WHEREAS, on July 15, 1992, Patrolman Prank Tibaudo ofthe Harper Woods Police Department, while off-duty,did ooserve a group of young males in the Cityof Grosse Pointe Woods: and

WPERBAS, off-duty Patrolman Tibaudo observed one of thegroup enter a garage on Manchester Avenue withinthe City of Grosse Pointe Woods and remove abicycle; and

WHEREAS, Patrolman Tibaudo did identify himself as apolice officer and did apprehend the youth withthe stolen bicycle and did detain such youthuntil the arrival of officers of the GrossePointe Woods Department of Public Safety;

NOW, BE iT RESOLVED that the City Council of the Cityof C:oase Pointe Woods dues hereby commend PatrolmanFrank Tibaudo of the Harper Woods Police Departmentfor his devotion to duty and for his quick actionin thwarting a criminal act, and the City Councilof Grosse Pointe Woods does express the appreciationof the community to Patrolman Tibaudo for hisaction.

Motion CARRIED by the following vote:YES: Alogdelis, Bidigare, Fahrner, Gilezan, Novitke,

Rice, WilsonNO: NoneABSENT: None

Motion by Fahrner, supported by Wilson, regardingAppointments to Building Authority, that the City Councilconcur with the recommendation of the Mayor's Mack AvenueBusiness Study Committee in their Minutes of July 21, 1992,that the following be nominated and elected as follows:

CLIFF MAISON, Administrationfor a term expiring December 31, 1996;

ANTHONY MISERENDINO, Residentfor a term expiring December 31, 1995;

EDWARD BARBIERI, Business Property Ownerfor a term expiring December 31, 1994.

Motion CARRIED by the following vote:YES: Alogdelis, Bidigare, Fahrner, Gilezan, Novitke,

Rice, WilsonNO: NoneABSENT: None

THE MEETING WAS THEREUPON OPENED AT 7:45 P.M. FOR A PUBLICHEARING TO HEAR THE APPEAL OF SUSAN AND STEWART FLEMING,1171 HAWTHORNE, WHO ARE APPEALING THE DENIAL OF THE BUILDINGINSPECTOR TO ISSUE A BUILDING PERMIT FOR CONSTRUCTION OF ANADDITION TO THE RESIDENCE AT 1171 HAWTHORNE. THE BUILDINGPERMIT WAS DENIED DUE TO A DEFICIENCY IN THE REQUIRED REARYARD AS SET FORTH IN SECTION 5-4-3(F) OF THE ZONINGORDINANCE OF THE CITY OF GROSSE POINTE WOODS. A VARIANCE ISTHEREFORE REQUIRED.

And with the desire of the building owner to straighten andcover the exterior wall on the south side of the building withouttearing down the building wall, the City Council authorizes theCity Attorney to draft an easement document for signature by the

Mayor and City Clerk, granting a one-foot easement on the

northerly side of said lot, which easement will revert to theCity if and when the building is removed.

applicant is not the owner of or entitled to the possession cf suchbicycle. The Department of Public Safety shall keep a record c_°the number of each license, the date issued, the name and ediresssof the person to whom issued and the number on the frane of the

bicycle for which issued, and a record of all bicycle license ices

collected by the Department-

WHEREAS, the Council deems it advisable and necessary and in

the best interest of the City to amend the Articles of

Incorporation of the following;

1' GW, THEREFORE , BE IT RESOLVED THAT:

by this reference incorporated herein is hereby approved and

2. The .tabor and City Clerk of the City are

authorized and directec to execute said First Arendment to Ar=ia-ea

of Incorporation for and on behalf of the City.

3. The executed First AnerdDent to Articles of Incorporatio •

shall be delivered to the County Clerk of the County of Wayne, who

shall take such steps as are necessary under the provisions of

state law to perfect the incorporation of the Authority.

4. The City Clerk shall cause the First Aoiandment to

Articles of Incorporat=on to be published in a newspaper of general

circulation in the City.

FIRST A,MI~DMENT TO

ARTICLES OF INCORRORATION

OF THE

CITY OF CR055= POINTE WOODS BUILDING AUTHORITY

Article V, section 11, of the Articles of Incorporation is

amended to provide as follows:

" Section ii . A, Con=•issioner may be removed from office for

cause or without cause by an affircative majority vote of the City

Council of the City. of Grosse Pointe Woods."

And that the Mayor and City Clerk be AUTHORIZED to executesuch; to file such with the County Clerk and publish such inThe Grosse Pointe News, the official newspaper of the City.

Motion CARRIED by the following vote:YES: Alogdelis, Bidigare, Fahrner, Gilezan, Novitke,

Rice, WilsonNO: NoneABSENT: None

Motion by Bidigare, supported by Gilezan, regarding Gabriel,Roeder, Smith & Company, that the City Council concur withthe recommendation of the Pension Board and APPROVE thefollowing for payment:

(1) Statement dated May 12, 1992 - in the amount of$200.00;

(2) Statement dated March 4, 1992 - in the amount of$150.00;

And to charge such to the appropriate account.
