GUIDELINES TOR TENDERERS TOR FILLING TENDER TORMS UNDER TWO BIDsYsTEM. PART uA" (TECHNTCAL) & PART uB', (PRTCE BrD).

1. Bihar Rajya Beej Nigam Ltd. (here in after called the purchaser) invites sealed

tender for the purchaser of HDPE bags of 3Ol4Okg., L5/20 kg, 1O kg & 6/8 kg

capacity and Non Woven bags. 2 kg & 4 kg capacity as mentioned in the Tender

Notice for packing of different seeds of cereals, oilseeds, Pulses. etc.

The tenderers participating in the tender must quote the rate for at least

50% of the quantity of each item notified in the NIT failing which the

tenderers will be treated as disqualified in the techno commercial Bid and

their price bid will not be opened

The specification of the bags may be seen in seen at Annexure A-1 & A-2

The terms & conditions of the purchase of bags may be seen at Annexure-B.

The tenderers are clearly advised to go through the specification of the bags &

terms & conditions carefully before filling the tenders forms. Bihar Rajya Beej

Nigam Ltd. will not be responsibie for any mistakes/error committed by the

tenderers in filling of the tenders.

The tender has been invited on two Bid System in which the tenderer has to fillupTwo Separate envelopes and both shotnld be put in one outer envelope af[er

sealing & superscribing clearly the reference of Notice inviting Tender ($T) & date

of opening of the tender on all three envelopes. The Outer envelopes must also be

sealed.

The tenderers are required to deposit the fixed amount of EMD strictly as per

tender document with the Technical Bid without which the tender will be rejected.

I. The envelope no.2 will contain the rates quotation by the tenderer in Annexure-C.

il. While quoting the raLes the tenderer rnust ensure that rates quoted in all casesmust be final & inclusive of all charges, F.O.R delivery at destination includingall packing & insurance charges for safe transit by road inclusive of all taxes,levis etc.

il. Erasure or alteration in the bid document should be avoided. Modificationerasure or a,lteration, if any, should bear the signature of the person signingthe bid along with stamp of the tenderer. Any modification not so signed willbe ignored and the tender will be rejected.

PROCEDURE FOR SUBMISSION OF TENDER

a) The envelop no. 1 TECHNICAL BID & envelop no. 2(PRICE Bid) must be put inOne Outer envelop clearly subscribing the reference no. of NIT & date of theopening of tender. After sealing the outer envelope the same should be put inthe tender box by the tenderer strictly as per the schedule mentioned in thetenderers.

b) Before putting the envelop in the tender box, the tenderer must ensure that theirtenders are duly sealed otherwise the same willbe summarily rejected.

c) The price bid will be opened as per schedule in respect of those tenderers onlywho have been declared qualified in the Technical bid.

SPECIAL INSTRUCTION FOR THE GUIDANCE OF THE TENDERS

1. The tenderers or their representatives are welcome at the time of opening of thetender if they so desire.

2. Tenderers must check theirenhalcement of prices willopening of the tender.

3. The rates quoted in al,l cases must be fina-1 and inclusive of all charges for freedelivery at destination including all packing and insurance charges for safetransit by road inclusive of al1 applicable. taxes/levies/Form 'C' etc.

4. Price quoted should be strictly in accordalce with the unit specified,"otherwisequotations are liabie to be rejected.

TERMS AND CONDITIONS

1. The tender is to be invited on Two Bid System (Technical Bid and Price Bid) inwhich the tenderer has to fi1i up Two Separate sealed envelopes and both shouidbe put in one outer envelope subscribing clearly the reference of Notice InvitingTender (NIT) & date of opening of the tender on al1 three envelopes.1.1 The Technical bid will contain EMD & other relevant documents like

Income Tax return,Balance sheet, experience certificate, along withperformance certificate etc. The price bid witl contain the rates quotation bythe tenderer on F.O.R destination basis inclusive of al1 packing & insurancecharges for safe transit.

L.2 Tenderers must fi11 their rates both in words and figures in this tender formof price bid (envelop no.2) and submit the sarne as mentioned above. Thetechnical bid should be submitted in a sealed envelope along with fi-xedamount of earnest money.

1.3 No alternations should be made to any of the Terms and Conditions of thetender by scoring out, altering or over-writing and no a-lternations arepermitted in their rates. No alternations will be allowed after the tender isreceived by this Office. Ambiguity must be avoided in Iilling tender. Thetenders not complying with these conditions wilr be rejected.

L-4 Tenderers are required to deposit the fixed amount as prescribed in TenderNotice whichever is applicable for the total va-lue of tender as EARNESTMONEY with the Corporation as notified in the tender notice, in shape ofBank draft. No EMD in cash or cheque will be accepted.(a) Offers without Earnest Money will be rejected.(b) NO ADJUSTMENT OF EMD FROM THE DUES, IF ANY, AVAILABLE

WITH THE CORPORALTION, AGAINST THE SUPPLItrS MADE BY THESUPPLIER IN THE PAST SHALL BE ALLOWED TtrNDERERS WITHSUCH REQUEST NOT ACCOMPANIED WITH REQUISITE AMOUNT OFEMD AND FREE FROM ANY ADJUSTMENT SHALL BE SUMMARILYREJECTED.

(c) The tenderers who are interested to quote the rates one or two items areeligible for participation in the'tender and will have to deposit ful} &fixed amount of EMD notified in the NIT and no exemption or relaxationon this ground will be accepted.

(d) Tenderers belonging to, who11y owned by Central/State Government willbe exempted from depositing EMD/Security Deposits. However, publicundertakings not who1ly owned by Centrat/State Govt. will be requiredto pay EMD/Security Deposit.

In case of selected tenderer the earnest money will be adjustedagainst the security deposit and the ba-1ance if any, will have to bemade by him/them within the above said period.The Corporation reserves the right to forfeit earnest money deposit ofthe successfui tenderers fail to deposit security deposit, if any, whichmay be required under the terms and conditions of the tender.

L.6 The tenders not conforming to the prescribed Terms and Conditions of theCorporation or conditional tenders or tenderers who do not adhere to theprescribed time schedule, are likely to be rejected,.

L.7 Only one rate will be entertained against one item.1.8 Any specia-l conditions which may be prescribed for specific purpose shall

a-lso be treated as part of this tender condition for all purposes.

ACCEPTANCE OF TENDERS2.L The Corporation is not bound to accept the lowest quotations. Any or all

the quotations may be rejected without assigning arry reason. It reservesthe right to accepting in whole or part of the offer made. The decision of theCorporation in the matter shall be final ald binding.

2.2 The Corporation may take decision to split the order arnong two or morethan two firms in a transparent manner as per terms and conditions.

LATE TENDER : In case of advertise tender enquiry or limited tender enquiry,the tender received after the specified date & time should not be considered.

3.1 The tender sent by telex, cable or facsimile willbe ignored & rejected.3.2 Successful tenders shall execute an Agreement Bond in accordance with

these terms and conditions.

4 AMENDMENT IN TENDER DOCUMENT

8 OUALITY COMPLAINTS :8'1 In case of any quality COMPLAINT the supplier and inspection agency bothwill be asked to attend the compraint through the registered/speed

postlcourier/fax and segregate the exact number of defective/substandardmaterial so that penal deduction may be made by the processing Divisionwhile forwarding the bills to the Finance Division for releas ing 9e%opayment to the supplier as per norms .

8.2 In case of length and width of all type of bags from 1 to 100kg. capacit5r, themaximum acceptance limit criteria(beyond the tolerance limit mentioned inthe speci{ication of BIS) is only upto 3cms. This acceptance timit witt Uemeasured after allowing the tolerance limit mentioned in the specificationof BIS. The consignment having the deviation beyond the maximumacceptance limit will be rejected summarily and action as per clause no.2tto 22 will be taken.

11 ROAD PERMITS/WAY BILL The concern unit of Bihar Rajya Beej Nigam Ltdwill ensure that the road permits/ Way Bill whichever is applicable are mustbe delivered to supplier within lOdays of the placement of the supply order sothat he may able to deliver the material to the destination as per schedule. Incase any unit fails to deliver the Way Bill /Road Permits to the supplier within1O days, the delayed period will automatically be added in the delivery periodprescribed for the supplier & no punishment to the supplier on this accountwill be made.

12 CANCELLATION OF CONTRACT FOR DEFAUT.TT & RE|COURSE TO BETAKEN BY THE PURCHASER : The purchaser may without pre-juice to anyother remedy for breach of contract by 7 days written notice of default sent tothe supplier, terminate the contract in whole or in part.

If the supplier fails to deliver any or al1 the stores within the time period specifiedin the contract, or any extension thereof granted by the purchaser.If the supplier fails to perform any other obligation under the contract within the

period specified in the contract or any extension thereof granted by the purchaser.In the event the purchaser terminate the contract in whole or in part, purchasermay take the course to any one or more of the following action.

Recovery of all damages sustained on account of cancellation.The security deposit is to be forfeited.The purchaser may procure the goods of the salne specification on the same termsand condition as deemed appropriate on the risk & cost of the supplier.However, the supplier shall continue to perform the contract to the extent notterminated

L4. Securitv Monev

Successful tenderer sha1I be required to furnish a security money of Sok for NonS.S.I Unit and 2oh for S.S.I Unit of the value of order placed to them within 7 days,from the date of issue of purchase order or before assigning agreement whicheveris earlier. This may be furnished in the shape of Demand Draft in favour of " BiharRajya Beej Nigam Ltd" payable at Patna.

Validity of Rate and Period

The tenderer sha-l1 keep their rates open for a period of one year fromthe date of supply order. Aftdr the initial order it sha-ll be open to theNigam to place order for the totallpafi quantity or distribute 4mong thesuppliers, on the same rate, terms and conditions. The same will remainvalid for any additional quantity likely to be ordered during the periodalso.

Bags shall be purchased for the Nigam time to time as per requirementin Rabbi & Kharif Season. The numbers of bags shown in the tendercan be increased or decreased as per requirement and availability offunds with BRBN.

16 FORFEITURE AND REFUND OF THE EARNEST MONEY/SECURITY DEPOSIT

16.1In case the selected tenderer does not suppiy the goods at the quote rateswithin the period of contract and commits breach of any one or more ofthese. Terms ald conditions, failed to replace the rejected material withinthe stipulated period, the Earnest Money/Security deposits by thetenderers will be forfeited by the Corporation.

76.2Eau-nest money of the un-successful tenderers shafl be refunded withoutinterest within a reasonable period from the date of decision regarding thetenders.

16.3The Earnest/Security Money deposited by successful tenderer shall beretained by the Corporation ti1l three months after the expiry of thecontract period i.e six months from the date of acceptance of the tender orthe date of which the supply is completed, including the supply which mayarise in consequences or repeat orders placed during the six months forwhich the rates quoted are to remain valid.

76.4On due performance and completion of the order in all respect during thecontract period, the security deposit will be refunded to the contract orwithout any interest within a period of three months with effect from thedate of receipt of request of this effect from the supplier.

17 FORCE MAJEURE CLAUSE: If supplies are delayed due to cause beyond thereasonable control of the supplier and whether such delay or impediment occursbefore or after the time of delivery an extension of time shall be granted at the solediscretion of SFCI taking into account a-11 factors like flood, drought, Naturalcalamities sabotage, Fires, Epidemics, Civil commotion,'Wars, Revolutions, lockouts,Strike ca-11ed by the Labors/Trade Unions, transporters etc.

1B JURISDICTION: In the event any matter concerning the implementation,interpretation or rights and liabilities, determination, the Courts at Patna shall haveexclusive Jurisdiction to try or entertain the same.

L9 NEGOTIATION

If L-1 price is not reasonable, the Corporation may as an exception negotiate the priceoniy with the lowest eva-luated responsive tenderer (L-1) in an attempt to bring down thesalne. If L- 1 reduces the price to the desired level, contract may be placed on them but ifit does not agree, then further action like re-tendering may be decided by theCorporation depending upon the merit of the case. The negotiation will be made only bythe purchase committee as per guidelines of CVC with the approval of the CompetentAuthority.

20 Settlement of Disputes

a) Any difference or dispute out of or in connection with this tender oracceptance thereof, on the contract entered or consequence thereof,shall be decided by arbitration. The Malaging Director of the Nigam orhis nominees sha]l be the sole arbitrator and the arbitrators decision

appointment of any body, on the ground whatsoever, including that thesuch nominees in his official capacity deal with the matter at any stage.

b) The parties agree that in the erzent of aly disputes, neither willapproach aly court of law unless they have resorted to ar-rd exhaustedthe remedy of arbitration as envisaged aborre.

c) The parties, do hereby also agree that the contract envisaged by theseterms and conditions shall be deemed to have been entered into atPatna and the civil courts at Patna only will have the jurisdiction to trylegal proceeding which may arise out of this contract. Neither partyshall file any proceeding in any other courts.

The Bank further agrees that the Nigam shall be the sold judge of and as towhether the said tenderer/suppiier has committed and breach or breaches of anyof the terms and conditions of the tender document/supply order and the extendof loss damages costs charges and expenses to or suffered by the Nigam onaccount thereof, but not exceeding the amount of earnest money/security moneystated above, and the decision of the Nigam that the said tender/supplier hascommitted such breach or breaches sha-l1 be final and binding on the Bank. TheBank hereby undertakes guarantee that it sha1l pay the amount of BankGuarantee on demand by the Nigam without asking or rajsed any question aboutthe validity of the demand

3. The Bank undertake that it shall not be necessary for the Nigam proceed againstthe tender/supplier before demanding the aforesaid amount of Bank Guaranteefrom the Bank or proceeding against the Bank and the guarantee hereincontained shall be enforceable against the Bank.

4. The Bank undertakes not to revoke the guarantee during currency except with theprevious consent of the Nigam in writing and agrees that any change in theconstitution of the tenderer of the Barlk shall not discharge the iiability of theBank hereunder.

5. Not with standing alything contained herein before the liability of the Bank underthis guarantee is restricted to Rs.... ....The guarantee of the Bank shallremain into force up to 210 days from the date of opening of the tender in case ofearnest money from the date of submission against security money deposit unlessthe Nigam make a claim from the Bank in writing on or before the said 180 days,all the rights of the Nigam under the said guarantee shal1 be forfeited and theBank shall be relieved and discharge from all liability hereunder.
