JIEB Eligibility, Registration and EnrolmentThe 2010 JIEB will take place on the 1st, 2nd & 3rd November. It is your responsibility to register with your respective Professional Body for the JIEB and to pay your exam fee. This is not included in the BPP course fees.

JIEB ExaminationsYou are eligible to sit the JIEB examinations if you have either:• Satisfied the requirements of your Recognised

Professional Body (RPB)• Satisfied the requirements of Secretary of State

for Trade and Industry• Satisfied the requirements of the Insolvency

Practitioners Association (IPA)

If you have any doubts about your eligibilty it is recommended that you contact your RPB directly, as only they can authorise you to sit the exams. Telephone the IPA for details of your eligibility on 020 7623 5108. The Insolvency Service at the DTI can be contacted on 0121 698 4000. Application information is also available from the JIEB examinations office, telephone 01908 248 020.

Registration, Enrolment and Exam DatesThe closing date for exam entries will be around the end of September 2010. Please check this date with your Recognised Professional Body. Candidates should submit their application form for the examinations through their professional body, the IPA or the DTI as appropriate. Confirmation and examination details will follow from the JIEB examinations office. The Exam is held at a number of centres throughout the UK.

Your Examination results will be available around the end of February 2011. You will be given an overall result of pass, referred or fail and in relation to individual papers, whether you have passed or have a marginal fail, fail or bad fail. The pass mark for each paper is determined by the JIEB, but is no higher than 50%.

The Joint Insolvency Examinations Board (JIEB) Examinations 2010

Why take JIEB in 2010?There is an increasing recognition of the need to have people with specialist knowledge and experience of handling insolvencies, and increased value in having staff with an understanding of insolvency procedure and practices.

In order to take the next step towards becoming an insolvency practitioner, you will need to pass the JIEB examinations.

You can apply to sit these examinations if you are a member of a Recognised Professional Body (RPB), or have satisfied the requirements of the Insolvency Practitioners Association (IPA), or Secretary of State for Trade and Industry.

The ExamThe JIEB are a set of exams with a practical emphasis, and are held once each year in November. Candidates must sit the examination through the relevant RPB or sponsoring body.

The examination consists of three papers;• Paper 1 - Liquidations• Paper 2 - Administrations, CVAs and

Receiverships• Paper 3 - Personal Insolvency

Each paper is three and a half hours in length and consists of a mixture of written and numerical questions on practical insolvency issues. The examination is open book and candidates in 2010 will need to bring to the final examination an unmarked copy of Butterworths Insolvency Law Handbook.

The overall standard is equivalent to the final qualifying examinations of recognised accountancy and legal bodies. You must pass all three papers to complete the qualification. You may attempt any number of papers at their first attempt, however any candidates that sit and retain a pass in any one paper must then pass the remaining two at the same session.

All papers must be passed within a period of 5 years of your first attempt.

It is now possible to take just the Personal Insolvency Paper to apply for a voluntary arrangement only licence. Details of this can be found in this brochure (see page 5).

The component courses of the Full link Programme are:

Introduction and Liquidations Course (3 days)This course will give you a full introduction to Liquidations including procedures and directors’ liability, as well as guidance on prioritising your work, study skills and exam technique.

Administrations, CVAs and Receiverships Course (3 days)This course covers Administration Orders, CVAs and Receiverships and the various procedures involved.

Personal Insolvency Course (3 days)Covers an introduction to Personal Insolvency, including both Bankruptcy and Individual Voluntary Arrangements.

Pre-revision Course (3 days)This course covers the more difficult topics for all 3 papers, concentrating on further exam techniques and study focus needed for each of the papers.

Link Exams and Home Study Mock ExamComprises nine mid-term practice examinations for you to complete at home and then send to us for marking and assessment. A further three mock exams are provided for completion prior to the Final Revision Course. Please note this is not the same as the final mock exam days.

Final Revision Course (9 days)An intensive 9-day final programme of lectures, tests and question practice designed to get you up to speed for the real exam. This course covers all of the main areas examined in this paper, and is packed with essential guidance on exam technique. The 9-day course is split into 3-day modules on Liquidations, Administrations and Personal Insolvency.

Final Mock Exam Days (3 days)These mock exam days will provide invaluable exam practice. Scheduled in the build up to the Final Examination, this gives candidates the opportunity to practice a freshly written exam style paper under exam conditions before working through their answers with their tutor during the afternoon session. There is one mock exam for each paper.

Distance Learning CourseOur distance learning programme can be used in conjunction with our classroom courses, or on a stand-alone self-study basis. You will receive clear and comprehensive sets of study notes (3), a work programme, question banks (3), audio presentations (3) and sets of passcards (3), as well as links exams (9) and mock exams (3) all to be completed at home.The distance learning course does not include any teaching days.

Candidates studying by distance learning who wish to attend individual tutorial days can book onto these at a set rate of £200 + VAT per day. Applications for individual tutorial days should be sent in writing, along with a completed application form.

Full Link course summaryOur link course, recommended for all first time candidates, comprises 24 days of tuition, linked together by direct home study and link examinations. You will receive a full material package, together with tutorial support for queries and ongoing help with your studies. Please see table above for course date options.

JIEB Accounts Course (3 days)This optional course is designed to help those unfamiliar with the accounts element of the syllabus, who need to develop skill and confidence in approaching the numerical questions in the JIEB exams.

In 2010 the 3 day accounts course will comprise of one day on each JIEB paper.Day 1: Liquidations• Statement of Affairs• Deficiency Accounts• Receipts and Payments Accounts• Treatment of costs in Liquidations• SIP 9Day 2: Administrations, CVAs & Receiverships• Receipts and Payment Accounts• SIP 7• Estimated Outcome Statements• Projected Profit & Loss

• Cashflow Statements• Balance SheetsDay 3: Personal Insolvency• The comparative estimated outcome statement (bankruptcy versus IVAs)• Statements of Affairs in bankruptcy• Calculating a dividend• Calculating the available equity in the bankrupts home• IVAs and cashflow forecasts.

You can attend the full 3 day course, or can book onto the individual days which relate to the papers you are attempting.

CostThis course costs £600 + VAT (or £200 per individual day). Course price includes all study material.

Section 389A of the Insolvency Act 1986 (inserted by the Insolvency Act 2000 on the 1st January 2003) allows the Secretary of State to recognise bodies to authorise their members to act as office-holders in Voluntary Arrangements.

Members of such bodies who meet acceptable requirements, as to education, practical experience and training can act as a nominee and supervisor taking appointments as Voluntary Arrangement Practitioners.

The Joint Insolvency Examination Board have recently agreed to allow candidates to sit just the personal insolvency examination at the November 2010 sitting. (Previously first-time candidates have been required to sit a minimum of two papers). At the time of writing it

is expected that successful candidates, meeting the other criteria of their RPBs, will be able to apply for IVA-only licenses but as yet, the date for this has not been confirmed.

S.389A has only recently been brought into force and candidates will need to get in touch with their RPBs in relation to the obtaining of a license.

To meet the needs of candidates wishing to take the JIEB personal insolvency paper BPP have a number of programmes leading to the November 2010 exam.

JIEB Accounts course in LondonAs we will be running this course twice in London, we will be running slightly different versions of this course.

IntroductionThis course will be tuition based and will be ideal for solicitors and those not fully confident in the basic areas of insolvency accounts.This class will move at a slower pace.

IntermediateThis course will be an intermediate class, where an understanding of the basics will be assumed. This course will be more question based and will move at a quicker pace. This course is ideal for accounts or those with a firm understanding of accountancy.

Do I need to have registered for the exams to attend the courses?No, you can book onto and attend BPP courses at any time without signing up for the exams.

Does registering for a BPP course automatically mean I am registered for the exam?No, registering for courses and signing up for the exam are separate. To register for the real exam you must contact your recognised professional body.

Can I attend individual days from the link course?You can book onto any individual days or courses from the link course at a daily rate of £200 + VAT. To do this, fill in the booking form at the back of this brochure, and tick the days you would like to attend, along with a cover note that these are the only courses that you require.

Do I have to attend all of my courses at the same centre?No, BPP will offer you as much flexibility with your studies as possible. If you cannot attend a course, and wish to swap to an alternative, we will do this for you free of charge, providing there are spaces on the course you wish to attend.

Is there a cut-off date to sign up for a BPP courses?You can book onto a BPP course at any time. If you wish to join the link programme after it has commenced, we will reduce the charge by the days you have missed. You can also book onto a Distance Learning Course at any time.

When is the cut-off point for new law being examined?All law passed up to 30th April 2010 will be examinable in the November 2010 sitting. Should any new examinable law be passed after the BPP materials have been published, we will inform all candidates.

How long does it take to study for the JIEB exam?This depends on the individual and the number of papers which you plan to attempt. Some candidates have more experience in certain fields than others and require less study time. The more time you spend preparing and working through the material the more chance of success you will have. Please contact us if you require further information.

I have started the course, but due to work commitments I will not be ready to sit the exams this year, what are my options?We have a very flexible policy regarding the deferral and cancellation of our courses. Please see our Terms and Conditions for further details regarding cancellation, or contact us for further details about deferring.

Can I use my BPP Membership for JIEB courses?BPP Membership discounts are not applicable to JIEB examination training, however we offer a vast range of Professional Development courses, where you can receive up to a 50% discount. First, decide how many papers you want to attend. The majority of candidates still take all 3 papers at the same sitting, however increasingly candidates will take 1 or 2 papers at the first attempt.

This decision will often depend on your experience, and the time you have available to study. We are happy to advise you on this, should you need any help.

Secondly, decide which papers you want to attend. If this is not your first attempt at the Joint Board, or you are attempting all 3, then this will be an easy decision, but if you are approaching the exams for the first time, there are important things to think about…

Do you intend to take the whole JIEB qualification, or are you only interested in the Personal Insolvency paper? Would you prefer to take 2 papers this year, and if so, which ones…

Thirdly, How do you want to study? Many candidates will take the full link programme for each of the papers they attempt, as this will give them the greatest level of preparation for the examinations, however, if your time is limited, or you are self-funding, then distance learning, or a selection of courses may be an option.

1. Payment Terms

1.1 Full payment or authorisation to invoice an employer, must accompany the application form.

1.2 Full payment or authorisation to invoice an employer is required when any Insolvency Study Materials are ordered and prior to any study materials being despatched.

1.3 Full payment or authorisation to invoice an employer for any online study tool is required when ordered and prior to any log on details being supplied.

1.4 BPP Professional Education Ltd acts as agent for BPP Learning Media Ltd in collecting payments for any Insolvency Study materials supplied under this agreement.

1.5 Where BPP Professional Education Ltd has received authorisation to invoice the employer the following payment terms apply: - Full payment is due within 30 days from the date of the invoice - Payment is due immediately if booking is made less than 30 days before the course start date - If BPP Professional Education Ltd fails to receive full payment of the invoice by the course start date or date of the Test the candidate may be refused entry to the course/Test - BPP Professional Education Ltd and BPP Learning Media Ltd reserve the right to charge late payment interest on any outstanding invoices, at a rate of 8% above the Bank of England base rate - BPP Professional Education Ltd and BPP Learning Media Ltd reserve the right to

recover any reasonable debt collection costs in connection with this agreement - The employer is liable for all unpaid invoices

2. Insolvency Study materials

2.1 All study materials, including but not limited to Distance Learning Materials, CD Rom, i-Learn CD Rom, i-Pass CD Rom, Audio Success CD, Revision/Assessment/Tool Kit, MCQ Cards, Passcards, Question Banks, Review Exercises, Mock Exams (papers and suggested solutions), Online Tests, Online Tutorials, Online Downloads and Study Texts are supplied to the customer by BPP Learning Media Ltd.

2.2 Unless Clause 3.2 applies BPP Learning Media Ltd will despatch Insolvency Study materials to the candidate on receipt of full payment or authorisation to invoice an employer in accordance with the following delivery guidelines. - UK: delivery within approximately 5-7 working days of despatch; - Europe: delivery within approximately 6-8 working days of despatch; and - Rest of the world: delivery within approximately 10-12 working days of

despatch.

2.3 BPP Learning Media Ltd will refund the cost of any Insolvency Study Materials (less postage and packaging) if returned by the candidate to BPP Learning Media Ltd, 17 Fairway Drive, Greenford, Middlesex, UB6 8PW within 14 days of receipt in a re- saleable condition. Proof of postage must be obtained by the candidate and produced in the event of any query.

2.4 BPP Professional Education Ltd must be notified of any queries, complaints or short deliveries within 14 days of receipt of Insolvency Study Materials.

3. Classroom Courses

3.1 Candidates must bring any relevant course joining instructions to all sessions of the Insolvency Course of Study. Failure to bring joining instructions may lead to candidates being refused entry to the course.

3.2 BPP Professional Education Ltd reserves the right to cancel, reschedule, or change the location of a course, if in the opinion of BPP Professional Education Ltd, such an action is necessary. BPP Professional Education Ltd will notify the candidate as soon as the change is made. In such circumstances, the candidate has the option to reschedule the course, apply the fees to another course, or to receive a refund or credit note for the course fees paid.

3.3 Subject to availability, provided full payment has been received, and BPP Professional Education Ltd is informed at least 1 working day prior to the course date, it may be possible to transfer to an alternative course date. Such transfer may also give rise to an additional charge by BPP Learning Media Ltd for replacement Insolvency Study Materials.

3.4 Under no circumstances are Insolvency Courses of Study or Insolvency Study materials transferable between candidates.

3.5 All cancellations and deferrals must be made in writing.

3.6 Provided that at least 1 days’ notice of a cancellation or deferral of a Course is provided to BPP Professional Education Ltd, a refund will be payable (less a deduction for the Insolvency Examination Study Manual and a cancellation fee of £100).

4. Distance Learning/Home Study Courses

4.1 Distance learning customers can upgrade to an appropriate classroom course and will be invoiced for the balance of the cost over and above the price of the distance learning course using the classroom course prices in force at the time of upgrade. There may also be an additional charge for replacement study materials.

5. Intellectual Property

5.1 BPP Learning Media Ltd grants the candidate a non-transferable, non-exclusive licence to use its products (including information, training material content, software and data) under the terms of this agreement.

5.2 This licence terminates upon termination of this agreement for whatever reason.

5.3 The candidate warrants that they shall only use the products of BPP Learning Media Ltd for their own educational purposes and shall not, without prior written consent, copy, make available, retransmit, reproduce, sell, disseminate, licence, distribute, publish, broadcast or otherwise circulate the products of BPP Learning Media Ltd (or any part of them) to any person other than in accordance with this agreement.

5.4 The candidate shall fully indemnify BPP Learning Media Ltd in respect of any infringement of any intellectual property rights arising as a result of use of their products in breach of this agreement.

6. Change of address or other contact details

6.1 BPP Professional Education Ltd must be notified in writing of any change in a candidate’s contact details, including the email address specified on the candidate’s application form.

7. Security

7.1 Personal possessions are the sole responsibility of the candidate and BPP Professional Education Ltd accepts no responsibility for anything that is lost or stolen from a venue. Customers are advised to keep valuables with them at all times.

8. Notices

8.1 Any notices required to be served by BPP Professional Education Ltd or BPP Learning Media Ltd under this agreement will be deemed properly served if sent via prepaid postage to the postal address, or emailed to the email address notified by the candidate, at BPP Professional Education Ltd’s discretion.

9. Limitation of Liability

9.1 The liability of BPP Professional Education Ltd and BPP Learning Media Ltd for direct losses arising out of their negligence (other than in respect of liability for death or personal injury), breach of contract or any other cause of action arising out of or in connection with this agreement shall be limited to the cash receipts from the candidate (or employer) for the Insolvency Course of Study or Insolvency Study Materials.

9.2 BPP Professional Education Ltd and BPP Learning Media Ltd shall not be liable for any indirect or consequential loss whether arising from negligence, breach of contract or otherwise.

10. Warranty

10.1 BPP Learning Media Ltd warrants that Insolvency Study Materials will be of satisfactory quality but does not warrant that they will be error free.

10.2 BPP Professional Education Ltd warrants that it will perform any services under this agreement with reasonable skill and care.

10.3 These warranties are provided in lieu of all other warranties express or implied which are hereby excluded to the fullest extent permitted by law.

11. Data Protection

11.1 Candidates agree that, in relation to information held from time to time, BPP Professional Education Ltd and BPP Learning Media Ltd may: - Use the information to perform their obligations and enforce rights under this agreement. - Use the information to inform customers about courses, products or services

which may be of interest to them. - Share the information with BPP group companies to inform the candidate about

other products or services which may be of interest to them. - Use the information to inform candidates of feedback and exam results. - Communicate with the candidate’s employer regarding their progress, results

and attendance.

11.2 Candidates have the right to receive details of the personal information held by BPP Professional Education Ltd or BPP Learning Media Ltd. A fee of £20 will be payable.

11.3 In the event that candidates do not wish to receive correspondence from BPP Professional Education Ltd or BPP Learning Media Ltd, a written request should be sent to the registered office.

12. Validity

12.1 If any provision of this agreement is held to be invalid or unenforceable by any tribunal of competent jurisdiction, the remaining provisions shall not be affected and shall be carried out as closely as possible according to the original intent.

13. Jurisdiction

13.1 The parties to this agreement irrevocably submit to the exclusive jurisdiction of the English Courts for the determination of disputes arising under this agreement.

These terms and conditions and the application form comprise the agreement pursuant to which BPP Professional Education Ltd provides Insolvency Courses of Study and Tests and BPP Learning Media Ltd supplies Insolvency Study materials to the candidate.
