 TO:    Honorable Mayor and City Council  VIA:    Magda Gonzalez, City Manager  FROM:   Yulia Carter, Finance Director    TITLE:  WARRANTS FOR THE MONTH OF AUGUST 2017 ______________________________________________________________________________  RECOMMENDATION: Accept the attached warrants list for the month of August 2017. During this month, we processed five check runs. The first was on August 1, 2017, totaling $47,374.25, the second was on August 9, 2017, totaling $1,865,841.44, the third was on August 14, 2017, totaling $911,392.50, the fourth was on August 21, 2017, totaling $27,848.65, and the fifth was on August 25, 2017, totaling $1,014,650.03. The grand total for all warrants for the month was $3,867,106.87.  STRATEGIC ELEMENT: This recommendation supports the Fiscal Sustainability and Inclusive Governance Element.  DISCUSSION: During this reporting period, the City processed payments related to 15 capital improvement projects, in a total amount of $ 1,035,314.11. These projects include the Library Replacement, Infrastructure Standard, Routine Crosswalk, Seymour Trail Bridge Relocation, Bike and Pedestrian, Parks Master Plan, Street Tree Assessment, Ted Adcock Roof Replacement, Ted Adcock Rehabilitation, New Accounting System, HWY 92 Safety & Operational Implementation, Pilarcitos Trail Bridge, Coastal Trail Erosion, Correas Street Underground, and the City Website Upgrade. Staff is also including a list of all payments above $30,000 processed during this reporting period, as listed in the table below.

THE COUNTY OF SAN MATEO  ______________________________________________________________________________  RECOMMENDATION: Authorize the City Manager to execute Amendment No. 9 to the Law Enforcement Services Agreement with the County of San Mateo.  FISCAL IMPACT:   With the approval of Amendment No. 9, the City will pay the County of San Mateo a total of $3,034,309 for Law Enforcement Services for Fiscal Year 2017‐2018, which includes a three percent cost‐of‐living adjustment (COLA), and credit for Unfunded Actuarial Accrued Liabilities (UAAL) payments made to CalPERS, and both have been included in the FY 17‐18 adopted budget.  STRATEGIC ELEMENT: This action supports the Healthy Communities and Public Safety Element of the Strategic Plan.  BACKGROUND: On June 7, 2011, the City of Half Moon Bay entered into an agreement with the County of San Mateo Sheriff’s Office to provide law enforcement services.  Since that time, the County and the City have agreed to eight amendments to the original agreement, primarily to adjust the term, service levels, and annual rates.  Amendment No. 8 was approved on June 21, 2016, extending the term through June 30, 2019, with additional options to extend through June 30, 2025.  Amendment No. 8 also replaced Exhibit A (Assignment/Selection of Personnel) to increase service levels, Exhibit B (Rates/Payments) to increase the annual charges for FY 16‐17 to $2,948,153, and Exhibit B‐1 (Calculated Rates) to reflect the increased service levels and cost of living adjustments.

DISCUSSION: During the term of the agreement, negotiated salary increases require an amendment to reflect the actual charges for services.  The FY 17‐18 charges are $3,034,309, which represent a 3 percent negotiated salary increase from the FY 16‐17 total charges.  Amendment No. 9 replaces Exhibit B (Rates/Payments) and Exhibit B‐1 (Calculated Rates) to reflect the increased charges for FY 17‐18.  There are no other changes to the agreement.   Under the agreement, the City continues to realize a cost savings, increased efficiencies, and access to a wider variety of resources and services over in‐house operations.  The community also benefits from recently expanded Sheriff resources including resource officers dedicated to community policing efforts and access to teams like the gang suppression unit.    The City is pleased with the services and the resources provided by the Sheriff’s Office and feels the relationship between the two agencies has developed into a strong partnership.   Staff recommends that the City Council approve a resolution to authorize the City Manager to execute Amendment No. 9 to the Law Enforcement Services Agreement with the County of San Mateo.  ATTACHMENTS: Resolution authorizing the City Manager to execute Amendment No. 9 to the Law Enforcement Services Contract with the County of San Mateo

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HALF MOON BAY AUTHORIZING THE CITY MANAGER TO EXECUTE AMEDNMENT NO. NINE TO THE LAW ENFORCEMENT SERVICES 

AGREEMENT WITH THE COUNTY OF SAN MATEO   

WHEREAS, in 2011, the City of Half Moon Bay entered into an agreement with the County of San Mateo to provide Law Enforcement Services for the City;   

WHEREAS, the agreement has been amended eight times to extend the term, increase service levels, and increase the charges. In 2016, Amendment No. 8 extended the term through June 30, 2019, increased service levels, and increased the total charges for FY 16‐17; and  

WHEREAS, the City and County desire to further amend the agreement to increase the total charges for FY 17‐18 to reflect negotiated three percent cost of living increases.  

NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of Half Moon Bay hereby authorize the City Manager to execute Amendment No. 9 to the Law Enforcement Services Agreement between the County of San Mateo and the City of Half Moon Bay.

______________________________________________________________________________  RECOMMENDATION: Adopt  a  resolution  rescinding  Resolution  No.  2017‐62  and  authorizing  the  City  Manager  to execute an agreement with Huffman‐Broadway Group (www.h‐bgroup.com) for the preparation of maps of environmentally sensitive habitat areas (ESHAs) for the comprehensive update of the City’s Local Coastal Program update in an amount of $82,450.   FISCAL IMPACT: There are sufficient funds appropriated in the Capital  Improvement Program (CIP) to fund the Huffman‐Broadway Group work ($82,450).    

STRATEGIC ELEMENT: The Local Coastal Program Land Use Plan update supports all Elements of the Strategic Plan: Infrastructure and Environment, Healthy Communities and Public Safety, Fiscal Sustainability, and Inclusive Governance.  BACKGROUND: At its meeting on August 15, 2017, the City Council adopted a resolution authorizing the City Manager to execute an agreement with Huffman‐Broadway Group for the preparation of maps of environmentally sensitive habitat areas (ESHAs) for the comprehensive update of the City’s Local Coastal Program. The August 15, 2017 staff report indicated an approximation of $80,000. While the consultant’s scope of work and budget (presented as Attachment 2 to the August 15, 2017 staff report) specified $82,450, the resolution did not reference the cost for this work.

DISCUSSION: The purpose of this staff report is to rectify the clerical oversight in the previous resolution with respect to the budget amount for this agreement which was inadvertently omitted. The exact amount of the proposed budget, as presented in the consultant’s scope of work is $82,450.   No other component of the City Council’s prior action is proposed to be revised. Huffman‐Broadway Group is under contract and has begun work on the mapping project. For the sake of the City’s accurate and complete accounting practices, the Finance Director has requested that this discrepancy be corrected through adoption of a new resolution (Attachment 1) so that the City has accurate records of its actions.  ATTACHMENT: Resolution rescinding Resolution No. 2017‐62 and authorizing the City Manager to execute a professional services agreement with Huffman‐Broadway Group

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HALF MOON BAY RESCINDING RESOLUTION NO. 2017‐62 AND AUTHORIZING THE CITY MANAGER TO EXECUTE AN 

AGREEMENT WITH HUFFMAN‐BROADWAY GROUP FOR BIOLOGICAL RESOURCES MAPPING FOR THE LOCAL COASTAL LAND USE PLAN UPDATE  

 WHEREAS, the City has been engaged in a comprehensive update to its Local Coastal 

Program Land Use Plan;   WHEREAS, the Local Coastal Program Land Use Plan must include updated and detailed 

mapping of coastal resources including environmentally sensitive habitat areas;   

WHEREAS, the City has determined that Huffman‐Broadway Group is uniquely qualified to prepare the necessary maps;   

WHEREAS, the proposed scope of work submitted by Huffman‐Broadway Group, is responsive to the needs of the task and will further the City’s ability to maintain and update these maps in the future;  

 WHEREAS, funds are available in the Capital Improvement Program project budget for 

the full cost of this work at $82,450.    

NOW, THEREFORE, BE IT RESOLVED THAT Resolution No. 2017‐62 is hereby rescinded.

PROGRAMS ______________________________________________________________________________  RECOMMENDATION: Adopt a resolution accepting the findings and recommendations from the San Mateo County Grand Jury Report, entitled “English Is Not Our Only Language: Are Local Law Enforcement Agencies Providing Multilingual Access To Outreach Programs?”  FISCAL IMPACT:   There is no fiscal impact associated with this action.  STRATEGIC ELEMENT: This action supports the Public Safety and Inclusive Governance Elements of the Strategic Plan.  BACKGROUND: On June 29, 2017, the San Mateo County Civil Grand Jury issued a reported entitled “English Is Not Our Only Language: Are Local Law Enforcement Agencies Providing Multilingual Access To Outreach Programs?”  The report identifies the large number of County residents that speak a primary language other than English, many of whom do not speak English well. The report seeks to identify the community outreach performed by local law enforcement agencies and their ability to communicate with these residents.  It also makes recommendations on how agencies may improve outreach efforts to these residents. The city is required to respond to the findings and applicable recommendations by September 27, 2017.  DISCUSSION: The City of Half Moon Bay contracts with the San Mateo County Sheriff's Office for Police Services, including community outreach related to law enforcement within the city.  The Sheriff’s Office has reviewed the findings from the report and agrees with each.

While the report contained two recommendations, only Recommendation 1 applies to the City of Half Moon Bay. Recommendation 1 recommends that all law enforcement agencies in San Mateo County modify their websites by including multilingual translation capability to potentially increase access and participation in outreach programs by non‐English speaking residents by December 31, 2017.  The Sheriff’s Office is currently in the process of updating its website and will include multi‐language support. They anticipate having the new site up before the end of 2017. In addition, the City recently launched a new website for City services, which includes multilingual translation capability.   ATTACHMENTS:

 TO:    Honorable Mayor and City Council  VIA:    Magda Gonzalez, City Manager  FROM:   Hanson Hom, Interim Community Development Director     Jennifer Chong, Management Analyst    TITLE:  URBAN COUNTY COOPERATION AGREEMENT ______________________________________________________________________________  RECOMMENDATION: Adopt a resolution authorizing the City Manager to execute the cooperation agreement with San Mateo County for participation in the County’s Housing and Community Development Program.  FISCAL IMPACT:   There is no fiscal impact associated with this action. Participation in Urban County makes Half Moon Bay eligible for future funding through the U.S. Department of Housing and Urban Development (HUD).  STRATEGIC ELEMENT: This action supports the Infrastructure and Environment and the Healthy Communities and Public Safety Elements of the Strategic Plan.  BACKGROUND: The County of San Mateo receives funding allocations from U.S. Department of Housing and Urban Development under three programs: Community Development Block Grant (CDBG), HOME Investment Partnership Program (HOME), and the Emergency Solutions Grant (ESG) Program. To maximize funding allocations for these programs, the County has been designated an Urban County by HUD. To maintain Urban County status, the County must requalify with HUD every three years and enter into a cooperation agreement with all non‐entitlement cities to solicit their cooperation and co‐participation in the Urban County housing and community development programs.   The City of Half Moon Bay is defined as a non‐entitlement jurisdiction by HUD and thus does not qualify for an individual or direct funding allocation from HUD. By participating in Urban County, the City can access CDBG, HOME, and ESG funds through the Program. Entering into

this agreement also enhances the ability of human service organizations to offer services to Half Moon Bay residents.  DISCUSSION: The City of Half Moon Bay has historically participated in Urban County which has greatly benefitted local organizations and projects. In FY 17‐18, the Coastside Adult Day Health Center (Aging in Place) and the Senior Coastsiders (Minor Home Repair) were recipients of $23,500 each. These two organizations have greatly benefited from the City’s participation in Urban County and have received a combined total of $409,825 from HUD since 2012. In addition to these two organizations, affordable housing projects (Half Moon Village, Main Street I and II, and Leslie Senior Apartments) have received funding from HUD through the City’s inclusion in Urban County.   In August 2017, HUD updated its requirements for Urban Counties. San Mateo County must enter into a new Urban County Cooperation Agreement with all non‐entitlement cities in its jurisdiction to incorporate the updated HUD requirements. This action is necessary to maintain its Urban County status and to continue to receive HUD funds.   The new agreement is primarily prompted by two HUD specific changes to the existing Urban County Cooperation Agreement as set forth in HUD Notice CPD‐17‐03: 1) the inclusion of the   Emergency Solutions Grant (“ESG”) program for emergency housing and related services as a covered component of Cooperation Agreement; and 2) the addition of language affirming the agreement of the County and participating cities to take all actions necessary to comply with federal fair housing provisions.   ATTACHMENTS: Resolution authorizing the City Manager to execute the Cooperation Agreement with San Mateo County for participation in the County’s Housing and Community Development Program

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HALF MOON BAY AUTHORIZING THE CITY MANAGER TO EXECUTE THE COOPERATION AGREEMENT WITH SAN 

MATEO COUNTY FOR PARTICIPATION IN THE COUNTY’S HOUSING AND COMMUNITY DEVELOPMENT PROGRAM 

 WHEREAS, San Mateo County (County) is an Urban County under the Act that receives 

funding allocations for the U.S. Department of Housing and Urban Development (HUD) from Community Development Block Grants (CDBG), HOME Investment Partnership (“HOME”), and Emergency Solutions Grant (ESG);  

 WHEREAS, to maintain Urban County status, the County must solicit the cooperation 

and co‐participation of public entities such as the City in its application for federal assistance under the Act for the Federal Fiscal Years 2018, 2019 and 2020 and subsequent three‐year periods thereafter;  

 WHEREAS, the City is not considered an eligible public agency but can cooperate and 

participate with an eligible public entity such as an urban county to become eligible;   

WHEREAS, a Cooperation Agreement by and between the City and County establishes 

the formal relationship to cooperate and co‐participate and is specifically authorized under the 

provisions of Government Code Section 6502 and 26227;  

 

WHEREAS, City has previously expressed its intent and desire to cooperate and 

participate with the County in its plan application and to engage in housing and community 

development activities within its incorporated limits thereunder; and 

 

WHEREAS, City understands that in becoming part of the Urban County, City 

automatically participates in the CDBG, HOME and ESG programs, which provide eligible local 

jurisdictions with federal funds for affordable housing activities. 

 

NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Half Moon Bay 

authorizes a Cooperation Agreement (Exhibit A) with San Mateo County to award Community 

Development Block Grants, HOME Investment Partnership, and Emergency Solutions Grant to 

eligible public entities; and 

 

BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute documents necessary to effectuate the Cooperation Agreement with San Mateo County.

DRAFT COOPERATION AGREEMENT

This Cooperation Agreement (the “Agreement”), entered into this _____ day of __________, 2017, between the COUNTY OF SAN MATEO, a political subdivision of the State of California (“County”"), and the CITY OF HALF MOON BAY, a duly incorporated City within the County of San Mateo (“City”).

WITNESSETH WHEREAS, the Housing and Community Development Act of 1974, as amended (the “Act”), provides for the distribution of federal funds through the Community Development Block Grant (“CDBG”) program to eligible public entities; and WHEREAS, those public entities which are eligible to receive said federal funds are cities with a population more than 50,000, “hold harmless” public entities, and urban counties; and WHEREAS, public entities that do not otherwise come within the definition of an eligible public entity may cooperate and participate with an eligible public entity such as an Urban County; and WHEREAS, since County has heretofore qualified as an “Urban County” under the Act, County again solicits the cooperation and co-participation of public entities such as City in its application for federal assistance under the Act for the Federal Fiscal Years of 2018, 2019 and 2020 and subsequent three-year periods thereafter; and WHEREAS, City, having a population of less than 50,000, desires to cooperate and co-participate with County in this venture; and WHEREAS, this Agreement by and between City and County establishes the formal relationship to cooperate and co-participate and is specifically authorized under the provisions of California Government Code sections 6502 and 26227; and WHEREAS, County has received a communication from the United States Department of Housing and Urban Development (“HUD”), regarding additional language which must be included in this Agreement; and WHEREAS, the Agreement with this additional language must be executed by the parties and submitted to HUD by September 21, 2017; and

WHEREAS, City has previously, by an official act of pronouncement, expressed its intent and desire to jointly participate in the housing and community development programs of the Urban County and to submit a joint application to establish or re-establish the Urban County for the fiscal years 2018, 2019 and 2020 and subsequent three-year periods thereafter, as designated under Government Code Sections 6502 and 26227 as required by the U.S. Department of Housing and Urban Development; and WHEREAS, City understands that in becoming part of the Urban County, City automatically participates in the HOME Investment Partnership (“HOME”) Program and the Emergency Solutions Grant (“ESG’) Program, which provide eligible local jurisdictions with federal funds for housing and community development activities; and WHEREAS, City now desires to enter into this Agreement with County so that it may qualify, under applicable provisions of the Act and HUD regulations, as co-participant with County in eligible activities under the Act. NOW, THEREFORE, IN CONSIDERATION OF THE FOREGOING, the parties hereto agree as follows:

1. Purpose: County and City agree to cooperate to undertake, or assist in undertaking, community renewal and lower income housing assistance activities, specifically urban renewal and publicly assisted housing; economic development, neighborhood facilities, housing rehabilitation, and other appropriate housing assistance to primarily benefit lower and moderate income people. This Agreement includes participation in the CDBG, HOME and ESG Programs.

2. Term:

The term of this Agreement shall be for the Federal Fiscal Years of 2018, 2019 and 2020, after which the term shall be automatically renewed unless action is taken by the City to terminate this Agreement. As provided by HUD rules and regulations, this Agreement shall automatically be renewed for participation in successive three-year qualification periods, unless County or City provides written notice electing not to participate in a new qualification period, provided however, that this Agreement shall remain in effect until CDBG, HOME and ESG funds and income received with respect to the three-year qualification period are expended and the funded activities are completed. County and City cannot terminate or withdraw from this Agreement while the Agreement remains in effect.

By the date specified in HUD’s Urban County Qualification Notice CPD – 17-03, and for a subsequent qualification period of three years, County will notify City in writing of its right not to participate. Should there be changes necessary to meet the requirements for cooperation agreements set forth in the Urban County Qualification Notice applicable for a subsequent three-year Urban County qualification period, amendment(s) to this Agreement shall be executed between County and City and then submitted to HUD. Failure to do so will void the automatic renewal of such qualification period.

a. County, as applicant, has ultimate responsibility for executing the housing and community development programs on behalf of the Urban County, following its Consolidated Plan, which provides for an analysis of housing and non-housing community development needs of the geographic area, and meeting the requirements of other applicable laws, including but not limited to the National Environmental Policy Act, the Uniform Relocation Act, the Fair Housing Act, Title VI of the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, Section 109 of the Housing and Community Development Act of 1974, and the Americans with Disabilities Act of 1990.

County is the lead agent for carrying out the Urban County CDBG Program and the ESG Program. The Urban County, as a CDBG entitlement jurisdiction, is qualified to receive its own allocation of federal HOME funds. However, to increase HOME funding access to County overall, County has formed the San Mateo County HOME Consortium, of which the Urban County is a member. County is also the lead agent for the HOME Consortium. The HOME Consortium is technically responsible for preparing and submitting to HUD the Consolidated Plan, which covers the geographic area of the Consortium. The Urban County is responsible for submitting its own non-housing community development plan, an Action Plan, and required certifications as part of the Consortium’s Consolidated Plan. As lead agent for the Urban County and the HOME Consortium, County is responsible for coordinating all activities necessary to prepare and submit a five-year Consolidated Plan on behalf of the Urban County, including providing assurances or certifications to HUD.

Therefore, County requires City, and City agrees to cooperate to undertake, or assist in undertaking, community renewal and lower-income housing assistance activities, strictly adhere to the Consolidated Plan as approved and to all assurances and certifications provided to HUD, including taking all actions necessary to comply with the Urban County’s certifications under Section 104(b) of Title I of the Act, Title VI of the Civil Rights Act of 1964, the Fair Housing Act, and affirmatively further fair housing. All parties to the Cooperation Agreement must comply with 24 CFR § 91.225(a) and to comply with section 109 of Title I of the Housing and Community Development Act of 1974, which incorporates Section 504 of the Rehabilitation Act of 1973 and the Age Discrimination Act of 1975. County requires City, and City agrees to comply with all other applicable laws.

This Agreement shall also prohibit the Urban County from funding activities in or in support of, any cooperating unit of general local government that does not affirmatively further fair housing within its own jurisdiction or that impedes County’s actions to comply with its own fair housing certification. This provision is required because noncompliance by a unit of general local government included in an urban county may constitute noncompliance by the grantee (i.e. the Urban County) that may, in turn, provide cause for funding sanctions or other remedial actions by HUD.

County shall not provide CDBG, HOME or ESG funds for activities in, or in support of City that does not affirmatively further fair housing within its own jurisdiction or for activities that impede County’s actions to comply with its fair housing certification. In addition, County and City are responsible for taking all required actions to comply with

the provisions of the National Environmental Policy Act of 1969. b. Further, pursuant to 24 CFR § 570.501(b), County, as applicant, has the responsibility for

ensuring that CDBG, HOME and ESG funds are used in accordance with all program requirements, determining the adequacy of performance under agreements and procurement contracts, and taking appropriate action when performance problems arise. Therefore, before disbursing any CDBG, HOME or ESG funds to City or projects in City, County will require City, and City agrees to enter into a written agreement for each individual project.

c. City may not sell, trade, or otherwise transfer all or any portion of CDBG funds to

another such metropolitan city, urban county, unit of general local government, or Indian tribe, or insular area that directly or indirectly receives CDBG funds on exchange for any other funds, credits or non-Federal considerations, but must use such funds for activities eligible under Title I of the Housing and Community Development Act of 1974, as amended. This requirement applies to the qualification and requalification of an Urban County and is contained in the Transportation, Housing and Urban Development, and Related Agencies Appropriation Act, 2014 Pub. L113-76.

4. City Subject to Same Requirements as Subrecipients:

Pursuant to 24 CFR § 570.501(b), City is subject to the same requirements applicable to subrecipients, including the requirement of a written agreement set forth in 24 CFR § 570.503. As applicant, County has the responsibility for ensuring that CDBG, HOME and ESG funds are used in accordance with all program requirements, determining the adequacy of performance under agreements and procurement contracts, and taking appropriate action when performance problems arise. Therefore, before disbursing any CDBG, HOME or ESG funds to City or projects in City, County will require City, and City agrees to enter into a written agreement for each individual project.

5. City’s Adoption and Enforcement of Policies:

a. A policy prohibiting the use of excessive force by law enforcement agencies within its jurisdiction against any individuals engaged in non-violent civil rights demonstrations; and

b. A policy of enforcing applicable State and local laws against physically barring entrance to or exit from a facility or location which is the subject of such non-violent civil rights demonstrations within jurisdictions.

6. City Eligibility for CDBG, HOME and ESG Funding

By executing this Agreement, the City understands that it a. May not apply for grants from appropriations under the Small Cities or State CDBG

Programs for fiscal years during the period in which it participates in the Urban County's CDBG Program;

b. May participate in HOME Program only through the Urban County. Thus, even if the Urban County does not receive a HOME formula allocation, City cannot form a HOME

Consortium with other local governments; and

c. May receive a formula allocation under the ESG Program only through the Urban County, although this does not preclude the urban county or a unit of government participating with the urban county from applying to the State for ESG funds, if the State allows.

7. Affirmative Action:

Under County’s ultimate supervision and responsibility, City covenants and agrees that it will abide by and enforce all applicable affirmative action requirements including, but not limited to Executive Order No. 11246, the Equal Employment Opportunities Act, the San Mateo County Affirmative Action Plan and local affirmative action plans.

8. County’s Responsibility to City:

In addition to the foregoing obligations:

a. County shall, in preparing Consolidated Plans, Annual Action Plans, and any relevant future plans (“plan”) under the Act, solicit to the extent allowed by the Act and all lawful HUD regulations, City’s participation in the development of such future plans which refer to City’s activities under the Act.

b. In accordance with instructions from HUD, County agrees to permit City to carry out the essential community development and housing assistance activities provided for in the application and in future Consolidated and/or Annual Action Plans.

c. County agrees to distribute funding it receives from its current Annual Action Plan and in

future Consolidated and/or Annual Action Plans, in accordance with the terms and provisions therein contained, or in accordance with such terms and conditions as required by the Act or HUD.

9. City’s Responsibilities to County.

In addition to the foregoing obligations:

a. City agrees to expend any funds received by virtue of any of the Urban County’s plans only in accordance with the terms and conditions stated therein, or as amended by HUD.

b. City agrees to cooperate with the Urban County, as it has heretofore, with the development of current and future Consolidated Plans for the Urban County in which housing and community development activities are funded by CDBG, HOME and/or ESG to be continued or undertaken by City within its boundaries are included.

10. Program Income.

a. City must inform County of any income generated by the expenditure of CDBG, HOME

or ESG funds received by City.

b. Any such program income must be paid to County, or City may retain the program income subject to requirements set forth in this Agreement.

c. Any program income City is authorized to retain may only be used for eligible activities

in accordance with all CDBG, HOME or ESG requirements as may then apply.

d. County has the responsibility for monitoring and reporting to HUD on the use of any such program income, and County shall require appropriate recordkeeping and reporting by City as may be needed for this purpose.

e. In the event of close-out or change in status of City, any program income that is on hand

or received subsequent to the close-out or change in status shall be paid to County.

11. Acquisition, Change in Use, and Disposition of Real Property Acquired or Improved with CDBG Funds:

If at any time after CDBG funds are allocated, in whole or in part, for the acquisition or improvement of real property, which is within the control of City, and if there is a change in the proposed use of said property, including disposition, City shall notify County of the proposed change. City shall reimburse County in an amount equal to the current fair market value (less any portion thereof attributable to expenditures of non-CDBG funds) of property acquired or improved with CDBG funds that is sold or transferred for a use which does not qualify under the CDBG regulations at any time prior to or subsequent to the close-out, change of status or termination of this Agreement between County and City.

12. Headings:

The headings in this document are merely for the convenience of the parties, and do not form a material part of this document. Headings shall not be considered in the construction of this document.

13. Minor Amendments to the Agreement.

Notwithstanding Section 2 above, should it become necessary to change the language of this Agreement to meet HUD approval, without making major changes and without altering the intent of the Agreement, such changes may be made administratively by City Manager of City.

REHABILITATION PROJECT ______________________________________________________________________________  RECOMMENDATION: Adopt a resolution authorizing the City Manager to award and execute a construction contract for the Main Street Pavement Rehabilitation Project to the lowest responsive and responsible bidder, Half Moon Bay Grading and Paving,  Inc. of Half Moon Bay, California,  in  the  total bid amount  of  $293,919.84,  and  approve  an  additional  contingency  amount  not  exceeding  10 percent, or $29,392, of the contract award amount for potential change orders.  FISCAL IMPACT:   The FY 17‐18 budget has allocated sufficient  funds  for  this contract award, potential contract changes,  project  management,  and  construction  inspection  services.    Funds  are  from  a specifically  identified  Main  Street  Pavement  Repair  Project  and  supplemented  from  the Pavement Management and Traffic Safety Program.   STRATEGIC ELEMENT: This action supports the Infrastructure and Environment and the Healthy Communities and Public Safety Elements of the Strategic Plan.  BID SUMMARY The City received one (1) bids before the scheduled bid opening time and date of 3:00 p.m. on September  12,  2017.  The  bids  and  engineer’s  estimate  are  tabulated  in  Attachment  2  and summarized as follows:      Bidder           Base Bid                   Total Bid

Half  Moon  Bay  Grading  and  Paving  has  extensive  experience  and  record  of  good  work performance on various projects of similar nature within and outside Half Moon Bay and San Mateo County. City staff has reviewed the bid and determined that the bid  is acceptable and free from significant material discrepancies.   DISCUSSION: Portions of asphalt pavement along Main Street from Correas Street to the Main Street Bridge are exhibiting localized structural failure resulting in surface deformities and cracking.  The areas of failure have been identified and marked, and are the subject of this base repair project.  Portions of pavement will be cut and removed, the underlying base will be recompacted and asphalt will be re‐placed over the compacted base.    The pavement repair work will be performed at night, Sunday through Thursday, between 10:00 p.m. and 5:00 a.m.  The work will require less than 10 working nights.  Construction is scheduled to begin the last week of September 2017.  City staff will be posting public notices in advance of the project.  One week prior to construction, staff will place a digital construction notification reader board on Main Street north of the Main Street Bridge. Staff will also post doorhanger notifications at businesses and residences along Main Street.    This project is categorically exempt from CEQA under section 15301(c) as a minor modification/repair of an existing street.      Half  Moon  Bay  Grading  and  Paving  Inc.  of  Half  Moon  Bay,  CA  was  deemed  the  lowest responsible and responsive bidder.    Staff  recommends Council authorize  the City Manager  to award and execute the construction contract with Half Moon Bay Grading and Paving.    ATTACHMENTS:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HALF MOON BAY  AUTHORIZING THE CITY MANAGER TO AWARD AND EXECUTE A CONSTRUCTION CONTRACT 

FOR THE MAIN STREET PAVEMENT REHABILITATION PROJECT   

WHEREAS, the City has invited and opened one (1) bid received at or before the scheduled time, date and place as set forth in the Public Contract Code for the Main Street Pavement Rehabilitation Project;   

WHEREAS, the lowest responsive and responsible bid was submitted by Half Moon Bay Grading and Paving, of Half Moon Bay, California in the total amount of $293,919.84; and  

WHEREAS, sufficient funds are allocated in the City approved budget for Fiscal Year 2017‐2018 for the recommended contract award. 

 NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of Half Moon Bay 

hereby accepts all bids and authorizes the City Manager to award and execute a contract for the Main Street Pavement Rehabilitation Project to the lowest responsive and responsible bidder, Half Moon Bay Grading and Paving, of Half Moon Bay, California, in the total amount of $293,919.84. Additionally, the City Manager is authorized to approve a contingency for contract changes in the aggregate amount not exceeding 10 percent of the contract award amount.

 TO:    Honorable Mayor and City Council  VIA:    Magda Gonzalez, City Manager  FROM:   Matthew Chidester, Deputy City Manager     Danielle Sanderson, Senior Management Analyst    TITLE:  ADJUSTMENTS TO THE PARKS AND RECREATION USER FEES SCHEDULE ______________________________________________________________________________  RECOMMENDATION: Conduct a public hearing and adopt a resolution authorizing adjustments to the City of Half Moon Bay Parks and Recreation User Fees Schedule for Fiscal Year 2017‐2018.  FISCAL IMPACT:   The proposed schedule, if adopted, decreases rates for private use of City owned recreational facilities by non‐profit entities.  All other fees remain as previously adopted.  The City does not currently have long‐term data on revenues for the rental of recreation facilities, but it is estimated that revenues will decrease as a result of reduced rates.   STRATEGIC ELEMENT: This action supports the Inclusive Governance Element of the Strategic Plan.  BACKGROUND: On May 16, 2017, the City Council adopted the Half Moon Bay Parks and Recreation User Fees Schedule for Fiscal Year 2017‐18, including fees for the private use of City owned recreation facilities (User Fees). The basis for the adopted User Fees were the published 2017 fees from the prior recreation services contractor, the Boys and Girls Club. Following adoption of the User Fees, the City was informed that for many of the non‐profits that were regular users of City facilities, rates had increased significantly.  Further investigation revealed that these non‐profits had not been charged the published rates, but rather discounted and inconsistent rates.  The disparity between the previously charged rates and the City’s adopted rates made it prohibitive for some non‐profits to continue to utilize City facilities.   At the September 5, 2017 City Council meeting, City staff made a presentation to provide background on the history of recreation services and user fees in Half Moon Bay, details on the transition to in‐house recreation services, concerns expressed by the public, and current

practices. After a lengthy discussion, the City Council directed staff to reduce the already discounted non‐profit rates for rental of City owned recreation facilities during regular weekday hours by an additional approximately 50 percent. Additionally, the Council directed staff to reduce non‐profit evening and weekend rates by less than 50 percent, in recognition that those are premium times for facility rentals and require additional City staffing. Further direction from the Council included elimination of cleaning fees and security deposits for non‐profit weekday rentals, as well as reduced security deposits for non‐profit evening and weekend rentals.  The City Council also affirmed the City’s minimum insurance requirement of $2 million in general liability for all facility rentals, as recommended by the City’s insurance pool provider, the Association of Bay Area Governments (ABAG).  DISCUSSION: The attached Half Moon Bay Parks and Recreation User Fees Schedule for Fiscal Year 2017‐18 has been modified to reflect the direction provided by the Council on September 5th.  The non‐profit weekday rates for facility rentals have been decreased by approximately 50 percent from previously adopted rates, and the non‐profit after hours and weekend rates have been reduced by approximately 30 percent. Adjustments have been made to the cleaning fee and security deposit requirements for non‐profit rentals. All other user fees remain as approved on May 16, 2017.  The City hopes that these adjustments to the rates and requirements allow more non‐profits to utilize the City’s facilities to provide important services, and cultural and social activities for the benefit of the community, specifically seniors and individuals with low to moderate incomes.  Staff recommends adoption of the revised User Fees, which will be implemented immediately.  For non‐profit organizations who have pre‐paid for events following implementation of the new User Fees, staff will adjust the rates and offer refunds where necessary.     ATTACHMENTS:   1.  Resolution authorizing adjustments to the Parks and Recreation User Fees   2.  Half Moon Bay Parks and Recreation User Fees Schedule for Fiscal Year 2017‐18

 WHEREAS, the City Council previously adopted the Parks and Recreation User Fees 

Schedule for Fiscal Year 2017‐2018, including fees for the private use of City owned recreation facilities; and 

 WHEREAS, following adoption of the User Fees, the City was informed that for many of 

the non‐profits that were regular users of City facilities, rates had increased significantly, and it was revealed that these non‐profits had not previously been charged the published rates, but rather discounted and inconsistent rates; and  

WHEREAS, on September 5, 2017, City staff made a presentation to the City Council regarding recreation services in Half Moon Bay; and    

WHEREAS, the City Council instructed staff to develop a revised Parks and Recreation User Fees Schedule with further reduced rates for non‐profits to rent City owned recreation facilities;  

NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of Half Moon Bay hereby adopts the modified Parks and Recreation User Fees Schedule for Fiscal Year 2017‐2018.

AND LICENSING PROGRAM ______________________________________________________________________________  RECOMMENDATION: Receive an update on public outreach and input related to the proposed commercial cannabis ordinance, and provide any feedback and direction to staff on the proposed ordinance and licensing program.  FISCAL IMPACT: There is no fiscal impact associated with this item.   STRATEGIC ELEMENT: This recommendation supports the Healthy Communities and Public Safety and the Fiscal Sustainability Elements of the Strategic Plan.  BACKGROUND: On November 8, 2016, California voters approved Proposition 64 (“Adult Use of Marijuana Act” or “AUMA”). AUMA legalized recreational use of marijuana under state law, and established a regulatory scheme to permit commercial marijuana activities associated with the cultivation, manufacturing, transportation, distribution, testing, and dispensing of marijuana for recreational use.  AUMA also allows limited cultivation and possession of marijuana for personal use. In Half Moon Bay, AUMA was approved by more than 69 percent of voters, higher than the County and State approval rates. Previous legislation in 2015, the Medical Cannabis Regulation and Safety Act, had developed a similar licensing scheme for medical marijuana commercial activities. On June 27, 2017, Governor Jerry Brown signed Senate Bill 94, creating the Medicinal Adult‐Use Cannabis Regulation and Safety Act (“SB 94”), which effectively integrated the regulatory and licensing schemes for both medical and recreational marijuana, now referred to as medicinal cannabis and adult‐use cannabis. The State is currently developing regulations pursuant SB 94, which are expected to be completed this November.  Since the

passage of AUMA and subsequently SB 94, the City Council has directed staff to draft an ordinance and licensing program that would potentially regulate limited commercial cannabis activities in the city of Half Moon Bay.    The City has held several public meetings on potential City regulations regarding Cannabis. Most recently, on September 13, 2017, the City hosted a community meeting to provide information on the state laws and potential future regulations surrounding commercial cannabis businesses, as well as to gather feedback on the City’s proposed ordinance.  This meeting was facilitated by Peninsula Conflict Resolution Center and attended by staff from all City departments.  Attendees were seated in small groups and, following a short presentation from City staff, facilitators led discussions based on the following questions: 

“Based on the information you’ve been presented regarding the City’s proposed 

ordinance,  

o What are your impressions? Please share your input. 

o What would you like the City Council to consider for the future ordinance?” 

Due to the timing of the Community Meeting, the information collected is not available at the writing of this report, but will be compiled and available to the City Council and general public at the September 19th City Council Meeting.  The proposed future ordinance and licensing program would include provisions and requirements above and beyond the State licensing requirements, specifically addressing the needs of Half Moon Bay and its surrounding coastside communities. Once the draft ordinance is completed, it will be presented to the City Council for consideration.  DISCUSSION: City staff, the City Attorney’s office, and City consultants are working to draft an ordinance which will include the following elements: 

Regulation of commercial cannabis activities in the following areas: 

o Cultivation in commercial greenhouse facilities in existence as of the date the 

ordinance is adopted 

o Ancillary to the primary cultivation use: 

Storage facilities 

Testing labs 

Distribution facilities  

Medicinal and/or adult use retail  

Important conditions that would apply to licensed commercial cannabis activities 

include, but are not limited to: 

o A local discretionary license has been issued to the business operator 

o A state license has been obtained by the business operator 

o Owners and key personnel have completed a thorough background check

which must be in separate facilities, totaling a maximum of 1,000 square feet of 

gross floor space 

o No on‐site consumption of cannabis products 

o No individuals under the age of 21 are permitted entry onto the Premises 

o Limited signage and hours of operation for on‐site retail 

o An operating plan has been provided detailing the following: 

Sustainability requirements are met regarding energy, water and waste 

Use of groundwater from private wells would be prohibited 

Stringent security requirements are met including video surveillance and 

on‐site security patrols 

Greenhouse operators have installed ventilation, odor control, water 

treatment, lighting equipment, and back‐up generators; consistent with 

best industry practices to provide safe, healthy and efficient operations 

that also minimize impacts to neighbors and the environment  

Light pollution is minimized or eliminated through the use of retractable 

screens or other means 

Policies to provide local workforce recruitment and training 

o All commercial cannabis activities must be ancillary and subservient to the 

primary use of cultivation, including the storage, distribution and sale of only 

cannabis products grown on site (except testing which would allow products 

grown off‐site). 

Other important considerations: 

o All commercial cannabis license application review would be discretionary, 

meaning staff would review and provide recommendations regarding individual 

applications, which would ultimately be considered by the City Council at a 

public meeting, allowing for public input on each application 

o Manufacturing is not permitted.   

o In addition to obtaining commercial cannabis cultivation licenses from the City 

and State, proposed sites and applicants must comply with other applicable 

local and state laws including the California Environmental Quality Act (CEQA) 

and the California Coastal Act, which would include obtaining a Local Coastal 

Development Permit.   

Following any feedback and direction from the City Council on the proposed ordinance, staff will continue drafting the proposed ordinance for future Council consideration, as well as develop a community outreach program to ensure community members and other stakeholders remain informed of the proposed ordinance.  Additionally, staff will continue to

monitor and work with County staff on their draft ordinance given it will impact residents of Half Moon Bay.    Staff will continue to develop the licensing process and program.  The oversight of the licensing program will be housed in the Community Development Department. A regulatory license fee will be assessed with each application.     Staff will also continue to explore options to tax commercial cannabis activities.

The bidder has performed a number of heavy civil projects in the San Francisco area. Staff have confirmed one favorable reference and will continue to check references between  now and the City Council meeting.   BACKGROUND: On June 20, 2017, the City Council directed staff to commence with design for construction of temporary erosion stabilization measures at Seymour Ditch.  The temporary measures are intended to stabilize the ditch while a permanent method of erosion stabilization is designed.    The temporary stabilization design is complete and staff has completed the bidding process for a construction contract. The temporary stabilization design features three rock check dams along Seymour Ditch and rock armoring at and below the ditch headcut.  The check dam rock is a graded 6‐inch to 12‐inch gabion type rock.  The rock specified for stabilization of the headcut and gully is a mix of the 6‐inch x 12‐inch rock with ½ ton rip‐rap.  During construction, rock and equipment for the project will be staged in the southerly half of the Poplar Beach parking lot, necessitating a closure of that portion. Rock will be transported from the parking lot to the construction site at the ditch via a temporarily improved surface immediately east of the Coastal Trail. By transporting rock on the temporary surface, users may continue to use the paved Coastal Trail for about 500 feet south of the Poplar Beach parking lot.  From there, users can detour onto a dirt trail to the southeast leading to the new Seymour Pedestrian Bridge and beyond.  There will be periods of time during construction, however, when the Coastal Trail and the Seymour Bridge will be entirely closed to the public.   Rock for the three check dams along the ditch will be placed by a mini‐excavator from the ditch bank.  Large equipment will not be allowed in the ditch. An equipment platform located near the old Seymour Bridge abutment will accommodate equipment to place rock at the ditch headcut and into the ditch gully below the headcut.   The Contractor will provide and maintain onsite detour signs and notices of the closures.  The City will provide a public information campaign to notify the public of the detours and closures.   The project allows for a 40‐day construction period with construction completion by the second week in November.    This project is noticed as exempt from CEQA as an emergency project. An emergency coastal development permit has also been issued for project construction.   The permit has been forwarded to the California Coastal Commission and is subject to a three‐day appeal period.  Staff and the consultant have met with Coastal Commission staff and have made changes to the project to address initial identified concerns.   The US Army Corps of Engineers has issued a permit for the project under a Regional General Permit 5 (RGP 5) emergency permit. The State Water Resources Control Board has commented

on the project via the overriding RGP 5 permit.  The State Department of Fish and Wildlife has been notified and is also following the project under the overriding RGP 5 permit.   DISCUSSION: The project bid was received on September 14, 2017. The bid is less than the engineer’s cost estimate, but exceeds the original preliminary estimate. Several factors have led to the increased costs associated with the project including:   

First, the bidding environment has changed dramatically over the past six months as contractors have become extremely busy and obtaining their interest in responding with bids has become challenging. Local jurisdictions in the region are typically receiving fewer bids and those bids include inflated unit costs due to the bidding environment. 

 

Second, material costs have increased significantly during the past four months. In some cases, material costs in the region have increased fourfold. This has impacted this project as there is significant rock material necessary for filling the channel.    

 

Third, the project scope has expanded during the past 60 days to accommodate input from regulatory agencies and land owners, and to address planning and public access concerns. This has limited the means and methods to be utilized by the contractor, and therefore, increases costs.  

 Cazadoro  Constructtion  Inc.  of  San  Francisco,  CA  was  deemed  the  lowest  responsible  and responsive  bidder.    Staff  recommends  that  the  City  Council  authorize  the  City  Manager  to execute the construction contract with Cazadoro.   Construction  is scheduled for the month of October 2017.  ATTACHMENTS:

 TO:    Honorable Mayor and City Council  VIA:    Magda Gonzalez, City Manager  FROM:   John Doughty, Public Works Director    TITLE:  HIGHWAY 1 SAFETY AND OPERATIONAL IMPROVEMENTS NORTH PROJECT ______________________________________________________________________________  RECOMMENDATION: 1) Adopt a resolution to affirm the conceptual design of the Highway 1 Safety and Operational Improvements North Project and direct staff to proceed with final PEER approval from Caltrans, complete environmental review, and obtain the Coastal Development Permit (CDP) for the Highway 1 Safety and Operational Improvements projects; and  2) Adopt a resolution authorizing the City Manager to execute an agreement with First Carbon Solutions (www.firstcarbonsolutions.com) to prepare an Initial Study / Mitigated Negative Declaration for the Highway 1 Safety and Operational Improvements North Project for $69,300.  FISCAL IMPACT:   The FY 17‐18 Capital Improvement Program includes sufficient funds to complete PEER, complete environmental review, and obtain the CDP.    STRATEGIC ELEMENT: This recommendation supports the following Elements of the Strategic Plan: Infrastructure and Environment, Healthy Communities and Public Safety, and Inclusive Governance.  BACKGROUND: Highway 1 is a critical north‐south arterial that connects residents to services, shopping, and activities in Half Moon Bay. School‐age children utilize the corridor for access to and from their schools. The lack of unprotected left turn lanes and left turn acceleration lanes continue to be a safety concern for residents and visitors. The lack of a pedestrian bicycle / pedestrian path on the east side of Highway 1 and controlled east‐west access across Highway 1 contribute to safety concerns as well as a lack of choice for alternate modes of transportation.  To address the safety and operational issues along Highway 1, the City submitted two separate applications to the San Mateo County Transportation Authority (SMCTA) for funding the Highway 1 Safety and Operational Improvements projects.  On October 4, 2012, the SMCTA

Improved bus stops   The new signal at Terrace Avenue is also a condition of development for the Pacific Ridge Subdivision (Ailanto Properties, Inc.).  This is a new subdivision under construction at the terminus of Terrace Avenue.  A total of 63 single‐family residences are permitted to be built on approximately 114 acres adjacent to the existing Terrace Avenue Neighborhood.  A traffic signal is required (per Conditions of Approval and Settlement Agreement) at Terrace Avenue and Highway 1 to mitigate traffic impacts from the project.  In accordance with the agreement, Ailanto Properties has provided Letters of Credit in the amount of $2,350,000 for the construction of the new Terrace Avenue signalized intersection and related improvements.  Per the agreement, by accepting the Letters of Credit, the City assumed full responsibility for construction of the signal and related improvements.  On April 18, 2017, the City Council conducted a study session on the Highway 1 Safety and Operational Improvements Project.  After reviewing the latest project plans, the City Council directed staff to move forward with the Highway 1 South project and amend the North project as follows:

Extend the easterly bicycle and pedestrian path north from Terrace Avenue to Grandview Boulevard; 

Transition to a two‐lane northbound configuration prior to Grandview Boulevard (as opposed to Kehoe Avenue) while utilizing the additional right‐of‐way savings to extend the bicycle and pedestrian path to Grandview Boulevard (and Spindrift Way if possible); 

Conduct a community meeting to present the Highway 1 North project, as modified to the neighbors and community at‐large; and 

Present the revised plans to the City Council prior to submitting a revised PEER to Caltrans.  

DISCUSSION: Following the City Council presentation on April 18, 2017, staff implemented the City Council requested modifications and actions as follows:  

a) Revised the northbound two‐lane transition to one lane prior to Grandview Boulevard.  This design provides vehicles exiting left turning exiting vehicles from Grandview Blvd to cross only one northbound lane (instead of two).   

b) Extended the easterly bicycle and pedestrian path from Terrace Avenue to Spindrift Way. 

c) Conducted a community meeting on August 30, 2017. d) Prepared revised PEER application for submittal to Caltrans subject to City Council 

authorization.  

During the community meeting held on August 30, 2017, there were 31 residents in attendance (approximately half from Half Moon Bay and the other half from other coastside neighborhoods).  Overall, consensus among the meeting attendees was to proceed with the project, as modified by the City Council on April 18, 2017, and to preserve the SMCTA funding.  There were some in the audience that expressed concerns about proposed development (and traffic impacts) on the coast and projects outside city limits.    To execute a funding agreement with SMCTA and secure these funds, final Caltrans permits (PEER), environmental clearance, and a coastal development permit is required.   The City has received a proposal from First Carbon Solution (FCS) for the preparation of an Initial Study / Mitigated Negative Declaration for this project.  The scope of work includes:  

Technical analysis for Air Quality and Greenhouse Gas Emissions, Biological Resources, Cultural Resources, and Noise

FCS was selected by staff due to their familiarity with the project and the community. FCS prepared the Mitigated Negative Declaration on behalf of the City for the Highway 1 Improvements Project Findings Analysis in 2012 as well as provided environmental services for many other prior City projects.  FCS is also preparing the environmental document for the Highway 1 “South” Project under a separate City agreement.   Since initial grant award, SMCTA has made numerous inquiries regarding the status of each of the projects.  In its most recent letter to the City dated May 29, 2017 (Attachment 2), SMCTA is requesting a letter from the City with detailed information demonstrating broad community support and project advancement.  The letter should specifically include reason for the project delay, an updated schedule with milestones, evidence of broad community support, and compliance with the original scope of work (any significant deviation will require board approval).  This letter is due from the City by October 31, 2017.  The actions requested with this item represent a significant advancement and commitment to the project which will be critical to retaining the funds. Completion of these tasks will allow the City to finalize the funding agreement with SMCTA for $3.5 million for final design and construction.  SMCTA funds will be supplemented by developer funds from the Pacific Ridge Subdivision.    Following approval by the City Council, staff and its consultant will submit the revised PEER application to Caltrans for final approval.  In addition, in parallel with preparation of the environmental document, staff will seek approval of the coastal development permit from the Planning Commission.  As noted previously, each of these actions are required to enter into a funding agreement with SMCTA.  At this point, staff is hopeful to enter into a funding agreement by December 2017 for the South project (early 2018 for the North project) and commence final design soon thereafter.    ATTACHMENTS:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HALF MOON BAY AFFIRMING CONCEPTUAL DESIGN OF THE HIGHWAY 1 SAFETY AND OPERATIONAL IMPROVEMENTS NORTH PROJECT AND DIRECTING STAFF TO PROCEED WITH FINAL PEER APPROVAL FROM 

CALTRANS, COMPLETE ENVIRONMENTAL REVIEW, AND OBTAIN THE COASTAL DEVELOPMENT PERMIT  

 WHEREAS, Highway 1 is a critical local north‐south arterial connecting residences, 

businesses and community uses in the City of Half Moon Bay; and  

WHEREAS, Highway 1 is also the primary means of access for public safety including law enforcement, fire, ambulance and other emergency services.; and 

 WHEREAS, Highway 1 not only serves automobiles and trucks, but also pedestrians and 

bicycles and it is a vital regional transportation link between Santa Cruz County, the San Mateo County coast side communities and San Francisco; and  

 WHEREAS, on October 4, 2012, the San Mateo County Transportation Authority 

awarded the City $3.5 million (for design, right‐of‐way, and construction) for each of the Highway 1 Saftey and Operational Improvements “North” and “South” projects for a total of $7 million; and  

WHEREAS, these projects have broad community support and would greatly improve safety and relieve congestion especially at peak commute hours, school drop‐off/pick‐up times and weekends.  

NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of Half Moon Bay hereby affirms conceptual design of the Highway 1 Safety and Operational Improvements North Project (as contained in Exhibit A) and directs staff to proceed with final PEER approval from Caltrans, complete environmental review, and obtain the Coastal Development Permit for the Highway 1 Safety and Operational Improvements projects.

WHEREAS, the City requires the services of an environmental firm to complete environmental review and a California Environmental Quality Act document for the Highway 1 Safety and Operational Improvements “North” project; and  

WHEREAS, the City received a proposal from First Carbon Solutions to prepare an Initial Study/Mitigated Negative Declaration for $69,300; and  

WHEREAS, FCS had previously prepared the environmental Findings Analysis for the earlier version of this project in 2012 and its related studies; and  

 WHEREAS, FCS is currently under an agreement with the City for the Highway 1 Safety 

and Operational Improvements “South” project; and  

WHEREAS, the City wishes to complete the environmental document for the Highway 1 North project to be eligible to enter into a funding agreement with San Mateo County Transportation Authority; and  

NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of Half Moon Bay hereby authorizes the City Manager to execute a Professional Services Agreement with First Carbon Solutions for $69,300 for environmental services consulting for the Highway 1 Safety and Operational Improvements North project.
