Hotnes are going up -- and one ofthe111 is occupied -- at Dialdo Cirande it1 the hills west of Patterson, even as a legal fight continues over the project's water source.

The water for the homes and the Diablo Grcnde golf resost is conling from the nearby California Aqueduct, under an agseetnent with the Kern county Water Agency, which allows Diablo Gsande to take the water before it gets to Kern.

This week the environtl~ental g~-OLIP Protect Our Water asked Stanisla~ls Cot~iltlty Superior Court to halt collstruction until officials coinply with a state court's Decerilber decision.

In that ruling, the 5th District Court of Appeal in Fresno ordered the Superior Court to set aside the county's approval of Diablo Gsande's deal for the water transfer fro111 the Kesn County agency.

The deal represented a switch from Diablo Grande's plan to take a transfer from the Berrenda Mesa Water District near Bakersfield.

The appellate co~i't said the co~lnty did not properly study the switch in a 2001 addendum to the Diablo Grande environinental itupact report.

Attorney Rose Zoia, representing Protect Our Water, said the decision means that Diablo Grande no longer has county approval to use the Kerx County wata and constnlction should stop everywhere on t l~e resort where the water is being used.

"If they are relying on Kern County Water Agency water, than, yes, constiuctioil should stop," Zoia said.

She said she filed the proposed order Thursday.

The lawsuit over the change in water supply dates to Jaluary 2002. The plaintif% are Protect Our Water, the San Joaquin Raptor Rescue Center and Steve Burke of Modesto. Judge William Mayhew nlled against them and the plaintiffs appealed.

Thursday, Diablo Grande and coilnty officials said the appellate decision involved a technical niatter and should not stop the project.

"There are a n ~ ~ i ~ l b e r of bases on which to continue constn~ction, continue enlploymetlt and contin~te the investment of funds in Stanislaus County," said Russ Newman, genzral counsel for Diablo Grande. He declined to elaborate.

The county is the principal defendant in the lawsuit, but Diablo Grande is responsible for the cost of defending the project in court.

The Board of Supeivisors' agenda for Tuesday calls for setting a March 30 heiu-ing on voiding approval ofthe 2001 addendum to the Diablo Grande environmental impact report.

Assistant County Counsel Jack Doering said tlie cout-t should delay additional phases of the resort until tlie issue is resolved. But it should not affect what the co~~nty already has approved -- 187 homes.

Project representatives said the Kern County water is enough to supply additional stages illat call for 2,000-plus homes, a hotel, conference center, spa and other recreation facilities. Two golf coilrses and a clubhouse with a restaurant arc in operation.

Switchit~g to the new water source involved only a change on paper and has no effect on the environment, Doering said.

Burke said there are substantial issues that need to be studied, sucli as what happens when the aqueduct is shut down for maintenance.

Newman said that if the acjueduct supply is cut off, Diablo Gratlde has the right to draw froin wells near Patterso~i.

The lawsuit is one of a n~~illber of court actions that Burke and others have brought against Diablo Gratlde in the 10 years that it I~as beell in the ~vosks.

Keith Scl~neider, developinenl coordinator, said he is leaving those matters to the lawyers. He is busy making things ready for people inoving into the gated cominunity.

The Villas at Diablo Grande's first resident moved in last weekend, project representatives said.

"Our b~iyers are fko~il all over," Sclineider said. "Tltey are fiotn the Bay Area and also fiom the valley."

And those looking for so~netliitig more than homes at The Villas, which are priced at $330,000 to $400,000, inigl~t want to coi~sider the resort's signature collectioti. Schneider said six of these 3,500-square-foot homes are going in along tile Diablo Grande golf courses. The price: $1.1 million.

For dhns Va'son, 48, the scenery -- and prices she can afford -- ouk.eigh concerns about a petiding lawsuit over Diablo Grande's water supply. Va'son, who visited the sales office Friday with her 20-year-old daughter, said she is looking for a place to rdire. She has been working at Locklleed Martiii Corp, in the Bay Area since age 24 and can retire at 5 5 .

"You ki~ow the prices here will go up," said Va'son, who niovdd to Patterson four years ago.

Though her retirement is years away, she is looking now, because she does not want to be priced out.

And though Diablo Grande is isolated now -- a scenic, but enipty, eight-mile drive froin the nearest grocery store, in Patterson -- Va'son said she likes the idea that Diablo Gsande could one day itlclude a swininiing pool and a town center with shops.

But Barber said the lawsuit niade her cautious about buying right away.

"I'd like things to be a liltle more established," Barber said. She does not want to buy Iai~ld uilless condo~~iitiiums and shops cat1 be built. "But it really is beautifill."

DIABLO GRANDE -- Sales banners flapped in the breeze, construc;tion hammers banged and a sZeady streani of prospective buyers visited model honies liere Friday.

"They're beautifitl," said Linda Barl>er, a retiree from Los Banos, as she emerged with her daughter and two grandchildren fioni one of the inodels at The Villas at Diablo Grande.

Barber said she first visited Diablo Grande in December, when she met a friend for lunch in the golf resort's clubhouse.

"I fell in love with it," she said of the scenery around Diablo Grande's two 18-hole golf courses. Developers ellvision 2,000 to 5,000 homes tucked anlid the Diablo mountain range west of Patterson.

When Barber learned that consin~ction at The Villas was under way, she came out to have a look.

Three model honies stand at The Villas' entrance. Aro~lnd the corner Friday, dozens of workers fiained houses, graded driveways and dug up fiont yards for pipes.

Seven hoines at the end of a cul-de-sac appeared to be finished. One is occupied; move-in day was last weekend. The venetian blinds were pastially open, but no one answered k~locks on the door Thursday and Friday.

"Sold" signs stood in fiont of several u~~finislzed l~ouses. Thirty of the 96 lots at The Villas have been sold, said Patricia Day, on duty Friday in the sales office of Western Paciilc Homes.

The homes are priced from $330,000 to $400,000, for floor plans ranging from 1,924 to 2,662 square feet. They are only about eight feet apart: At the model homes, a visitor can look out a side window into the house nex? door.

More cons3ruction is about to start, said Kent Bacl~mnan, director of sales and marketing for another builder, Private Island Hoines.

"We'll probably be grading within a week," Bachman said. "We're looking to get models under consdructiot~ here in a couple of weeks." Private Island will offer 52 lots, he said.

In the opinion of the undersigned, the appeal filed by ~r.r%uike, to which he referred in his letter to you, regardless of its outcome, would not materially affect the Diabla Grande project, Phase I (Unit 1-A). The issues involved in the case would not, in my opinion, be likely to be meaningful in any material sense to a prospective purchaser of a lot in Unit 1-A of the Diablo Grande subdivision project.

My opinion is based upon the attached letter from the litigation attorney Iiandling tho appeal.

map, it was filed far too late to challenge the approval of, or development under, this subdivision map.

0. On March 23 and 24, 2000, KCWA and WHWD entered into the water supply contract for this subdivision. KCWA adopted a Negative Declaration pursuant to CEQA for this water supply contract on March 23,2000, and filed a notice of determination on March 24,2000. Under CEQA, the statute of limitations for challenging this approval was 30 days, under Public Resources Code section 21 167, No lawsuit has ever been filed challenging this contract.

The original conditions provided that the development of this map would be served with water from on-site wells and from the Berrenda Mesa Water District ("BMWD"). The amendment also allowed the project to be served with water from KCWA, pursuant to the above- referenced water contract. It was originally contemplated that BMWO would provide water to the development from KCWA pursuant to a sub-contracting arrangement. This modification eliminated the need to use BMWD as a "middle man" and now provides for the same water supply to be ,

obtained directly from KCWA. The County adopted an addendum b its original OR for this project to incorporate KCWA's March 23,2000, negative declaration (which was beyond legal challenge). The above-referenced lawsuit was filed within the limitations period to challenge this modification to he tentative map conditions, but it should not be able to invalidate the tentative subdivision map itself.

D. Even if the Court were to somehow invalidate the County's approval of the modification to the tentative map condition (and it is inconceivable to me why the Court would do this), the chances of the Court taking any action adverse to the interests of third-party purchasers of individual lots are extremely remote, given the petitioners' failure to seek any preliminary injunctive relief against the recording of the final map or other development activities. The most I could see the Court doing is requiring further environmental study by the County, in the very unlikely event we do not prevail against petitioners' appeal,

I am the litigation attorney representing Diablo Grande Limited Partnership in the above-referenced lawsuit, brought by petitioners Protect bur Water, San Joaquin Raptor Rescue Center, and Steve Burke. This lawsuit, which is now on appeal, seeks a writ of mandate to void the County of Stanislaus's approval of a minor modification made to a condition of approval of the Phase I tentative map for the Diablo Grande project, and to enjoin development of the Diablo Grande project pending further environmental review. Notwithstanding the fact that petitioners seek this relief, in' my opinion, regardless of the outcome of the appeal, this lawsuit should not result in either of the following:

t. invalidation of the recorded subdivision map for Diablo Grande Unit No. ?A, (which is a map for part of the property approved under the Vesting Tentative Subdivision Map 97-01); or

2. invalidation or adverse impact upon the water supply contract entered into between Kern County Water Agency ("KCWA") and Western Hills Water District ("WMWD") to supply water to development of this subdivision.

A. The County approved Vesting Tentative Subdivision Map 97-09 on December 9, 4999. The statute of limitations for challenging this approval was 90 days under Government Code section 68499.37. Alternatively, the maximum statute of limitations for bringing an action under the California Environmental Quality Act ("CEQA") to challenge this approval was 180 days under Public Resources Code section 21 167. No lawsuit was brought challenging the approval of this map within either limitations period, and the above-referenced lawsuit was not filed until January 10, 2002. While this lawsuit appears to try to challenge Diablo Grande's ability to develop under this

APPEAL OF PLANNING COMMISSION APPROVAL FOR USE PERMIT APPLICATION NO. 2002-28 - SANTA FE AGGREGATES -A request to excavate sand and gravel from approximately 110 +I- acres of two parcels totaling 153+1- acres located in eastern Stanislaus County. This is an extension of a Santa Fe Aggregates operation (UP 87-32) to the east of the project site. The site is located approximately four miles east of the City of Waterford, near State Route 132 and near Modesto Reservoir. The project site is located south of the Tuolumne River Channel at approximately River Mile 35.5 at the east end of Lampley Road in the unincorporated area of Stanislaus County.

The property is further identified as Assessor Parcel Number 008-009-01 8 and 008-009-019. The Board of Supervisors will consider approval of a Mitigated Negative Declaration for this item.

The public hearing notice sent out under date of March 12, 2004, in connection with the above matter indicated that all interested persons will be given an opportunity to speak and also indicated that evidence could be presented; however, in fact, the public hearing was closed by the Board of Supervisors on February 10, 2004 and further evidence will not be received. The purpose of the continued public hearing is for the Board of Supervisors to publicly deliberate and reach a decision on the matter.
