.

So now you’re ready to put your access plantogether. I’m not saying this will suit everyone,but use it more as a guide and try get as much ofeverything I mentioned above into it. It doesn’tmean you have to get it all in but use it as a guideto suit your family’s circumstances. Your child willthank you for it. It should be noted also that thisis just a guide and should not be seen as legaladvice.

Based on the above factors to consider regardingyour access plan you weekly access could includeafter school access during the week and maybe

overnight too, and weekend access. Maybe onecould have 1 night every weekend or 2 nightsevery second weekend. Again this is best ifparents live far apart to reduce travelling for thechild. Some parents work full time, and can’t doany midweek access, but for those who can itsbest for children to see both parents during theweek and weekends as it stop’s the child fromseeing one fun parent at weekends always andthe other a disciplinarian during the week. Itallows children to see both parents in both roles.

Ok we have our access plan or proposal, andnow we either need to make the agreement withthe other parent, a mediator or go to Court. Ifyou cannot come to an agreement you shouldapply to your local District Court for access. Thisis where the access proposal comes in. Beforeapplying to Court you should write a letter to theother parent outlining that you wish to put yourdifferences aside for the sake of the children andyou wish to put a plan in place in relation toaccess. You can inform them that you haveattached an access proposal for them to reviewand that you are open to negotiation if they wishto amend it in any way. You should send thisletter by registered post so you can prove to theCourt that you made attempts to be reasonableand to come to an agreement. If they do not wishto respond within a certain amount of time,usually 14 days, that you will have no choice butto apply to the District Court. Or if you haveapplied already when sending it you can informthem that you have applied. In conclusion think hard regarding the bestinterests of your child when putting your accessplan together taking into account all that wasmentioned in this article. Try to make a proposalbefore going straight to Court with the otherparent by writing a letter and sending it byregistered post. Local Fine Gael TD and Minister of State BrianHayes has warmly welcomed the announcementby Education Minister, Ruairi Quinn that a newfurther education and training authority calledSOLAS (Seirbhísí Oideachais Leanúnaigh agusScileanna) is to be established.

Minister Hayes said, “The new SOLAS mandatewill be to ensure the provision of 21st centuryhigh-quality further education and trainingprogrammes to jobseekers and other learners.These programmes will be integrated, flexible,value-for-money and responsive to the needs oflearners and the requirements of a changed andchanging economy. SOLAS will implement thesignificant transformation programme needed todeliver this. The Government is giving the furthereducation and training sector a clear direction forthe future. I am delighted with this announcement,SOLAS will ensure that further education andtraining programmes provide jobseekers andother learners with the new skills needed for thenew jobs in Ireland today. In Dublin South Westwe have over 10,000 people unemployed with a

significant proportion of these under the age of26.”

The new authority will operate under the aegis ofthe Department of Education and Skills. SOLASwill co-ordinate and fund the wide range oftraining and further education programmesaround the country. It will fulfil a role for thefurther education and training sector similar tothat exercised by the Higher Education Authorityfor higher education institutions. It will draw onits own expertise and that of the Expert Group onFuture Skills Needs to help identify skills gaps,point to weaknesses and duplication in existingprovision and link courses more closely to boththe needs of the individual and the labour market.

Minister Hayes said “SOLAS will also ensure thatthere is a shift away from skills provision fortraditional occupations like construction whichhave seen a huge fall in employment, and it willhave a greater focus on training and educationprogrammes which prepare jobseekers and otherlearners for occupations in growth areas like the

services, ICT, medical devices, food andbiopharma sectors,” said Minister Hayes.

In advance of the passing of the relevantlegislation by the Oireachtas, FÁS will berenamed SOLAS on an administrative basis assoon as possible. As a first step, SOLAS will takeresponsibility for all those FÁS staff and premisesnot being transferred to the Department of SocialProtection as part of the restructuring alreadyunderway.

Over time, FÁS Training Centre premises andmost FÁS regional staff will be transferred to theVECs, so that VECs will ultimately be responsiblefor the delivery to the public in an integrated wayof both further education and training services.This will strengthen the role of the reformed VECsin their local communities.

Participants on current FÁS and further educationcourses will not be affected by the establishmentof SOLAS and will continue their courses underthe new authority.

FÁS maybe dead but let thelight of SOLAS shine on!

Mayor CaitrionaJones officiallyhosts a celebrationof accessibility inthe Camac ValleyCaravan andCamping Park onFriday 22nd July2011 Over the past year South Dublin CountyCouncil has undertaken a significantprogramme of access works to facilitate thediverse needs of disabled visitors to the CamacValley Caravan and Camping Park. Theoverall aim of the project was to create afacility that disabled tourists could visit and

enjoy in complete independence and we areconfident that this has been achieved.The award winning Camac Valley Caravanand Camping Park is Ireland's first municipaltourist caravan and camping park, servicingboth foreign and domestic tourists. The facilityopened in 1996 and occupies 15 acres in thesouth western area of Corkagh Park, on theGreen Isle Link Road off the Naas Road DualCarriageway (N7). Visitors come to the Parkfrom 40 countries around the world, with over85,000 visitors staying since the beginning of2006.

The Park is a wonderful amenity, in a quietsetting on the edge of Clondalkin, and aperfect location for visitors to Dublin city andthe wider country.

General facilities on site include:• 113 caravan parking bays andapproximately 50 pitches for tents;• A touring bus area (a particular feature ofschool tours from continental Europe);• Caravan bays and tent locations areserviced with mains water and electricity, andchemical toilet disposal points are readilyavailable;• Toilets and showers both in the Main

building and in thepurpose built showerblock;• Campers kitchenetteand laundry room;• Playground, PuttingGreen and VolleyballCourt.

The significant workswhich have beencarried out werefunded by the NationalDisability Strategy andFáilte Ireland.

Access improvements, underpinned by theprinciples of universal design include:• enhanced ramped access to the mainbuilding and shower block;• accessible campers kitchenette;• induction hearing loop in reception;• accessible reception desk;

• Braille and tactile way finding signage;• accessible chemical toilet disposal point; and• 7 accessible toilets and 6 accessible levelentry showers.

During 2010 access works were also carriedout in the adjoining Corkagh Park. Access tothe playground, Visitors Centre, Fishery andPet Farm was greatly increased and disabledpeople caravanning or camping at the CamacValley Park can explore and enjoy thewonderful natural resource and its’ variousactivities.

The facility has been shortlisted for an awardin the Chambers Ireland Excellence in LocalGovernment Awards 2011 (in theOutstanding Customer Service category) dueto the programme of access works.

Camac Valley is an excellent example oftourism for all, and universal access, in closeproximity to a variety of leisure, retail, andtourist amenities, which provides easy accessto the island of Ireland thus making tourists’visits to our County a more quality experience.Initial feedback from disabled visitors to thePark has been very positive.

Guided tours of the Camac Valley Caravanand Camping Park will be available during theCelebration of Accessibility, and examples ofadapted campervans will be present.

Travellingwith your petWe’re all excited in the education office thisweek; well it’s a bank holiday weekend andsome lucky colleagues are heading off tosunnier climes. With that in mind, I want toremind pet parents to make every effort toensure their pets have a safe and happyexperience when travelling to and from thatholiday destination; whether it’s by road, sea,rail or air. Remember, travelling can be stressful for bothyou and your pet; I know, I’m one of thosepeople who bring their dogs everywhere, infact, poor holiday planning has been be listedas grounds for divorce in our house!However, with thoughtful preparation, youcan ensure a safe, happy and comfortableexperience for everyone.

Here’s a few top tips from a weary traveller.• When arranging your travel plansand destinations, make sure you remember tofactor your pets into the equation. • Take your pets to the vet to ensurethey’re up to date on all vaccinations and thatyou have a supply of any medication they’recurrently taking. • If you own dogs that will be incontact with other dogs, make sure they’revaccinated against kennel cough. • Additionally, make sure your doghas basic training so that he’ll at least behaveduring the trip.• Obtain a clean certificate of healthfrom your vet and make sure this is dated atleast 14 days before your departure if

travelling by air or sea.• Ask your vet about any parasites,health risks, etc., to your animal that may beassociated with your planned destination. • Make sure your pet wears a collar,an ID tag and is micro chipped. Make surehis details are up to date and clearlydisplayed.For Air/Ferry Travel:The first time I took my dogs on a ferry andsomebody described them as “cargo,” I threwa wobbly. However this is how they’reconsidered and even if your dog is the mostrelaxed canine in the world, the cargo holddoes not make for a pleasant travelexperience. If required, purchase an approved shippingcrate – it should be large enough for your petto comfortably stand, sit, lie down and turnaround in. Write the words ‘LIVE ANIMAL’clearly on at least two sides of the crate anduse arrows to prominently indicate the uprightposition of the crate. Make sure the door issecurely closed but not locked so thatairline/ferry personnel can open it in case of

emergency.Whenever possible, book direct flights and tellevery airline/ferry employee you encounterthat you’re travelling with a pet in the cargohold. This way they’ll be ready if anyadditional attention is required. Always check ahead with your airline’s/ferry’spet policies. For Car Travel:Plan the journey taking into account any reststops and/or restaurants where you cansafely eat with your pet. In order to make the journey safe and secure,a well ventilated pet carrier/crate, largeenough for your pet to stand, sit, lie down andturn around in should be provided. Alterna-tively a pet harness/safety belt should beattached. However, if your dog is anythinglike my lot, they’ll probably gnaw through thestraps, rendering them useless. So, it’s up toyou; you know your own pet so you’ll knowthe best way to secure them. Don’t allow your pet to travel with his headoutside the window. This can subject him toinner ear damage and lung infections and

The Awards are a nationwide, island of Irelandinitiative. The public is invited to nominatesomebody who is Deaf or hard of hearing forthe Awards. Those who are Deaf or hard ofhearing can also nominate themselves for anAward.All nominations are treated in confidence andare only viewed by the judging panel. Theclosing date for nominations is 15th August andthe winners will be announced at an AwardsCeremony in Dublin in late August.

Submissions will be reviewed by anindependent panel. The awards are free toenter and any member of the public or organi-sation may nominate.

SummerDriving TipsWith the summer upon us, and driving being amajor part of many workjourneys, now is a goodtime to focus people’sattention on safe summertravel.

By applying the followingsimple guidelines beforetravelling and en-route,you will ensure your safetywhile driving for work.

Before travelling, make sureyour vehicle is roadworthy: even the slightest doubtabout how it's running needs checking. Make surethat vehicle maintenance is up to date, and if indoubt arrange to have it looked at by a qualifiedmechanic.

Then, check the following at least daily (especially ifthe vehicle is hired or loaned):

Tyre tread and pressures.Oil, water and fluid levels.Head -, brake - and indicator - lights.Safety equipment including warning-triangle, torch,hi-vis jacket, first-aid kit, sunglasses and maps.

Plan the route beforehand, and travel during off-peak periods if possible leaving ‘more than enough’time to negotiate the holiday congestion. Check theweather forecast and travel news before and duringjourneys.

Timely route and traffic information is available froma range of organisations.

On the road, make sure everyone is buckled up,including rear seat passengers, and drivedefensively by:

Being prepared for unsafeactions by others or forpoor driving conditions.Obeying the road signsand signals.Never ever use alcoholand drive.Be extra careful in theearly morning or atdusk and during thenight, when animalsand agricultural

BHAA DCC 5km road race – Ringsend,Wednesday, July 13th

Ladies RaceBernie Stapleton as ever, produced a most

impressive display of long distance running whenshe completed the DCC 5km course in an amazingtime of 22 minutes 12 seconds. This placed Berniea fantastic 5th in her category as she continues toprove herself one of the top ladies in the BHAAseries of races. Eileen O’Brien made a return toaction with a bang as Eileen produced asensational run crossing the line in a brilliant timeof 24 minutes 32 seconds. Eileen, making a returnto action after her outstanding run in the Cork CityMarathon in early June secured yet anothervictory in her category.

Men’s RaceDerry McVeigh continued his remarkable run of

results as he raced home in a superb 17 minutes35 seconds. This placed Derry 10th – his highestfinish in a BHAA race . Starting and finishing onthe Irishtown track with 3 laps of Ringsend Parkalso thrown into the mix, Derry produced adisplay of fantastic 5k running to add to his

catalogue of excellentperformances over thedistance this year.Following Derry homewe had the bang in formBrendan Maher.Brendan continuing hisscintillating form in 2011produced a fantastic runon this bendy course inclocking a fantastic timeof 19 minutes 25seconds. This placedBrendan an excellent 6thin his category. Nexthome for Lucan wasGerry Byrne Snr. Gerry,following up hisimpressive displays onthe track in recent weeks,used the speed he hasgarnered preparing forthese races as heproduced a very quickfinish to the race to crossthe line in an incredibletime of 20 minutes 54seconds. Gerry Martin,closely followed Gerryhome as Gerry crossedthe line in a lightningquick time of 21 minutes12 seconds. Gerry iscontinuing to raceextremely impressivelythroughout the summerseason and no doubtthere is plenty more tocome from Gerry.

Irish Runner 5 mile roadrace – Phoenix Park,Saturday, July 16th

Eileen continued her remarkable run of victoriesin her category. Eileen ran an magnificent time of39 minutes 32 seconds. This performance cementsEileen's reputation as one of the top masterrunners in the country. Deirdre Daly produced hersecond fantastic run since joining Lucan as sheraced home in a superb time of 36 minutes 01second. Run on a testing course Deirdredemonstrated that her marathon preparations areright on track with this brilliant run. Fiona Doylehaving impressed over 10kms in the Women'sMini marathon in early June continued her finevein of form as Fiona completed the 5 miledistance in an excellent time of 43 minutes45seconds. This is excellent running by Fiona andeven more so that Fiona is so new to the club.Closely following Fiona was the excellent Maria

Byrne. Maria who has been in sensational formsince returning to the club last year continued heryear of fantastic displays as Maria had anoutstanding run completing the 5 mile course in abrilliant 44 minutes 44 seconds. Followng Mariaand continuing her super form from the MiniMarathon in early June we had an other newmember Una Cassoni. Una raced home in asensational time of 47 minutes 44 seconds.This isyet more fantastic running by an athlete so new toclub running. In hot pursuit of Una we hadJosephine Dignam. Josephine tackled the PhoenixPark course in an exceptional time of 47 minutes55 seconds. Josephine has kept herself busy thisyear and has shown exceptional form throughoutthe year.Another athlete keeping herself busythroughout the year is Eibhlin Ni Chonchuir. Thisactivity is certainly reaping dividends as Eibhlinran a brilliant time of 53 minutes 58 seconds overthe 5 mile distance.

Men's RaceFor the men Partick Holden led the Lucan

charge.Patrick, having looked particularly strongin the recent hill sessions carried this form into therace and produced a very strong run on a difficultcourse to race home in a fantastic time of 33minutes 35 seconds. No doubt this is just the startof things to come from Patrick over the comingmonths.Terry Meyler continued his excellent formfrom the Wexford Half Marathon when he tackledthe first race in the build up to this year's DublinMarathon. Terry produced an outstanding run onthe Phoenix Park 5 mile course as Terry crossedthe line in a noteworthy time of 35 minutes 59seconds. Colum Maddox followed Terry home asColum ran a very quick time of 38 minutes 54seconds. This was yet more very strong distancerunning from Colum as he continues his fine formfrom the Kildare Half Marathon recently. .

Dear Michelle,My Granddad who had been living on his ownfor the last fifteen years recently went into anursing home as he has dementia and severeshort term memory loss which makes itdangerous for him to be alone now (he keptleaving the cooker on etc). He has not spokento my father (who incidentally I don’t speak toeither) for the last five years since he lent hima large sum of money that he never repaid.Last week while I was collecting clothes for myGranddad at his house I found a copy of a willhe made ten years ago which leaves €5,000worth of prize bonds to my father and then thehouse and everything else he owns to mysister and I. I just know that if anythinghappens to my Granddad that my father willbe sniffing around. Will he be able to contestthe will? And can we stop him getting theprize bonds? I would hate to think he couldget his hands on the house or anything elsefor that matter after basically robbing him ofhis life savings. I am certain that my Granddadwouldn’t want him to either.

Dear Sir,I am sorry to hear of your Grandfather’s condition

and what must be a very sad andunsettling time for him and yourfamily.In terms of whether your father cancontest the will, I’m afraid that hewould in such circumstances beentitled to make an application toCourt for proper provision fromyour Grandfather’s estate underS117 of the Succession Act 1965.

However this is not to say that he would automat-ically succeed.There are basically two parts to the test applied bythe Courts in such applications that would have beproved your father. Firstly, that your Grandfather,who would be referred to as the Testator, displayeda positive moral failure to make proper provisionfor your father in accordance with his means. Inhis regard, it would appear that, even taking awild guess at the value of the house, andconsidering that you mentioned your Grandfatherhas other property, a mere €5000 worth of bondsmay not be seen by the Court as fair provision.However, under the second leg of the test, yourfather would have to prove that he has a particularneed that your Grandfather could have satisfiedthrough his will or otherwise during his lifetime butfailed to do so.The Court would, if an application was broughtexamine these factors against various otherfactors, including but not limited to the positionsof other siblings and even their spouses, if any andwhether provision was made during yourGrandfather’s lifetime. Also relevant is the fact thatif your Grandfather’s wife is still living, a S117application cannot interfere with her legal right

share of the estate. On a side note, neither canany gifts to you or your sister.You never mentioned in your letter whether yourGrandmother was still alive (or if so, still marriedto your Grandfather. The terms of separation andDivorce normally include a waiver on SuccessionRights) neither did you mention whether yourfather had any brothers or sisters. Without thesedetails at the very least, it is impossible for me togive a definitive opinion upon whether your fatherwould be likely to succeed in any application thathe may decide to make.With regard to whether you can prevent yourfather receiving the €5000 worth of prize bonds,my first instinct on the matter would be, ‘no’ I’mafraid. Regardless of your certainty that yourGrandfather would not want your father to benefitfrom his estate, the reality under the law is that awill speaks from death and if the last valid willyour Grandfather made, in his right mind, makessuch a gift, then that’s how the matter willstand. The only way around the matterwould be to prove defects in either theconstruction of the will or in yourGrandfather’s mental capacity tomake the will. I.e. whether or nothe was of sound mind at the timeit was made. I would have to seethe actual will and the notesmade by the Solicitor whodrafted and witnessed the will tocomment on the first matterand the second is notoriouslydifficult to prove as the lawin this area presumes that aperson making the will has

the mental wherewithal to do so. Also even if you did manage to contest the validityof your Granfather’s will, it would not be the gift toyour father alone that would fail, but the entirewill, which would open up an entirely different canof worms that could result in you receiving nothingat all as the estate would then be distributed underIntestacy Rules which would favour your fathergiven his closer blood relationship to yourGrandfather.All I can advise at this point, based on theinformation provided, is that in the event that yourGrandfather passes away, you take the originalcopy of your Grandfather’s last will to a Solicitorand recount full details relating to all other familymembers and circumstances.

Dear Michelle,I was on my way home from the pub onSunday night and was hit by someone on amotorbike while crossing the road atpedestrian lights near the Square. I wasknocked to the ground and fractured my wristand also badly grazed and bruised my hip.The motorbike stopped for a few seconds andthen sped off. I was in too much pain andshock to even think about getting the reg. Myboyfriend called the police and ambulanceand I was taken to Tallaght Hospital. Thepolice say that they have not caught the driveryet but that they will keep us informed if anyinformation is handed in about him. Wheredoes this leave me if I want to take a claim formy injuries?

GOVERNMENTDECISION ONELECTRICITYTRANSMISSIONASSETS IN THECONTEXT OF EU3RD PACKAGEON ENERGYMinister for Communications, Energy andNatural Resources, Mr Pat Rabbitte TD, todayannounced that in the context of the EU ThirdEnergy Package the Government hasdecided that the ownership of the electricitytransmission assets is to remain with ESB whilethe operation and development of thetransmission system will continue to be theresponsibility of EirGrid.

The Government decision follows a process ofconsideration over the past eighteen months,

including a report carried out by FrontierEconomics Limited, under the independentchairmanship of Mr Fergus Cahill. Thedecision also takes account of the currentfinancial and economic climate.

There will now follow, in light of theGovernment Decision, a process of certifi-cation under Article 9 (9) of the EU Directiveto demonstrate the compliance with theDirective of the existing arrangements forelectricity transmission in Ireland. The certifi-cation process, which will take a number ofmonths, is a matter for the Commission forEnergy Regulation and the EuropeanCommission.

In the meantime, the Minister has spoken withthe Chairs of ESB and EirGrid and has askedthem to ensure optimal cooperation in the cost-effective development and maintenance of thenational transmission infrastructure in theinterests of electricity consumers.
