Story: Dillon is a 15.2 hd golden buckskin gelding that has been used on a ranch in south Texas his whole life. He is sure footed and sound with a good mind and a great handle. Dillon has been ridden by all levels of riders from green horns to top hands.
1. Southern Colorado Livestock Auction, INC. and its associates act as agent only on all sales, and are not responsible for buyer/seller error or misunder-standing. All Guarantees are strictly between he buyer and seller. All horses
are sold AS IS without any other express or implied warranties.
2. Consignment forms must be accompanied by original registration papers
and a signed transfer OR entry fee and a photocopy of the registration papers.
3. Individual NEGATIVE COGGINS TEST (original – not faxes or copies) current within 12 months must be provided day of sale. $35.00 charge if
drawn at sale. Brand Certificates required from brand states
4. Foal must be kept in the same pen as the mare or will be charged separate
fees.
5. Mares selling in foal must have a completed and signed breeder’s certifi-cate OR a letter of guarantee from the stallion owner stating the breeder’s certificate will be issued at time of foaling. Or buyers must be informed that the
foal will be GRADE.
6. Any defects or bad habits must be called when horse is presented in sale’s ring. (Example: Cryptoids, Cribbers, Lameness or Unsoundness, Parrot
Mouth, HYPP N/H or H/H, etc.).
7. Consignors will be paid within 10 banking days from day of sale.
8. CATALOG FEE – Regular consignment -$100. Commission is 8% of the selling price. No Sales or Pass Outs must be stated before the horse leaves
the sale’s ring.
9. The Catalog Fee is non-refundable. Consignor agrees not to withdraw entry except for serious injury, sickness or death, and will furnish sales company
with a veterinary statement prior to day of sale.
10. Upon execution of this contract, Consignor agrees not to sell the horse by private sale. All horses must go through the sale’s ring. NO horses are to be sold prior to going to the sale’s ring. (NO trading out back). ANY HORSES SOLD OUTSIDE THE RING WILL BE ASSESSED AN 8% COMMISSION
CHARGE.
11. A $7.00 halter charge may be deducted for every horse sold. A new halter
might be given to the buyer when payment is made.
12. Only horses that are consigned to the sale will be allowed on the sale grounds. All other horses sold before, during, and after sale will be charged
8% commission and a catalog fee.
13. All horses are subject to a selection process.
14. Data Provided in this catalog is generally correct, but occasionally errors occur due to incorrect data received, processing mistakes and other causes. We disclaim liability for such errors, but appreciate their being called to our
attention.
15. Title passes to buyer at fall of the hammer, or upon final bid and buyers number presentation. All risk of injury to the horse becomes buyers risk at passing of title. Buyer agrees to release, defend, indemnify, and hold owners, managers, and employees harmless from all losses, expenses, and claims related to the possession, care, custody, control or maintenance after the fall of the hammer of any horse on which he or she is the successful bidder, whether resulting in whole or in part from their own negligence including but not limited to any claims arising out of injuries or damage caused by the horse after the fall of the hammer. The horse will be held for the buyer until buyer makes settlement as provided. Buyer shall immediately present himself to make settlement if requested, but in any other case shall present himself
within thirty (30) minutes of conclusion of the sale.
16. Any Claimed defect, injuries, or bad habits will be inspected by SCLA Vet
or authorized vet, or SCLA management before any monies are transferred.
17. Feed & Yardage - $10.00/Horse/Day,
18. All Horses subject to blood testing, at sale managements discretion.
