COMMITMENT FOR TITLE INSURANCE

Chicago Title Insurance Company, a Nebraska Corporation ('Company'), for a valuable
consideration, commits to its policy or policies of title insurance, as identified in Schedule A, in favor
of the Proposed Insured named in Schedule A, as owner or mortgagee of the estate or interest in
the land described or referred to in Schedule A, upon payment of the premiums and charges and
compliance with the Requirements, are subject to the provisions of Schedules A and B and to the
Conditions of this Commitment.
This Commitment shall be effective only when the identity of the Proposed Insured and the amount
of the policy or policies committed for have been inserted in Schedule A by the Company.
All liability and obligation under this Commitment shall cease and terminate 6 months after the
Effective Date or when the policy or policies committed shall issue, whichever first occurs, provided
the failure to issue the policy or policies is not the fault of the Company.
The Company will provide a sample of the policy form upon request.

Requirements
1. Amended Civil Code Section 2941, which becomes effective on January 1, 2002, sets
the fee for the processing and recordation of the reconvey and recordation of the
reconveyance of each Deed of Trust being paid off through this transaction at $45.00.
The reconveyance fee must be clearly set forth in the Beneficiary's Payoff Demand
Statement ("demand"). In addition, an assignment or authorized release of that fee,
from the Beneficiary to the Trustee of record, must be included. An example of the
required language is as follows: "The Beneficiary identified above hereby assigns,
releases, or transfers to the Trustee of record, the sum of $45.00, included herein as
a Reconveyance Fee, for the processing and recordation of the Reconveyance of the
Deed of Trust securing the indebtedness covered hereby, and the escrow company
or title company processing this pay-off is authorized to deduct the Reconveyance
Fee from this Demand and forward said fee to the Trustee of record or the successor
Trustee under the Trust Deed to be paid off in full." In the event that the
reconveyance fee and the assignment, release or transfer thereof is not included
within the demand statement, then theTitle Company list in this report may decline to
process the reconveyance and will be forced to return all documentation directly to
the Beneficiary for compliance with the requirements."
2. Any Notice of Sale recorded on or after September 8, 2008 for deeds of trust
recorded between January 1, 2003 and December 31, 2007 must include a
declaration from the mortgagee, beneficiary, or authorized agent, substantially as
follows: “The undersigned declares that the borrower was contacted to assess the
borrower’s financial situation and to explore options for the borrower to avoid
foreclosure.” In the alternative, the declaration may list the efforts made, if any, to
contact the borrower in the event no contact was made. The company reserves the
right to add additional exceptions and/or requirement upon review of said declaration.

CONDITIONS
1. The term mortgage, when used herein, shall include deed of trust, trust deed, or other security
instrument.
2. If the proposed insured has or acquired actual knowledge of any defect, lien, encumbrance, adverse
claim or other matter affecting the estate or interest or mortgage, thereon covered by this
Commitment than those shown in Schedule B hereof, and shall fail to disclose such knowledge to
the Company in writing, the Company shall be relieved from liability for any loss or damage resulting
from act of reliance hereon to the extent the Company is prejudiced by failure to disclose such
knowledge. If the proposed insured shall disclose such knowledge to the Company, or if the
Company otherwise acquires actual knowledge of any such defect, lien, encumbrance, adverse
claim or other matter, the Company at its option may amend Schedule B of this Commitment
accordingly, but such amendment shall not relieve the Company from liability previously incurred
pursuant to paragraph 3 of these Conditions.
3. Liability of the Company under this Commitment shall be only to the named proposed Insured and
such parties included under the definition of Insured in the form of policy or policies committed for
and only for actual loss incurred in reliance hereon in undertaking in good faith (a) to comply with the
requirements hereof, or (b) to eliminate exceptions shown in Schedule B, or (c) to acquire or create
the estate or interest or mortgage thereon covered by this Commitment. In no event shall such
liability exceed the amount stated in Schedule A for the policy or policies committed for and such
liability is subject to the insuring provisions and Conditions and the Exclusions from Coverage of the
form of policy or policies committed for in favor of the proposed Insured which are hereby
incorporated by reference and are made a part of this Commitment except as expressly modified
herein.
This Commitment is a contract to issue one or more title insurance policies and is not an abstract of
title or a report of the condition of title. Any actions or rights of action that the proposed Insured may
have bring against the Company arising out of the status of the title to the estate or interest or the
status of the mortgage thereon covered by the Commitment must be based on and are subject to
the provisions of this Commitment.

The policy to be issued contains an arbitration clause. All arbitrable matters when the Amount of
Insurance is $2,000,000 or less shall be arbitrated at the option of either the Company of the Insured

You may be entitled to receive a $20.00 discount on escrow services if you purchased, sold or
refinanced residential property in between May 19, 1995 and November 1, 2002. If you had
more than one qualifying transaction, you may be entitled to multiple discounts.
If your previous transaction involved the same property that is the subject of your current
transaction, you do not have to do anything; the Company will provide the discount, provided
you are paying for escrow or title services in this transaction.
If your previous transaction involved property different from the property that is subject of your
current transaction, you must inform the Company of the earlier transaction, provide the
address of the property involved in the previous transaction, and the date or approximate date
that the escrow closed to be eligible for the discount.
Unless you inform the Company of the prior transaction on property that is not the subject of
this transaction, the Company has no obligation to conduct an investigation to determine if you
qualify for a discount. If you provide the Company information concerning a prior transaction,
