RESOLUTION TO REPLACE THE COOLING TOWERS AND PERFORM RELATED WORK AT

BOROUGH OF MANHATTAN COMMUNITY COLLEGE November 25, 2019

WHEREAS, The City University Construction Fund (“CUCF”) is responsible for developing, planning and designing the capital facilities for the City University of New York (the “University”); and

WHEREAS, The main BMCC building, located at 199 Chambers Street, houses all of the college's labs, data servers, media center, security and phone systems for all of BMCC, and the majority of the college's classrooms, computer centers, faculty and administrative offices; and WHEREAS, The Cooling Towers at the Borough of Manhattan Community College’s main building (BMCC) are at the end of their useful life, are in poor condition and need replacement (the “BMCC Cooling Towers Project”); and

WHEREAS, Funding has been appropriated to CUCF for the BMCC Cooling Towers Project with fifty (50%) of the funding being provided by the City and fifty (50%) of the funding being provided by the State, for an amount not to exceed $24,000,000.

NOW, THEREFORE, BE IT:

RESOLVED, That the University’s Board of Trustees request CUCF to provide funding for the BMCC Cooling Towers Project in an amount not to exceed $24,000,000.

EXPLANATION: BMCC’s existing 3,000 ton and 350 ton cooling towers and their associated piping, valves and dunnage are over 30 years old and have reached the end of their useful life. These cooling towers are key components of the existing HVAC system that provides cooling to the entire 780,000 square foot main campus building, located at 199 Chambers Street. The main building houses all of the college's labs, and the majority of the college's classrooms, computer centers, faculty and administrative offices. This building also contains the data servers, media center, security and phone systems serving this and other buildings at BMCC. The scope of work will include the installation of new cooling towers, piping, valves, and dunnage. The design will provide a safe, easily maintained and code-compliant heat rejection system for the two new chillers recently installed in the building. This project will be built using a DASNY Energy Performance Contractor for the design and construction management services in consultation with CUNY and the college. Construction is scheduled to begin April 2020 and end November 2020.

A. APPROVAL OF THE MINUTES OF THE MEETING OF APRIL 15, 2019. Moved by

Committee Vice Chair Wilkin and seconded by Trustee Charles Shorter, the minutes were approved as submitted. Prof. Kathleen Barker abstained.

B. POLICY CALENDAR

1. City University of New York – Adoption of Fiscal Year 2019-2020 Capital Budget.

Committee Vice Chair Wilkin requested the Committee’s approval to adopt the University’s Capital Budget, consisting of $444.5 million in new State capital appropriations; $2.66 billion in State capital re-appropriations, and $232.8 million in the City Fiscal Years 2019/20 capital budget, for projects authorized by the City University Construction Fund to address critical maintenance, infrastructure, and programmatic initiatives in support of the University’s mission. Vice Chancellor Judy Bergtraum presented the Capital Spending Plan and answered questions about the Capital Budget, including anticipated project costs relating to contingencies. Moved by Committee Vice Chair Wilkin and seconded by Trustee Shorter, and following discussion, the item was unanimously approved for submission to the Board.

2. Bronx Community College – University-Wide Program to Upgrade Fire Alarm Systems. Committee Vice Chair Wilkin requested the Committee’s approval to authorize the City University Construction Fund to effectuate and provide funding for the fire alarm upgrades, in an amount not to exceed $14 million. Moved by Committee Vice Chair Wilkin and seconded by Trustee Shorter, and following discussion, the item was unanimously approved for submission to the Board.

3. Queens College – Boiler Plant Replacement. Committee Vice Chair Wilkin requested the

Committee’s approval to authorize the City University Construction Fund to effectuate and provide funding for the Queens College boiler replacement project in an amount not to exceed $40 million. Moved by Committee Vice Chair Wilkin and seconded by Trustee Shorter, and following discussion, the item was unanimously approved for submission to the Board.

4. Amendment – New York City College of Technology – Namm Complex – Cooling System

for the Data Center and Telephone Equipment Room. Committee Vice Chair Wilkin requested the Committee’s approval to amend the CUNY Board resolution from December 4, 2017, from a not-to-exceed amount of $1.25 million to a not-to-exceed amount of $1.55 million, for the design, purchase and installation of new cooling systems for the data center and telephone equipment room in the Namm Hall building, and to authorize the City University Construction Fund to effectuate and provide funding for the increased scope of the cooling system project. A discussion about the amendment followed, including the timeframe of the cooling system installation. Moved by Committee Vice Chair Wilkin and seconded by Trustee Shorter, and following discussion, the item was unanimously approved for submission to the Board.

5. York College – Retro-Commissioning Work at Performing Arts Center and Health and Physical Education Complex. Committee Vice Chair Wilkin requested the Committee’s approval to authorize the City University Construction Fund to effectuate and provide funding for the HVAC retro-commissioning project in an amount not to exceed $350,000. Moved by Committee Vice Chair Wilkin and seconded by Prof. Barker, and following discussion, the item was unanimously approved for submission to the Board.

6. Baruch College – Newman Library 4th Floor – High Density Shelving. Committee Vice Chair Wilkin requested the Committee’s approval to authorize the City University Construction Fund to effectuate and provide funding for the high-density shelving for the fourth floor of the Newman Library at Baruch College in an amount not to exceed $1,550,500. Vice President for Information Services and Dean of the Library Arthur Downing made a few comments, stating that the replacement of the shelving will consolidate the lending collection on one floor and yield additional seating for students as recommended in the Library Facilities Master Plan. A discussion about the shelving replacement followed, including the importance of high-density shelving.

Moved by Committee Vice Chair Wilkin and seconded by Prof. Barker, and following discussion, the item was unanimously approved for submission to the Board.

7. City University of New York – Central Office – New Lease at 111 Washington Avenue,

Albany, New York. Committee Vice Chair Wilkin requested the Committee’s approval to authorize the General Counsel to execute the new lease, and such other ancillary documents, on behalf of the Central Office. A discussion about the lease agreement followed, including terms and conditions relating to the Original Lease as modified by the Current Lease. Moved by Committee Vice Chair Wilkin and seconded by Prof. Barker, and following discussion, the item was unanimously approved for submission to the Board.

8. Lehman College – Short-term Lease for Dormitory Space at 247 Bedford Park Boulevard,

Bronx, New York. Committee Vice Chair Wilkin requested the Committee’s approval to authorize the General Counsel to execute the new dorm lease, and other documents on behalf of Lehman College. A discussion about the Dorm lease followed, including maintenance of the building and safety codes relating to ADA standards. Moved by Committee Vice Chair Wilkin and seconded by Trustee Shorter, and following discussion, the item was unanimously approved for submission to the Board.

II. INFORMATION ITEMS:

A. Report of the Senior Vice Chancellor Assistant Director Anton Wolfshorndl gave a presentation on the Nursing, Education, Research and Practice Center (NERPC) at Lehman College, noting the new Nursing building will provide classroom space and specialized labs to facilitate nursing education there. A discussion about the Nursing Center followed, including the current amount of nursing faculty, anticipated new hires, student spaces, the architect of the new Center, and ADA accessibility.

Committee Vice Chair Wilkin moved to adjourn the meeting. The motion was seconded by Trustee Shorter and the meeting was adjourned at 5:15 p.m.

RESOLUTION RELATED TO CUNY SCHOOL OF LAW – DESIGN AND CONSTRUCTION OF A TRIAL

PRACTICE COURTROOM November 25, 2019

WHEREAS, The City University Construction Fund (“CUCF”) is responsible for developing, planning, designing and construction of the capital facilities for the City University of New York (the “University”); and WHEREAS, In 2011, CUCF purchased a condominium unit (the “CUCF Condominium Unit”) which comprises approximately 45% of the condominium building at 2 Court Square, Long Island City, New York 11101 (the “2 Court Square Condominium”) from Citigroup for use by the CUNY Law School (the “Law School”), and Citigroup retained a condominium unit comprising approximately of 55% of the 2 Court Square Condominium; and WHEREAS, The Law School plans to convert an existing classroom within the CUCF Condominium Unit into a modern, fully equipped Trial Practice Courtroom (The Trial Practice Courtroom Project); and WHEREAS, Under the documents governing the 2 Court Square Condominium, the property manager for the 2 Court Square Condominium may procure and hold all contracts for capital work, with CUCF having approval rights for work within the CUCF Condominium Unit which CUCF has used to require that all capital work within the CUCF Condominium Unit be subject to the same CUCF capital requirements for prevailing wage and minority- and women-owned business enterprises used by CUCF for its capital projects on University facilities; and WHEREAS, The City of New York has appropriated funding to CUCF for the design and construction of the Trial Practice Courtroom Project in an amount not to exceed $1,100,000. NOW, THEREFORE, BE IT: RESOLVED, That the University’s Board of Trustees request CUCF to provide funding for the Trial Practice Courtroom Project, to be chargeable to City Project No. CL018-015, for an amount not to exceed $1,100,000.

EXPLANATION:

The Law School plans to convert a classroom into a modern, fully equipped Trial Practice Court that will function as a place where students in courses and on competition teams can hold mock trials, and as a demonstration courtroom for classes and groups from both inside and outside the Law School. The scope of work will include demolition of the existing fixed furnishings, closets and closet doors, a portion of a wall, finishes, floor boxes, electrical conduit and wiring, and ceiling-mounted equipment. The scope of work also includes installation of fixed cabinetry and furniture, such as constructing a raised judge's bench, a witness stand, an elevated jury box, counsel tables and fixed seating for viewers as well as new finishes and electrical infrastructure. It is anticipated that construction will begin April 2020 and end August 2020.

Project History In 2011, CUCF purchased a condominium unit comprising approximately 45% (the “CUCF Condominium Unit”) of the condominium building at 2 Court Square, Long Island City, New York 11101 (the “2 Court Square Condominium”) from Citigroup for use by the CUNY Law School, where Citigroup retained a condominium unit comprising approximately 55% of the 2 Court Square Condominium.

4. AMEND THE ARCHITECTURAL SERVICES CONTRACT FOR THE NEW ACADEMIC BUILDING AT NEW YORK CITY COLLEGE OF

TECHNOLOGY November 25, 2019

WHEREAS, The City University Construction Fund (“CUCF”) is responsible for developing, planning, designing and construction of the capital facilities for the City University of New York (the “University”); and WHEREAS, On June 23, 2008, Cal. No. 6D, the Board of Trustees previously requested that CUCF execute a consultant contract with the firm of Perkins Eastman in an amount not to exceed $16,000,000; and WHEREAS, On November 22, 2010, (Cal. No. 6F) the Board of Trustees requested that CUCF amend the consultant contract previously approved in an amount not to exceed $17,000,000; and WHEREAS, On February 21, 2017 (Cal. No. 5D) the Board of Trustees requested that CUCF amend the consultant contract previously approved for the second time, in an amount not to exceed $20,000,000; and WHEREAS, An additional amendment to the previously approved architectural services contract for the New Academic Building at New York City College of Technology is required to provide unanticipated additional design and commissioning services that will address required HVAC design, related construction work, construction sequencing, coordination and system performance and functionality, completion of the exterior façade, and additional construction administration services (the “New Academic Building Project”); and WHEREAS, New York State appropriated capital funding to CUCF for the New Academic Building Project in an amount not to exceed $975,000.

NOW, THEREFORE, BE IT RESOLVED, That the Board of Trustees of the City University of New York amends its previous resolution adopted on June 23, 2008 (Cal. No. 6D), amended on November 22, 2010 (Cal. No. 6F) and further amended on February 21, 2017 (Cal No. 5 D) for the increase in the approved amount of $975,000; and BE IT FURTHER RESOLVED, That the CUCF be requested to execute an amendment to an existing consulting contract to reflect the Fund’s purchase of additional design and construction related services to complete the construction closeout for the New Academic Building for the increased scope of $975,000 for a total not to exceed amount of $20,975,000. EXPLANATION:

Due to the complexity of the building’s HVAC system and controls, and the curtain wall façade, additional inspections and commissioning work was required during the construction phase that contributed to the extended duration of the project schedule and final completion of the facility. As a result, the construction phase has extended beyond the construction schedule of 60 months. Additional construction administration services by the design team, commissioning authority and the contractor are required to complete the project. Some of the issues that require additional design input and construction administration services are the completion of the exterior façade, which is expected to be completed by the spring of 2020, ongoing HVAC commissioning work, and associated work in the laboratories to address operational requirements. There is sufficient project funding to cover the increases in consultant fees. The design services will address unanticipated additional design requirements and related construction sequencing, coordination and system performance and functionality, completion of the exterior façade, additional HVAC design, operational requirements in laboratories, and additional construction administration services. These additional services were not anticipated as part of the original agreement with Perkins Eastman.

RESOLVED. That the Board of Trustees of The City University of New York authorize the General Counsel to execute a consultant

contract 'with the firm of Perkins Eastman for professional design and construction-related services as required for the New Academic

Building at New York City College of Technology, CUNY Project No. NY123-004. The contract cost shall be chargeable to the State

Capital Construction Fund, ProJect No. 2582909999 for an amount not to exceed $16 million. The contract shall be subject to approval

as to form by the University Office of the General Counsel.

EXPLANATION: New York City College of Technology's 2000 Master Plan calls for the construction of new program space on a site

that combines the Klitgord Center site, located on Jay Street between Tillary and Johnson Streets in downtown Brooklyn, with the

adjacent New York City Department of Education ("DOE") TV Studio site.

The project will consist of the demolition of the existing Klitgord Center structure and an existing TV Studio (located on the TV Studio

site), and the design and construction of a new building of approximately 325,000GSF to replace antiquated facilities and to meet the

rapidly growing needs of the NYCCT campus. The program for the new building has already been developed and includes classroom,

laboratory, and clinic spaces for various NYCCT departments, including Biological Sciences, Chemical Technology, Dental Hygiene,

Restorative Dentistry, and Vision Care Technology. The program also includes a 1,000-seat auditorium and athletic facilities, including

a full-length basketball court, to replace existing facilities in Klitgord.

The proposed firm was selected in accordance with law and procedures established by the University.

RESOLVED, That the Board of Trustees of The City University of New York amend the prior resolution, adopted June 23, 2008, Cal.

No. 6.D., for execution of a consultant contract on behalf of New York City College of Technology with the firm of Perkins Eastman for

professional design and construction-related services as required for the College's New Academic Building; and be it further

RESOLVED, That the City University Construction Fund be requested to execute an amendment to an existing consultant contract to

reflect the Fund's purchase of additional design services to complete the design for the New Academic Building. The total cost of the

amendment shall be chargeable to the State Capital Construction Fund, Project No. 258209999, for an amount not to exceed

$1,000,000.

EXPLANATION: The additional design services will include the design of the TV and Radio Studio and other services not anticipated

as part of the agreement with Perkins Eastman.

Initial plans called for others to move the existing TV and Radio Studio occupants from the project site. Subsequent to

commencement of design, it was determined that the relocation of the TV and Radio Studio would be required in order to advance the

project, and that during construction, the TV and Radio Studio would be housed in the CUNY Graduate Center. The relocation of the

TV and Radio Studio to the Graduate Center became an additional scope item for this project and will be handled by CUCF through an

existing consultant contract.

RESOLVED, That the Board of Trustees of The City University of New York amend the prior resolution, adopted June 23, 2008 (Cal. No. 6D), and amended on November 22, 2010 (Cal. No. 6F) for execution of an Architectural Services Contract with Perkins Eastman on behalf of New York City College of Technology for the College's New Academic Building. The amendment is to authorize an increase in the approved amount from $ l 7M to $20M; and be it further RESOLVED, That the City University Construction Fund be requested to execute an amendment to an existing consultant contract to reflect the Fund's purchase of additional design and construction- related services to complete the construction for the New Academic Building. The total cost of the amendment shall be chargeable to the State Capital Construction Fund, Project No. 2582909999, for an amount not to exceed $3M. The contract amendment shall be subject to approval as to form by the Fund's General Counsel.

EXPLANATION: The additional design services will address unanticipated field conditions, programmatic changes and additional construction-administration services as a result of the extended construction schedule. These services were not anticipated as part of the agreement with Perkins Eastman.

During the construction phase unanticipated field conditions and programmatic changes re,quested by the College needed to be addressed by the design team so as to not delay the construction schedule. During the construction phase the construction manager issued a revised 46 month construction schedule. The revised schedule added an additional 17 months of construction beyond the original 29 month schedule requiring additional construction­administration services.
