New Property Tax RulesShaun McGivern, from Haigh Lyon, provided us with a explanation on the new tax rules. The Property Tax Rules changedon 1 October 2015, with a couple of important changes that you should be aware of. The new bright-line test will requireVendors to pay tax on capital gains on residential property bought andold within two years. There will however be three exceptions to the rule:
1. If the property being transferred qualifies as your “Main Home”;2. If the property is transferred under a property relationship agreement; or3. If the property is transferred by an executor or administrator for a

Home” exemption if you show a regular pattern of buying and sellingesidential property. You can only live in one “Main Home”, and that is thehome that you have the greatest connection to.
When buying, selling or transferring property in New Zealand, you will need toprovide your New Zealand IRD number, and your tax pay identificationumber from any countries where you have to pay tax on your worldwide
ncome. You will also need to c omplete the Land Transfer Tax StatementTax Statement) and provide this to your solicitor as they will need to enterelevant details into the e-dealing with Land Information New Zealand, thatas been prepared to effect the transfer.
or all properties being purchased under a Trust, you are now required topply for an IRD number. This process could take up to two weeks.
To avoid delays in settlement, we strongly recommend applying for an IRDnumber before you even start the buying or selling process, as your transfer
annot be registered without an IRD number for the Trust. The forms formaking an application for an IRD number are avaliable online and in the
ase of Trusts, the applicant will need to provide a copy of the Trust Deedlong with the tax details of each Trustee. The Inland Revenue will then issuehe Trust with its own IRD number which is entirely separate to that of the
Trustees. You will also need a fully functional New Zealand bank account asyou will need to include this on your IRD number application.
Vendors should not overlook that existing tax rules still apply to dealings inand where the property was purchased and sold within 10 years. Typically,hese rules affec t people that have been in business of dealing with land,uilders and developers or where the land has been subdivided.
