A major breakthrough in the development of the Koi fish industry in South Africa, generat- ing millions of rands, will be spearheaded by the Great- er Tzaneen Municipality (via GTEDA, the GTM’s development arm). The colourful Koi (Cyprynis carpio) will be produced on a large scale by a few selected local authorities in Limpopo and ex- ported to Brazil and European countries, earning much needed foreign exchange for their treasuries. The current world market price is US$1 000 (more or less R14 500) for a Koi of 30 cm. The Koi is a karp and can reach the age of a hundred years. When commercially bred, the life span is between 20 and 35 years. Tzaneen was selected as the first of three municipalities in Lim- popo, initiated by a consortium of German businessmen, to launch the international project in SA, due to our weather con- ditions. Confidential negotiations between the GTM’s parks di- vision and the SA Koi Keepers Society (SAKKS) in Gauteng is well under way regarding the regulations and desired species for Koi farming, while at least two Koi specialists from Nishikigoi in Japan will be contracted to run the operation. This opportunity came as a lifebuoy for the GTM to recover the R17 million expenditure wasted on the new unattended swimming bath, which will be used in the initial phase of the project. Researchers established that the size and depth of the bath will be ideal for the Koi venture. Paramedics were soon on the scene, but Van Niekerk remained at the patient’s side until he was loaded into the ambulance. “He is such a gentle soul and now, he ap- pears to be a lifesaver too.” The following day, aſter the incident, Van Niekerk re- turned to Adam’s Café to find out how the man he had helped, was doing. Van Niek- erk and his partner, Gerda, are well known in Tzaneen. Locals talk of the strong man who walks the streets with his engine-less motorbike, collecting scrap metal all over town and transporting it to scrap metal dealers in the industrial area. He doesn’t really talk to passersby and ap- pears to live happily in the life that he has chosen. “I was just in the right place at the right time, and when I saw the man fall down and hurt himself, I couldn’t just stand there and let him bleed in the street,” said Van Niekerk. “The man needed help and I was nearest to him so I picked him up and helped as best I could. I just hope he is alright now.” It is not clear which hospital the man was transported to and at the time of going to print it was unclear whether the man had suffered a heart aack or an epileptic fit. A Tzaneen man, aff ectionately known as “Koos Scrap” or “Sterk Kosie”, may very well have saved the life of a stranger on Tuesday aft ernoon.

The incident occurred in the parking lot outside Adam’s Cafe’s outlet in the Old In-dustrial area in Tzaneen.

According to witnesses, a courier vehicle stopped outside the café at around 16:30. When the driver exited the vehicle, he sud-denly collapsed and hit his head on the tarmac. Koos van Niekerk, who was in the parking lot at the time, saw what happened and immediately rushed to his aid.

“There was so much blood,” said Mina Kru-ger, Adam’s Café manager. “We know the driver very well as he is a regular here at our store. Such a friendly man too. We were hor-rifi ed to see him like that and so we shouted for help. Koos happened to be in the shop at the time and he immediately rushed over to the man, picked him up and carried him onto the sidewalk in front of our store.”

Die “senior” pasiënt, wat verkies om nie geïdentifi seer te word nie, is goed aan ‘t herstel en reeds uit die hospitaal ontslaan. Een van die voordele van ‘n lapa-roskopiese prosedure is juis dat pasiënte heelwat vinni-ger herstel en vroeër huis toe kan gaan. Die prosedure neem minder tyd in beslag as ‘n operasie en die teatertyd (en narkosetyd) is dus ook korter.

Daar is geen lang litt eken nie, die pasiënt

verduur baie minder pyn en die genesingtyd is baie korter. In ‘n laparoskopiese prose-

dure word ‘n klein insnyding (gaatjie) in die buik gemaak en dan word met ‘n optiese instrument(e) gewerk.

A memorial service was held in Nkowankowa for GTM traffi c offi cer Hector Butana Mlondovodzi yesterday (Thursday). He died in a hit and run accident on Sunday. A large group of family members, friends and colleagues attended the service a the Tivumbeni centre. The funeral will be held tomorrow (Saturday). His bereaved wife, Makhanana, is second from right. Authority for the expropriation The authority of SANRAL to source gravel for the construction of roads from nearby farms comes from section 41 of the South African National Roads Agency Limited and National Roads Act 7 of 1998 (SANRAL Act). Section 41 reads as follows:

“Expropriation of land for purposes of na-tional road

41. (1) Subject to subsection (2) and to the obliga-tion to pay compensation, for which the Agency will be responsible, the Minister, if satisfied on reasona-ble grounds that the Agency reasonably requires—

(a) any land for a national road or for works or other purposes connected with a national road, including any access road, the acquisition, ex-cavation, mining or treatment of gravel, stone, sand, clay, water or any other material or sub-stance, the accommodation of road building staff and the storage or maintenance of any plant, ve-hicles, machines, equipment, tools, stores or ma-terial, may expropriate that land for the Agency;

(b) gravel, stone, sand, clay, water or any other material or substance on or in land for the con-struction of a road or for works or any of the pur-poses mentioned in paragraph (a), may take it for the Agency or authorise the Agency to take it;

(c) the right to use land temporarily for any of the purposes for which the Minister is competent to expropriate land under paragraph (a), may take that right for the Agency or authorise the Agency to take that right.

Subsection (b) clearly permits the Minister of Transport to source gravel from surround-ing properties. Subsection (a) permits the Minister to expropriate the land for that pur-pose if need be and sub-section (c) permits the Minister to temporarily expropriate land for those purposes if need be. The process that must be followed is regulated by the current Expropriation Act of 1975. Once the Expropriation Bill currently before parlia-ment is passed, it will regulate the procedure that must be followed (notice of intention to expropriate, notice of ex-propriation, offers and coun-ter offers of compensation etc.). An important addition to that process is contained in subsection of the SANRAL Act (2), which obliges the Min-ister to first attempt to acquire the gravel, temporary use or portion of the land as the case may be through negotiation with the owner. In other words, before expropriation can take place, the Minister (or his designate) must first attempt to “buy” the gravel, land or temporary use of land as the case may be. A similar provision is contained in the Ex-propriation Bill. Subsection reads as follows:

(2) The Minister may not exercise a power in terms of subsection (1) unless satisfied on reason-able grounds that the Agency is unable to acquire the land or anything mentioned in paragraph (b) of that subsection, or the right to use the land temporarily, by agreement with the owner of the land or the holder of any relevant right in respect of the land, as the case may be.”

Initial negotiations The first step in the process would therefore

be for the land owner and SANRAL to nego-tiate a price. During these negotiations, it is important for the land owner to remember that he is not obliged in any way to agree to prices or stipulations offered by SANRAL. Despite the fact that SANRAL is a state enti-ty, and that they are empowered by statute, these negotiations are completely voluntary and should be treated as such. The owner should not permit him or herself to be bul-lied or intimidated in any way as the process

is completely voluntary. If the owner is not happy with price or any other stipulation proposed by SANRAL, he or she can simply reject the offer. In this event SANRAL could decide subsequently to expropriate however this is a separate administrative process that should not be confused with the initial, vol-untary negotiations. Expropriation

Expropriation is an administrative proce-dure. This means that the state is obliged to follow a prescribed procedure which includes the delivery of a notice of intention to expropri-ate, a notice of expropriation as well as offers of compensation with the opportunity to make counter offers. The detailed procedure is con-tained in the current 1975 Expropriation Act which will be replaced by the procedure con-tained in the Expropriation Bill as soon as that Bill is promulgated in the near future. Once the Bill is promulgated Agri SA will make a guide-line available to its members wherein the de-tailed process is unpacked. It will therefore not be attempted in this document.

Should land be expropriated for the pur-pose of sourcing gravel, either permanently or temporarily, compensation must be pay-able. In this regard it is absolutely crucial for property owners to know what exactly it is that will be compensated for. As will be explained below, where the land taken was not currently used to mine gravel, the owner is entitled to compensation for the land (or temporary use thereof) based on its current use, and not for quantity of gravel removed.

In the case of Du Toit v Minister of Transport , the then South African Roads Board issued a notice in terms of section 8 (1) of the Nation-

al Roads Act (Act 54 of 1971) indicating their intention to expropriate land temporarily to dig a gravel pit for road maintenance. Sec-tion 8 (1) of the National Roads Act has since been repealed and replaced with section 41 of the SANRAL Act, the contents and object of which are essentially the same. As a result, the court’s interpretation is still relevant.

When it came to calculating the amount of compensation, the owner argued that he should be compensated for the amount of gravel removed, whereas the state argued that he should be compensated for the loss he suffered as a result of not being able to use that land. The court stated that the object of expropriation is to place the owner in a simi-lar position as that which he was in before the expropriation took place. As such, he should receive just and equitable compensation for the farmland that he lost. Since he was not exploiting the gravel deposits himself, the value of the amount of gravel removed was ‘hypothetical loss’, whereas the loss of that portion of his farmland was his ‘actual loss’. The compensation should therefore place him in a similar position by compensating him for the portion of farmland that he lost.

The court furthermore adopted the ap-proach whereby market value serves as the point of departure, and then any other fac-tors (either listed in section 25(3) or not) can be applied to add or subtract from the value.

In this case, the starting point was therefore the market value of that portion of undevel-oped farmland and other factors applied to adjust it slightly. The costs incurred by SAN-RAL to rehabilitate the land was also taken into consideration.

The principles laid out in the Du Toit case are still relevant, however another factor that has been introduced since the facts in the case came to light which may also have an impact is the promulgation of the Min-erals and Petroleum Resources Development Act (MPRDA).

In terms of the MPRDA, South Africa’s mineral resources be-long to the ‘nation’ with the state acting as ‘custodian’. The min-erals therefore no longer belong to the owner of the land. Gravel falls within the definition of a ‘mineral’ to which the Act ap-plies. In this regard, a mineral is defined as:

“‘mineral’ means any substance, whether in solid, liquid or gaseous form, occurring naturally in or on the earth or in or under water and which was formed by or subjected to a geological pro-cess, and includes sand, stone, rock, gravel, clay, soil and any mineral occurring in residue stock-piles or in residue deposits, but excludes-

(a) water, other than water taken from land or sea for the extraction of any mineral from such water; (b) petroleum; or (c) peat;”

As a result, the gravel underground no longer belongs to the owner of the land an-yways. The issue of compensating the own-er for the gravel therefore becomes almost moot the gravel does not belong to him or her in the first place.

The effect is that owners will whose land is expropriated, either temporarily or per-manently, will be receive just and equitable compensation based on the current use of the land, and not the potential value of the gravel.

Environmental aspects Although ‘Gravel’ falls within the defini-

tion of ‘Minerals’, the activities in question has been specifically exempted from the operation of the MPRDA, although this ex-emption is qualified. Section 106 of the MPR-DA states that private owners are exempted from the operation of the MPRDA whilst an organ of state may be exempted but still have to submit an environmental management programme as required by the National En-vironmental Management Act (NEMA) to the relevant Minister. In this regard section 106 and section 38 of the MPRDA states:

“106. Exemptions from certain provisions of Act

(1) The Minister may by notice in the Gazette, exempt any organ of state from the provisions of sections 16, 20, 22 and 27 in respect of any activ-ity to remove any mineral for road construction, building of dams or other purpose which may be identified in such notice.

(2) Despite subsection (1), the organ of state so exempted must submit an environmental man-agement programme for approval in terms of sec-tion 39(4).

(3) Any landowner or lawful occupier of land who lawfully, takes sand, stone, rock, gravel or clay for farming or for effecting improvements in connection with such land or community develop-ment purposes, is exempted from the provisions of in subsection (1) as long as the sand, stone, rock, gravel or clay is not sold or disposed of.”

“38A. Environmental authorisations (1) The Minister is the responsible authority for

implementing environmental provisions in terms of the National Environmental Management Act, 1998 (Act No. 107 of 1998) as it relates to prospecting, mining, exploration, production

or activities incidental thereto on a prospecting, mining, exploration or production area.”

This requirement will seemingly have to apply irrespective of whether the owner and SANRAL can come to an agreement on a price for the gravel extraction or if the owner is expropriated

In terms of section 24N the NEMA, an en-

vironmental management programme must outline mitigation and remediation meas-ures that must be applied by the relevant organ of state. In this regard section 24N (2) and (3) reads as follows:

“(2) The environmental management pro-gramme must contain—

(a) information on any proposed management, mitigation, protection or remedial measures that will be undertaken to address the environmental impacts that have been identified in a report con-templated in subsection 24(1A), including envi-ronmental impacts or objectives in respect of—

(i) … ; (ii) … ; (iii) … ; (iv) the rehabilitation of the environment; and (v) … ; (b) details of—

(i) … ; (ii) … ; (c) … ; (d) … ; (e) … (f) as far as is reasonably practicable, measures

to rehabilitate the environment affected by the undertaking of any listed activity or specified ac-tivity to its natural or predetermined state or to a land use which conforms to the generally accept-ed principle of sustainable development; and

(g) a description of the manner in which it in-tends to—

(i) modify, remedy, control or stop any action, activity or process which causes pollution or en-vironmental degradation;

(3) The environmental management programme must, where appropriate—

(a) … (b) contain measures regulating responsibilities

for any environmental damage, pollution, pump-ing and treatment of polluted or extraneous water or ecological degradation which may occur inside and outside the boundaries of the operations in question;”

In other words, even though the digging of gravel pits by SANRAL will not be consid-ered a mining activity, it still has to prepare an overarching environmental management programme to be submitted to the Minister of Mineral Resources. The plan must outline the mitigation measures as well as any reme-dial measures where possible. This plan will be generalised in nature and not specific to any instance. In other words, SANRAL will have to prepare a policy of sorts that address-es these environmental concerns, however they will not develop a new environmental management programme for each gravel pit. A land owner can request to see the relevant programme from SANRAL in order to gain insight into the mitigation and remedial measures that they intend to implement.

In addition, where peat soils are removed from a watercourse, the Environmental Im-pact Assessment regulations to the NEMA also require an EIA to be conducted and an environmental authorisation to be obtained. The environmental authorisation can also stipulate specific rehabilitation and mitiga-tion measures that must be complied with.

Farmer’s rights in respect of the expropriation and rehabilitation of gravel pits for road construction

The rehabilitation of parts of the Georges Valley route may soon start. It is a given that gravel could be needed for road works on certain stretches of the road. AgriSA has supplied

valid and valuable information regarding the authority of SANRAL (the SA National Roads Agency Limited) to source gravel for the cosntruction of roads (including gravel for road

repairs) from nearby farms. Farmers in the area are thus ad-vised to read this explanation of why farmers cannot refuse SANRAL’s rights to source gravel from nearby farms.

Menace on the roadsIt is hoped that the traffi c authorities in the Mopani region — provincial as well as municipal — will be heedful of the menace on our roads and in out streets, called inconsiderate and reckless drivers.

The untimely death of a respected and well-liked traffi c offi cer of the GTM will hopefully open the eyes of traffi c offi -cials in and around Tzaneen.

Motorists in general and the drivers of mini bus taxis seem to think that the laws and traffi c rules don’t apply to peo-ple when they drive in and around Lim-popo’s second biggest town.

The traffi c fl ow in and around Tzaneen has become increasingly hectic in the past number of years and there seems to be a growing att itude that this area has become lawless.

However, it is not a case of lawlesness, but rather a matt er of motorists chal-lenging the traffi c authorities and the rules of the road.

Traffi c lights are only respected when green. Red means you stop and go if there is not oncoming traffi c and amber means you increase speed, to enable you to get through the crossing before the light turns red.

It is time for real action!

The fi rst winner of a special project to honor and reward helpful, friendly and polite police offi cers in the Tzaneen area, launched by the Bulletin, was also

announced on the front page of this particular edition of the newspaper.

A tangled mess: local elections in real jeopardyBy Stephen Grootes

With so much of the political posturing cur-rently on display by the political players, it is sometimes missed that this year’s local govern-ment elections are in grave danger. The Tlokwe case, soon to be argued before the Constitutional Court, could reach a conclusion where judges decide it is not possible to hold a free and fair election in South Africa right now. It may not have seemed so just two weeks ago, when the Independent Electoral Commission submitt ed its papers, but the arguments submitt ed by the independent candidates who started this whole process are seriously strong. This is a Gordian Knot that will require all the wisdom of our Con-stitutional Court judges to untangle.

Two weeks ago, just hours before Mcebisi Jonas started another national convulsion by confi rming what we already knew, the Independent Electoral Commission (IEC) submitt ed papers to the Constitutional Court in the Tlokwe case. Technically, this is the IEC appealing against an Electoral Court judgment. That judgment ruled in favour of a group of independent candi-dates from Tlokwe, who said the IEC had not complied fully with an earlier Consti-tutional Court ruling (in a case referred to as “Kham” aft er Xolile Kham, the candidate in whose name the fi rst case was brought), which specifi ed it must include the ad-dresses of voters on the voters’ roll.

That ruling was careful to talk about peo-ple registering to vote in the future, from the date of the ruling, and said there must be “suffi cient particularity” about the address given by the potential voter, so as to ensure

that that voter was not cheating. The reason these candidates brought all of these cases is that they believe the ANC was trying to move voters around to make sure it won particular wards in Tlokwe by-elections.

In its application the IEC made several major points, but said fi rst that it would not be possible to comply fully with the Kham judgment and hold local government elec-tions this year. It said that it would take until about 2020 to get all of the address in-formation specifi ed, and that it had a duty to ensure that no one lost their right to vote through all of this. At the time, many peo-ple, including this reporter, thought they had a strong case. It’s almost unanswerable: everyone must have the right to vote, and no one should lose it through some legal red-tape palaver.

Well, I can’t remember the last time my view on an issue has changed so quickly.

It’s a simple argument really, summed up in the candidates’ papers like this:

“There is simply no substance of having the right to vote, in the widest sense possi-ble, if such right is to be exercised in rigged elections. Voting becomes a mere formality with a certain outcome.”

There’s more: “It is tantamount to reducing the im-

portant local government elections, due in 2016, and the General Elections, due in 2019, to a formality, where the constitution-ally-enshrined right to participate in free and fair elections should be sacrifi ced at all costs on the altar of the right to vote.”

It’s a prett y simple argument. What’s the point in having the right to vote if the

whole thing is rigged in the fi rst place? Why bother?

One of the major frustrations these candi-dates have, and it comes through in fairly abrupt legal language, is with how the IEC just doesn’t seem to care about the possi-bility of this fraud occurring. The nature of these elections is important in local gov-ernment polls: one of your two votes is for your ward, the geographic space in which you live. The concern these candidates have is that people will be moved into certain wards to ensure they vote for a particular party, and that party will retain the control of certain councils as a result.

There is also a very strong criticism of the lack of eff ort the IEC has made in trying to deal with this issue. The candidates’ att or-neys did a simple thing, they used the in-formation they had available, from various databases, and were able to come up with addresses for a random sample of voters. But the frustration clearly shines through when they point out that “more strikingly, some of the addresses confi rmed the fears of the Independents (the candidates) that these people are not resident in the wards where they are registered”.

They also point out that which every South African knows, to get a cellphone SIM card you have to be able to provide proof of address. And the requirements there are actually stricter than the requirements the Constitutional Court has spelt out for the voters’ roll. They also say there are various maps and tools available, including Google Maps, that can be used to help voters show

On Thursday last week two motor vehicles collided next to Karibu Leisure Resort out-side N’wamitwa. A cyclist was also hit in the incident. The drivers of the vehicles and their passengers were not injured, but the man on the bicycle was slightly injured and taken to Letaba Hospital for treatment. It is alleged that the driver of the light delivery vehicle (photo below) fled after the accident , but he later re-appeared and it is assumed that it could have been due to shock. The cause of the accident is not yet known but police are investigating the accident. — Gittel Baloyi

• Continued from page 6offi cials exactly where they live. This, they say, will make it easy for people who cannot read to explain where they live, and provide the “suffi cient particularity” that the judges have previously asked for.

Time and time again in these papers comes through a perfectly legitimate complaint that the IEC is simply not even bothering to try. They “fi nd it very interesting to note” that through all of the advertising by the Com-mission to encourage people to register to vote, there has been no warning that the Commission “might not have an address for them that could bar them from voting or urging voters to update information with the Commission. One would expect that the Commission, knowing that it faces this pre-dicament, would have done so”.

It is actually amazing, this. The IEC has known about this issue for some time. Sure-ly, as a precaution, it would make it clear to voters that this is an issue, and at least make sure it gets all the information it can from people during its registration weekends.

And that means it’s probably right for the candidates to accuse of the IEC of wanting to “hold the same court and the country at ransom to rectify its mistakes”. The IEC is also accused of trying to “literally ambush the above Honourable Court to succumb to the pressure of off ering a devastating and unrealistic solution for a problem the Com-mission has created for itself in its failure to implement and comply with the relevant provisions of the Electoral Act over a period of several years”.

That’s strong stuff . And it makes the point that it’s only the fault of the IEC that it has not done what it should have done 13 years

ago, when the current voting legislation was brought in.

To go through this argument is, for me at least, to be swayed prett y strongly in the di-rection of the candidates. But there are sever-al massive problems that this case may gener-ate. First, the Constitution is clear, we have to have elections by 16 August this year. (Sure, we don’t all turn into pumpkins the day later, but some will say we might turn into a ba-nana.) Second, the IEC is bound to say that for all of this argument to hold weight, it has to be shown that vote-rigging is going to oc-cur. But that is probably not the point – the point is to make sure that it will not occur, and that the IEC is following the law.

And no doubt the IEC will simply say it has no choice, it doesn’t have the time and the resources, even using Google Maps, to fully comply with the Constitutional Court’s Kham ruling, as interpreted by the Electoral Court.

But the judges will surely be right to feel that they are being held to ransom here, that the IEC is not playing fair. And that it should not be allowed to get away with it. The ques-tion then, as always, is what then? Could they really put the local government polls on hold? Could they go ahead with a fl awed election? Or will they do what South Afri-cans always do, come up with some fudge and hold our collective thumbs?

This is turning out to be a very important case indeed. For our democracy, for our peo-ple, the future may be decided by the way top judges of the land untangle the small case from a small city in the north-west cor-ner of South Africa that over the years grew into a Gordian Knot, all but impossible to solve gently, or wisely.Credit: Stephen Grootes & Daily Maverick

A motorist will appear on a charge of murder in the Tzaneen Magistrate’s Court this morning

(Friday), aft er the hit and run inci-dent on Sunday which claimed the life

of traffi c offi cer Butana Hector Mlondo-bodzi (40) [photo left ].Akani Brendon Mgimeti (22), was ar-

rested on Sunday night on a charge of culpable homicide. During his fi rst court appearance on Tuesday the charge was changed to murder, due to the extreme serious circumstances of the off ence. Ad-ditional charges such as reckless and/or negligent driving and failing to stop aft er an accident were also added. Mgimeti, who stayed in detention, is the son of a former magistrate’s court prosecutor in Tzaneen.

It is alleged that the accused refused to stop aft er being confronted by traffi c of-fi cers moments earlier on Sunday. They

alerted Mlondobodzi, who was on duty on the R36 near Macdonalds, on the approach-ing speedster. Sadly he was knocked down while trying to stop the car.

A memorial service for Mlondobodzi was held at the Nkowankowa Stadium yesterday. The burial will be tomorrow at Mhlaba Cross.

Police are investigating the motive behind the accident, as it is alleged that the accused and the victim are somehow related. They said that no stone will be left unturned on the matt er.

Tzaneen police have arrested 49 people for various criminal activities over the past week, such as assault, assault GBH, violation of a protection order, failure to comply with a maintenance order, att empted murder, murder, shoplift ing, theft , housebreaking and theft , theft out of a vehicle, malicious damage to property, possession of car break-ing implements, armed robbery, escaping, illegal gambling, counterfeit goods, failure to comply with the Animal Identifi cation Act and for failure to comply with the Road Traf-fi c Act.

Six killed in R36 accidentSix people, including three children, were killed and two others injured on Saturday night, when a SUV rolled on the R36 near Mooketsi, ER24 spokesperson Russel Meir-ing announced. ER24 paramedics‚ along with provincial emergency services‚ arrived on the scene to fi nd the SUV lying against a large tree. The vehicle was severely dam-aged, and left trail of debris from the road to the tree.“On inspection‚ paramedics dis-covered numerous bodies lying around the scene that had apparently been ejected from the vehicle”. Three children‚ two girls and a

boy, believed to be aged between 4 and 10‚ and two adults were de-clared dead on the scene. Three

other adults were injured in the ac-cident‚ one of them a woman who

was in a critical condition. “Paramedics treated the patients and provided the criti-cally injured patient with advanced life sup-port interventions. The injured were taken to Kgapane Hospital for treatment”. “Upon arrival at the hospital‚ the critically injured patient succumbed to her injuries‚” Meir-ing added. The cause of the collision is not yet known but local authorities were on the scene to fully investigate the accident.

Vehicle rolls, injuring three

Three people were injured on Friday af-ternoon when the vehicle they travelled in rolled multiple times at Tarentaalrand, according to an ER24 spokesperson. ER24 paramedics and members of the provincial emergency services arrived on the scene and found the light passenger car on its side amongst the bushes on the side of the road. “Paramedics found that all three occupants had sustained only minor injuries. Paramed-ics treated the patients and then they were taken to Letaba Hospital. The cause of the incident is being investigated.

Three escapees rearrested Three of the seven prisoners who escaped from Tzaneen Police holding cells last week

Tuesday morning were re-arrested in various locations. Lt Col Moatshe Ngoepe, spokes-person for the Tzaneen Police Cluster, said: “It is alleged that these prisoners escaped during the routine check in the cells by police offi cers. Huston Mabasa (27) was re-arrested at Westfalia. The other two, Lucky Mashato-la (24), was re-arrested between Tzaneen and Modjadjiskloof on Wednesday and Goodwill Marana Sekhwela (26), was re-arrested in a village outside Tzaneen while in hiding. His arrest followed on a tip-off from members of the community,” Ngoepe said. The search for the remaining escapees continues.

Three killed, one injured by fl ood watersThree people died and one maintained seri-ous injuries when their car got stuck and was later swept away by heavy fl ood waters on Tuesday last week. The incident took place in the early hours of the morning, when four people were travelling in a passenger car between Ga-Kgapane and Mokwakwaila. Three people died instantly and one sus-tained serious injuries. He still being treated in the Ga-Kgapane Hospital. The Limpopo Department of Economic Development, Environmental Aff airs and Tourism is in the fi nal stages of developing an Environ-mental Outlook Report for the Limpopo Province.

The purpose of the 2016 Limpopo Environmental Outlook (LEO) Report is to provide scientifi cally credi-ble, timely, policy-relevant information on the current

state and future prospects of environmental conditions and trends, and the interac-tions with human well-being, to inform sound decisions that aff ect the environment.

Preliminary fi ndings of the LEO Report indicate that there is a general increase in waste within the Province and a rise in issues regarding waste management.

An increase in the number

of general waste sites and percentage of landfi ll sites appear to be positive re-sponses by the Province.

Throughout stakeholder engagement consultations however, waste manage-ment was raised as a critical and increasingly key concern across the Province.

Increasing incidences of pol-lution and the negative im-pacts thereof on human and environmental health and wellbeing require urgent and proactive active responses from government, the private sector and civil society.

The degradation of ecosystem health and pro-

ductivity and the subsequent economic losses will con-tinue unabated if waste man-agement in the Province is not addressed as a matter of top priority.

Key actions needed include the fi nalisation and implemen-tation of Local Municipality In-tegrated Waste Management Plans. In addition, more eff ec-tive monitoring and planning for hazardous waste disposal

is required across the Province. The performance of general formal and informal waste sites also need top priority attention in terms of eff ective monitoring and implementa-tion at the local level.

Lim waits for report

Acclaimed animal rights photojour-nalist, Ms Jo-Anne McArthur from Toronto in Canada, was in South Africa briefl y to meet, interview and photograph inspiring women at the forefront of animal advocacy.

Together with her co-author Prof Keri Cronin, a historian and professor of Sociology and Feminism in Toron-to, they will produce the book “Un-bound Project”. McArthur has and is meeting some two hundred women who are changing animals’ lives for the bett er and Unbound Project will highlight the most inspirational.

Unbound Project brought McAr-thur to Letsitele and to the Vervet Monkey Foundation to interview

and photograph co-director and re-habilitator Ms Josie du Toit. Du Toit is at the forefront of ground break-ing work in terms of rehabilitating vervet monkeys.

Others in South Africa on Mc-Arthur’s list of inspirational wo-men are the Black Mamba anti-poaching team from Balule outside Hoedspruit, Ms Samantha Dewhirst from Care for Animal Rehabilitation and Education (C.A.R.E.) outside Phalaborwa, Ms Cora Bailey from Community Led Animal Welfare (CLAW) and Ms Smaragda Louw from Ban Animal Trading (BAT). Further afi eld McArthur has met with Ms Kadri Taperson, the woman

who started animal rights in Estonia. She still has several more women to meet in Africa, before heading to other parts of the globe for the book.

McArthur studied English and Ge-ography at Ott awa University. One of her courses was printing and this be-came the catalyst for her career as an animal rights photojournalist. For the past fi ft een years McArthur has been involved in investigative work in par-ticular fur farms around the world.

She says, “Most countries see ani-mals as possessions. My work gets people to look and not look away. What the public is usually shown is not what’s happening behind the scenes. These atrocities are happen-

ing because of us, as we don’t see be-yond our noses.“

Ten years of investigative work culminated in the book “We Ani-mals”. It illustrates and investigates animals in the human environment. She provides lessons about human treatment of animals, makes animal industries visible and accountable and widens the human circle of com-passion to include all sentient beings.

She joined Capt Paul Watson’s Sea Shepherd and helped intercept and save fi ve hundred whales from Japa-nese slaughter that year. The sights have aff ected her and she’s gone through two bouts of depression and a diagnosis of PTSD. McArthur says

that she’s had to learn to compart-mentalize in a healthy way.

McArthur takes on commercial work to pay for her global work with animals. She doesn’t hide the fact that her country, Canada, still has the largest seal hunt in the world. Hap-pily she states that Italy, Switzerland and Germany are gett ing into fi ght-ing animal abuse.

The heavy rains leading up to the annual Ebenezer Mile provided the perfect setting for swimmers and spectators alike on the weekend preceding the Easter break. Close on 400 swimmers from across Limpopo and other provinces made the trek to the Moun-tain Yacht Club near Haenertsburg, and braved the icy wa-ters in three separate events.

Originally known for the 1 600 meter swim comparable to that of the internationally popular Midmar Mile, the Ebenezer event has incorporated a longer 3 000 meter swim for the daring and a fun 500 meter race for those eager to experience the thrill of an open water event.

The day was open to all swim-mers, from as young as 13 years old to the aquatic veterans well into their golden years.

This year saw the legendary “Walrus” make his appearance on the banks of the Ebenezer, as he has done every year since the event’s

inception in the early 1990’s. Al-though nobody knows his true iden-tity, this moustache branding legend has never missed a race and in fact, competes in every event on the day

which equates to a total of three miles plus the 3 000 meter event.

The highlight of this year’s event was un-doubtedly the shatter-ing of the 1 600 me-ter record by Abdul Malick Railoun, who finished in a time of 00:19:02 — which was a five second improve-ment on Ockert Ver-meulen’s long stand-ing record. Reino van Wielligh took second in an equally impres-

sive time of 00:19:54, with Brandon Thysse taking third in 00:20:51.

A special entrant, the different-ly-abled swimmer Saskia Schulze also completed the event to add credentials to the notion that any-thing can be achieved, provided you put your mind to it. The main event for ladies between 13 and 30 years of age saw Anel de Vos take the gold in a stunning time of

00:22:04, with Annelize Mentz and Adriana Venter close on her heels with their times of 00:24:14 and 00:24:42 respectively.

This popular occasion is organised by the Rota-ry Club of Haenertsburg and, as a charity event, all proceeds go to local community projects. In addition, other charities

ran food stalls and catered for the big crowd with a selection of deli-cious eats. These groups were the Haenertsburg Care Association,

Tzaneen Rotary Club, Tzaneen Rota-racters and the Mountain Yacht Club.

Kaizer Chiefs (Amakhosi) fans in Nkowankowa met at Mariveni bar lounge on Sunday aft ernoon, in preparation of the vibrant Amakhosi Nkowankowa branch formation, which is expected to be launched in about a month’s time.

Mr Pat Twala said the purpose of the meeting was to check att endance and fi nalise the date of the launch. They will have one more meeting before the launch. “We have received a great turn out and the Kaizer Chiefs Nkowankowa Branch will be launched at a venue to be communicated at a later stage,” he said.

The third round of the Raga Bolo Street Soccer promotion was held over the Easter weekend and the Bulletin’s Joe Dreyer was in attend-ance to capture some of the action moments. The crowds attending this tournament grow every week and it is clear that the street soccer could become very popular. Teams taking part in the tournament come from all over the coun-try. They play in various divisions. The winners of the Limpopo league will have to meet the winners of the Mpumalanga league at the end of April. The winning team will take home R100 000! Teams are associated with lo-cal taverns and the taverns will also share in the prize money. Tomorrow the next round in the Limpopo league will be played at Sheshego.

Die menings, uitsprake, standpunte, verwysings, komplimente, beledigings, humor, ensovoorts, van Oubal is nie noodwendig dié van die Bulletin of die eienaar en personeel van die koerant nie!

Oubal wil al die skoolhoofde wat twee jaar gelede die busse laat omdraai het, die mammies wat inderhaas hulle kinders by die skole gaan soek het, asook die ondersteuners wat voor gegrendelde hekke opgedaag het om ‘n rakbiedag teen Pretoria Boys High te gaan kyk, vriendelik daarop wys dat dit vandag 1 April, Gekkedag, is.

‘Tja, dis ‘n belangrike dag in SA se rakbiegeskiedenis, maar Oubal sal daarby kom, wees geduldig. Twee maande ge-lede het die NZ Rakbie-unie aangekondig dat Kieran Read by Richie McCaw oorneem as AB-kaptein. Ons weet Steve Hansen is hul afrigter sedert 2012 en gaan heel waarskyn-lik oor twee jaar deur Wayne Smith, hulle assistent-afrigter, vervang word, in ‘n weldeurdagte voortsett ingsplan. Oubal vermoed die AB’s het ook ‘n keurkomitee wat deesdae elke Superakbiewedstryd met arendsoë dophou.

SA, aan die anderkant, is sedert Heynecke Meyer in No-vember verlede jaar op sy swaard geval het afrigterloos. Ons het nie meer ‘n keurkomitee nie en Nick Mallett en Brendan Venter het aangedui hulle stel nie belang nie, waarvoor Ou-bal hulle nie verkwalik nie. Die laaste van ons drie kapteins tydens 2015 se rampspoedige WB, Fourie du Preez, het ver-lede week aangekondig hy tree uit internasionale rakbie, so ons is ook kapteinloos (tensy Victor Matfi eld sy soveelste

terugkeer maak!).Maar vandag, 1 April, is die groot dag. Dis die datum wat

SARU aangedui het waarop hulle die nuwe Bokafrigter gaan aankondig. Oubal dink dis ‘n heel gepaste datum. SARU is ‘n organisasie wie se HUB onder verdenking is weens ‘n geldskandaal en van wie hulle hulself onlangs ge-distansiëer het, net om kort daarna ‘n ommekeer te maak en te sê hulle het alle vertroue in hom.

Natuurlik nadat hulle ‘n regsmening gekry het wat hulle daarop gewys het dat hulle arbeidswetgewing sal oortree indien hulle die man afdank, voor ‘n hof ‘n bevinding teen hom gemaak het.

Maar SARU se president, Oregan Hoskens, gaan vandag praat (of so het hulle belowe). Dis nou dieselfde Hoskens wat vise-president van Wêreldrakbie is, en volgens wat Ou-bal verneem het, hoë aspirasies gehad het om die hoof van

dié organisasie te word. “Gehad”, want WR het blyk-baar klaar aangedui dat Bill Beaumont later vanjaar by Bernard Lapasset gaan oorneem.Dit is dus nie vir Oubal vreemd dat Oregan klaar ge-

luide gemaak het dat hy uit rakbie-administrasie gaan uitt ree nie. Oregan het nou soos Tokyo Sexwale, wat as-

pirasies gehad het om by ou Sepp Blatt er by FIFA oor te neem, agtergekom dat wêreldorganisasies hulle nie onder-werp aan die gees van toe-eiening wat hier te lande vaardig is nie. ‘n Man moet wys jy kan ‘n skip stuur, anders word jy oorboord gegooi!

So van toe-eiening gepraat, Oubal gaan maar vir Oregan voorspring en voortydig aankondig dat Allister Coetzee van vandag af die nuwe Bokafrigter is. Wie sy bestuurspan gaan wees, het Oubal geen idee van nie, maar Robbie Fleck het ‘n goeie kans om hulpafrigter te wees, met Jacques Nienaber die verdedigingsafrigter. Verwag dus ‘n Bokspan wat hul-self (nog meer) tot oorwinning gaan probeer verdedig.

Me Andri Prinsloo het sewende geëindig in die ouderdomsgroep vir vroue tussen 14 en 30, met ‘n tyd van 28:11,09. Erno Botha het tweede in die ouderdomsgroep vir mans tussen 1 en 13 met ‘n tyd van 24:41,22 geëindig. Ockert Schoe-man was tiende in die ouderdomsgroep vir mans tussen 1 en 13, met ‘n tyd van 30:45,54. Wernich Schmidt het elfde gekom in die ouderdomsgroep vir mans tussen 1 en 13 met ‘n tyd van 30:47,27.

The Easter weekend did little to dampen the spirits of the four Mbombela-based street soccer teams who faced off in the capital. This was part of the ongoing Smirnoff 1818 Raga Bolo Street Soccer tournament held nationwide. Mbombela falls under the same district as the Polok-wane leg of this exciting tournament. The winners of the Mbombela series will face the winners of the Polokwane league in three week’s time, to determine which team will go on to compete in the semi-fi nals to be held in Gauteng. The ultimate prize of R100  000 seems within reach of the Polokwane teams, as they head the log ta-bles at the start of the third round. Polokwane will host the third day of matches this weekend in Sheshego, in what promises to be an adrenalin fi lled aff air.
