FOREWORD

Democracy is the crucial foundation on which the magnificent

edifice of our modern Indian society is conceived and engineered by

the founding fathers of our Nation and free and fair elections, based

on universal adult franchise, lies at the very heart of this splendid

conception. The Election Commission of India, mandated and empowered by the

Constitution, has laudably and outstandingly, ensured the progressive realization of this

glorious vision through its outstanding direction, superlative control and sterling

superintendence of successive elections to the Parliament and State Legislatures, always

setting ever-higher standards of excellence, which are globally acknowledged as

international benchmarks in election management.

In view of the burgeoning complexities of our modern times, especially the

explosion of the electronic audio-visual media and the all-pervasive penetration of the

world wide web (internet) and their near ubiquitous and myriad influences on our daily

existence, it is, but, natural, to comprehend that the election process itself cannot remain

aloof from its inexorable sway. And ,therein, lies the imperative of necessary checks and

effective monitoring of the emerging technologies and advances in mass communication

and social media platforms in order to ensure that the purity of the electoral process is not

compromised in manner whatsoever and the foundations of our democratic edifice remain

strong and robust.

Towards this worthy end, the Election Commission of India has foresightedly

initiated the concept of Media Certification and Monitoring Committee (MCMC), in a

hierarchical structure, entrusted with the task of not just pre-certification of the election-

related material to be projected on the electronic media, but more importantly, to serve as

an effective and vigilant systemic mechanism to monitor the various print and electronic

media for any publication/broadcast of material repugnant to the Model Code of Conduct

or violative of the extant election laws. The MCMC is also tasked with the onerous

responsibility of tackling the pernicious menace of 'Paid News', which, if not stymied

forcefully, portends to corrode the vitals of our electoral systems.

Fully realizing the vital significance and imminent relevance of this

sagacious initiative from the Election Commission of India, the South-West District

Election Office undertook the task of planning, establishing, executing and monitoring the

functioning of the MCMC in the right earnest, in order to comply with each and every

direction of the Commission in true letter and spirit. Since, this is a novel and incipient

concept, there would, understandably, be a scope of many future improvements, but I am

quite satisfied to record our sincerity of effort, clarity of purpose and firm conviction in our

abilities and initiatives in giving a concrete and robust shape to the MCMC, which is

functioning round-the-clock and monitoring a slew of cable TV and Satellite Channels,

radio broadcasts and FM transmissions, besides print media and social media platforms on

the internet.

A word of appreciation is in order for the sterling efforts of Shri Prince

Dhawan, IAS (Probationer), who as Nodal Officer MCMC etched the contours of this

virtually uncharted territory and formulated an implementable strategy for operationalizing

the MCMC. I would also fervently acknowledge the excellent contributions of Shri

Subhash Gupta, SDM (Elections) South-West, Shri Navil Kapur, Ex-Member Secretary,

PREFACE

The Media Certification and Monitoring Committee (MCMC) is one of the

recent initiatives of the Election Commission of India. Given the rise of the menace of paid

news and spread and reach of the audio-visual media as well as the print media, the

MCMC has come to occupy an important place in the electoral process of our country.

Since, this committee is still in its infancy as far as the electoral process goes, best

practices in its functioning are yet to be evolved.

During the Delhi Legislative Elections-2013, we, in the South-West District

of NCT of Delhi, under the dynamic and visionary leadership of our District Magistrate

and District Election Officer Sh. Nikhil Kumar, IAS have tried to establish a standard for

running the MCMC professionally. Thus, the MCMC of District South-West runs 24x7 in

three shifts, with constant monitoring of TV channels, radio channels, print media, social

media as well as complaints from aware citizens. This has been established by organizing

the manpower into multiple shifts and assigning specific channels/newspapers/websites to

each individual to monitor. We have also compiled an exhaustive rate-list of

advertisements in these media and have evolved a clear procedure to certify advertisements

of candidates and book their expenditures accordingly.

This booklet details the nuances of the functioning of MCMC, District South-

West and is brought out in the hope that these would be widely adopted and improved

upon.

1. SYNOPSIS OF THE BEST PRACTICES OF MCMC CELL OF DISTRICT

SOUTH-WEST, NCT OF DELHI, KAPASHERA.

BACKGROUND

In compliance of the Election Commission guidelines a Media Certification and

Monitoring Committee (MCMC) is to be setup in each district and in compliance

thereof the Office of the District Magistrate/DC & District Election Officer (SW) has

setup MCMC cell in the DEO Office of District South-West, Kapashera. The MCMC

cell will be formed in each district with the following members:

(a) DEO/RO (of Parliamentary Constituency)

(b) ARO (not below SDM)

(c) Central Govt. I&B Ministry official (if any in the district)

(d) Independent Citizen/ Journalist as may be recommended by PCI

(e) DPRO/District Information Officer/equivalent – Member Secretary

The MCMC cell of District South-West Delhi has been constituted as per the prescribed

guidelines of the Election Commission of India.

The cell was envisaged as a media-monitoring unit, which would undertake its

activities of watching the TV and listening to the FM radio on 24x7 basis. In view of its

continuous nature of monitoring, it was considered appropriate to run the MCMC cell

round the clock in three shifts of 6.00 am to 2.00 pm from 2.00 pm to 10.00 pm, and from

10.00 pm to 6.00 am. The staff has been deployed in three shifts to ensure that the

monitoring activities continue without any break on a continuous basis. The office is

concurrently running three other cells as well on 24x7 pattern and the personnel deputed in

these cells are assigned the duty to take the attendance of the other cell so that an automatic

cross check of attendance happens and everyone’s presence in the shifts is ensured.

The Media Certification and Monitoring Committee (MCMC) is headed by the

DEO as its Chairperson. The MCMC has been set-up by the Nodal Officer in-charge who

has seen to it that the Cell is operationalized with the basic infrastructure for monitoring

TV and FM radio. The setting up of Computers with inter-net connection and other office

equipment to enable the MCMC to run efficiently has been accomplished under the

supervision and personal care of the Nodal Officer in-charge. The Nodal Officer has also

ensured that technical personnel are deployed to carry out constant maintenance of all the

equipment on a regular basis. The Nodal Officer is also the link between the Chairperson

of the MCMC and the Member Secretary deputed in the MCMC. Member Secretary of the

MCMC actively micro manages the daily activities under the cell. The Member Secretary

of the MCMC builds up the cases for permission for certification of political

advertisements and all correspondence required therein. The day-to-day administration

and management of the cell is delegated to the Member Secretary of the MCMC who

endeavors to make the MCMC run smoothly and seamlessly and provides the daily report

to the office of DEO.

2. SETTING- UP OF THE MCMC CELL

The MCMC cell of District South-West Delhi has been set-up in the office of

the DC Kapashera. The cell has been set-up in a dedicated room meant for this purpose.

The cell has been equipped with three LCD Television sets with two sets having TATA

SKY recordable Set Top Boxes, which have the capacity to record two programmes on

each TV at a time.

The other TV besides these two has a cable connection, which provides

transmission of local cable channels operated at the MSO level that are not available on the

DTH platform. This TV set is also equipped with recording facility.

THE CELL HAS A RADIO WITH RECORDING FACILITY

The cell has a FM radio with recording facility.

The cell gets on a daily basis leading national newspapers both in English and

Hindi. The cell has basic office infrastructure comprising computers, printers and

photocopier machine to handle office work. The desktop is having a broadband connection

to enable browsing of Election Commission directions and other news, as also to watch the

social media sites like Facebook and Twitter etc. The cell is running in three shifts of 6.00

am to 2.00 pm, from 2.00 pm to 10.00 pm and from 10.00 pm to 6.00 am.

3. MONITORING OF TV CHANNELS

The cell has been equipped with three LCD Television sets with two sets having

TATA SKY recordable Set Top Boxes, which have the capacity to record two programmes

on each TV at a time. The other TV besides these two has a cable connection, which also

has the facility of recording its content as well. The staff deputed in the cell monitors the

news channels in half hour timeslots and 5 channels are recorded at a time.

The monitoring is done on a continuous basis across three shifts of 6.00 am to 2.00

pm, from 2.00 pm to 10.00 pm and from 10.00 pm to 6.00 am. A register is being

maintained to keep track of the channels being watched and recorded the name and number

of channels is specifically assigned to each individual.

The main focus is to monitor any suspected paid news instances, as also to monitor

any news of the Delhi South-West region.

4. MONITORING OF FM RADIO CHANNELS

The cell has a FM radio with recording facility. A register is being maintained to

keep track of the FM channels being heard and recorded the name and number of channels

are specifically entered in the register maintained and two people are assigned to listen to

each FM channel for 30 minute slots.

The main focus is to monitor the radio jingles of the political parties being

transmitted on the FM channels and record them so as to take appropriate steps to ascertain

their certification and other expenditure details.

5. MONITORING OF DAILY NEWSPAPERS

The cell gets on a daily basis leading national newspapers both in English and Hindi.

The staff in the cell browses the newspapers and makes a file with cuttings of news related

to the assembly elections Delhi 2013.

The specific focus of the exercise is to identify any suspected 'Paid News' instance

as also to monitor any news of the District South-West region. The cuttings after being

made are submitted in the office of the DEO each day. A file of the prominent cuttings

from the newspapers is made on a daily basis for perusal.

6. INTERNET CONNECTIVITY AND DEDICATED TELEPHONE LINE

The cell has been equipped with Internet connectivity that enables the cell to keep

track of the on-line news. It also helps in browsing the Election Commission site for any

directions or instructions that require to be taken note of or to be acted upon. The Internet

connection also helps in tracking the social media sites like Face book and Twitter.

The dedicated telephone line to the cell provides it access to the officers and any

complaints etc. are attended promptly. The telephone also helps in administrative

management and staff monitoring activities.

7. CERTIFICATION PROCESS

The cell also received a proposal from a sitting MLA, who submitted a CD along

with the request to run the small clipping on local cable TV. The proposal was submitted as

per the prescribed format for the application and it was examined as per the extant

guidelines of the EC. The expenditure was analyzed as per the prescribed rates of DAVP

and Rate List of District South West (Annexure I & II). The proposal was examined in the

light of the Rate Lists available and the expenditure admitted by the applicant was

compared with the possible expenditure incurred as per the analysis of the prevailing rates

by the Committee and the rate so determined was brought to the notice of the applicant.

Thereafter, the video clip submitted by the applicant was examined and since the applicant

was advocating the cause of a political party he was accorded permission subject to certain

conditions. The expenditure was determined and the applicant was informed about it and

its method of computation. The applicant was, thereafter, given permission (Annexure III)

to run the video clip on local cable network in his local area only subject to the condition

that the expenditure would be booked in the Party’s account.

8. COMPLIANCE OF ELECTION COMMISSION GUIDELINES

The MCMC cell of District South-West Delhi has also been monitoring the

orders/instructions of the EC in this regard Election Commission’s circular dated 23-10-

2013 (Annexure IV) was taken note of, wherein, the Commission has reiterated their order

dated 21/11/2008 where it was directed that advertisements of political nature on radio

channels during the period of operation of Model Code of Conduct should be required to

be certified in the same manner as in the case of advertisements on TV channels/Cable TV

networks. In this regard radio jingles noticed by the MCMC cell with respect to certain

political parties were identified and the Media In-charges of those parties were requested to

provide the MCMC cell with details of certification and expenditure etc. (Annexure – V)

9. SUBMISSION OF DAILY REPORT

The Member secretary, MCMC Cell takes stock of the daily activities of the Cell.

The various activities undertaken by the cell with respect to the maintenance of the

logbook, the register for TV viewing & FM radio are checked the file of the clippings of

news papers is also gone through to determine whether any pertinent fact needs to be

brought into the daily report. At the end of the day the daily report as prescribed by the ECI

is submitted in the office of the DEO. This report is submitted on each day without fail on

all seven days of the week (Annexure – VI).

10. ADMINISTRATIVE MANAGEMENT OF THE MCMC CELL

To ensure constant and continuous monitoring of TV & FM Channels the MCMC

Cell runs on a 24X 7 pattern & to do this the MCMC Cell runs in three shifts of 6.00 am to

2.00 pm, from 2.00 pm to 10.00 pm and from 10.00 pm to 6.00 am. The Cell with its

limited staff strength has managed to run the shifts successfully.

A logbook is maintained continuously to ensure that the monitoring activity is not left

unattended at any given point of time.

The cell has a Logbook which is carefully maintained

The logbook is an important tool to monitor the activities in each shift and it

also helps in keeping an account of the various activities and recording being made in the

cell. It also helps in keeping a check and regulating the breaks that the staff takes

periodically as each short break is logged and there is someone attending to the cell in

those breaks as well.
