The Markets Service The Markets Service manages a number of indoor and outdoor markets across the district, attracting many visitors each year and selling everything from Mediterranean foods to jewellery, fresh food to children's shoes. Our venues offer a strong local customer base; however, we continually seek to improve our product when stalls occasionally become available and encourage applications that offer new and interesting uses not currently available in the Market.

Key Selection Criteria The broad overarching framework that the Markets Service follows when considering an application to take up a vacant stall(s), in no particular order of priority, are summarised below: • Proposals for the design of the trading unit and an explanation of how it will be funded • Complete product / service portfolio containing a well defined and rationalised product / service range • Assessment of the expertise of business in the chosen area demonstrating skills and experience of product / service range • Clear customer policy that shows how the business will deliver excellent customer service dealing with complaints returns and faulty goods, etc • Credit worthiness and payment history where known All applications will be assessed on the above criteria and the applicant scoring the highest results using the scoring criteria overleaf will be considered further. Therefore, it is important that you provide as much detail as possible when completing the application form.

TIMESCALES Assessment of applicants takes approximately one month from the closing date for the application. All applications will be notified of the outcome of their application and unsuccessful applicants will be entered onto the mailing list if so desired. The applicant that has been short listed must attend an interview and provide stock samples to the lettings panel. The lettings panel will normally consist of the Markets Manager, the Business Support Officer and another representative of the Markets Service which may be appointed by the Markets Manager from time to time. Should the applicant be successful at the interview stage then the Markets Service will write to the applicant offering the opportunity to take a lease of a vacant stall(s) and provide and explain the terms and conditions of letting for further consideration by the applicant. The Letting will be subject to the successful applicant entering into a formal legal agreement and the applicant will be responsible for the payment of all legal costs attributed to the subsequent letting.

Location The premises currently available are situated within the Halifax Borough Market. The location of the premises is shown on the attached plan.

Accommodation The shop unit comprises 195 square feet or thereabouts, and is currently available for immediate occupation.

Rating The rating multiplier for the financial year 2016/2017 is £0.497 and the rateable value is £4150. However this maybe subject to small business rate relief.

Service Charge Annual service charge is £1809.60 per annum (£34.80 per week) and an additional charge of £101.40 per annum (£1.95 per week) is payable for membership of the tenants association.

Terms of Lease 1. The rental will be collected by direct debit, where applicable or weekly on Wednesdays

(which may incur an additional charge).

2. The service charge will be collected weekly with the rent.

3. Business rates are paid directly by the tenants.

4. The service charge is reviewed annually on 1st January. 5. Should the successful applicant’s offer fall below the base rental of the market then the

base rent will be introduced and will be subject to the normal rent negotiations undertaken within the market hall.

6. The shop must be kept open and stocked for trading during market trading hours; the

successful applicant will be issued with all rules and regulations appertaining to the operation of the market applied for.

7. The successful offeror will be required to enter into the Council’s standard form of

agreement, which is available on request.

8. Any alteration to the shop will have to be carried out to the satisfaction of Calderdale MBC and the style and design agreed prior to commencement.

9. A six month notice period will be required for termination within the first five year

period.

Offer Procedure Applicants are asked to make their offer by completing the enclosed offer form in the following way:

1. Complete all personal details and required information from Sections A through to F. Section G is optional.

2. Submit an annual tendered rent payable for the unit and/or 3. Payment of a lump sum at the commencement of the agreement.

Traders selling any type of clothing and selected other goods such as mobile

phones, greeting Cards, bags and leather goods need not apply. The Council will not accept any offers below the current levels of £4582.50 per annum. The service charge and rates are payable in addition to the rent. The offer form should be submitted using the address label included in these particulars. The envelope shall not bear any name or mark indicating the sender. If you intend using the services of an independent delivery service (such as the Royal Mail or similar company) for the delivery of your offer by the return date, you should ensure that they do not affix anything to the offer envelope which can identify you as the sender of the documents otherwise your offer will be invalidated and will not be considered.

Viewings The property can be viewed by contacting the Markets Office, Albion Street, Halifax during the opening hours of the market i.e. 9am to 5pm on Monday to Saturday, telephone 01422 393583.

Mailing List Due to the high number of enquiries received to send out details of Market properties via our mailing list service, details will only be kept on the list for three months. If you wish to be kept on the mailing list for a further three months after your initial enquiry, please re submit your details to the markets office.
