On October 25, 2015, pursuant to the authority granted by Section y 1.103 of the Los Angeles Municipal Code (“L.A.M.C”), the Department of Building and Safety (the “Department”) investigated and identified code violations at: 1523 East Sandison Street, Los Angeles, California, (the “Property”). A copy of the title report which includes a full legal description of the property is attached as Exhibit A.
Following the Department’s investigation an order or orders to comply were issued to the property owner and all interested parties. Pursuant to Section 98.0411(a) the order warned that “a proposed noncompliance fee may be imposed for failure to comply with the order within 15 days after the compliance date specified in the order or unless an appeal or slight modification is filed within 15 days after the compliance date.” The owners failed to comply within the time prescribed by ordinance.
In addition, on February 01, 2007, October 26, 2007, August 01, 2013 and July 28, 2015, pursuant to Section 98.0402(e) of the L.A.M.C. the Department performed annual inspections on the vehicle repair facility located at the same address. The property owner was given notice of the unpaid annual inspection fees on the property'. The Department imposed non-compliance fee and annual inspection fee as follows:

Pursuant to the authority granted by Section 7.35.3 of the Los Angeles Administrative Code, it is proposed that a lien for a total sum of S4,084.82 be recorded against the property. It is requested that the Flonorable City Council of the City of Los Angeles (the “City Council”) designate the time and place protest can be heard concerning this matter, as set forth in Sections 7.35.3 and 7.35.5 of the Los Angeles Administrative Code.
It is further requested that the City Council instruct the Department to deposit to Dept. 08, Fund 48R, Balance Sheet Account 2200J: any payment received against this lien in the amount of $4,084.82 on the referenced property. A list of all the names and addresses of owners and all interested parties entitled to notice is included (Exhibit B). Also attached is a report which includes the current fair market value of the property', including all encumbrances of record on the property as of the date of the report (Exhibit C).

JTHIS DEED OF TRUST AND SECURITY AGREEMENT, ASSIGNMENT OF LEASES AND RENTS, SECURITY AGREEMENT AND FIXTURE FILING (the "Security Instrument”) is made as of May 18, 2006, by Ruben Chavez, having an address at 524 North Gulf Avenue, Wilmington, CA 90744, as grantor ("Borrower''), to Investors Title Company, as Trustee ("Trustee'1), for the benefit of InterBay Funding, LLC, a Delaware Limited Liability Company, having an address at 130) Virginia Drive, Ste #403, Fort Washington, PA 19034, as beneficiary ("Lender").
RECITALS:
Borrower by its promissory note of even date herewith given to Lender is indebted to Lender in the principal sum of One Hundred Forty-Eight Thousand Five Hundred and No/100 Dollars ($148,500.00) in lawful money of the United Stales of America (the note together with all extensions, renewals, modifications, substitutions and amendments thereof shail collectively be referred to as the "Note"), with interest from the date thereof at the rates set forth in the Note, principal and interest to be payable in accordance with the terms and conditions provided in the Note and with a maturity date of June 1,2031.
Borrower desires to secure the payment of the Debt (hereinafter defined in Article 2) and the performance of all of il obligations under the Note and the Other Obligations (defined in Article 2).
ARTICLE 1. - GRANTS OF SECURITY
PROPERTY IN TRUST. To secure the full and timely payment and performance of the Debt and theSection 1.1,full and timely performance and discharge of the Other Obligations, Borrower has GRANTED, BARGAINED, SOLD and CONVERTED, and by these presents does GRANT, BARGAIN, MORTGAGE, SELL, CONVEY and CONFIRM in trust with power of sale, to the fullest extent permitted by applicable law, unto Trustee the following described "Property", subject, however, to the Permitted Exceptions (defined in Section 5.1), TO HAVE AND TO HOLD the Property unto Trustee, his successors in trust and the Trustee's assigns forever, and Borrower does hereby bind itself, its successors and assigns, to warrant and forever defend title to the Property unto Trustee against every person whomsoever lawfully claiming or to claim the same or any part thereof; provided, however, that if Borrower shall pay (or cause to be paid) the Debt as and when the same shall become due and payable and shall perform and discharge (or cause to be performed and discharged) all of the Other Obligations of Borrower under the Note and this Security Instrument and the Other Security Documents on or before the date same are to be performed and discharged, then the liens, security interests, estates and rights granted by this Security Instrument and the Olher Securily Documents shall terminate and be released by the Trustee, otherwise same shall remain in full force and effect. In the event of such termination and release, Trustee, shall, at the request of Lender and at the expense of Borrower, execute an instrument in writing and in recordable form reconveying the trust property to Borrower and shall otherwise release the liens, securily interests, estates and rights granted by this Security Instrument and the Other Security Documents,
As used herein, the term "Property" shall mean the following property, rights, interests and estates now owned, or hereafter acquired by Borrower (collectively, the "Property"):
Land . The real property described in Exhibit A attached hereto and made a pan hereof (the "Land");(a)
Additional Land . AH additional lands, estates and development rights hereafter acquired by Borrower for use in connection with the Land and the development of the Land and all additional lands and estates therein which may, from lime to time, by supplemental deed of trust or otherwise be expressly made subject to the lien of this Security Instrument;

Improvements . The buildings, structures, fixtures, additions, enlargements, extensions, modifications, repairs, replacements and improvements now or hereafter erected or located on the Land (the "Improvements");

All easements, rights-of-way or use, rights, strips and gores of land, streets, ways, alleys, passages, sewer rights, ditches and ditch rights, wells and well rights, well permits, springs and spring rights and reservoirs and reservoir rights appurtenant to or historically used in connection with the premises and all of Trustors rights and interests under applicable state or Federal law to all water, and to use or consent to use all water, contained in or available from any part of the water bearing formations underlying the Premises, together with all associated easements and rights of way; any and all rights to obtain water, sewer and other services from service districts, water, water courses, water rights, licenses and powers, air rights, mineral rights (including but not limited to hard rock minerals, oil and gas) and development rights, all crops, timber, trees, shrubs, flowers and lands aping plants and materials now or hereafter

A proposed .noncompliance fee in the amount of $660.00 may be imposed for failure to comply with the order within 15 days after the compliance date specified in the order or unless an appeal or request for slight modification is filed within 15 days of the compliance date.If an appeal or request for slight modification is not filed within 15 days of the compliance date or extensions granted therefrom, the
determination of the department to impose and collect a non-compliance fee shall be final. Section 98.0411 L.A.M.C.NOTE: FAILURE TO PAY THE NON -COMPLIANCE FEE WITHIN 30 DAYS AFTER THE DATE OF MAILING THE INVOICE,
MAY RESULT IN A LATE CHARGE OF TWO (2) TIMES THE NON-COMPLIANCE FEE PLUS A 50 PERCENT COLLECTION FEE FOR A TOTAL OF $2,310.00.Any person who fails to pay the non-compliance fee, late charge and collection fee shall also pay interest. Interest shall be calculated at the rate of one percent per month.
PENALTY WARNING :Any person who violates or causes or permits another person to violate any provision of the Los Angeles Municipal Code (L.A.M.C.) is guilty of a misdemeanor which is punishable by a fine of not more than $1000.00 and/or six (6) months imprisonment for each violation. Section 11.00 (m) L.A.M.C.
REVOCATION OF CERTIFICATE OF OCCUPANCY and FINE WARNING :The failure to correct the violations on or before the compliance date or any authorized extension thereof may result in commencement of proceedings to revoke the Certificate of Occupancy. Such proceedings may involve a Revocation Hearing. A personal appearance at the hearing may only be avoided if the violation is corrected and a fine paid according to the fine schedule in Section 12.26 F 14 or 12.26 I. 16 ofthis subsection. Sections 12.26 F. 9, 12.26 J. 11,98.0402(f)2A L.A.M.C.
The compliance date as specified in the notice may be extended for an additional period not to exceed 45 days if the owner or operator of the yard presents satifactory evidence to the Superintendent that unusual difficulties prevent substantial compliance without such extension.
APPEAL PROCEDURES:Notwithstanding any provisions of the Municipal Code to the contrary, there shall be no appeal to the Board of Building and Safety Commissioners from any notice issued or detennination made by the Superintendent pursuant to Subsection 12.26 F, 13, 12.26 I. 15.

Except for extensions of time granted by the Department of Building and Safety and the Board of Building and Safety Commissioners as authorized in Subdivision 12.26 F. 4(b) and/or 12.26 I, 7(b), and notwithstanding any provisions ofthis code to the contrary, there shall be no appeal to the Board of Building and Safety Commissioners from any notice issued or determination made by the Department pursuant to Subsection(s) 12.26 F. and/or 12.26 I. There is an appeal procedure established in this city whereby the Department of Building and Safety and the Board of Building and Safety Commissioners have the authority to hear and determine err or abuse of discretion, or requests for slight modification of the requirements contained in this order when appropriate fees have been paid. Section 98.0403.1 and 98.0403.2 L.A.M.C.
REPEAT VIOLATIONS :If an Order to Comply is issued pursuant to Sections 12.26 F. or 12.26 K. of the Los Angeles Municipal Code, and after compliance with the Order, a subsequent Order to Comply is issued for violation of the same provisions occuring within one year of the date of the initial Order, the repair/installation facility or storage yard facility operator shall pay a fine as specified in Section 98.0402(f)] L.A.M.C. as follows:
A. For each auto dismantling, junk yard, scrap metal or recycling materials processing yards, recycling collection and/or buyback centers, recycling materials sorting facilities and cargo container storage yards....$200,00
