The meeting was called to order at 11:00a.m. Heather Parks took roll call. For the record, Chair Eileen Rhodes and members, David Arenas, Pam McDonough, Saul Morse, Beverly Potts, and Glyn Ramage were all present via WebEx. Ms. Romano made a correction to #11 Board Resolution No. 20-01 to be 21-01. David Arenas moved, and Glyn Ramage seconded a motion for the adoption of the agenda, with the correction to #11. Chair Rhodes called for a vote, and the motion was approved unanimously. Glyn Ramage moved, and David Arenas seconded a motion for adoption of the minutes of the May 11, 2021 meeting. Mr. Lance gave an update of the Best Interest of the State Selections. Mr. Wright gave an update of Small Contract Selections, Single Bid Award, Change Order for Board Authorization Proceed Orders, Previously Board Approved Proceed Orders That Have Been Voided. He also gave the Quarterly Remobilization Project Report and Quarterly Construction Report. Kamaria Morris was introduced as CDB’s new Public Information Officer. Welcome to CDB Kamaria.

State of Illinois Capital Development Board Request for Board Approval of Single Bid CDB Project No. 321-110-068 Replace Water Main Piping Ludeman Development Center Park Forest, Cook County, IL Subject: Single Bid Award Project History: The scope of work for this project provides for replacing the watermains, fire hydrants, and water service to each building at the Ludeman Development Center. The current water system a is a 50-year old loop design that is no longer recommended by the Illinois Department of Public Health due to stagnation and water quality issues. The current water system is also in poor condition and is prone to failures. Emergency repairs to fix the failures create substantial and ongoing interruptions to facility operations as well as unexpected expenses. Requested Action: Bids were opened on April 28, 2021 and a single bid was received for the plumbing trade. Thirteen plan rooms and ten contractors held drawings for the bidding. The Ludeman Development Center is a 70-building facility established in 1972. The water service piping buried throughout the site is failing. Original water distribution systems is approaching 50yrs old, in poor condition and prone to failures. Emergency repairs create a substantial and ongoing interruptions to facility operations as well as unexpected expenses. The loop design is no longer recommended by IDPH due to stagnation and water quality concerns. Scope of work provides for replacing the site watermains, fire hydrants and service to each building.

Single Bid was received for Plumbing trade on April 28th 2021. Thirteen plan rooms and ten contractors held drawings for the bidding. Bid in the amount of $1,045,000.00 was received from Calumet City Plumbing. AE’s (Milhouse

Engineering) estimate was $376,000.00 Bid received is 178% over the AE’s estimate. AE provided a letter of explanation (attached).

Related project (321-110-067, Rehabilitate Roads, Parking lots, Sidewalks, Street and Walkway Lightning) to this one (321-110-068, Replace Water Main Piping) received the ATP on 3/5/2021 and is waiting for Water Main Piping replacement project. The Roadway project (321-110-067) will also require additional funding for material increase, time delay and additional mobilization and remobilization if we don’t move forward. Per the mtg 6/30/2021 we decided to move forward with the rehabilitation of Parking lots and all the sidewalks not affected by the Water Main project. Options on how to move the Water Main Project were discussed.

General Work Upon speaking to several of the bidders on the project, they indicated that the proposed route has a large number of utility crossings that may limit installation to am extimated 100 lf per day from a typical installation of approximately 300 lf per day. One of the contractors indicated that the linear foot per day could be increased to an estimated 300 lf per day if the route was modiifed for the water main to run in the street (and potentially be directionally drilled).

Additionally, PVC pipe prices were at a low in early 2020, but the result of limited supply due to the pandemic, back to back hurricaines, and the deep freeze in Texas and Louisans in early 2021 has caused pvc prices to triple in Mid March, which resulted in a 270% increase in the material cost for the PVC pipe.

Bid Tabulation Summary

Plumbing Continuing shortages of raw materials and manufacturing during 2020 and early 2021 has led to signifcant price increases for material in 2021. These price increases are reflected in the bid prices submitted for the plumbing scope of work. Copper prices rose approximately 180% from Early 2020 to March 2021. Ductile Iron Pipe prices rose approximately 20% over the same period. Additonally builing materials have also increased significantly, so the increased cost of these raw materials is reflected in the proposal.

This multiple prime project’s General Trade was bid on 6/9/21 and the single bid received for the General Contract work came in at 7.85% over the A/E’s estimate:

Stark Excavating - $731,000; A/E GC estimate - $677,800

This bid has been deemed responsive by CDB Contracts.

I believe this project had active competitors prior to the bid date and was bid in a competitive bid environment. It is my opinion and the A/E’s that the current bidding environment is highly competitive relative to the paving work that is under the General Contract due to an IDOT letting on 6/11/21. We are also of the opinion that materials are difficult to procure due to the Covid-19 situation with cost increases and long lead times. This project is also located at a secure facility, and some contractors may not want to bid a project with the security and logistics involved.

This project was hosted in 6 plan rooms, and there were 8 plan holders for the General Trade.

I am requesting that the single bid for the General Contract work be awarded even though it is a single bid, due to that fact that if we were to rebid we may miss the DMA funding cutoff date of 9/30/21 to have the federal funds obligated. If these funds are not obligated, then they are lost.

Note: This announcement is for the completion of a partial program analysis, an on-site design charrette with an end result of a 35 percent design with the option reserved to execute a contract modification(s) for full design services pending project approval and funding.

The scope of work provides for various replacements, repairs, and upgrades to the heating, cooling, ventilation, exhaust, and temperature control systems, as well as any related or supporting general, electrical, or other work.

PROJECT SCOPE OF WORK: The Appellate Court 3rd District (P0200) is a 15,000 square foot, 3-story building established in 1858.

The scope of work provides for removing the existing ramp at the main entrance and replacing it with a code compliant ramp in addition to demolishing, reconstructing and restoring components of the monumental stairs at the main entrance. Work also includes remodeling the existing second floor restrooms and replacing them with a code compliant restroom plus removing approximately 47 windows, frames, sub-frames and sills, and replacing with new windows and supporting components. The work will include heating, ventilating, air conditioning and electrical work in addition to removing existing paint on the building exterior and painting to match original painting.

Hazardous materials may be encountered.

The State Historic Preservation Office should be consulted during every phase of this project.

PROJECT SCOPE OF WORK: The Appellate Court 4th District Building (M0112) is a 16,400 square foot, 4-story building constructed in 1922.

The scope of work provides for restoring approximately 116 wood window sashes plus painting all exterior surfaces of window frames and sashes. The work also includes removing the ground level security bars and providing alternative methods of securing these openings.

The State Historic Preservation Office should be consulted during every phase of this project.


There are no VBE/PBE goals applied to the A/E team, but participation is encouraged.

PROJECT SCOPE OF WORK: The William Rainey Harper College in Palatine, is a 22-building facility established in 1969.

The scope of work includes improvements to the steam condensate system that serves the entire campus and the replacement of the HVAC systems in Building V. The improvements to the steam condensate system include the replacement of condensate stations, pumps and flash tanks in select buildings and rerouting of select condensate lines. The HVAC system replacement in Building V includes a new building boiler plant, ventilation systems, cooling system, rooftop units, VAV boxes, ductwork, unit heaters, exhaust fans and controls throughout the building and finned tube radiation, suspended unit heaters and ventilation specific to the green house area. The existing equipment is undersized or has exceeded its life expectancy and requires replacement.

Feasibility studies have been completed and will be provided to the selected firm to review, confirm and identify the specific needs of the project.

The scope of work provides for upgrading the boiler and controls, including modifying and upgrading Boiler #5, air/fuel delivery and its control systems, restoring it to dual-fuel capability. It will also replace associated equipment, including pumps, condensate receiver, valves, chemical feed, brine tank and fuel oil system and their related controls. The project will replace the roof over the south addition of the steam plant building (3,500 square feet) with new roof membrane, as well as, replace some of the supporting gypsum panels located over the equipment. The project will include enhancements related to the relocation of the control room/office within the steam plant building. A study was completed in January 2020 regarding Boiler #5 and will be provided to teams short-listed for interviews.

The project will also include replacing pipe insulation, repairing and/or replacing pipe supports, and addressing structural damage and egress issues of the tunnels.

The scope of work provides for repairing and upgrading the HVAC systems, including, but not limited to, the building air handling systems, control systems, VAV boxes, energy recovery systems, ductwork, and hydronic systems with a focus on energy conservation. The project includes removal of associated stand-alone pneumatic controls and addition of new replacement DDC control system to communicate with the existing University central building automation software system. The work also provides for evaluation and replacement of all vertical ribbon strip curtain wall sections and upgrade of plumbing, electrical and mechanical systems, including lab hoods, safety showers and eye wash stations. The existing rooftop HVAC equipment results in a negative aesthetic impact on this prominent ISU building. The work also includes roof repair or replacement and architecturally appropriate equipment screening of this equipment or replacement with new equipment more architecturally suited to the building's campus character.

There will be an independent third-party commissioning agent assigned to this project.

General Counsel DATE: July 7, 2021 RE: Revised Board Resolution No. 21-01: Request to Extend

Executive Director Approvals Proceed Orders, Change Orders, and A/E Modifications Costs Related to the Budget Impasse and Project Suspensions due to COVID-19 At the June, 2021 Board meeting, Board Resolution No. 21-01 was presented for the Board’s review and consideration. The Resolution amends the levels of authority for approving proceed orders, change orders, and A/E modifications for costs related to the budget impasse and costs for restarting projects that were suspended due to COVID-19. The Board approved Board Resolution 21-01 with certain amendments that were discussed during the Board meeting. Specifically, the Board recommended amending the Resolution to clarify that the delegation of authority provided in the Resolution does not apply to projects in the design phase. The Board requested that the amended version be provided for review. Attached find a revised version of Board Resolution 21-01. The original amendments, as presented at the June, 2021 Board meeting, are underlined in black. The new amendments recommended by the Board are underlined in red and found in paragraph 3.J. on page 4.

Executive Director – Authority Single Bids/Proceed Orders and Change Orders/Modifications/Release of Funds

RESOLUTION

WHEREAS, the Capital Development Board, at its November 28, 2007 meeting, revised the approval levels for the award of single bids, the execution of change orders, approval of A/E modifications and the recommendation of release of funds to the Governor; WHEREAS, the Capital Development Board, at its August 9, 2016 meeting, adopted changes to the approval levels for change orders, proceed orders, and A/E modifications for costs related to the budget impasse which automatically repealed in one year unless extended by the Board, as well as approval levels for additional services in A/E modifications (Resolution 16-03); WHEREAS, the Capital Development Board, at its July 11, 2017 meeting, extended, for one year, the approval levels for change orders, proceed orders, and A/E modifications for costs related to the budget impasse (Resolution 17-02);

WHEREAS, the Capital Development Board, at its June 12, 2018 meeting, extended, for one year, the approval levels for change orders, proceed orders, and A/E modifications for costs related to the budget impasse (Resolution 18-03);

WHEREAS, the Capital Development Board, at its June 11, 2019 meeting, extended, for

one year, the approval levels for change orders, proceed orders, and A/E modifications for costs related to the budget impasse (Resolution 10-03);

WHEREAS, the Capital Development Board, at its June 9, 2020 meeting, extended, for

one year, the approval levels for change orders, proceed orders, and A/E modifications for costs related to the budget impasse and restart costs due to projects suspended due to COVID-19 (Resolution 20-01);

WHEREAS, an additional extension is necessary to address approval levels for change

orders, proceed orders, and A/E modifications for costs related to the budget impasse and suspensions caused by COVID-19; and

WHEREAS, the Capital Development Board requests the approval levels for change

orders, proceed orders, and A/E modifications related to costs related to the budget impasse be extended by one year, and that this approval process include costs related to restarting projects suspended due to COVID-19. NOW, THEREFORE, be it resolved, that the Board extends the following approval exemptions for the award of proceed orders, change orders, and A/E modifications for costs related to the budget impasse, and allow the following approval exemptions for restart costs related to COVID-19:

1. Single Bids: On bid lettings which result in a single bid, the bid may be opened and

the Executive Director is authorized to award contracts if the bid is less than or equal to $500,000. Such awards must be determined by the Executive Director to be in the best interest to the State of Illinois and based on the recommendation of the staff of the Capital Development Board.

That recommendation shall be based on factors such as availability of registered contractors in the project area, whether there was sufficient notification to those contractors by advertisement of the work, the number of valid plan holders, the type of work being bid and the availability of contractors to bid that work, and whether the bid is less than or equal to 150% of the A/E’s estimate. If the Executive Director determines that the project team failed to foster a competitive bidding situation, the Executive Director shall direct a rebid of the contract.

The Executive Director shall submit to the Board single bids exceeding $500,000

or exceeding 150% of the A/E’s estimate, along with the staff’s recommendation for approval.

The Executive Director shall submit to the Board as an informational item any single bid awarded within his/her authority. This section shall not apply to emergency projects.

2. Proceed Orders and Change Orders

A. The Executive Director shall have approval authority for any proceed order or

change order less than $100,000. The Board shall have approval authority on all proceed orders and change orders $100,000 or over in value, except as provided in paragraphs D., E., and F. below. Notwithstanding the above, change orders which incorporate alternate bids at the bid price or less shall not require Board approval, regardless of their value.

B. The Executive Director may delegate proceed order and change order approval levels as follows: Deputy Director of Construction $50,000 to $74,999 Construction Administrator $25,000 to $49,999 Regional Manager $10,000 to $24,999 Project Manager $ 0 to $ 9,999

C. For purposes of this resolution, a change order is any individual change order, or a package of all related proposed contract changes to construction contracts on the project. A proceed order is any individual proceed order, or a package of all related proposed contract changes to construction contracts on the project. The value of the project is the sum of all construction contract awarded amounts for

that project or that phase of the project. The value of the change orders are determined by their add amounts. Credits, or

deduct, change orders, are not required to be approved by the Board, regardless of their amount.

D. Board approval is not required for proceed orders or change orders $100,000 or

over for emergency projects. CDB shall present such proceed orders and change orders to the Board as informational items.

E. Board approval is not required for a change order related to a proceed order for

the same work if the change order is within the not-to-exceed amount listed in the proceed order. CDB shall present such change orders to the Board as informational items.

F. The Board delegates approval authority to the Executive Director for proceed

orders or change orders $100,000 or over which seek costs related to the budget impasse containing the 118/218 change order code and which seek costs related to restarting projects suspended due to COVID-19 containing the 119/219 change order code. CDB shall present such proceed orders and change orders to the Board as informational items. This paragraph F. is automatically repealed one year from the date of Board approval of this paragraph unless the repeal date is further extended by the Board.

G. By Resolution numbers 17-02, 18-03, 19-03, and 20-01, the Board extended the

approval authority delegation for costs related to the budget impasse provided in paragraph F. above until June 9, 2021. The Board extends the approval authority delegation provided in paragraph F. for costs related to the budget impasse for an additional year from the date of Board approval of this Resolution 21-01.

3. A/E Modifications:

A. The Board shall have approval authority for modifications to professional service

contracts whose value of basic services and additional services plus any related reimbursable costs exceeds $100,000 and were not provided for in the original contract, except as provided in paragraph I. and J. below. Basic services and additional services are those professional services as defined by the contract.

B. The Board shall also have approval authority for modifications consisting of only

reimbursables that exceed $100,000 and which include a mark up for overhead and profit to the contracting party, except as provided in paragraph I. and J. below. Modifications greater than $100,000 for reimbursables at cost (without mark up) to the contracting party shall not require Board approval.

For reimbursables with mark ups, the Board may grant specific exemptions for a project.

C. For professional services contracts that are initially awarded without an amount

for basic services or only a partial amount due to funding restrictions or lack of an adequate scope or program, any modification required to obligate the full amount for the basic services, additional services, and related reimbursables shall not require Board approval.

D. For A/E contracts, reimbursables are defined as those expenses that are usually

outside the normal design services and include soil boring, testing, additional reproduction costs, special studies and reports to comply with State statutes such as the Historical Preservation Act, etc. These reimbursables require authorization by CDB.

E. For construction management contracts, items defined as reimbursable will vary

with the contract as negotiated with the construction manager. Reimbursable items include job site facilities for the CM and project general condition items such as temporary utilities, road, barriers, clean up, etc.

F. Such modification must be germane to the original project program or scope.

When the need for a modification becomes necessary, the contract shall not be modified in increments or parts to meet that need. The Contract Executives shall review and recommend approval of all modifications.

G. The Executive Director may approve, or delegate appropriate approval levels on

modifications that do not exceed $100,000 or do not require Board approval as outlined above. Currently these delegated levels are equal to those for change orders.

H. The Executive Director may approve any modification to an existing contract that

is the result of a new A/E selection that has been approved by the Board. If the A/E has a current contract open at the same facility for the same using agency, the current contract may be modified in lieu of issuing a new contract.

I. Board approval is not required for modifications to emergency contracts. CDB

shall present such modifications to the Board as informational items. J. The Board delegates approval authority to the Executive Director for

modifications $100,000 or over which seek costs related to the budget impasse containing the 750-modification code and which seek costs related to restarting projects suspended due to COVID-19 containing the 719-modification code. CDB shall present such modifications to the Board as informational items. This delegation of approval authority does not apply to projects in design. This paragraph J. is automatically repealed one year from the date of Board approval of this paragraph unless the repeal date is further extended by the Board.

K By Resolution numbers 17-02, 18-03, 19-03, and 20-01, the Board extended the

approval authority delegation for costs related to the budget impasse provided in paragraph J. above until June 9, 2021. The Board extends the approval authority delegation provided in paragraph J. for costs related to the budget impasse for an additional year from the date of Board approval of this Resolution 21-01.

4. Release of Funds:

A. The Executive Director is hereby authorized to request the Governor’s Release of Funds for all projects for the total value of less than One Hundred Thousand Dollars ($100,000).

The Executive Director shall provide to the Board quarterly reports of all Single Bid, Change Order and Architect/Engineer Modification activity approved within her/his authority.
